Purpose:

To approve the amendments to the salary schedule, side letters, and reclassifications necessary to

Page 14 of 109 ends

implement the code enforcement and fleet maintenance personnel changes adopted in the Fiscal Year 24/25 operating budget.

Council’s Strategic Goals:

This item addresses the City Council’s Strategic Goals of Infrastructure and Fiscal Responsibility by providing the classification and compensation options necessary to effectively recruit and retain quality employees in key positions responsible for the growth and maintenance of the City’s infrastructure.

Background:

As part of the recent annual budget process, the Public Works and Development Services administration evaluated the staffing required to meet organizational structure and public service needs for Fiscal Year 24/25 and made several personnel change requests. City Council approved these personnel change requests as part of the Fiscal Year 24/25 operating budget adoption on June 18, 2024.

Some of the changes approved require additional Council action to establish the new or updated classifications and the corresponding amendments to the salary schedule, as well as to address incumbent employees impacted by these requests, including classifications within the Development Services Building Division (Code Enforcement) and Public Works Maintenance Branch (Fleet Maintenance Division). A high-level summary of these items is shown in Figure A, with additional detail provided in the Analysis section below:

Analysis:

The Departments recommend the establishment of the following classifications for code enforcement and fleet maintenance functions, as proposed in Request Nos. 1 and 2. The Public Works Department also requests the establishment of an annual tool allowance for the Fleet Maintenance Division for the use of their personal tools, as proposed in Request 3. The Departments request that the recommended changes be effective at the start of the next pay period, October 5, 2024.

Staff has met and conferred with the affected bargaining unit, Public Employees’ Union, Local 1/AFSCME 57 (Local 1), on the new classifications and amended salary schedule. Representatives from the unit have executed a side letter to their Memorandum of Understanding (MOU) amending the represented positions as described above (Exhibit 1B).

Staff has met and conferred with both affected bargaining units, Local 1 and First Level Managers (FLM), on the proposed fleet maintenance tool allowance. Representatives from both units have executed side letters to their MOUs to add the provisions for the allowance (Exhibits 2A & 2B).

Request 1. Code Enforcement Officer I/II:

The Development Services Department currently has one (1) permanent full-time Code Enforcement Officer and one (1) Code Enforcement Officer (Limited Term) within the Building Division, supported by temporary part-time staff as necessary. The Department determined that a second, regular full-time Code Enforcement Officer, rather than a limited term position, is essential to managing the case load and level of service desired for the City’s Municipal Code enforcement needs. Thus, management recommended that the limited-term position be converted to a permanent position in the fiscal-year budget submission.

In order to implement this request, the Department recommends splitting the Code Enforcement Officer to a I/II series, establishing the Code Enforcement Officer I salary schedule at 10% below the existing journey-level salary in alignment with other Local 1 series, and reclassifying the limited-term incumbent employee to the regular full-time role. The incumbent permanent Code Enforcement Officer would slide into the new series as a Code Enforcement Officer II, while the limited-term incumbent would be reclassified to a Code Enforcement Officer I in the new series based on incumbent minimum qualifications.

Request 2. Fleet Maintenance Mechanic I/II and Senior:

The Fleet Maintenance Division in the Public Works Department Maintenance Branch consists of one (1) Fleet Maintenance Supervisor, one (1) Mechanic – Lead, and two (2) journey-level Mechanics. One of the two journey-level Mechanic positions has been vacant for a number of months, as the City has been unable to recruit a candidate with sufficient skills and experience to meet the minimum qualifications. In addition to the current vacancy, the Division also faces a near-term retirement, increasing equipment regulations, and future vehicle and equipment additions for public safety.

Page 16 of 109 ends

Public Works recommended the addition of a third Mechanic and the creation of an entry-level classification for Fleet Maintenance in order to successfully recruit sufficient candidates to train internally and meet short- and long-term needs. The Department recommends converting the Mechanic classification to a flexibly staffed Fleet Maintenance Mechanic I/II position, retitling the Mechanic classifications to match the Fleet Maintenance Division series (i.e. to a “Fleet Maintenance Mechanic – Senior”), and setting the Fleet Maintenance Mechanic I at 10% below the journey-level salary schedule to align with other Local 1 series. The incumbent Mechanic would slide into the new series as a Fleet Maintenance Mechanic II, and the incumbent Mechanic – Lead would slide into the new series as a Fleet Maintenance Mechanic – Senior. The current vacancy and the new entry-position would both be at level I until new employees are hired and demonstrate skill sets allowing progression to the II level.

