CITY OF YUBA CITY
STAFF REPORT
Date: May 20, 2025
To: Honorable Mayor & Members of the City Council;
From: Development Services Department
Presentation By: Doug Libby, Deputy Director of Development Services Summary
Subject: Plumas Street Overlay District
Recommendation: Initiate a Municipal Code amendment to establish an Overlay District in downtown Yuba City from Colusa Avenue (State Hwy 20) to Bridge Street and along Center Street, to prohibit new tobacco and vape retailers as well as the sale of alcohol for offsite consumption to promote better health, entertainment, and a family friendly environment
Fiscal Impact: No direct fiscal impact will result from amending the Municipal Code to establish an overlay district as existing budgeted monies will be used for this effort Purpose:
To initiate a Municipal Code amendment to establish an overlay district in downtown Yuba City along the Plumas Street commercial corridor from Colusa Avenue (State Hwy 20) to Bridge Street and along Center Street, to prohibit certain commercial uses to reflect a direction and path for the downtown to promote better health, entertainment, and a family friendly destination.
Council’s Strategic Goal:
This item is consistent with the Council’s Public Safety Strategic Goal because restricting certain uses and establishing appropriate standards will enhance public safety in the community.
This item is also consistent with the Council’s Business Friendly Strategic Goal. Establishing appropriate uses for our downtown business district to promote better health, encourage entertainment, and a family-friendly destination is consistent with the Council’s Business-Friendly Strategic Goal.
Background:
The City and Downtown Business Association (DBA) have made significant investments in the downtown Plumas Street area over the last 30 years to create a vibrant downtown shopping district.
The City Council has supported further development of this downtown district to include additional restaurants and other entertainment opportunities. In 2024, the City Council approved a noise exception allowing for additional entertainment opportunities in the Plumas Street area from Colusa Avenue (State Hwy 20) to Bridge Street and along Center Street.
Proposal:
The City recently received separate letters from the DBA and Blue Zones Project requesting the City consider restricting certain uses in the downtown business corridor from Colusa Avenue (State Hwy 20) to Bridge Street. The basis of the request is to prohibit certain commercial uses to promote better health, entertainment and a family-friendly destination.
The restriction of the following activities is proposed:
• Tobacco and vape product sales – businesses commonly referred to as “smoke shops.” • Prohibit the sale of alcohol for offsite consumption.
If one of these activities occurs today, that business can continue. However, if the use were to cease for a period of one year or more, Municipal Code Section 8-5.7302(d) would prohibit the use from reestablishing.
The intent of prohibiting alcohol sales for offsite consumption is not to impact restaurants in the downtown, having lawfully established outdoor dining consistent with Municipal Code Title 8, Chapter 5, Article 49 (the City’s Outdoor Dining Ordinance).
Should the Council desire to implement such restrictions, Staff propose establishing an overlay zone covering properties zoned Community Commercial (C-2) District within the DBA area from Colusa Avenue (State Hwy 20) to Bridge Street and along Center Street. An overlay district is a land-use planning tool that adds additional requirements or limits uses of specific properties and is in addition to the property’s existing zoning.
A draft ordinance is required to first be considered by the Planning Commission at a noticed public hearing and a recommendation provided for the City Council’s consideration.
Fiscal Impact:
No additional fiscal impact will result from amending the Municipal Code to establish an overlay district over the downtown Plumas Street area. Existing budgeted monies are paying for staff time to address this matter.
Alternatives:
The City Council may determine not to initiate a Municipal Code amendment to establish an overlay district over the Plumas Street area to limit certain uses. The City Council may provide alternate direction to staff concerning this matter.
Recommendation:
Initiate a Municipal Code amendment to establish an Overlay District in downtown Yuba City from Colusa Avenue (State Hwy 20) to Bridge Street and along Center Street, to prohibit new tobacco and vape retailers as well as the sale of alcohol for offsite consumption to promote better health, entertainment, and a family friendly environment.

RE: Request to Establish Commercial Overlay Zone for Plumas Street Dear Mr. Libby,
On behalf of the Blue Zones Project Yuba Sutter, I am writing to express our strong support for creating a Commercial Overlay Zone for the Plumas Street commercial corridor, spanning from Colusa Avenue to Bridge Street. We respectfully urge the City to take proactive steps in restricting uses incompatible with our shared vision for a vibrant, healthforward, and family-friendly downtown district.
We are particularly concerned with the continued presence and expansion of tobacco and vape retailers on Plumas Street. These establishments contradict our community’s efforts to promote well-being and pose significant risks to youth and public health. For this reason, we request that tobacco and vape retail establishments—commonly referred to as “smoke shops”—be prohibited within the overlay zone.
Tobacco retail density has been shown to increase rates of youth initiation and adult tobacco use, undermining the very public health efforts that Blue Zones Project and the City have worked to promote. The normalization of tobacco use through retail visibility, especially in pedestrian-oriented areas where families, youth, and visitors gather, is harmful and inconsistent with our community goals.
