Agenda Item No. 4
CITY OF YUCAIPA
AGENDA REPORT
TO: Honorable Mayor and City Council
FROM:Raymond A. Casey, City Manager
Sherrie M. O'Connell, Emergency Services Coordinator/Community Liaison FOR: City Council Meeting of February 14, 2022
SUBJECT: Resolution No. 2022-09 — Termination of Local Emergency RECOMMENDATION:
That City Council adopt Resolution No. 2022-09, proclaiming the termination of the December 2021 Storm Event local emergency.
BACKGROUND:
In 2020, the El Dorado Fire burned approximately 22,744 acres. Post -fire watershed assessments were conducted in the burn areas to identify on-site and downstream threats to public health or safety from landslides, debris flow, flooding, road hazards, and other post -fire -related concerns, as well as to determine measures to prevent or mitigate identified threats. On Tuesday, December 14, 2021, the City of Yucaipa experienced severe weather conditions that brought over 3 inches of rain to the Oak Glen Watershed and caused the San Bernardino County Sheriff's Department to issue an evacuation order for residents who lived in or near Oak Glen, Forest Falls, Mountain Home Village, Northeast Yucaipa, east of Bryant Street and north of both Date Ave and Highway 38 from Bryant to Angelus Oaks. On December 14, the City Manager proclaimed a local emergency due to the storm.
On Wednesday, December 15, 2021, the City Council held a Special Meeting and adopted Resolution No. 2021-79, ratifying the proclamation of the existence of a local emergency by the City Manager and waived the requirement to review the need for continuing the local emergency proclamation every 14 days to extend the proclamation until the next City Council meeting of January 10, 2022. On Monday, January 10, 2022, and in the following two meetings since, City Council has extended the declaration of a local emergency as a result of the December 2021 Storm Event.
During the December 14th storm event, a significant amount of debris, mud, and sediment was transported in runoff from the burn areas through several drainage channels/creeks, and accumulated at several roadways and drainage structures along Spoor Canyon/Creek, Wilson Creek, and Oak Glen Creek. City staff evaluated these areas, determined immediate action was required to protect life and property, and authorized emergency contract work to clear the roadways of debris/mud at select locations, and to clear debris and mud immediately downstream and upstream of several drainage structures. In addition to the emergency work that has already occurred primarily in the Spoor Canyon/Creek areas, there is also additional repair work that has been identified as a result of this storm event at other areas within Yucaipa (Wilson Creek and Oak Glen Creek).
City Council Agenda Report
Termination of Local Emergency
For the Meeting of February 14, 2022
Pursuant to Yucaipa Municipal Code 8.36.160 and Section 8630 of the California Government Code, the City Council shall review, at least every fourteen (14) days, until such local emergency is terminated, the need for continuing the local emergency. Such declaration facilitates the City's response to combat perilous conditions by providing limited immunity for emergency actions of public employees and governing bodies, authorizing the issuance of orders and regulations to protect life and property, and activating pre -established local emergency provisions such as special purchasing and contracting procedures.
Conditions of extreme peril due to the December 2021 Storm Event no longer exist, thus the extension of the declaration is no longer warranted. City staff will continue to work with California Office of Emergency Services (Cal OES) representatives for potential reimbursement and will return to City Council with future updates.
FISCAL IMPACT:
Staff has applied for California Disaster Assistance Act funding through the state and is working diligently with Cal OES to provide the needed information for their ongoing review. Cal OES will continue to review the list of projects identified by the City and expects this process to take several months. Cal OES staff has confirmed terminating the declaration will not have an impact on those requests.
