Agenda Item No. 9

CITY OF YUCAIPA

AGENDA REPORT
TO: Honorable Mayor and City Council
FROM:aymond A. Casey, City Manager
FOR: City Council Meeting of May 9, 2022
SUBJECT: Law Enforcement Services
RECOMMENDATION:

That City Council approve and authorize the Mayor to execute an amendment to the Law Enforcement Services Contract between the City of Yucaipa and the San Bernardino County Sheriff's Department, for a total annual service contract in an amount not to exceed $12,329,951, less the annual personnel credit in the amount of $599,695, for a total net contract amount of not to exceed $11,730,256 for fiscal year 2022-2023.

DISCUSSION:

Since its inception, the City has always contracted for police services with the San Bernardino County Sheriff Department. The attached Amendment No. 37 to the contract incorporates the enhanced levels of service (1 additional Deputy) to be included in the upcoming FY 2022-2023 Draft Budget.

Recent developments in the contract include:

1. On August 9, 2021, the City Council approved the 2021-2022 Law Enforcement Services contract between the City of Yucaipa and the San Bernardino County Sheriff's Department for a total annual contract in an amount not to exceed $11,838,869, less the annual personnel credit in the amount of $608,375 for a total net contract amount of not to exceed $11,187,502. The annual personnel credit reflects the amount that the Sheriff credits the City's contract for providing a level of law enforcement services for the surrounding unincorporated service areas.

2. On April 26, 2021, the City Council approved the 2021-2022 Law Enforcement Services Contract between the City of Yucaipa and the San Bernardino County Sheriff's Department for a total annual contract in an amount not to exceed $11,460,020, less the annual personnel credit in the amount of $615,551 for a total net contract amount of not to exceed $10,844,469. The annual personnel credit reflects the amount that the Sheriff credits the City's contract for providing a level of law enforcement services for the surrounding unincorporated service areas.

3. On April 27, 2020, the City Council approved the 2020-2021 Law Enforcement Services Contract between the City of Yucaipa and the San Bernardino County Sheriff s Department for a total annual contract in an amount not to exceed $10,782,688, less the annual personnel credit in the amount of $590,546 for a total net contract amount of not to exceed $10,192,142. The annual personnel credit reflects the amount that the Sheriff credits the City's contract for providing a level of law enforcement services for the surrounding unincorporated service areas.

4. On February 8, 2021, the City Council approved funding for an additional deputy during the mid -year budget review process. Adding the additional deputy position dedicated to traffic enforcement and other police activities promotes public safety by addressing traffic violations and other police activities, with the goal of reducing collisions and providing more resources on the City streets. In addition, a full-time traffic deputy performs other duties important to city government. A few of the responsibilities of the new deputy include:
• General Patrol
• Daily traffic enforcement
• Traffic collision investigations
• Driving under the influence investigations
• Traffic planning for special events
• Regional Major Accident Investigation Team membership • California Office of Traffic Safety grant enforcement and management • Traffic Calming Committee membership
Traffic safety is critical to all residents, even those who may have little or no other interaction with law enforcement. Traffic complaints are the most common complaints received by the police department, outside of the 911 system. In addition, more patrol resources visible on the streets will provide more of a deterrent to criminal activity.

This additional resource for the police department will also free up regular patrol deputies to spend more time attending to 911 calls for service.

5. On March 22, 2021, the City Council approved an amendment to the Law Enforcement Services Contract between the City of Yucaipa and the San Bernardino County Sheriff's Department, for a total annual service contract in an amount not to exceed $11,003,617, less the annual personnel credit in the amount of $590,546, and less the credit for July 2020 to April 2021 for an additional deputy position, for a total net contract amount of not to exceed $10,242,716 for fiscal year 2020-2021.

6. On April 26, 2021, the City Council approved an amendment to the Law Enforcement Services Contract between the City of Yucaipa and the San Bernardino County Sheriff's Department, for a total annual service contract in an amount not to exceed $11,460,020

(including additional dispatch services associated with two radios), less the annual personnel credit in the amount of $615,551, for a total net contract amount of not to exceed $10,844,469 for fiscal year 2021-2022.

7. On August 23, 2021, the City Council adopted a Police Department Staffing and Strategic Plan including one additional deputy this year and one additional deputy next year. In addition, Sheriff Dicus has agreed to add two additional deputies to serve the County jurisdictional area managed from the City of Yucaipa Police Station over the next several years as staffing becomes more available.

The San Bernardino County Sheriff s Department has completed their review of the Police Services contract extension for the 2022-2023 fiscal year. The contract is reviewed annually to incorporate any cost -of -living adjustments that may be negotiated for department personnel, both sworn and non -sworn. In addition, the contract may be amended to reflect changes in non -negotiated items, including vehicle and facility costs, services and supplies, and other administrative costs. This amendment to the City's Law Enforcement Services Contract incorporates the changes associated with that review and the most recent enhancement of law enforcement services approved by the City Council.

FISCAL IMPACT:

The changes resulting from the 2022-2023 amendments to Schedule A of the Law Enforcement Services Contract will result in a net increase in an estimated amount of $542,754 over FY 2022- 2023. The total proposed contract amendment is expected to be in an amount not to exceed $11,730,256, less the annual personnel credit in the amount of $599,695, for a total net contract amount of not to exceed $11,730,256 for fiscal year 2022-2023. All other provisions associated with the proposed amendment to the contract will remain materially the same.
