RECOMMENDATION:

That City Council conduct a public hearing and subsequently:

1. Direct staff to notify the County of San Bernardino in writing Yucaipa's intent to terminate its participation in the Comprehensive Disposal Site Diversion Program (Recommended by Solid Waste Committee); and

2. Consider the following options regarding the Household Hazardous Waste Collection Contract and provide direction as appropriate:
a. (Option 1) Approve and authorize the Mayor to execute a contract with the San Bernardino County Fire Protection District to operate and manage the collection and disposal of household hazardous waste and hold one Household Hazardous Waste/E- waste Collection Event per year in Yucaipa from July 1, 2022 to June 30, 2027 for a total contract amount of $428,528.45; or
b. (Option 2) Approve and authorize the Mayor to execute a contract with the San Bernardino County Fire Protection District to operate and manage the collection and disposal of household hazardous waste from July 1, 2022 to June 30, 2027 for a total contract amount of $262,115.17 (Recommended by a member of the Solid Waste Committee); and

3. Receive the 2021 Solid Waste Annual Report from Yucaipa Disposal; and

4. Determine the Residential Rate Adjustments, which includes Food Waste and Recycling, to be implemented July 1, 2022, which will modify the rates by either:
a. (Option 1) Implementing all standard increases; however, the rates are remixed to apply the same percentage increase of 6.2% on all three -barrel services resulting in a 15-gallon rate increase of $1.07 (from $17.14 to $18.21), 30-gallon rate increase of $1.42 (from $22.74 to $24.16) and a 60-gallon rate increase of $1.92 (from $30.79 to $32.71) (Recommended by Solid Waste Committee); or
b. (Option 2) Implementing all standard increases; however, the rate subsidy to the 15 and 30-gallon rates are reduced resulting in a 15-gallon rate increase of $1.74 (from $17.14 to $18.88), 30-gallon rate increase of $1.61 (from $22.74 to $24.35) and a 60-gallon rate increase of $1.82 (from $30.79 to $32.61); or

c. (Option 3) Implementing all standard increases; however, the rates are remixed to apply the same monetary increase on all three -barrel services resulting in a 15-gallon rate increase of $1.77 (from $17.14 to $18.91), 30-gallon rate increase of $1.77 (from $22.74 to $24.51) and a 60-gallon rate increase of $1.77 (from $30.79 to $32.56); and

5. Approve the proposed Commercial Refuse Rate Adjustment, which includes Food Waste and Recycling (Recommended by Solid Waste Committee); and

6. Adopt Resolution No. 2022-18, requesting the County of San Bernardino to place collection of costs for single-family residential solid waste, green waste, and recycling services for Fiscal Year 2022-2023 on the County of San Bernardino property tax roll pursuant to Chapter 8.28 of the Yucaipa Municipal Code.

DISCUSSION:

Pursuant to a California Supreme Court Decision in 2006, refuse collection rates are subject to Proposition 218 requirements. To comply with the requirements of Prop 218, the City must conduct a public hearing not less than 45-days after mailing the notice, which must include the amount of the highest proposed fee; the basis upon which the fees were calculated; the reason for the fees; and the date, time and location of the public hearing on the proposed fees. Yucaipa Disposal (YD) mailed out notices to Yucaipa customers on April 3, 2022 (Attachment A). If written or verbal protests against the proposed fees are not presented by a majority of parcel(s) owners, the City may authorize the proposed fee increases.

On March 28, 2022, the Solid Waste Committee (Committee) met with City staff and a representative of Yucaipa Disposal to review and discuss the 2021 Annual Report, proposed rates for Fiscal Year (FY) 2022/23, household hazardous waste fees, the San Bernardino County Comprehensive Disposal Site Diversion Program, and residential and SB 1383 program updates. The following details the issues discussed at the Committee meeting:
2021 Annual Report (AR)
The AR (Attachment B) focuses on YD's performance and quality of service over the prior year. Issues discussed in terms of the Annual Report include:

Commercial Food Waste Bin and Barrel Service — AB 1826 mandates organics recycling services (MORe) for certain commercial and multi -family establishments. In 2018 and 2020, the City adopted ordinances to meet the State mandates, which requires all businesses generating more than 4 cubic yards (in 2018) and 2 cubic yards (in 2020) of solid waste to recycle organics. Of the 353 businesses that fall within the threshold, 71 commercial customers are signed up for food waste recycling and 122 are either not in compliance or are eligible for a waiver. The large number of non -compliant customers is based on AB 1826 threshold changes from 4 cubic yards to 2 cubic yards that occurred in October 2020. YD is currently coordinating with City staff to address non -compliant accounts for further action.