Request 3. Fleet Maintenance Tool Allowance:

The Fleet Maintenance Division employees utilize their own personal sets of professional shop tools to conduct the majority of day-to-day operations. The use of employee-provided tool sets is an industry standard in fleet maintenance; however, this is a significant economic obligation for these employees, including risk from damage, loss, or wear. In order to compensate these employees for the use of their tools, Public Works recommends the establishment of an annual tool allowance for permanent employees in the Fleet Maintenance Supervisor, Fleet Maintenance Mechanic – Senior, and Fleet Maintenance Mechanic I/II classifications. Staff recommends an annual allowance of nine hundred dollars ($900) per employee, to be paid at the start of each fiscal year, based on research into the tool allowances at comparable agencies and discussion with the bargaining units and impacted employees.

The side letters specify that payment for this initial fiscal year is to occur with the first full pay period of October, which begins October 5, 2024, so that the qualified employees will still receive the allowance for Fiscal Year 24/25.

Fiscal Impact:

Sufficient funding for these new or modified positions was budgeted in the Fiscal Year 24/25 operating budget adopted on June 18, 2024, proportionately shared across general, road, water, and wastewater funds as appropriate. Sufficient funding for the recommended tool allowance was also budgeted into the Fleet Maintenance Division’s Fiscal Year 24/25 operating budget.

Alternatives:

1. Provide staff with alternative direction regarding the recommended salary schedule or recruitment and reclassification options. This will delay implementation of the expanded scope of services provided by these roles.

2. Deny or direct staff to modify the recommended fleet maintenance tool allowance.

Recommendation:

A. Adopt a Resolution:

1. Approving a side letter with the Public Employees’ Union, Local 1/AFSCME 57 bargaining unit to modify their represented classifications to accommodate the updated classifications approved by Council in the Fiscal Year 24/25 operating budget for the Public Works and Development Services Departments for code enforcement and fleet maintenance functions.

2. Authorizing the Finance Director to amend the salary schedule to alter existing classifications to reflect the personnel changes approved by Council in the Fiscal Year 24/25 operating budget.

3. Reclassifying code enforcement and fleet maintenance incumbent employees in positions

Page 17 of 109 ends

impacted by the updated classifications adopted in the Fiscal Year 24/25 operating budget.

B. Adopt a Resolution:

1. Approving a side letter with the First Level Managers bargaining unit to establish a fleet maintenance tool allowance for the Fleet Maintenance Supervisor.

2. Approving a side letter with the Public Employees’ Union, Local 1/AFSCME 57 bargaining unit to establish a fleet maintenance tool allowance for the Fleet Maintenance Mechanic I/II and Fleet Maintenance Mechanic – Senior classifications.

C. Authorize the Finance Director to make budget adjustments as necessary.

Agenda Item 5

CITY OF YUBA CITY

STAFF REPORT
Date: October 1, 2024
To: Honorable Mayor & Members of the City Council;Honorable Chairperson and Directors of the Successor Agency to the Redevelopment Agency of the City of Yuba City
From: Administration Department
Presentation By: Diana Langley, City Manager
Summary
Subject: Redevelopment Agency Recording on Property Title - Southwest Corner of C Street and Wilbur Avenue (APN 052-380-017)
Recommendation: Adopt a Joint Resolution confirming that the Successor Agency of the former Redevelopment Agency of the City of Yuba City will not enforce against Sutter Valley Medical Foundation the terms of redevelopment proceedings or otherwise impose liability upon Sutter Valley Medical Foundation through such proceedings.

Fiscal Impact: None.

Purpose:

To address title issues related to the former Redevelopment Agency of the City of Yuba City on property located at the southwest corner of C Street and Wilbur Avenue (APN 052-380-017) recently sold to Sutter Valley Medical Foundation.

Council's Strategic Goal:

This item addresses Council's goals of Business Friendly.

Background:

In 2011, based on a California Supreme Court decision, all redevelopment agencies in California were dissolved as of February 1, 2012. As a result, all redevelopment agencies were required to dissolve and transfer any assets and liabilities to "Successor Agencies" that would bring to a close the redevelopment agencies' business matters. On January 10, 2012, the City Council elected to become the Successor Agency to the Redevelopment Agency of the City of Yuba City (Successor Agency).

