CITY OF YUCAIPA

AGENDA REPORT
TO: Honorable Mayor and City Council —
FROM: Fermin Preciado, Director of Development Service/City Engineer Fr - Landon
Kern, Assistant City Engineer LK
FOR: City Council Meeting of March 28, 2022
SUBJECT: Acceptance of Contract Work - 12"' and 13"' Street Safe Routes to School (SRTS) Sidewalk Project - Project No. 10878
RECOMMENDATION:

That City Council:

Accept the contract work completed by Three Peaks Corporation of Calimesa CA. in the amount of $896,134.40 for the 12"' and 13t' Streets SRTS Sidewalk Project - Project No. 10878 (Project); and

2. Approve the final payment for the Project; and

3. Authorize the recordation of the Notice of Completion for the Project BACKGROUND/DISCUSSION:

The 12'" and 13`1' Street Safe Routes to School (SRTS) Sidewalk Project - Project No. 10878 (Project) is included in the FY2021/2022 Capital Improvement Program (CIP) and is a Federal Safe Routes to School (SRTS) Grant funded project. The Project includes sidewalk construction, ADA access ramps, curb/gutter, minor drainage improvements and associated street improvements on the west side of 12t' Street from Avenue E to Kentucky Street, and on the east side of 131h Street from Avenue E to Oak Glen Road. The Project is consistent with the City's General Plan Transportation Element and is one of five (5) grant funded sidewalk, pedestrian and bicycle facility improvement projects prioritized by the City Council for the Dunlap area of the City, specifically benefitting Dunlap Elementary School and Yucaipa High School. Including this Project, four of the five projects have now been completed. The remaining project is currently in the design and environmental review phase.

In 2011, The City applied for and was awarded $508,600 in federal SRTS Grant funds for this Project. From 2012 through 2015, the City of Yucaipa and the Yucaipa Calimesa Joint Unified School District (YCJUSD) hosted several public outreach meetings. Some of these meetings were held at the Dunlap Elementary School campus. The purpose of the meetings was to gain input from the public for the Project. At the public outreach meetings, infonmation was provided to parents and the public about the Federal and State Safe Routes to School Program administered by Caltrans and

the pedestrian/bicycle facility improvements related to the Project. Public input was collected at these meetings and some of the input was incorporated into the Project plans, such as school related signage and striping. Staff then worked with Caltrans to document and report the outreach efforts required by the SRTS Grant Program. This included reporting the survey information collected by staff from residents, students and teachers from Dunlap Elementary and Yucaipa High School at the various public outreach meetings as well as other various community and City events held between 2016 and 2019. The information collected is used by Caltrans and their various pedestrian and bicycle facility grant program administrators to determine current and future needs of the public related to improving pedestrian and bicycle safety, especially for students traveling to and from school.

On February 10, 2021, staff was notified by Caltrans that additional SRTS Grand Funds in the amount of $232,235 were available for the Project. On March 8, 2021, City Council Amended the FY2020/2021 CIP by allocating the additional amount of $232,235 in grant funding to the Project.

On March 8, 2021, following a formal public bid process, City Council awarded a construction contract to Three Peaks Corporation Inc. for the Project. The contract was in the amount of $847.834.75, with a total construction budget in the amount of $1,012,834.75 that included the amounts of $85,000 for construction contract contingency and $80,000 for construction contract administration, inspection, surveying, permitting, and materials testing costs.

Throughout the course of construction, staff approved Change Orders 1 through 4 for a net increase in the amount of $48,299.65. The change in work included removal of additional trees, removal and replacement of additional concrete driveway transitions onto private property, and additional retaining wall and fence construction required to complete the project. The approved change order amounts are less than the construction contract contingency amount of $85,000 approved by City Council for the contract.

The construction of the Project has been completed. Field inspections performed by staff during the course of the work and upon completion of the work have assured that the work was completed according to the plans and specifications for this project and in accordance with the requirements and conditions described in the specifications. As a result, staff is recommending that City Council accept the contract work and direct staff to file the Notice of Completion for the Project.
