Agenda Item No. 9

CITY OF YUCAIPA

AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Megan Wolfe, Director of Community Services j
FOR: City Council Meeting of March 14, 2022
SUBJECT: Professional Services Agreement with Props AV
RECOMMENDATION:

That City Council:
1) Authorize the City Manager to execute an amendment to the Professional Services Agreement with Props AV to provide production services at the Yucaipa Performing Arts Center and various City special events, increasing the agreement amount by $300,000, with a not to exceed amount of $350,000, for a two-year term; and 2) Find that the public interest will not be best served by a formal proposal process, waive the formal solicitation of proposals/qualifications in accordance with the City of Yucaipa Municipal Code Section 2.24.060 and Ordinance No. 42.

DISCUSSION:

On July 1, 2022, the City entered into an agreement with Props AV for production services for the Yucaipa Performing Arts Center (YPAC), under the City Manager's purchasing authority in the amount of $50,000. Staff requests a waiver of the formal proposal process for the following reasons:
• Props AV provides the highest level of customer service at City events, to City staff, and when working with rental clients; and
• Props AV has knowledge of and a positive track record with using and maintaining City owned equipment; and
• The City does not own all equipment needed for the production of shows and Props AV is willing to supply the equipment needed and/or requested by clients; and • Props AV is a local family-owned small business.

Additionally, using Props AV to provide production services helps execute Council's goals for the YPAC of:
• Implementing cost-effective programming, with a goal of 50% cost recover; and • Producing an outdoor season of 4 ticketed concerts; and • Producing an indoor season of 10 ticketed events; and • Collaborating with local businesses to facilitate artistic and cultural experiences for the community; and
• Utilizing the YPAC as a rental facility.

Under the existing agreement Props AV provides production services at the YPAC and coordinates with YPAC staff to ensure rental clients recet94 the production services desired to execute their

event. Due to the number of YPAC rentals, YPAC shows and City special events, the agreement with Props AV is close to exceeding the purchasing authority of the City Manager. Staff is recommending that the City Council approve the continued partnership with Props AV and extend the terms of the agreement to include, a not to exceed amount of $350,000, an expiration date of June 30, 2023, staff training and production services for special events.

Of the $350,000, it is anticipated a minimum of 50% of the cost will be reimbursed through revenues earned from ticket sales and rental clients. City produced YPAC and special events are requiring a larger more costly production.

With COVID restrictions ending it is anticipated the number of rentals and amount of people attending YPAC events will increase resulting in higher revenues and a cost recovery percentage well above 50%.

FISCAL IMPACT:

The estimated expenditures in the amount of $175,000, for both pass-through and city events are included in the FY 21/22 Budget and the amount of $175,000 will be included in the FY 22/23 draft budget to be submitted to City Council at a later date.