In 2015, a Long Range Property Management Plan (Plan) was prepared by Fraser & Associates, in which the Plan recommended that the southwest corner of C Street and Wilbur Avenue (Site), APN 052-380-017, among other properties, be sold for private development.

On August 16, 2022, the City Council, acting as the Successor Agency, declared the Site to be surplus

Page 45 of 109 ends

land and directed the City Manager to follow procedures set forth in the Surplus Land Act for the sale of the property.

On May 7, 2024, the Successor Agency authorized the sale of the Site to Sutter Valley Medical Foundation. Upon receipt of the Preliminary Title Report, Sutter Valley Medical Foundation representatives notified staff regarding exceptions to the condition of title for the property, particularly Exception 6 related to the effect of a Statement of Redevelopment Proceedings by the City of Yuba City, recorded July 18, 1989, amended May 28, 1996, and again amended January 6, 2000 (together comprising the Property Encumbrance). Further detail related to the Property Encumbrance is provided below:

I. July 18, 1989 Document - Recorded as Book 1308, page 210 of Official Records - The City Council of the City of Yuba City adopted Ordinance No. 1073 on July 17, 1989, approving and adopting the Redevelopment Plan for the Yuba City Redevelopment Project. The document included a legal description of the boundaries of the Redevelopment Project Area and corresponding map.

II. May 28, 1996 Amendment - Recorded as Instrument No. 1996-08247 of Official Records - The City Council of the City of Yuba City adopted Ordinance No. 02-96, an amendment to the Redevelopment Plan for the Yuba City Redevelopment Project, incorporating specified new and revised time limits for conducting various redevelopment functions.

III. January 6, 2000 Amendment - Recorded as Instrument No. 2000-0000182 of Official Records - The City Council of the City of Yuba City adopted Ordinance No. 17-99, an amendment to the Redevelopment Plan for the Yuba City Redevelopment Project, extending the time limits for conducting various redevelopment functions.

Sutter Valley Medical Foundation agreed to proceed with the purchase of the Site provided that staff address Exception 6 to the title.

Analysis:

With the dissolution of the Redevelopment Agency, such relevant documents comprising the Property Encumbrance have either terminated by their terms, or are no longer enforced. The attached Resolution acknowledges that the Successor Agency will not enforce against Sutter Valley Medical Foundation the terms of the documents comprising the Property Encumbrance or otherwise impose liability upon Sutter Valley Medical Foundation through such documents comprising the Property Encumbrance.

Fiscal Impact:

None.

Alternatives:

Take the necessary steps to "unwind" the Property Encumbrance documents and set aside Ordinance No. 17-99. This will take a significant amount of staff time, and does not result in a different outcome.

Recommendation:

Adopt a Joint Resolution confirming that the Successor Agency of the former Redevelopment Agency of the City of Yuba City will not enforce against Sutter Valley Medical Foundation the terms of redevelopment proceedings or otherwise impose liability upon Sutter Valley Medical Foundation through such proceedings.

Beale AFB offers significant advantages, including ample hangar space, secure energy sources, an established weapons load facility, and strategic partnerships. The existing Temporary Flying Restriction (TFR) improves the operational readiness of the base and will facilitate a seamless transition from the current U-2 mission to the CCA mission.

1201 Civic Center Boulevard . Yuba City, CA 95993 . yubacity.net The Honorable Frank Kendall
Secretary
U.S. Department of the Air Force
1670 Air Force Pentagon
Washington, D.C. 20330-1670
Dear Secretary Kendall,
As the Mayor of Yuba City, I am writing on behalf of our city to express our support for Beale Air Force Base and to advocate for the placement of the Collaborative Combat Aircraft (CCA) mission on this important installation. Beale AFB has been a crucial contributor to both national security and the local economy, and the addition of the CCA mission would further solidify its role.

Beale Air Force Base provides significant strategic advantages for hosting the CCA mission.

With the U-2 program winding down, there is ample hangar space available. The base is wellequipped with secure energy sources and multiple reliable power supplies. Its favorable location, characterized by low humidity, minimal light pollution, and spacious land for future expansion, along with limited urban encroachment, makes Beale an ideal site for the CCA mission.