We also recommend restricting businesses that primarily sell alcohol for off-site
consumption, as they can similarly detract from the area’s appeal and safety.
Plumas Street has become a cornerstone of our downtown identity—a place where people come to connect, dine, shop, and experience the heart of our city. The continued revitalization of this area depends on a thoughtful approach to business mix and land use.
Creating a commercial overlay that prevents uses inconsistent with a healthy, walkable, and inviting environment is an important next step.
At Blue Zones Project Yuba Sutter, we are committed to transforming the environments where people live, work, and play. Our goal is to make the healthy choice the easy choice— and that starts with shaping public spaces like Plumas Street to reflect the values and needs of the people who call this community home.
We fully support the Downtown Business Association in this effort and welcome the opportunity to collaborate with the City as you prepare a staff report and consider an ordinance to create this overlay. We stand ready to provide data, community feedback, and policy support as needed.
Thank you for your leadership and consideration of this important request. Together, we can ensure that Plumas Street remains a place where health, community, and local pride thrive.
Sincerely,
Marni Sanders

CITY OF YUBA CITY
STAFF REPORT
Date: May 20, 2025
To: Honorable Mayor & Members of the City Council;
From: Development Services Department
Presentation By: Ben Moody, Public Works & Development Services Director Summary
Subject: Planning Division Fee Schedule Update
Recommendation:
A. Conduct a Public Hearing to receive comments on a proposed Planning Fee Schedule Update and after consideration;
B. Adopt a Resolution amending the Schedule of Fees and Charges for Planning Services beginning fiscal year 25/26
Fiscal Impact: A potential increase in cost recovery of approximately $123,900 annually Purpose:
To adjust planning service fees to recover City costs of providing services and to align with comparable services in the region.
Council’s Strategic Goals:
This item addresses Council’s Strategic Goal of Fiscal Responsibility.
Background:
The City’s Development Services Department provides necessary planning entitlement services to residents and developers within the City, through the Planning Division.
The Planning Fee Schedule is adjusted using the Consumer Price Index (CPI) for all urban consumers on an annual basis along with the City’s Master Fee schedule. However, the last time that the planning fees were analyzed and adjusted to reflect cost recovery was in September 2001. In the time since, there have been significant changes in the development processes within the City and State, the cost of services, and the complexity of planning processes, which have contributed to a growing gap between the fees collected and the actual costs of providing planning services.
Analysis:
Staff reviewed the planning fees of ten (10) comparable cities. This review incorporated the City’s planning fees and compared them to both the mean and median planning fees in multiple entitlement categories. Yuba City’s current planning fees fall significantly below both the mean and median
amounts in all categories analyzed.
Staff additionally analyzed the actual costs of staff time to identify the recommended proposed fee update amounts. The proposed fees will not fully recoup actual costs at application, however, with the implementation of development, the City will receive long-term financial benefit through property taxes and potential sales tax dollars to offset original costs.
In addition to the proposed fee updates, Staff recommends deleting some categorical specifications under the planning entitlements, as well as adding in fees for Development Agreements, Administrative Permits, Ministerial Map processing, and an Undefined category. These changes are shown in the Proposed section of the Planning Fee Schedule attachment.
On December 17, 2024, Staff requested input from Council regarding updating the Planning Fee Schedule, specifically related to cost recovery and implementation timelines. Council directed Staff to return to Council with a Resolution on updating the Planning Fee Schedule that included implementing the proposed fees utilizing the City’s established timeline of updating department fee schedules on July
1. Council also directed staff to reach out to local developers who regularly do business within the City and gather their input on the proposed planning fee updates.
On April 4, 2025, Staff conducted a survey of input for the proposed planning fee update and emailed local developers and interested residents to provide access to the survey, as well as the proposed fees.
Staff requested input by April 25, 2025. Two responses were received and are summarized below:
1. Suggestion of incrementally increasing fees overtime.
2. Inquiry as to whether discounts would be available for affordable housing.
The Proposed Planning Fee Update Public Hearing was also noticed in the Appeal Democrat on May 6 and May 13, 2025, and data made available to any interested parties at the City Clerk’s office.
Fiscal Impact:
In FY 2023-2024, the City collected approximately $117,000 in planning fees. If services provided stay consistent, the proposed Planning Fee Schedule will increase those fees by approximately $123,900, to total $240,900 per year. This is an estimate, as services required vary by year.
Alternatives:
Provide Staff alternative direction related to updating Planning service fees.
Recommendation:
1. Conduct a Public Hearing to receive comments on a proposed Planning Fee Schedule Update and after consideration;
2. Adopt a Resolution amending the Schedule of Fees and Charges for Planning Services beginning fiscal year 25/26.