Recycling Revenues, Processing Fees and Contamination — The commercial and residential recycling revenues and processing fees comparisons from 2019 to 2021 are located on pages 5 - 7 of the AR. The commercial commingled recycling revenues (Table 7) increased over the prior year from $48,962.92 in 2020 to $113,548.47 in 2021. This increase is attributed to improved z 1 2021 Annual Report, FY 2022/23 Solid Waste Rate Adjustment, Tax Roll Billing & HHW Collection Agreement -238-

markets for cardboard and other recyclable commodity values. The residential commingled recycling revenues (Table 9) also increased over the prior year from $32,815.02 in 2020 to $153,342.46 in 2021. However, the 2021 processing fees of $503,050.87 to sort residential commingled recyclables and dispose of all residential waste creates an overall net cost of $349,708.41.

In addition, residential contamination (Table 10) decreased in 2021 to 30% versus 31 % in 2020.

Total residue tons decreased from 2,015.56 tons (2020) to 1,889.86 (2021). The slight decrease in contamination continues to be attributed to increased volumes of residential solid waste during the pandemic and on -going foreign recycling markets' scrutiny on cleaner recycling bales with less trash contamination and the lack of market outlets for certain plastics. The Committee is recommending ongoing public education and outreach programs to minimize contamination along with running the "Right Stuff' campaign for another year.

Street Sweeping & Sharps Collection — On June 24, 2019, City Council approved the Revised and Restated Solid Waste Franchise Agreement (FA) with Yucaipa Disposal. Enhanced services were negotiated, which included City-wide street sweeping and a residential sharps collection program. Yucaipa Disposal assumed the street sweeping contract and all costs associated with the program. Since July 2019, residential and collector streets have been swept one time per month and arterial streets are swept two times per month. As depicted in Table 20, a total of 713.75 tons of sweeping debris was collected during 2021 compared to 666.39 tons of sweeping debris collected in 2020.

The residential sharps collection program began in October 2019, also pursuant to the FA. The drop box container was constructed by Yucaipa Disposal and is located near the main entry of the Yucaipa Police Department. As depicted in Table 21, a total of 0.28 tons of sharps have been collected in 2021, compared to 0.38 tons collected in 2020.

Proposed Residential & Commercial Rate Adjustments — FY 2022/23 Per the City Council adopted rate -setting procedures, which are detailed in Section 17(C) of the current FA, the annual adjustment of rates is implemented July I" of each year. Pursuant to the FA, the annual rate adjustment is based on: (1) increase/decrease in the landfill fee charged by the County of San Bernardino or other authorized landfill; (2) Operator fee shall be adjusted by 90% of the annual change in the Consumer Price Index (CPI) for the prior calendar year; and (3) recycling rate adjustments based on collection, transportation, processing, non -recyclable disposal, community education, state/county/city reporting and recyclable revenue credits.

The residential and commercial rate proposal is based on the FA terms identified above and the implementation of state -mandated residential food waste recycling consistent with SB 1383, County of San Bernardino solid waste tip fee adjustments pursuant to the Waste Disposal Agreement (WDA), the elimination of the e-waste collection fee and improved recyclables commodity markets. The proposed residential rates include: an operator fee increase of 3.45%, which is based on 90% of the percentage change in the monthly CPI for the prior calendar year (3.83%), a landfill disposal increase of $5.41/ton (from $38.00/ton to $43.41/ton), a green waste processing fee increase of $38.44/ton (from $41.56/ton to $80.00/ton), a recycling processing fee decrease of $16.72/ton (from $66.09/ton to $49.37/ton), HazMat and franchise fees. The cumulative impact of the cost component changes results in a proposed residential rate increase of 6.2% per month for all barrel service types. 3 12021 Annual Report, FY 2022/23 Solid Waste Rate Adjustment, Tax Roll Billing & HHW Collection Agreement -239-