Additionally, Beale also has a weapons load facility already in place to support the new CCA mission, along with established partnerships with the Fallon Range Training Complex in nearby Nevada. Also, a new battle management squadron is being formed and integrated with Beale’s Common Mission Control Center. This squadron will streamline the collection and delivery of continuous intelligence, surveillance, and reconnaissance data, enhancing the combat capabilities of both manned and unmanned systems.

We respectfully urge the Department of the Air Force to consider Beale AFB for the new CCA missions. Its infrastructure, strategic location, and proven track record make it the ideal choice to support this advanced capability, benefiting both our national defense and the local economy.

Thank you for your consideration. We look forward to further discussions and appreciate your attention to this important matter.

Sincerely,

Agenda Item 7

CITY OF YUBA CITY

STAFF REPORT
Date: October 1, 2024
To: Honorable Mayor & Members of the City Council;
From: Development Services Department
Presentation By: Doug Libby, Deputy Director of Development Services Summary
Subject: Rezone 24-02: Sutter County Schools Career Training and Conference Center Ordinance Adoption
Recommendation: Adopt an Ordinance of the City Council of the City of Yuba City to adopt Rezone 24-02 for the Sutter County Schools Career Training and Conference Center project located at the southeast corner of Harter Parkway and an extension of Spirit Way (Assessor’s Parcel Number: 63-010-146 and -147) by title only, and waive the second reading.

Fiscal Impact: The cost for processing land use entitlements is funded by the project applicant through the payment of application fees.

Purpose:

To adopt Rezone (RZ) 24-02 for approximately 2.5 acres, located on the southeast corner of Harter Parkway and an extension of Spirit Way.

Council’s Strategic Goal:

This item implements the Council’s goal of Business Friendly.

Background:

The applicant, Sutter County Superintendent of Schools, filed applications for DP 24-01 and RZ 24-02 in February 2024. Development Plan 24-01 is an application to construct a new 38,000 square foot building to be utilized by the Sutter County Superintendents of School as a career training facility.

The X19 Combining Zone District was originally applied to this area to ensure that needed street intersection signalization would occur as the area is developed. The X19 Combining Zone District provides requirements for development to pay its fair share of improvements to the Walton Avenue/Lassen Blvd. intersection, the Tharp Road/Lassen Blvd. intersection, and dedication of the appropriate right-of-way. Since that time, other programs have been established, making the X19 District unnecessary. This includes the 2007 Yuba City Update of the AB 1600 Fee Justification Study, 2020 Traffic Model Update, 2021 City of Yuba City Cumulative Traffic Forecasts and Operations Analysis, El Margarita Master Plan studies and various site-specific traffic studies performed in the area. Since there are now programs in place requiring those intersection improvements be timely made

Page 86 of 109 ends

as part of developing these properties, and also that there is a mitigation measure applied to this project that refers to improvements to other nearby intersections (discussed below), the X19 Combining District is no longer necessary.

It should be noted the X19 District was similarly removed in early 2023 from the Spirit Drive Parcel Map project (TPM 22-04, GPA 22-06 and RZ 22-08) located at the southeast corner of State Route 20 and El Margarita Road, which is immediately west of John L. Sullivan dealership.

On August 28, 2024, the Yuba City Planning Commission conducted a public hearing, where no people spoke in opposition to the project, and the Planning Commission unanimously:

1. Adopted a Resolution recommending the City Council of the City of Yuba City approve Environmental Assessment (EA) 24-02, by adopting a Mitigated Negative Declaration, subject to the Conditions of Approval and Mitigation Measures, approve DP 24-01 for the proposed Sutter County Schools Career Training and Conference Center, and adopt an ordinance approving RZ 24-02, for 2.5 acres, located at the southeast corner of Harter Parkway and an extension of Spirit Way.

On September 17, 2024, City Council conducted a public hearing for DP 24-01 and RZ 24-02. The City Council approved both entitlements and voted to advance the rezone to a second reading.

Analysis:

Traffic
RZ 24-02: The X19 Combining Zone District was established to ensure that as certain properties develop, they will be responsible for paying their fair share of local transportation needs. Specifically, the X19 District identifies several intersections, including Walton Avenue/Lassen Boulevard and Tharp Road/Lassen Boulevard. At that time, the improvements needed for these intersections to support local growth were not in place. The X19 District was added to provide an interim solution to address that concern.

