Employees may contribute to a Flexible Spending Account (FSA) on a pre-tax basis to assist with the cost of medical, dental, and vision expenses, deductibles, and copayments.
Employees may contribute to a Dependent Care Spending Plan on a pre-tax basis to assist with the cost of eligible child or elder care expenses.
The (EAP) is an employee benefit that assists employees with personal problems and/or work-related problems that may impact their job performance, health, mental and emotional well-being. The EAP offers free and confidential assessments, short-term counseling, referrals, and follow-up services for employees and their household members. For details about the EAP program please see the Human Resources Department.
Effective July 1, 2023, the City contributes point three four percent (0.34%) of the employee’s base rate of pay into their RHSA per pay period. Employees contribute twenty-five dollars ($25.00) per pay period. Employees will have twenty (20) hours of their vacation converted to cash and deposited into their RHSA annually during the month of June. Upon separation, employees will have one hundred (100) hours of vacation converted to cash and deposited into their RHSA. Employer contributions are fully vested.
The POA may increase employee contributions annually in November for the following year.
PFLM has elected to enroll its civilian, non-sworn members (“the Civilian Employees”) in CA State Disability Insurance (SDI) program.
Civilian Employees receiving benefits under either a short or long-term disability insurance program may elect to have their accrued leave coordinated and used to supplement disability benefit payments in order to receive the equivalent of a full paycheck (gross basis). In no instance shall the combination of disability insurance payments and accrued leave or other City benefit payments exceed 100% of an employee’s typical paycheck based on working regularly-scheduled hours. Civilian employees who wish to use accrued leave are required to notify Human Resources within five (5) business days of receipt of disability benefits to communicate the leave banks to be used and report the amount of SDI benefits received so that the City can determine the number of leave hours to be used. In the event of an inadvertent overpayment, the
11 City of Yuba City Police First Level Managers 6/27/2026 to 6/30/2028 employee will be notified and must make immediate arrangements with Finance to repay the overpayment.

13 City of Yuba City Police First Level Managers 6/27/2026 to 6/30/2028 Appendix “A” – Catastrophic Illness and Injury Donation Plan Purpose
To assist employees confronting personal or family catastrophic illness or injury who need the support of City employees to avoid financial hardship.
Plan Guidelines
1. Regular and probationary employees who are on an approved leave of absence (in accordance with Human Resources Rules 2.11 (B) or (D)) may receive donated hours of vacation, sick leave, or compensatory time off (CTO) from other employees.
2. Employees seeking donations of time must submit a written request to the Human Resources Department stating the reason(s) for the request. The Director of Human Resources reviews the requests. Each request is evaluated solely on its merits. If approved, the Director of Human Resources will initiate efforts to notify City employees of the request for the donation of hours. The name of the employee will be identified but the City will not release confidential medical information.
If disapproved, the requesting employee may seek review of the decision by the joint labor-management committee consisting of one representative from each of the following groups:
A) Yuba City Employees Association
B) Firefighters’ Association
C) Police Officers’ Association
D) Middle Managers Group
E) First Level Managers Group
F) Human Resources Department
In the event the Committee reaches a tie decision, the decision will be made in favor of the employee.
The decision of the labor-management committee is final and binding and is not subject to the grievance procedure.
3. To be eligible for donated leave hours, the employee must be on an approved leave of absence for their critical illness or injury or to provide required care for a family member (spouse, child, parent) who is critically ill or injured. The guidelines of Family Care Leave (Human Resources Rule 2.11 (D)) will be used to determine whether the critical illness or injury qualifies for the donation of leave hours. Verification of need via physician statements will normally be required. The employee must have exhausted, or is reasonably expected to exhaust, accumulated leave hours (vacation, sick leave, CTO) to receive leave.
14 City of Yuba City Police First Level Managers 6/27/2026 to 6/30/2028 Appendix “B” – Counseling Memo Policy
When a department head becomes aware of employee conduct, which requires documentation but does not warrant formal disciplinary action, a counseling memorandum may be issued to the employee. The purpose of a counseling memo is to provide notice to the employee of a deficiency or problem observed, document infractions, and modify behavior.
Counseling memos will be issued in a standard form used by the City. A copy of the counseling memo will be given to the employee and a copy is to be maintained in the employee’s personnel file for a period of two years. At the conclusion of two years, the employee can ask that the counseling memo be removed from the personnel file. At that time or any time thereafter that it is discovered that a counseling memo exists in the personnel file after two years, all copies are to be removed from any file maintained by the City, including the department or supervisor, and given to the employee. No future reference to the counseling memo will be made in a subsequent disciplinary process or performance evaluation. However, should an employee receive a subsequent counseling memo, or other disciplinary action within the two-year period, a counseling memo is not discarded until a two-year period has passed in which no counseling memo or disciplinary action has been issued.
During the two-year period the counseling memo may be used by a supervisor to support disciplinary action. The fact that a counseling memo has been issued is not to be referenced in a performance evaluation, however the substance of the counseling memo may be referenced in a performance evaluation if the supervisor deems it necessary.