The residential rate proposal provides 3 options for Council consideration, which include:
a. (Option 1) Implementing all standard increases; however, the rates are remixed to apply the same percentage increase of 6.2% on all three -barrel services resulting in a 15-gallon rate increase of $1.07 (from $17.14 to $18.21), 30-gallon rate increase of $1.42 (from $22.74 to $24.16) and a 60-gallon rate increase of $1.92 (from $30.79 to $32.71) (Recommended by Solid Waste Committee); and
b. (Option 2) Implementing all standard increases; however, the rate subsidy to the 15 and 30-gallon rates are reduced resulting in a 15-gallon rate increase of $1.74 (from $17.14 to $18.88), 30- gallon rate increase of $1.61 (from $22.74 to $24.35) and a 60-gallon rate increase of $1.82 (from $30.79 to $32.61); and
c. (Option 3) Implementing all standard increases; however, the rates are remixed to apply the same monetary increase on all three -barrel services resulting in a 15-gallon rate increase of $1.77 (from $17.14 to $18.91), 30-gallon rate increase of $1.77 (from $22.74 to $24.51) and a 60-gallon rate increase of $1.77 (from $30.79 to $32.56)
Proposed Rates — Commercial
The Committee is recommending the various commercial rates outlined in Exhibit D (Attachment C).

Household Hazardous Waste
One of the factors that impacts residential and multi -family solid waste rates are the Household Hazardous Waste (HHW) fees. Since incorporation, the City has contracted with the San Bernardino County Fire Protection District (District) to administer the City's HHW Collection Program. The District provides a comprehensive HHW Collection Program to ensure the safe collection, recycling, treatment, and disposal of HHW that is generated by households in the City and conducts one HHW/E- waste Collection Event (Event) in Yucaipa per year. The District's central processing facility is located at the San Bernardino International Airport and supports the fifteen (15) regional collection centers around the County that are available to all County residents.

In 2017, Council approved a five (5)-year HHW Collection Contract (Contract) with the District that will expire on June 30, 2022. The Contract for FY 2021/22 totals $77,578.62, which is paid by the City to the District to provide the City's HHW Program. The following table identifies the number of residents that use the County Collection Centers, number of participants at the annual Event and total pounds collected on an annual basis for the current Contract term.

On June 14, 2021, as part of the annual solid waste rate adjustment, City Council authorized an increase in the HHW fee from $0.30 to $0.33 per month per single-family and multi -family residential customer to cover the District Contract. The total amount of HHW fees collected and paid to the City over the past three years is summarized in Table 5 on page 4 of the AR. The fees collected are deposited into a Special Revenue Fund and reviewed annually. It is projected that the estimated fund balance as of June 30, 2022, will be approximately $9,000. However, for the past 3 years, the fund balance has been used to off -set the difference between the amount collected and cost of the Contract.

The Contract cost associated with the annual Event, for the current year, is approximately $29,000.

Based on the level of participation at the annual Event and the costs associated, City staff requested that the District present two contract options (with the Event and without the Event) for Council consideration. The following chart summarizes the proposed annual contract amount over a five-year period with and without the Event.

As summarized above, the proposed total cost difference between the two contract options is $166,413.28. In addition, there are City staff costs (Public Works & General Services Departments) associated with planning, promoting, set-up/breakdown, and working alongside District staff during the Event.

On May 11, 2022, a member of the Solid Waste Committee (Committee) met with City staff to review the level of participation at the Collection Centers and annual Event(s), Contract options and City staffing costs associated with the annual Event. Based on the information received, the Committee member is recommending approval of the Household Hazardous Waste Collection Contract without the event.

Comprehensive Disposal Site Diversion Program (CDSDP)
On November 26, 2007, City Council approved Amendment No. 3 to the WDA, which allowed a separate per ton fee to fund the CDSDP to assist the County and WDA cities in achieving the State's AB 939 diversion requirement (50% in 2007). The CDSDP targets roll -off loads that are delivered to County landfills that have not been through a recycling recovery process and have some diversion potential.

Currently, a $12 per ton fee is charged to self -haul customers, commercial (non -franchised and non - permitted haulers), all roll -offs (including roll -offs either controlled or hauled by the City) and other city -owned vehicles. Regular trash trucks and transfer trucks are not charged the fee because these vehicles deliver waste that has already been subject to a diversion program. Loads that have substantial divertible materials and those divertible loads that are source separated are sent to the diversion area at the landfill for processing and recycled. All self -haul loads that bring comingled construction debris are S 12021 Annual Report, FY 2022/23 Solid Waste Rate Adjustment, Tax Roll Billing & HHW Collection Agreement -241-

charged a $12 per ton fee; however, the material is landfilled due to unavailable labor at the landfill. In addition, with CalGreen requirements and future Organics diversion mandates, there is nominal diversion from trash roll -off loads that are being delivered by WDA haulers (also charged $12/per ton on top of the WDA gate rate). The additional $12 per ton impacts local WDA rates, with minimal diversion, and with new legislation, the CDSDP may no longer be practical for the WDA cities.

