Agenda Item No. 4
CITY OF YUCAIPA
AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Jennifer Crawford, Assistant City Manager ZL
FOR: City Council Meeting of January 24, 2022
SUBJECT: CalRecycle Grant Programs Application Authorization and Senate Bill 1383 Local Assistance Grant Program
RECOMMENDATION:
That City Council adopt Resolution No. 2022-04 authorizing the submittal of applications for all grant programs offered by the California Department of Resources Recycling and Recovery ("CalRecycle") and authorize the City Manager or his/her designee to execute all documents on its behalf.
BACKGROUND:
On September 19, 2016, Senate Bill (SB) 1383 was signed into law to reduce organic waste disposal (food waste, green waste, paper products, etc.) by 75% (20 million tons) and increase edible food recovery by 20%, by 2025 in an effort to address climate change, and specifically short-lived climate pollutants. SB 1383 is the State's most ambitious waste reduction law in the last 30 years.
As a result of SB 1383, the California Department of Resources Recycling and Recovery (CalRecycle), which is the state department tasked with administering California's waste and recycling programs, developed prescriptive regulations to achieve the State's outlined organic waste disposal goals. To meet these goals CalRecycle is requiring jurisdictions to adopt and enforce actions related to this bill. This enforcement includes providing organic waste recycling to residents, implementing a food recovery program, conducting outreach and education, procuring recycled organic waste products such as mulch and compost and maintaining related records.
On January 10, 2022, the City Council adopted Ordinance No. 403, adding mandatory organic waste disposal reduction requirements to the Yucaipa Municipal Code.
DISCUSSION:
On January 6, 2022, the City received notice that CalRecycle announced the SB 1383 Local Assistance Grant Program (Grant) for local jurisdictions to assist with the implementation of regulation requirements associated with SB 1383. The Grant application submittal deadline is February 1, 2022.
City Council approval of Resolution No. 2022-04, grants staff the authorization to apply for, receive and expend any local CalRecycle grant funds for which the City is eligible. Grant funds can be utilized for activities such as:
• Capacity Planning
• Collection
• Edible Food Recovery
• Education and outreach (includes organic waste & edible food recovery) • Enforcement and Inspection
• Program Evaluation/Gap Analysis
• Procurement Requirements (using recycled organic products — compost, mulch, electricity, and/or renewable gas and recycled paper and paper products) • Record Keeping
This is a one-time payment, non-competitive grant, and if approved, the City's share of the Grant has been estimated to be approximately $73,990.
FISCAL IMPACT:
Direct cost to the City is limited to staff time for application preparation and administration of funds received. If the Grant application is approved, funding estimated to be in the amount of approximately $73,990 would reduce the City's local funding costs for implementation of the State mandates under SB 1383.