Counseling memos used prior to the adoption of this Memorandum of Understanding are subject to this policy.

Agenda Item 10
CITY OF YUBA CITY
STAFF REPORT
Date: August 18, 2026
To: Honorable Mayor & Members of the City Council;
From: Human Resources Department
Presentation By: Gina Rowland, Human Resources Director Summary
Subject: Side Letter Agreements with Yuba City Firefighters’ Association-Local 3793 and Yuba City Fire Management Unit
Recommendation: Adopt a Resolution approving side letter agreements with the Yuba City Firefighters’ Association - Local 3793 and Yuba City Fire Management unit to provide a one-time lump sum payment of $2,250 per employee in lieu of an ongoing salary increase
Fiscal Impact:
The cost for Fiscal Year 2026/27 to provide a one-time lump sum payment in the amount of $2,250 for each employee on payroll as of the date the side letters are approved by the City Council is $115,250. This cost will be paid for by the Fire Department with salary savings from existing budgeted amounts by holding a command staff position vacant until December 31, 2026. No additional General Funds are requested.
Purpose:
To approve side letter agreements with Yuba City Firefighters’ Association and the Yuba City Fire Management unit.
Strategic Focus Area:
Approval of side letters with Fire bargaining units supports the Council’s Strategic Plan goal of Fiscal Responsibility by entering into agreements that are acceptable to employees and that do not result in additional General Fund expenditures.
Background:
The current MOU’s with the Yuba City Firefighters’ Association-Local 3793 and Yuba City Fire Management unit included a wage reopener for May 2026 that required the parties to discuss the City’s financial position on the issue of wage to determine if an agreement can be reached on wage increases only to be effective the first pay period in July 2026.
Analysis:
The City and the Firefighters’ Association met for the wage reopener on June 25, 2026. The Firefighters’ Association and the City subsequently reached agreement to provide a one-time, nonpensionable lump sum payment in the amount of $2,250 per employee.
Following the tentative agreement with the Firefighters’ Association-Local 3793, the City reached out to offer the lump sum payment to the three members of the Fire Management unit. As all members of the Fire Management unit are CalPERS Classic Members, the lump sum payment will be reported to CalPERS for these employees over the next 22 pay periods. The employee representative for the Fire Management unit advised the City on July 27, 2026 that the employees had accepted the City’s offer for the lump sum payment.
The current MOU’s with both Fire units end on June 25, 2027. The City and the bargaining units will commence negotiations for successor MOU’s in January 2027.
Human Resources recommends City Council approval of the attached Resolution approving the side letter agreements with Yuba City Firefighters’ Association Local 3793 and Yuba City Fire Management.
Alternatives:
Do not approve staff’s recommendation. This option is not recommended as the tentative agreement was negotiated by the City’s Chief Negotiator within the authority provided by the City Council.
Recommendation:
Adopt a Resolution approving side letter agreements with the Yuba City Firefighters’ Association-Local 3793 and Fire Management to provide a one-time lump sum payment of $2,250 per employee in lieu of an ongoing salary increase.

CITY OF YUBA CITY
STAFF REPORT
Date: August 18, 2026
To: Honorable Mayor & Members of the City Council;
From: Public Works Department
Presentation By: Joshua Wolffe, Public Works Director
Summary
Subject: Wildewood West Landscaping District Budget Allocation Recommendation: Adopt a Resolution authorizing the Finance Director to appropriate $17,194.56 from available reserves in Wildewood West Landscaping District Fund 275 to Account No. 6196-63663 (Materials) for fence replacement Fiscal Impact: $17,194.56 from FY 26/27 Operating Reserve for Wildewood West Landscaping District Fund 275.
Purpose:
To allocate funds in order to replace fencing on East and West sides of entrance into Wildewood West Landscaping District.
Council's Strategic Focus Area:
This addresses the City Council's Strategic Focus Area of improving and maintaining the City's Infrastructure.
Background:
The City annually levies and collects special assessments in order to maintain and service landscaping and fencing improvements that provide special benefit to the parcels identified in the Wildewood West Landscaping District. If the total budget is not used within the year, it is transferred to a reserve fund where it is held until needed.
The wooden fence on the East and West side of the entrance on Lyndsey Lane in the Wildewood West neighborhood has reached the end of its useful life (see Exhibits A and B). It is unrepairable and must be completely replaced with a new wood fence to maintain the standard and safety of the neighborhood.
Analysis:
Staff utilized an informal bidding process by contacting three local fencing companies that produced two responsible, responsive bidders as shown below.
Company Bid
Rodriguez Landscape Services $17,194.56
Twin Rivers Fencing $24,660.00
Rodriguez Landscape Services is the low, responsible, responsive bidder.
The project construction is expected to begin late August 2026 and completed by end of August 2026.
The amount required for this project exceeds the normal operating budget for the Wildewood West Landscaping District and reserve funds are available for this project.
Fiscal Impact:
The total cost to replace the fencing is $17,194.56. The Special Maintenance District Budget Analysis shows a projection of the FY 26/27 Operating Reserve for Wildewood West Landscaping District Fund 275 to be $18,189.02. There is no fiscal impact to the general fund.
Alternatives:
1. Direct staff not to use the reserves and fund the project with other funds.
2. Direct staff not to proceed with the fence replacement.
Recommendation:
Adopt a Resolution authorizing the Finance Director to appropriate $17,194.56 from available reserves in Wildewood West Landscaping District Fund 275 to Account No. 6196-63663 (Materials) for fence replacement.

Summary
Subject: Verkada Citywide Security Hardware and Install Contract Award Recommendation: Adopt a Resolution which takes the following actions:
A. Awards the purchase to Monarch of San Francisco, CA and installation of Verkada security hardware in the not to exceed amount of $148,487.38 plus 10% contingency of $14,848.74 for a total of $163,336.12 utilizing the CMAS contract number 3-26-01-1007, with the finding that it is in the best interest of the City
B. Authorizes the Finance Director to transfer $19,062.07 from Account 941023 (City Hall Improvements) to Account 941028 (Improvements to Buildings & Grounds)
Fiscal Impact: Up to a total of $163,336.12 from the following Improvements to Buildings & Grounds accounts:
$19,062.07 from Account 941028
$137,280.74 from Account 901028
$6,993.31 from Account 971028
Purpose:
To update the security hardware and monitoring systems into one integrated platform at all City facilities to help protect and secure the assets and infrastructure of the City along with the well-being and safety of City staff and the community.
Strategic Focus Area:
Updating the security hardware and monitoring system addresses the City Council’s Strategic Focus Area of Infrastructure as it will increase our ability to proactively protect city facilities and assets.
Background:
Ensuring the safety and well-being of staff, the public, and City facilities is a top priority. To maintain a secure environment, the City must have reliable systems in place to control, track, and document access to all facilities. The current security hardware installed in conjunction with the fire alarm system by current vendor Vyanet dba Eagle Security, is now outdated and incompatible with the City’s modern Verkada video surveillance system. Upgrading to newer, integrated security technology will strengthen
overall facility protection and streamline monitoring across all locations.
With recent increases in vandalism and theft, the ability to pair real-time video monitoring by Verkada’s state-of-the-art monitoring center with updated security devices will enhance proactive response, improve incident documentation, and support a safer environment for City employees and the community.
Analysis:
The current security hardware lacks integrated real-time camera monitoring and cannot connect to the surveillance cameras installed across City facilities. The City has standardized its security infrastructure on the Verkada platform for both video surveillance and access control. Transitioning from the existing hardware to Verkada security hardware will establish a fully integrated, modern system that enables 24/7 real-time monitoring through Verkada’s monitoring center, improving overall security and incident response.
The current fire alarm system vendor, Vyanet dba Eagle Security, will continue to maintain and monitor the fire system with no lapse in coverage during the installation transition to Verkada security hardware.
Monarch of San Francisco, CA has proven to be a valuable partner in implementing these systems and have gone out of their way to make sure they are providing excellent service in the installation and support of these systems. Monarch of San Francisco, CA has been awarded a contract under the California Multiple Award Schedule (CMAS) for the sale and installation of Verkada security and access control systems. Staff recommends piggybacking on the cooperative contract used by the City's IT Department for the current Verkada camera systems under the CMAS contract number of 3-26-01- 1007 and is valid through December 31, 2028.
CMAS is a California Department of General Services program that creates a pool of suppliers that governmental agencies can solicit offers from for information technology products and services which have been assessed to be fair, reasonable and competitive. Pursuant to Municipal Code Section 2-
6.14, Council may waive competitive bidding requirements when it determines it is in the best interest of the City to do so in favor of cooperative purchasing.
Fiscal Impact:
Hardware plus installation cost of $148,487.38 plus 10% contingency of $14,848.74 for a total up to $163,336.12 from the following Improvements to Buildings & Grounds accounts based on installation site:
1. $19,062.07 from Account 941028
2. $137,280.74 from Account 901028
3. $6,993.31 from Account 971028
Recommendation:
Adopt a Resolution which takes the following actions:
A. Awards the purchase to Monarch of San Francisco, CA and installation of Verkada security hardware in the not to exceed amount of $148,487.38 plus 10% contingency of $14,848.74 for a total of $163,336.12 utilizing the CMAS contract number 3-26-01-1007, with the finding that it is in the best interest of the City.
B. Authorizes the Finance Director to transfer $19,062.07 from Account 941023 (City Hall Improvements) to Account 941028 (Improvements to Buildings & Grounds).
Alternative:
1. Advise staff to submit the project for formal bids and return to council with bid results.
2. Do not purchase and continue with the current security system, which would result in less secure City facilities.

Presentation By: Gina Rowland, Human Resources Director Summary
Subject: Side Letter Agreements with Yuba City First Level Managers Recommendation: Adopt a Resolution approving side letter agreements with the Yuba City First Level Managers unit to add supervisor classes eligible to work standby, extend the wage reopener to January 2027, and add provisions for supervisors assigned to work as relief operators at the Water Treatment Plant and the Wastewater Treatment Facility
Fiscal Impact: There is no increased General Fund cost for these side letter agreements. The Street Maintenance Supervisor and Wastewater Collections Supervisor will be assigned standby duty on an “as needed” basis when there are an insufficient number of front-line workers in the standby rotation. Any costs associated with standby and call back pay for these two supervisors are paid for by Roads Funds and the Utilities Enterprise Fund
There is also no General Fund cost for Treatment Plant supervisors who are assigned to work a shift as a relief plant operator during periods of low staffing.
Any overtime costs resulting from this side letter will be paid for by the Utilities Enterprise Fund
Purpose:
To approve side letter agreements with Yuba City First Level Managers bargaining unit.
Strategic Focus Area:
Approval of side letters with the First Level Managers unit supports the Council’s Strategic Plan goal of Workforce Excellence as they assist with employee retention by ensuring supervisory employees are treated equitably with the employees they supervise.
Background:
Employee representatives from the First Level Managers bargaining unit reached out to Human Resources in June to request consideration of a side letter agreement that would allow the Streets Maintenance Supervisor and Wastewater Collections Supervisor to be assigned standby duty on an “as needed” basis when there are an insufficient number of line staff employees available. Currently,
the Electrical/Instrumentation Supervisor and the Water Distribution Supervisor are both eligible for standby duty and call back pay; however, the Streets Maintenance Supervisor and Wastewater Collections Supervisor are not listed in the Memorandum of Understanding (MOU) between the City and the First Level Managers.
In addition, the current MOU with Yuba City First Level Managers includes a wage reopener for May 2026 that required the parties to discuss the City’s financial position on the issue of wage to determine if an agreement can be reached on wage increases only to be effective the first pay period in July 2026.
Lastly, the existing MOU between the City and First Level Managers does not include language for how the Wastewater Treatment Facility Chief Operator, Wastewater Treatment Facility Supervisor, Water Treatment Facility Chief Operator and Water Treatment Facility Supervisor are to be paid when they work as a relief operator at their respective treatment plants during periods of low staffing. The Local 1 MOU for line staff includes provisions that treatment plant operators may not work more than 12 hours in a 24-hour period, nor will they be required to work more than 16 hours straight in a 24-hour period.
In addition, when line staff treatment plant operators work an extra shift without receiving a minimum two week notice, they receive overtime for the extra shift and continue to receive full pay for their regularly assigned schedule for the workweek, even if they are required to take the day off because they have worked the maximum number of hours allowed in a 24-hour period.
Analysis:
The City and the First Level Managers’ unit reached agreement to enter into a side letter to add the supervisory classes of Streets Maintenance Supervisor and Wastewater Collections Supervisor to Section 14.2 of the MOU pertaining to Call Back and Standby Time. This change will ensure the City has the ability to assign standby duty to all similarly situated supervisors as needed when there is an insufficient number of front-line workers available for the standby rotation.
Agreement was also reached to extend the May 2026 wage reopener to January 2027 when the City will have more information on its mid-year budget.
The City and the First Level Managers also agreed to enter into a side letter agreement to modify Section 14.7 for Treatment Plant Relief Operators. Section 14.7 already included language for a 5% shift differential for supervisors who work a night shift at either the Water Treatment Plant or the Wastewater Treatment Facility. New language added addresses compensation for shift schedule changes when supervisors work a front-line operator work shift. This addition to the MOU between the City and the First Level Managers ensures supervisory employees are treated the same as the employees they supervise.
The current MOU with the First Level Managers bargaining unit ends on June 25, 2027. The City and the bargaining unit will commence negotiations for a successor MOU in the Spring of 2027.
Fiscal Impact:
There is no increased General Fund cost for these side letter agreements. The Street Maintenance Supervisor and Wastewater Collections Supervisor will be assigned standby duty on an “as needed” basis when there are an insufficient number of front-line workers in the standby rotation. Any costs associated with standby for these two supervisors are paid for by Roads Funds and the Utilities Enterprise Fund.
There is also no General Fund cost for Treatment Plant supervisors who are assigned to work a shift as a relief plant operator during periods of low staffing. Any overtime costs resulting from this side letter will be paid for by the Utilities Enterprise Fund.
Alternatives:
Do not approve staff’s recommendation or approve some but not all of staff’s recommendation. If the side letters are not approved, staff would need to immediately commence meeting with the First Level Managers for the May 2026 wage reopener required by the MOU. The recommended new MOU language for Streets Maintenance Supervisor and Wastewater Collections Supervisor eligibility for standby duty and call back pay and the language for Treatment Plant supervisors assigned to work a relief operator shift would be pushed to the negotiations for a successor MOU.
Recommendation:
Adopt a Resolution approving side letter agreements with the Yuba City First Level Managers unit to add supervisor classes eligible to work standby, extend the wage reopener to January 2027, and add provisions for supervisors assigned to serve as relief operators at the Water Treatment Plant and the Wastewater Treatment Facility.

Date: August 18, 2026
To: Honorable Mayor & Members of the City Council;
From: Public Works Department
Presentation By: Joshua Wolffe, Public Works Director
Summary
Subject: Tierra Buena Mobile Home Park Water Consolidation Project Award Recommendation: Adopt a Resolution taking the following actions:
A. Denies Newland Entities, Inc.’s request for relief based on a claimed clerical mistake pursuant to California Public Contract Code sections 5100 through 5107; evaluates the bid in accordance with the Proposal Documents at $198,580.00; and finds that Ridgero Engineering, Inc. is the lowest responsive and responsible bidder
B. Awards a construction contract to Ridgero Engineering, Inc of Olivehurst, California, in an amount not to exceed $97,600.00 and authorizes the City Manager to execute the contract on behalf of the City, subject to review and approval as to legal form by the City Attorney C. Authorizes a construction contingency in an amount not to exceed $19,520.00, and authorizes the Public Works Director to approve change order(s) addressing changes in quantities, unforeseen field conditions, utility conflicts, design clarifications, and other circumstances arising during construction, provided the cumulative value does not exceed the authorized contingency
D. Authorizes the Finance Director to execute a supplemental appropriation in the amount of $126,880 to CIP Account No. 951092-65501, Water Line Extension & Distribution Piping Enhancements, for the Tierra Buena Mobile Home Park Water System Improvement Project, and to process a corresponding budget adjustment to recognize grant revenue in Account No. 951092-43126 (State Revolving Fund Grant Revenue)
E. Finds that the Project is categorically exempt from the California Environmental Quality Act pursuant to CEQA Guidelines Section 15304, that the actions authorized herein are within the scope of the previously approved Project, and that no further environmental review is required Fiscal Impact: $126,880– Total Construction-Phase Project Cost - Account No. 951092-65501 (Water Line Extension & Distribution Piping Enhancements) $97,600 – Construction Contract Award Amount
$19,520 – Construction Contingency (20%)
$9,760 – CM, Inspection, City Administration (5%)
Purpose:
To provide safe drinking water to the residents of the Tierra Buena Mobile Home Park through the consolidation of its private water system with the City's water system.
Council's Strategic Goal:
This project addresses City Council’s Strategic Focus Area’s of Improving the City’s Infrastructure and maintaining fiscal responsibility.
Background:
The Tierra Buena Mobile Home Park operates a private community water system that does not meet current State drinking water quality standards. To provide residents with a long-term, reliable drinking water supply, the State Water Resources Control Board and the City have been coordinating the consolidation of the mobile home park into the City’s municipal water system.
The proposed consolidation will connect Tierra Buena Mobile Home Park to the City’s existing water distribution system and allow the mobile home park’s existing water facilities to be abandoned or removed as appropriate. The Drinking Water State Revolving Fund application identifies Tierra Buena Mobile Home Park as serving approximately 52 residents and requests approximately $175,000 in financial assistance for the consolidation work. The application anticipated construction beginning in September 2026 and completion by December 2026. The Project generally includes installation of the City water service and associated piping, valves, backflow-prevention equipment, testing and disinfection, removal of existing private-system components, demolition of the existing hydro tanks and deep well, and restoration of disturbed areas. The construction documents estimate approximately 30 days to complete the work.
On August 19, 2025, Council adopted a resolution authorizing the City to carry out the Project, enter into a funding agreement with the State Water Resources Control Board, accept and expend State funds, and designate the City Manager or designee to execute the funding agreement and related documents. The State funding agreement was subsequently executed on May 12, 2026. By late May 2026, the plans and specifications were complete and the City was proceeding with solicitation of construction bids.
The Project is time-sensitive because Tierra Buena Mobile Home Park residents currently rely on bottled water assistance as an interim drinking water supply. Earlier coordination records identified an October 31, 2026 expiration date for the bottled water agreement and noted that an extension would be pursued to avoid a lapse in service if construction was not complete. Subsequent project coordination continued to identify the bottled water agreement as a schedule constraint, with the State indicating it would revisit the agreement in September. Based on the City’s current understanding, bottled water grant assistance is expected to be available only through December 2026, making timely award and completion of the consolidation work important to avoid interruption of safe drinking water service to the residents.
The City began soliciting construction bids in June 2026. The bid period was extended to July 2, 2026, and staff began reviewing the bids for presentation to the City Council. During that review, staff identified discrepancies in the apparent low bidder’s proposal, requiring further review under the Proposal Documents and the California Public Contract Code before an award recommendation could be finalized.
Analysis:
The Tierra Buena – Water Consolidations Project was advertised for bids beginning June 11, 2026.
Plans and specifications were posted on publicpurchase.com and provided to local builder/contractor exchanges. On July 2, 2026, four (4) bids were received and opened by the City Clerk. A list of the bids received and the Engineer’s Estimate are shown below:
Company Total Bid (Bid Schedules)
Newland Entities, Inc. $88,880.00
Ridgero Engineering, Inc. $97,600.00
North Star Construction and Engineering, Inc. $104,450.00 C.E Cox Engineering $106,280.00
_____________________________________________________
Engineer’s Estimate $110,000.00
Newland Entities, Inc. is the apparent low, responsive, and responsible bidder.
Apparent Low Bidder Rejection:
Newland Entities, Inc. submitted the apparent low bid in the amount of $88,880.00. Following bid opening, staff identified discrepancies between the stated item prices and corresponding extended totals for various bid items.
The Proposal Documents provide that, in the event of a discrepancy between an item price and the total entered for that item, the item price shall prevail. Because the discrepancies materially affected the evaluated bid amount, staff consulted with the City Attorney and notified Newland of the discrepancies.
Newland was advised that, if it believed the discrepancies resulted from a clerical mistake, it could submit a written request for relief pursuant to California Public Contract Code section 5103.
Newland subsequently submitted a written request asserting that various bid items contained a clerical error, that the bid amounts “populated incorrectly,” and that its intended bid amount was $85,280.00.
Staff and the City Attorney reviewed Newland’s request. The submission did not include contemporaneous estimating worksheets, bid recap documents, calculations, quotations, spreadsheets, or similar documentation explaining how the claimed error occurred or demonstrating that the revised prices represented Newland’s intended bid at the time of submission. Staff and the City Attorney therefore determined that Newland did not establish entitlement to relief.
The City evaluated the bid as originally submitted in accordance with the Proposal Documents.
Applying the stated item prices throughout the bid schedule results in an evaluated bid amount of $198,580.00.
Accordingly, staff recommends denying Newland’s request for relief and evaluating its bid at $198,580.00 in accordance with the Proposal Documents.
Award Options
The options available to move the Project forward are to reject all bids and rebid the Project or to award the contract to the next lowest responsive and responsible bidder. Staff does not recommend rebidding the Project for the following reasons:
• Rebidding would delay construction and increase the risk of interruption to temporary bottled water service.
• Rebidding may result in higher bids or reduced bidder participation.
Staff has reviewed the bid submitted by Ridgero Engineering, Inc. and determined that it is responsive
to the bidding requirements. Staff has also reviewed the bidder’s qualifications and recommends finding Ridgero Engineering, Inc. responsible and awarding the construction contract in the amount of $97,600.00.
Fiscal Impact:
The estimated total construction phase cost is $126,880, consisting of a construction contract with Ridgero Engineering, Inc. in an amount not to exceed $97,600, a 20% construction contingency in an amount not to exceed $19,520, and approximately 10% ($9,760) for construction management, inspection, and contract administration by City staff.
A 20% construction contingency is recommended due to the nature of the Project, which includes connecting an existing private water system to the City's municipal water system, abandonment of existing facilities, excavation around existing underground utilities, and work where existing utility records and subsurface conditions are limited. The contingency provides sufficient flexibility to address unforeseen field conditions, utility conflicts, quantity adjustments, and minor design modifications while minimizing construction delays.
The Project is funded through the State Revolving Fund (SRF) Grant. Staff recommends a supplemental appropriation in the amount of $126,880 from CIP Account No. 951092-65501 – Water Line Extension & Distribution Piping Enhancements to CIP Account No. 951092-43126 – Water Line Extension & Distribution Piping Enhancements to fund the Project.
All eligible project costs, including construction, construction management, inspection, engineering, administration, City hot-tap and connection fee’s, and other actual costs incurred by the City, will be tracked separately for reimbursement through the SRF Grant. Upon receipt of grant reimbursements, funds will be returned to CIP Account No. 971092.
Environmental:
On August 30, 2024, the City filed a Notice of Exemption (SCH No. 2024-081416) with the Sutter County Clerk for the Tierra Buena Mobile Home Park Water System Improvement Project pursuant to CEQA Guidelines Section 15304 (Minor Alterations to Land). The recommended actions are within the scope of the previously approved Project, and no further environmental review is required.
Alternatives:
1. Reject the bids and either rebid or delay/cancel the project, which would require the mobile home park to continue providing bottled water to its residents.
2. Provide other direction.
Recommendation:
Adopt a Resolution taking the following actions:
A. Denies Newland Entities, Inc.’s request for relief based on a claimed clerical mistake pursuant to California Public Contract Code sections 5100 through 5107; evaluates the bid in accordance with the Proposal Documents at $198,580.00; and finds that Ridgero Engineering, Inc. is the lowest responsive and responsible bidder.
B. Awards a construction contract to Ridgero Engineering of Olivehurst, California, in an amount not to exceed $97,600.00 and authorizes the City Manager to execute the contract on behalf of the City, subject to review and approval as to
legal form by the City Attorney.
C. Authorizes a construction contingency in an amount not to exceed $19,520.00, equal to 20% of the construction contract, and authorizes the Public Works Director to approve change order(s) addressing changes in quantities, unforeseen field conditions, utility conflicts, design clarifications, and other circumstances arising during construction, provided the cumulative value does not exceed the authorized contingency.
D. Authorize the Finance Director to execute a supplemental appropriation in the amount of $126,880 to CIP Account No. 951092-65501, Water Line Extension & Distribution Piping Enhancements, for the Tierra Buena Mobile Home Park Water System Improvement Project, and to process a corresponding budget adjustment to recognize grant revenue in Account No. 951092-43126 (State Revolving Fund Grant Revenue).
E. Finds that the Project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15304 (Minor Alterations to Land), that the recommended actions are within the scope of the previously approved Project, and that no further environmental review is required.

Purpose:
To facilitate construction of the WWTF Septage Receiving Station Project and improve wastewater treatment operations.
Council's Strategic Goal:
This project addresses City Council’s Strategic Focus Area’s of Improving the City’s Infrastructure and maintaining fiscal responsibility.
Background:
The City’s Wastewater Treatment Facility (WWTF) receives septage and other hauled wastewater from commercial haulers. The existing receiving process provides limited screening capability and limited ability to accurately monitor hauled wastewater volumes entering the treatment facility.
As part of the 2020 Wastewater Treatment Facility and Collection System Master Plan, the City identified construction of a Septage Receiving Station as a recommended WWTF condition-related improvement project. The Master Plan included the facility within the recommended Capital Improvement Program and identified the improvement as necessary to support continued reliable treatment plant operations.
Consistent with the Master Plan recommendations, staff initiated the WWTF Septage Receiving Station Project (25-04) to design and construct a dedicated receiving facility for hauled wastewater. HERWIT Engineering prepared the plans and specifications for the project.
On June 17, 2025, City Council awarded the purchase of a Franklin Miller Spiralift Model SR30 Septage Receiving Station and related equipment to Franklin Miller, Inc. of Livingston, New Jersey in the amount of $400,000, including tax and contingency. The equipment was procured in advance of construction because of the manufacturer’s estimated 32- to 34-week lead time and to avoid future price escalation and contractor markup.
On June 16, 2026, City Council adopted a Class 1 Categorical Exemption under the California Environmental Quality Act (CEQA), approved the plans and specifications, and authorized advertisement for bids for the project.
The project generally includes the following improvements:
• Installation of the City-furnished septage receiving equipment. • Construction of a concrete pad, roadways, drain and sewer pipelines, and manholes. • Site piping, valves, mechanical connections, electrical service, instrumentation, and controls. • Equipment supports, grounding, testing, startup coordination, and integration with the existing wastewater treatment facility infrastructure.
Analysis:
The Project was advertised for bids beginning June 26, 2026, through the City’s online bidding platform.
The City received five (5) bids by the 2:00 p.m. deadline on July 30, 2026, at which time the bids were publicly opened.
Company Total Bid
Golden State Excavating $645,000
GSE Construction Company $1,056,400
Gateway Pacific Contractors $1,135,000
W.M. Lyles Co. $1,209,010
Cushman Contracting Corporation $1,526,000
_________________________________________
Engineer’s Estimate $660,000
The bid documents included a bid alternate for additional paving improvements. Because the additional paving is not required for operation of the Septage Receiving Station and available project funds are limited, staff recommends awarding base bid only.
Golden State Excavating, Inc. (Golden State) submitted the apparent low bid in the amount of $645,000. Following bid opening, Golden State timely notified the City that it had discovered a material clerical error in compiling its bid. Golden State stated that installation costs associated with the Cityfurnished septage receiving equipment were calculated during bid preparation but were inadvertently classified with the excluded owner-furnished equipment procurement value and omitted from its final bid total. Golden State requested relief from and withdrawal of its bid pursuant to California Public Contract Code sections 5100 through 5105 and offered to provide its contemporaneous bid worksheets, final bid recap, supporting calculations, quotations, and related records.
Golden State’s request identifies a bid-compilation and classification error that materially affected the amount submitted, rather than a post-bid change in pricing or an error in business judgment. Based on the written notice and supporting contemporaneous documentation provided by Golden State, staff finds that the request satisfies the applicable requirements for relief under California Public Contract Code section 5103 and recommends consenting to withdrawal of the bid without forfeiture of bid security.
Separately, during the City’s review of the bid, staff determined that Golden State submitted a copy of the bidder’s bond rather than the original bidder’s bond required by Section 00200, Article 10 of the Contract Documents. The Contract Documents expressly required each bid to be accompanied by an original bidder’s bond and provided that a bid not accompanied by proper bidder’s security would be considered nonresponsive. This defect existed at the bid deadline and was not corrected before bid opening. Accordingly, Golden State’s bid is also nonresponsive and must be rejected on that independent basis.
Award Options
GSE Construction Company’s bid is $396,400, or approximately 60%, above the Engineer’s Estimate of $660,000. Although the bid exceeds the estimate, staff considers the bid reasonable based on the competitive bid results and the relatively close range of the three lowest responsive bids, which were within approximately 15% of one another.
The bid results suggest that current contractor pricing for the specialized civil, mechanical, electrical, instrumentation, equipment integration, and startup work required for the Project is higher than anticipated in the Engineer’s Estimate.
The options available to move the project forward are to reject all bids and rebid the project or to award the contract to the next lowest responsive and responsible bidder. Staff does not recommend rebidding
the project for the following reasons:
• Rebidding would delay construction and the operational benefits of the project. • Rebidding may result in higher bids or reduced bidder participation.
Staff has reviewed the bid submitted by GSE Construction Company and determined that it is responsive to the bidding requirements. Staff has also reviewed the bidder’s qualifications and recommends finding GSE Construction Company responsible and awarding the construction contract.
Supplemental Inspection & Engineering Services During Construction (ESDC):
HERWIT Engineering prepared the plans and specifications for the Project and has detailed knowledge of the design, project requirements, and owner-furnished septage receiving equipment. To support construction of the Project, staff requested a proposal from HERWIT Engineering to provide engineering services during construction and supplemental construction inspection services.
The proposed services generally include attendance at construction meetings, review of submittals and requests for information, preparation of design clarifications, review of proposed changes, coordination with the contractor and City staff, assistance with startup and testing, preparation of record drawings, project closeout support, and construction inspection as requested by the City.
City staff will also perform construction management and inspection for the Project. HERWIT Engineering’s inspection services will supplement City inspection efforts and provide specialized technical support where familiarity with the design, equipment, and project-specific requirements is beneficial.
Retaining the design engineer for these services will provide continuity between design and construction, facilitate timely resolution of technical questions, and help ensure that the improvements are constructed in accordance with the plans and specifications. Staff has reviewed HERWIT Engineering’s proposal and determined that the proposed scope and fee are reasonable for the services required.
Staff therefore recommends awarding a professional services agreement to HERWIT Engineering for an amount not to exceed $72,460 for engineering services during construction and supplemental construction inspection.
Fiscal Impact:
The estimated total construction-phase project cost is approximately $1,313,730. This amount includes a construction contract of $1,056,400 and a 15% construction contingency of $158,460, for a total construction authorization not to exceed $1,214,860. The recommended construction contract and bid construction-phase cost are based on the base bid only and exclude the bid alternate. The remaining project costs consist of engineering services during construction, inspection, and City administration.
Staff requests express authorization of the 15% construction contingency and authorization for the Public Works Director to administer and approve change orders within the authorized contingency amount. This authority will allow necessary changes to be addressed promptly during construction while maintaining expenditures within the authorized construction amount. Approval of the contingency does not authorize expenditures beyond the total project funding identified in this staff report.
CIP Account No. 981329-65501 (Septic Station) currently has approximately $757,000 available. The current account balance reflects funding allocated during prior Capital Improvement Program budget cycles based on preliminary project cost information available at the time. The final construction estimate was completed after development of the most recent CIP budget and was lower than the
responsive bid prices received. As a result, the existing CIP allocation did not fully account for the actual construction contract amount, the requested 15% construction contingency, engineering services during construction and inspection, and City administration costs.
Based on the recommended contract award and associated construction-phase costs, an additional $556,730 is required to fully fund the Project.
Staff recommends authorizing the Finance Director to transfer $556,730 from the Unallocated Wastewater Fund to CIP Account No. 981329-65501 and to make any related budget adjustments necessary to implement the transfer.
Environmental:
On June 16, 2026, City Council determined that the project falls within the Class 1 Categorical Exemption set forth in CEQA Guidelines Section 15301 as a minor alteration of an existing public Wastewater Treatment Facility involving negligible or no expansion of existing use. There has been no substantial new information or change to the project requiring additional environmental review.
Alternatives:
1. Reject the bids and either rebid or delay/cancel the project.
2. Provide other direction.
Recommendation: Adopt a resolution taking the following actions:
A. Rejects the bid submitted by Golden State Excavating, Inc. as nonresponsive for failure to provide the original bidder’s bond required by the Contract Documents and separately consents to withdrawal of the bid without forfeiture of bid security based on the bidder’s demonstrated material clerical error pursuant to California Public Contract Code sections 5100 through 5107.
B. Awards a construction contract to GSE Construction Company of Livermore, California, in an amount not to exceed $1,056,400 and authorizes the City Manager to execute the contract on behalf of the City, subject to review and approval as to legal form by the City Attorney.
C. Authorizes a construction contingency in an amount not to exceed $158,460, and authorizes the Public Works Director to modify the scope of work through change order(s) to address changes in quantities, unforeseen field conditions, coordination with existing operating facilities, design clarifications, and other circumstances arising during construction, provided the cumulative value of such change orders does not exceed the authorized contingency amount.
D. Awards a professional services agreement to HERWIT Engineering of Clayton, California, for engineering services during construction and supplemental construction inspection in an amount not to exceed $72,460 and authorizes the City Manager to execute the agreement on behalf of the City, subject to review and approval as to legal form by the City Attorney.
E. Authorizes the Finance Director to execute a budget transfer in the amount of $556,730 from the Unallocated Wastewater Fund to CIP Account No. 981329- 65501 (Septic Station), utilizing available balances within the Unallocated
Wastewater Fund.
F. Finds that CEQA was previously assessed for the Project, a Class 1 Categorical Exemption was adopted, the actions recommended herein are within the scope of the previously approved Project, and no further environmental review is required under CEQA.