The WDA allows WDA cities to readily exit the CDSDP as they develop other diversion programs to address State mandates. WDA Section 3.6(D)(6) states, "The City recognizes its obligation to continue participation in the CDSDP but reserves the right to terminate its participation in the CDSDP, at any time, for any reason. If the City decides to terminate its participation in the CDSDP, the City agrees to notify the County in writing of such intention to terminate its participation sixty (60) days prior to termination of its participation in the CDSDP." Since 2007, the City has adopted and implemented several recycling/diversion programs (Mandatory Commercial and Residential Recycling Program, Construction and Demolition Waste Diversion Program, Mandatory Organics Recycling, etc.) to achieve the State's current mandate of 65% diversion for construction and demolition related projects. Based on Yucaipa's established programs and compliance with State mandates, staff is recommending terminating Yucaipa's participation in the CDSDP. Leaving the CDSDP program saves self -haul and roll -off customers $12 per ton which can total up to $120 per load (based on the average maximum load at 10 tons). (Solid Waste Committee recommends terminating Yucaipa's participation in the CDSDP) Residential and SB 1383 Program Updates
On September 19, 2016, Senate Bill (SB) 1383 was signed into law to reduce organic waste disposal (food waste, green waste, paper products, etc.) by 75% (20 million tons) and increase edible food recovery by 20%, by 2025 in order to mitigate methane emissions from landfills reportedly caused by landfilled organics. SB 1383 is the State's most ambitious and impactful waste reduction law in the last 30 years. This Legislation requires all businesses, residents, and multi -family complexes to subscribe to the City's organic waste collection and recycling services that captures source separated food scraps and landscaping waste, among other organic waste materials. On January 10, 2022, City Council adopted Ordinance No. 403, adding mandatory organic waste disposal reduction requirements to the Yucaipa Municipal Code.

Since the adoption of Ordinance No. 403, YD and City staff have been working together to plan/implement the SB 1383 compliance program and fulfill the state mandated requirements ensuring the following mandates are met:

1. Residential food waste recycling program
a. Collection Program (Yucaipa has a three -barrel system):
i. Blue container: Recyclable materials (plastics #147, glass bottles, jars & aluminum cans, cardboard, and paper). Container will include required labeling to identify the primary acceptable items allowed and not allowed. ii. Green container: Organic waste materials (grass, weeds, flowers, leaves, pruning's and other types of source separated organics resulting from normal yard and landscaping activities). In addition, starting in July/August of this year, residents will be instructed to put their food waste in plastic bags and place it in the green container. Container will include required labeling to identify the primary acceptable items allowed and not allowed.
6 1 2021 Annual Report, FY 2022/23 Solid Waste Rate Adjustment, Tax Roll Billing & HHW Collection Agreement -242-

iii. Black/Brown container: Refuse materials (non -organic and non -recyclable waste materials). Container will include required labeling to identify the primary acceptable items allowed and not allowed.

2. Commercial organics waste recycling program — Tier 1 and 2 generators are edible food generators that will be required to donate edible food to local recovery organizations pursuant to the State regulations. YD and City staff are currently identifying qualified Tier 1 and 2 edible generators and developing a program to: estimate the amount of edible food currently being disposed, identifying existing food recovery organizations, developing/ensuring adequate infrastructure is made available to support the program and diverting 20% or more of estimated edible food from disposal to food recovery organizations. a. Tier 1 (began January 1, 2022) — Businesses that typically have more produce, fresh grocery and shelf -stable foods to donate (wholesale food vendors, food service providers, food distributors, grocery and supermarkets that are over 10,000 sq. ft.) b. Tier 2 (begins January 1, 2024) — Businesses that typically have more prepared foods to donate which often require more careful handling to meet food safety requirements (hotels, local education agencies (with on -site food facilities), restaurant facilities over 5,000 sq. ft. or 250+ seats and large venues and events).

3. Inspection and mandatory enforcement of SB 1383 compliance to include investigating complaints on 1383 non-compliance.

4. Conduct outreach and education to all impacted parties — YD and the City will use a variety of outreach methods such as: social media outlets, websites, newsletters, short videos, Community Service Guide, newspaper articles, and mailers to ensure the programs ongoing success.

5. Procure recycled organic waste products like paper, compost, mulch, and renewable natural gas. a. City staff will be required to ensure all vendors provide recycled -content paper products that consists of at least 30%, by fiber rate, postconsumer fiber instead of non -recycled products. Records are required to be maintained and shall include a copy of the invoice, written certifications of recycled content, and other general information. b. YD will assist the City in meeting its recycle organic waste procurement targets, to include the following:
i. Community compost and mulch giveaway events.
ii. Community parks landscape and turf enhancements where recycled organic products are used to minimize water usage and improve soils.