Availability of City Services
City water and wastewater as well as stormwater drainage are available to the property.

Environmental Determination:

An environmental assessment was prepared for this project in accordance with the requirements of the California Environmental Quality Act (CEQA) Guidelines. This process included the distribution of requests for comment from other responsible or affected agencies and interested organizations.

Based upon the attached environmental assessment, including the proposed mitigation measures, staff has determined that with the mitigation measures proposed there is no evidence in the record that the project may generate any new significant effects on the environment and recommends adoption of a mitigated negative declaration for this project. The findings of the mitigated negative declaration are that, with the proposed mitigation measures for Greenhouse Gases, Geology and Soils, Transportation and Traffic, and Tribal Cultural Resources, the proposed Development Plan will not create any significant impacts to the neighborhood or vicinity. As a result, the filing of a mitigated negative declaration is appropriate in accordance with the provisions of CEQA. The proposed mitigations are included with the project conditions of approval.

Page 87 of 109 ends

Fiscal Impact:

The cost for processing land use entitlements is funded by the project applicant through the payment of application fees.

Alternatives:

1. Deny the application to establish Rezone 24-02.

2. Provide staff with alternate direction.

Recommendation:

Adopt an Ordinance of the City Council of the City of Yuba City to adopt Rezone 24-02 for the Sutter County Schools Career Training and Conference Center project located at the southeast corner of Harter Parkway and an extension of Spirit Way (Assessor’s Parcel Number: 63-010-146 and -147) by title only, and waive the second reading.

STAFF REPORT
Date: October 1, 2024
To: Honorable Mayor & Members of the City Council;
From: Administration Department
Presentation By: Kristi Morales , Administrative Analyst Summary
Subject: Community Sponsorship
Recommendation: Consider the monetary sponsorship request from SAYLove. If approved:

Adopt a Resolution to approve a monetary sponsorship request to SAYLove for $5,000.00
Fiscal Impact: Monetary Sponsorship for $5,000.00 - Account No. 4220-66010 (Community Contributions).

Purpose:

City sponsorships reflect support of specific programs or events by an organization. The intent is that the public will receive some intrinsic cultural, economic, educational, or entertainment value from the program or event.

Council's Strategic Goal:

The overarching strategic goal of "Quality of Life."
Background:

On January 18, 2022, Council adopted an Amended Community Sponsorship Policy which specifies the following factors that will be considered during the approval process:
• The City Council will approve all monetary sponsorship requests at a public meeting. • Resources available (e.g., budget, staff, workload capacity, etc.) • Compatibility with the strategic goals of the City Council and the mission of Yuba City. • Impact of an event on City Facilities.
• Risk to the City.
• The ability of the organization to obtain liability insurance naming the City as an additional insured.
• The overall benefit to the community.

The following sponsorship request was received from:

Page 97 of 109 ends

SAYLove Sutter and Yuba
SAYLove is a grassroots organization dedicated to enhancing the Yuba-Sutter area through community clean-ups and beautification projects. By collaborating with individuals, businesses, and organizations, SAYLove brings together resources to make positive changes and foster community pride. SAYLove representatives meet monthly with City staff to coordinate their workday activities, held on the last Saturday of each month. They are partnering with the City for a city-wide cleanup day on October 26th.

Analysis:

SAYLove is seeking $5,000 to support its general activities in Yuba City, focusing on the October event in partnership with the City of Yuba City. The request includes funding for signature yellow t-shirts to foster volunteer unity and recognition, printed materials for event outreach, and the purchase of sustainable cleanup tools, such as recycled buckets and garbage pickers, which will feature the City’s logo and support future cleanup efforts.

The Amended Community Sponsorship Policy states, "The budget for the Community Sponsorship Program shall be established by City Council each year during the annual budget process," and "applications will be presented to Council quarterly on a first-come, first-served basis." For FY 24-25, City Council budgeted $20,000 for Community Contributions and $10,000 for Community Events.

Budgeted funds are to be considered and allocated on a quarterly basis, which provides $5,000 quarterly for Community Contributions and $2,500 quarterly for Community Events. Below is a breakdown of each account, including the above request and all requests to date:
