CITY OF YUCAIPA

AGENDA REPORT
TO: Honorable Mayor and City Council Members
FROM:P7—Sherrie
Raymond A. Casey, City Manager
M. O'Connell, Emergency Services Coordinator
FOR: City Council Meeting of March 14, 2022
SUBJECT: Resolution No. 2022-13 - Termination of Local Emergency for COVID-19 and Proclaim a Local Emergency for the Emergency Medical Services System
RECOMMENDATION:

That City Council:

1. Adopt Resolution No. 2022-13, proclaiming the termination of COVID-19 local emergency; and

2. Declare that there is an urgent need to proclaim a local emergency within the City of Yucaipa resulting from the impact of the worldwide Novel Coronavirus pandemic on the Emergency Medical Services system.

COVID-19 PANDEMIC BACKGROUND/DISCUSSION:

The Coronavirus Disease 2019, known as COVID-19 ("COVID-19"), is an infectious disease caused by a novel (new) coronavirus known as severe acute respiratory syndrome coronavirus 2 ("SARS-CoV-2"). The disease was first identified in China in late 2019 and has spread globally.

The first cases in California were confirmed in the end of January 2020.

On March 4, 2020, Governor Gavin Newsom declared a state-wide state of emergency due to the spread of COVID-19. On March 10, 2020, the San Bernardino County Department of Public Health proclaimed a Public Health Emergency, and the Board of Supervisors issued a Proclamation of Local Emergency. On March 11, 2020, the World Health Organization declared the COVID-19 outbreak to be a pandemic. On March 13, 2020, the President of the United States declared a national state of emergency.

On March 18, 2020, the City Council held an emergency meeting and adopted Resolution No. 2020-16, declaring the existence of a local emergency due to the spread of COVID-19.

Government Code Section 8630(c) requires the City Council to review the need for continuing the local emergency at least once every 60 days until the City Council terminates the local emergency. -51-

City Council Agenda Report
Extending Local Emergency Due to the COVID-19 Pandemic
For Meeting of March 14, 2022
Since the City's proclamation of emergency, various orders and/or recommendations have been implemented by the State of California, San Bernardino County, and the City (e.g., stay at home orders, prohibitions on social gatherings, closing of non-essential businesses and public venues, imposing social distancing measures and requiring face coverings.

Beginning June 15, 2021, all sectors in the Blueprint Activities and Business Tiers Chart, from the California Department of Public Health, were permitted to return to usual operations, in compliance with Cal OSHA Emergency Temporary Standards and other statewide agency guidelines, with limited public health restrictions, such as masking and testing or vaccination verification requirements for large-scale higher -risk events. The State's Emergency Declaration is, however, still in effect at this time.

Through the COVID-19 Pandemic, the City has provided creative options to give flexibility to businesses and organizations that are impacted as a result of the reduced capacity for indoor operations through the approvals of Executive Orders 20-02, 20-03, and 20-04. These Orders temporarily suspended the City's applicable parking requirements and established outdoor space availability for businesses so that they can remain open at a pre-COVID-19 level. The approval of each specific site is administered through an administrative COVID-19 Temporary Use Pen -nit (COVID-19 TUP) application, reviewed by the City Planner at no cost to the business, to approve the proposed outdoor configuration. The approved COVID-19 TUPs are permitted to remain as long as the City's Emergency Declaration is in effect.

At the June 14, 2021, City Council Meeting, staff recommended, and Council approved the local State of Emergency for COVID-19 be extended to allow businesses and places of worship to remain open for outdoor dining and worship services, to help recuperate losses and create a seamless transition back to pre-COVID operations, and to allow staff time to prepare written communication for businesses and places of worship on the future tennination on their COVID- 19 related TUP.

On June 29, 2021, a letter was sent to all COVID-19 TUP applicants regarding the winding down of the emergency order and provided direction for any establishment desiring to continue to provide a similar experience following the closure of the emergency order. Since that date, most establishments have closed outdoor operations and two have since submitted permit requests for ongoing outdoor dining. There are a limited few still with tents, who will be receiving additional correspondence.

Additionally, a General Plan Amendment and Conditional Use Permit was submitted for the site associated with the Sanctuary Church COVID-19 TUP. It was deemed incomplete, and on Wednesday, October 20, 2021, staff met with Sanctuary Church representatives to discuss the need to press on with the subsequent submittal, given the incompatible use with the existing land use designation, and the COVID-19 TUP nearing an end. As of January 24, 2022, staff had not received the submittal and at that time mailed a status inquiry letter to both the church project manager and the pastor, highlighting the importance of finalizing the land use application for their place of worship. On Thursday, March 3, 2022, Sanctuary Church resubmitted their application and staff will be starting the review as soon as possible. Others that may have been relying on the -52-

City Council Agenda Report
Extending Local Emergency Due to the COVID-19 Pandemic
For Meeting of March 14, 2022
Temporary Use Permit guidelines associated with the COVID-19 Emergency Declaration have been notified of the recommendation to terminate the Declaration.

At the March 1, 2022, San Bernardino County Board of Supervisors meeting, the board approved to terminate the County Emergency Proclamation for COVID-19; however, proclaimed a local emergency within San Bernardino County resulting from the impact of the worldwide Novel Coronavirus pandemic to the Emergency Medical Services system.

Pursuant to Yucaipa Municipal Code 8.36.160 the City Council shall review, at least every fourteen (14) days, unless waived by the City Council to meet State requirements, until such local emergency is terminated, the need for continuing the local emergency. Such declaration facilitates the City's response to combat perilous conditions by providing limited immunity for emergency actions of public employees and governing bodies, authorizing the issuance of orders and regulations to protect life and property, and activating pre -established local emergency provisions.

General conditions of extreme peril due to the COVID-19 Pandemic no longer exist, thus the extension of the general declaration is no longer warranted. However, an emergency relative to emergency services does persist given the impacts of COVID-19 on emergency service staffing in hospitals, emergency transport operations and other emergency services. Declaring a "narrowed" emergency for such services consistent with the County's declaration allows the City to align with the County in their efforts to take any and all appropriate measures to continue to improve those services for Yucaipa residents and for the entire County.

FISCAL IMPACT:

City staff will continue to work with Federal Emergency Management Agency representatives for any potential further reimbursement and will provided needed information for their ongoing review.

EXECUTIVE SUMMARY
2020 PERFORMANCE BASED CONTRACTS ANNUAL REPORT
Inland Counties Emergency Medical Agency (ICEMA) is tasked with ensuring an effective system of quality patient care and coordinated emergency medical response by planning, implementing and evaluating an effective emergency medical services (EMS) system. A primary component of these responsibilities is developing a system for the timely response and transportation of patients via ambulance to specialty care centers and local receiving hospitals within San Bernardino County.

Under direction from the San Bernardino County Board of Supervisors, ICEMA entered into agreements with ambulance providers including memorandum of understandings with public ambulance providers and performance-based contracts (PBC) with private ambulance providers.

These contracts provide a detailed methodology for assurance of compliance with ICEMA policies and protocols. The PBCs add an emphasis on response time compliance and provide financial penalties or liquidated damages for response time non-compliance.

To ensure in-depth monitoring of the EMS response system, ICEMA collects data from transport providers to develop reporting as part of the quality improvement strategies. ICEMA is in the developmental stages of an official exemption policy. This draft policy will be presented to the ICEMA Board of Directors in early 2022.

BACKGROUND INFORMATION
Performance-based contracts or agreements with public and private ambulance providers in the County ensure a more in-depth monitoring of the EMS system for compliance with standards, policies and procedures designed to provide citizens with the best possible pre -hospital emergency care. Rural, wilderness and underserved areas were given special consideration regarding term of contract, penalty provisions, breach language, bond requirements and other areas that would otherwise have seriously affected the provider's ability to continue to provide emergency medical services.

San Bernardino County is divided into 26 total Exclusive Operating Areas designated as urban, rural, or wilderness areas, and where ambulance services are provided by private companies, public fire departments or fire districts, or by volunteer fire departments. All private providers are required to enter into a performance based contract; public providers are encouraged to enter into a Memorandum Of Understanding (MOU).

Performance based contracts provide for a detailed methodology for assurance of compliance by the contractor with all ICEMA policies and procedures with an emphasis on response time compliance. In some cases private provider agreements provide for financial penalties for response time non-compliance.

Term of Agreements:

The term of the agreement is provided in the "ALS Transportation Provider List" with evergreen clauses provided for rural/wilderness and public providers.

Responsibilities of Providers:

Personnel and Equipment:
• Provide all necessary personnel, equipment and materials to ensure availability and EMS response on a continuous 24-hour basis. • Staffing: ALS units — one paramedic and one EMT per unit; BLS units 2 EMTs per unit; CCT units in accordance with ICMEA policy. • Develop and maintain personnel, including plan for immediate recall of personnel, and patient care policies
• Provide in-service training to employees
• Ensure courteous conduct and professional appearance
• Ensure proper state licensure and ICEMA accreditation/certification • Ensure all personnel comply with ICEMA QI Plan
Coordination with other providers:

First responders (fire agencies)
• Develop and initiate mutual aid agreements
• Develop and maintain a first responder orientation program • Coordinate and work under the Incident Command System • Make available to first responder personnel continuing education programs
Police Chiefs and County Fire Chiefs Association:
• Provide an administrative representative or designee to attend meetings upon reasonable request
ICEMA, Transport Provider data. Compiled 12/22/2021 PW. Page 4 of 78 -96-

Mutual Aid:
• Respond to requests from neighboring jurisdictions that require Code 3 response, to the extent resources are available
• During disaster response, commit necessary and appropriate resources
Quality Improvement:

Medical Control:
• Adhere to all ICEMA plans, policies, standards and protocols, applicable county ordinances and state laws
• Adhere to standards of medical control established by ICEMA • Provide a physician medical director to work with ICEMA Medical Director to ensure compliance with established clinical standards (not required of rural/wilderness providers)
Response time standards:
• Compliance measured and calculated monthly on fractile basis using computer aided dispatch (CAD) data when and wherever possible. • Cancelled calls included in determining compliance; supervisory support vehicles are not included for the purpose of determining compliance
• Submit monthly each instance when a call results in exceeding maximum response time standard
Data Collection and Reporting:
• For each patient, an ICEMA approved patient care report (PCR) or electronic patient care report (ePCR) form must be completed • As an enhancement to the existing patient care reporting process, ICEMA implemented a patient data system for provider data submissions. Providers who utilize ICEMA's existing ePCR software are the first being transitioned. ICEMA now requires all EMS Providers to utilize a compliant ePCR data platform as the only acceptable standard.
• Submit accurate and complete data monthly, including CAD data, for each response and patient care data as specified by ICEMA approved electronic data collections and submission format
Currently, 48 providers are using the ImageTrend software. Providers currently on ImageTrend ePCR:
• American Medical Response - Rancho Cucamonga

Amendment 1 of the contract approved by BOS (Nov.
21, 2006, Item 81) authorized valid method for
computing EOA 5 response time compliance. Using
this method, EOA response time compliance is
calculated by combining monthly runs until enough
runs have accumulated to provide a statistically valid
measurement. The number of runs required for a
statistically valid measurement is based on the
previous year's runs. Based on 2019 data, 91 runs
are required for CY2020 compliance calculations.

Two cycles were completed in CY2020 and one cycle
will be completed in CY2021.

SUBJECT
Proclamation of Local Emergency - Emergency Medical Services System

RECOMMENDATION(S)

BACKGROUND INFORMATION
Inland Counties Emergency Medical Agency, as the local Emergency Medical Services (EMS) agency, is responsible for ensuring effective EMS for the Counties of San Bernardino, Inyo, and Mono. ICEMA administers State and local codes and regulations governing the provision of emergency medical care to the sick and injured at the scene of an emergency and during transport to a care hospital.

The Novel Coronavirus (COVID-19) originated in Wuhan, China in late 2019 and began spreading, initially, within China and then to other countries. On January 30, 2020, the World Health Organization declared the outbreak to be a "public health emergency of international concern". This was followed on January 31, 2020 by the United States Human Services Secretary declaring a public health emergency. California issued a Proclamation of a State of Emergency (Governor's Proclamation) on March 4, 2020 in order to deal with the cases in California. Subsequently, San Bernardino County proclaimed a local emergency on March 10, 2020.

For nearly two years, San Bernardino County has taken response actions to help mitigate the impacts of COVID-19 including providing large scale testing and vaccination services. San Item 34

Proclamation of Local Emergency - Emergency Medical Services System
March 1, 2022
Bernardino County has developed many best practices to better manage COVID-19 and help ensure public safety. Despite sustained efforts, COVID-19 continues to put a strain on the EMS System in San Bernardino County. Paramedic staffing shortages resulting from delayed training programs due to pandemic restrictions continue to be an ongoing challenge. Disruption in supply chains have resulted in ambulance manufacturing delays impacting local providers ability to purchase additional transportation vehicles. The County's largest emergency transport provider, American Medical Response has utilized out of State resources to help mitigate the staffing shortage. To continue to ensure public safety, it is imperative that First Responder agencies and ambulance transport providers maximize the number of available resources to maintain the ability to meet the anticipated emergency transportation needs of the County.

Pursuant to Government Code section 8630(c), the Board shall review the need for continuing the local emergency at least once every 60 days until the Board terminates the local health emergency.