6. Maintain accurate and timely records of SB 1383 compliance — YD will partner with the City to maintain records that demonstrate compliance. These records will document the City's progress in complying with the regulation in accordance with the statutory requirements.

7. Contamination minimization and waste audits — YD will partner with City Code Enforcement to ensure commercial businesses and multifamily establishments are subscribed to organic recycling services and complying with the regulatory requirements. YD will also implement route audits and a waste evaluations program to address the container contamination minimization requirements. Beginning January 1, 2024, Notice of Violations may be issued to enforce compliance if necessary.

Single -Family Residential (SFR) Tax Roll Billing
On March 11, 2019, the City adopted Ordinance No. 373, amending Chapter 8.28 of the Yucaipa Municipal Code, to include provisions pertaining to County of San Bernardino tax -roll billing for SFR solid waste, green waste, and recycling service fees. Tax -roll billing was implemented for the July 1, 2021— June 30, 2022 service period with the adoption of Resolution No. 2021-23. As depicted in Table 7 12021 Annual Report, FY 2022/23 Solid Waste Rate Adjustment, Tax Roll Billing & HHW Collection Agreement -243-

I of the AR, a total of 12,558 residential customers paid for services through tax roll billing and 870 customers pre -paid to prevent the fees from going on their tax bill.

Tax roll billing provides an efficient and streamlined method of billing and addresses delinquent service fee collections. Over the past 4 years, the solid waste lien list for SFR has had a significant reduction in delinquencies, as detailed below:

NOTICE OF PUBLIC HEARING IN CONNECTION WITH THE

CITY OF YUCAIPA REFUSE COLLECTION SERVICE CHARGES
NOTICE IS HEREBY GIVEN that on May 23, 2022, at 6:00 p.m., or as soon thereafter as practicable, in the City Hall, Council Chambers, 34272 Yucaipa Blvd, Yucaipa, California, 92399, the City Council of the City of Yucaipa will hold a public hearing concerning the charges for refuse collection service.

INFORMATION ABOUT THE CHARGES
A. Basis upon which the charges were calculated — The City Council has previously determined that the collection and disposal of refuse in the City is a service to be performed by a private company, under an exclusive franchise agreement.

The monthly residential curbside collection charge is comprised of five components: (1) an amount for the administration and operation of automated curbside refuse collection service, which includes the provision of three collection carts; the option of either a 15, 30, or 60-gallon refuse cart, one 90-gallon recycling cart and one 60-gallon green & food waste cart, with weekly pick-up service, (2) an amount for the hauler to dispose of the refuse and process the green & food waste and recyclables (the "tipping fee"), (3) an amount to operate the curbside bulky item collection service, (4) an amount for the administration and operation of a Household Hazardous Waste Program, and (5) an amount to compensate the City for its administrative costs in connection with the services (the "franchise fee").

The monthly commercial collection charge is comprised of three components: (1) an amount for the administration and operation of commercial bin refuse and recycling collection service, (2) an amount for the hauler to dispose of the solid waste (the "tipping fee"), and (3) an amount to compensate the City for its administrative costs in connection with the services (the "franchise fee").

The charges represent the amount the City has negotiated with the private company franchisee for refuse collection services.

B. Reason for the charges — The City uses the refuse collection charges for the operation and administration of the refuse disposal, recycling, and household hazardous waste programs. The proposed increases per month represent the additional costs, as negotiated with the franchisee, to provide collection service, refuse, recycling, green waste, food waste, and manure collection service in compliance with state mandates. The proposed increases will be finalized after the public hearing but will not exceed the amounts set forth in this notice.

The 2022-2023 proposed increases are due to changes in the consumer price index (CPI), implementation of state - mandated residential food waste recycling consistent with SB 1383, trash disposal tip fee adjustments, and reductions in the residential e-waste program improved recyclables commodity markets. In addition, commercial rate adjustments are impacted by state diversion and compliance mandates related to organics and recyclables diversion programs that also include SB 1383 programming.

C. Charge per parcel — The City proposes to adopt a revised Exhibit D (exhibit of Franchise Agreement) that increases the residential refuse collection services charges for fiscal year 2022-2023 as follows:

The City also proposes to increase the charges for residential bin service and commercial bin service for fiscal year 2022-2023. A complete listing of all proposed charges for commercial and residential services is printed on the reverse of this notice. If you need assistance determining the charge for your property or parcel, please contact Yucaipa Disposal by calling (909) 797-9125.

WRITTEN REPORT
The City has caused a written report to be prepared and filed with the City Clerk regarding the proposed increased commercial and residential bin collection service charges. As required by California Government Code Section 66016, the written report also provides data indicating the amount of cost, or estimated cost, to provide refuse collection service and the revenue sources anticipated to provide the service. A copy of the written report will be available on the City website at www.yucaipa.org and at City Hall by May 12, 2022.

PUBLIC HEARING
At the public hearing, the City will hear and consider all objections or protests to the proposed rate increases. All interested persons shall be afforded the opportunity to hear and be heard. Written protests regarding the proposed increases must be filed with the City Clerk prior to the close of the public hearing pursuant to the requirements stated on the May 23, 2022, City Council Agenda, which will be available on the City's website for at least 72 hours prior to the start of the City Council meeting.

As of December 2021, there were 456 single family and 97 multi -family and mobile home park (MHP) customers utilizing the 15-gallon trash barrel option that was approved in November 2009. This is an ideal cost savings alternative for low volume residential trash generators that maximize recycling and waste reduction efforts. In Q4 of 2021, MHP barrel subscriptions increased when an account was added for barrel services. A list of the mobile home parks and current services is provided in Exhibit A. Special services include accounts with extra trash, recycling and/or green waste barrels and accounts with animal waste barrels.

Please note that the 37 direct bill customers were not included in the tax roll billing for one of the following reasons: vacant property/non-billed account at the time of tax roll submittal, new residential start service after tax roll submittal, and residential service level changes during the tax roll year.

B. Commercial customers may select either a 60 gallon barrel, 1.5 cubic yard, 3 cubic yard or 10 cubic yard to 40 cubic yard container serviced once per week or as often as six pick-ups per week. Customers can also choose between a variety of service options: trash, recycling, green waste, or food waste. Table 2 summarizes the commercial containers as of December 31, 2021,

The commingled recycling bin subsidy program began in October 2009. Under this program, businesses, mobile home parks and multi -family facilities on bin service can subscribe for a recycling barrel or bin at no additional charge. Mandatory commercial recycling (MCR) became effective July 1, 2012, with the passage of state legislation, AB 341, and the corresponding City Ordinance No. 314.

The all-inclusive program where recycling services are available at no additional cost continues to be an ideal solution for businesses and multi -family establishments because the recycling costs are included with the trash service. The financial incentives are built into the commercial rate structure through avoided trash disposal and allows for more accurate tracking of recycling and diversion activities. Table 3 summarizes commercial MCR participants.

The commercial food waste recycling program began in July 2016. The program was implemented in response to the mandatory organics recycling (MORe) law, AB 1826, that became effective April 1, 2016. AB 1826 mandates organics recycling services for certain commercial and multi -family establishments. In order to eliminate barriers, the City adopted an equalized food waste rate structure where a food waste recycling bin is available at a comparable rate as a trash bin. Program implementation included development, customer identification and outreach.

In December 2020, the City approved a mandatory organics recycling program (Ordinance, No. 398) where all businesses generating more than two cubic yards per week of solid waste are required to recycle organics. Table 4 summarizes commercial food waste recycling participation. As of December 2021, there are 45 commercial customers subscribed to food waste recycling and 122 commercial customers not signed for food waste recycling and are out of compliance with AB1826. Please note that the change in non -compliant customers is based on AB1826 threshold changes that expanded on September 15, 2020. Burrtec is currently coordinating with City staff to address the status of non -compliant accounts for further action.

Franchise fees are computed as a percentage of the operator pick-up fee. Ten percent was used for 2021 and is the current franchise fee amount. Franchise fees have increased due to slightly higher billings and service subscriptions.

It should be noted that Yucaipa Disposal, Inc. is remitting franchise fees and household hazardous waste fees to the City based upon service billings rather than customer payments. This results in a cash flow benefit to the City and also provides for a more accurate audit process.

Table 6 shows the current operator fee effective July 1, 2021 for residential and commercial customers. These serve as the basis for the franchise fee payments listed in Table 5. Please note that, due to community impacts associated with the pandemic, Yucaipa Disposal, Inc. elected not to impose the annual CPI increase to residential customers.

Foreign markets continue to be the primary outlets for recyclable materials. Net commercial recycling costs decreased due to increased cardboard values.

Illegal scavenging at commercial premises continues to be a regional problem.

Yucaipa Disposal continues to promote its anti -scavenging message through commercial newsletters and collection equipment labeling.

Table 8 captures roll -off activity wherein the majority of roll -off loads are deposited at San Bernardino County Landfills and processed as part of the County's Consolidated Disposal Site Diversion Program (CDSDP). Construction and Demolition (C&D) roll - off loads with potential revenue commodities or high diversion requirements are processed at the Agua Mansa Material Recovery Facility. Diverted CDSDP tonnage data is provided by San Bernardino County and includes self -haul materials that were not delivered to the landfill by Yucaipa Disposal.

2021's recovered tonnages displayed a positive trajectory across the commercial sector. While scavenging issues have decreased, they are not altogether gone as there is still value in certain recycling materials, such as CRV items. Yucaipa Disposal will continue to work on its anti -scavenging program to include messaging to commercial and multi -family businesses to discourage scavenging and donating recyclables to 3rd party entities.

Table 13 includes a recap of both residential and commercial food waste and organics tonnages collected and diverted from the County landfill. Some of the green waste material that is processed into mulch is re -used by Yucaipa residents and the City as part of the green waste reuse program. Commercial food waste tons totaled 106.36 during 2021.

Christmas tree recycling occurred from December 291h through January 8th where trees were collected via curbside collection. In addition, special collections were arranged with mobile home parks and multi -family complexes to accommodate those residents. Despite the industry shortage of Christmas trees, Yucaipa Disposal still collected 1,047 trees for a total of 13.09 tons during the two -week period. The Christmas Trees were delivered to green waste processors for diversion credit and special Christmas mulch was offered on a first come, first serve basis for residents through the end of January at the Agua Mansa Material Recovery Facility.

V. AB 939 REPORTING REQUIREMENTS
Beginning with the 2007 annual report, the Department of Resource Recycling and Recovery, (CalRecycle), modified the AB939 50% compliance measurement from solely a disposal and program based system to a per capita and employment based disposal factor. The City's population and employment factors are utilized to establish a target rate of pounds per person per day (PPD) to measure and gauge AB939 compliance.

Table 22 shows that the City of Yucaipa is in compliance with the state's waste diversion requirements. Target numbers are "not to exceed" amounts in order to be compliant with diversion goals.

To achieve AB939 diversion mandates, the City was one of the first in San Bernardino County to offer a pricing structure with variable rates. In March 2006 the City of Yucaipa eliminated the 90-gallon trash barrel. In November 2009 the City of Yucaipa approved the 15-gallon trash barrel. Residents continue to have the option of either a 15-gallon, 30-gallon or 60-gallon trash barrel. The rate structure for these services has been developed to subsidize the lower volume trash services in an effort to incentivize recycling and waste reduction efforts.

Commercial recycling programs include commingled recyclables, green waste, food waste, inert materials and other materials. The City implemented further commingled recycling incentives by offering a subsidized commercial recycling and food waste program. Required bin serviced customers are mandated to subscribe to recycling services at no additional cost thereby reducing their solid waste disposal costs. Yucaipa Disposal promotes this program through outreach efforts including mailings, newsletters and personal visits.

Yucaipa Disposal is currently diverting 37.5% of the collected tonnage, as referenced in Table 26. The chart below shows a three- year trend (2019 — 2021) of diversion tonnages and Table 25 reflects the actual tonnage, by waste stream, collected by 12 -269-

Attention Food Service Providers Is Your Business in
Compliance?
Existing state lave requires certain businesses to implement a recycling and organics program. However, the new law which went into effect July 1, 2020, requires food establishments that provide trash containers for products purchased and consumed on the premisesto also provide properly labeled containers for recyclables and organic waste (food waste). These containers must be placed adjacent to trash containers.

AB 827 applies to limited -service
restaurants such as those restaurants
where customers order and pay at the
counter and bus their own tables after
eating. The law will affect restaurants,
malls, and other businesses that serve
food. Full -service food establishments that
do not provide access to trash containers
for products consumed on the premises
will be exempt, as food workers will likely
separate post -consumer food waste and
recyclables in the dish washing areas.

It will also require edible food generating businesses such as grocery stores, food service distributors, supermarkets and restaurants to provide the edible food that would otherwise be disposed, to organizations that will redistribute it. California passed a law, Senate Bill 1383, to improve air quality by reducing greenhouse gas emissions from organic waste disposal such as food and landscape waste. Landfilled organic waste decomposes and generates methane gas. This greenhouse gas is released into the atmosphere, affects air quality and contributes to global warming. To comply with this mandate, communities will have to begin a Food Waste Recycling Program for residential customers. More information will be provided once the program is developed. For more information, please visit:

Residential Recycling
Yucaipa Disposal is working in partnership with your community to raise awareness of the importance of recycling, increase recycling participation and eliminating contamination from recycling and green waste containers. This initiative is part of the City's efforts to promote recycling cost impact awareness and the success of the recycling programs.

The recycling container is for plastic containers, cardboard products, paper products, metal products and recyclable glass products only.

The green waste container is for brush, grass clippings, leaves, palm fronds, shrub trimmings, small branches, tree trimmings and weeds only.

Items other than the above mentioned materials must not be placed in the recycling or green waste barrel(s), as it significantly impacts the recycling process and must be removed at a considerable cost. Recycling loads containing unacceptable items may be rejected for processing and sent to the landfill, which eliminates the benefits that are produced from the recycling program. High contamination of your recyclables could result in increased processing costs which may impact your trash and recyclables collection fees.

Everyone has a role to play to ensure we keep unacceptable materials out of the recycling or green waste container(s). Not sure about what goes in each container? Contact our Customer Service team for assistance at (909) 797-9125.

Help Keep Your Recycling Clean
As of2018, China, the largest market forthe world's recycling materials, enforced the new "National Sword" policy. This policy banned numerous materials including several types of plastics, unsorted mixed paper and set strict standards for contamination levels. This policy has impacted recycling operations across the U.S. such that stakeholders are now faced with the challenges of stockpiled recyclables with little to no value in commodities markets, improving and lowering the levels of contamination from recyclables, and learning that certain materials may no longer be recyclable. We need your support. In order to continue pursuing alternative markets and help contain costs, please help lower the levels of contamination by only placing acceptable materials in your recycling container.

Sorted recycle bales are shipped to recycling manufacturing companies and made into new products. Atthe sorting line atthe Material Recovery Facility (MRF), workers must remove any contaminants— this is an essential but also time-consuming step that can slow down the process. If any contaminants are missed in the sorting process, the finished recycle bales could be rejected by recycling manufacturers and, therefore, not acceptable to be recycled. Keeping your containers free of trash and non -recyclable contaminants will help in reducing unavoidable future recycling cost increases. Spread the message, "Help keep your recycling clean!" G - F

Are You Ready to Recycle your Food Waste?
California passed a law, Senate Bill 1383, with a goal to improve air quality by reducing negative emissions from food waste and landscape waste being delivered to landfills. This law will require businesses and multi -family complexes to recycle their food waste and landscape waste. It will also require edible food generating businesses such as grocery stores, food service distributors, supermarkets and restaurants to provide the edible food (that would otherwise be disposed) to organizations that will redistribute it. These programs will be in effect in 2022. For more information, please visit: https://www.cairecycie.ca.gov/climate/slcp Accepted GI Not Accepted

Is Your Business in
Compliance?
The City of Yucaipa adopted a Mandatory Commercial
Recycling Ordinance No. 314 (8.28.055). Beginning July
1, 2012, the ordinance requires businesses and public
entities, generating four (4) cubic yards of trash or more and multifamily residential dwellings with five or more units, to establish and maintain recycling service.

Recycling conserves our natural resources and landfill
space. Yucaipa Disposal's staff can assist in selecting the appropriate recycling service level, along with the necessary education and outreach to residents and

Attention Food Service Providers
Existing state law requires certain qualifying businesses to implement a recycling or organics recycling program. Effective July 1, 2020, Assembly Bill 827 now requires food establishments that provide trash containers for products purchased and consumed on the premises to also provide properly labeled containers for recyclables and food waste for materials purchased on the premises for immediate consumption. These containers must be placed adjacent to trash containers.

The new law applies to limited -service
restaurants such as those restaurants
where customers order and pay at the
counter and bus their own tables after
eating. The law will affect restaurants,
malls, and other businesses that serve
food. Full -service food establishments
that do not provide access to trash
containers for products consumed
on the premises will be exempt, as
food workers will likely separate food
waste and recyclables in the dish
washing areas.

Storms with heavy rainfall may cause debris flows and many other issues in our streets. In order to prevent trash and recycling barrels from adding to the issue follow these guidelines:

1. Be aware of storm and windy weather forecasts.

2. Be aware of potential storm water flows in and around your property.

3. Avoid placing barrels and bulky items where flows can create hazards. In swift moving waters, these items can float and rush out into the street.

4. Place trash and recyclables in bags and then in barrels. This will minimize spillage onto city streets.

If you have any questions, please contact our Customer Service office.
