Agenda Item No. 26
CITY OF YUCAIPA
AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Megan Wolfe, Director of Community Services
FOR: City Council Meeting of June 27, 2022
SUBJECT: Community Services Department User Fees
RECOMMENDATION:
That City Council conduct a Public Hearing and subsequently approve Resolution No. 2022-23, rescinding Resolution No. 2020-07, and adopting an update to the Community Services User Fee Schedule and amending fees and charges for services rendered in relation to Community Services, and making related determinations pursuant to the California Environmental Quality Act.
BACKGROUND:
On August 28, 2017, City Council conducted a Public Hearing and adopted Resolution No. 2017-29, pertaining to various Community Services User Fees (CSUF). Resolution No. 2017-29 included a revised Exhibit A, which included:
• A standard increase of 7.8% on all Community Services programs and services. • An additional 10% increase to the non-resident fee, changing the fee from 20% to 30% more than the resident fee.
• Maintain the Council approved cost recovery rate goal of 54%.
On March 26, 2018, City Council conducted a Public Hearing and adopted Resolution No. 2018-09, rescinding Resolution No. 2017-29, and revised CSUF Exhibit A - User Fee Schedule, which addressed fee discrepancies and added new fees for various community services provided by the City. Fees were not increased by Consumer Price Index (CPI) at that time.
On March 25, 2019, City Council conducted a Public Hearing and adopted Resolution No. 2019-07 and revised Exhibits A and B, which amended the CSUF as follows:
• Added five user/groups to the Yucaipa Performing Arts Center (YPAC) fee structure o Resident Company: Yucaipa based, non-profit performing arts organizations o Resident Non -Profit and K-12 Schools: Yucaipa based, non-profit organizations and California State accredited public or private educational institutions, K-12, including elementary, middle, or junior -high, and high schools
o Resident Standard: Yucaipa based person or organization o Non -Resident, Non -Profit and K-12 Schools: Non-profit organizations and California State accredited public or private educational institutions, K-12, including elementary, middle, or junior -high, and high schools, not based in the City of Yucaipa o Non -Resident Standard: Non -Yucaipa based person or organization. • Added Rental Fees for the YPAC
Fees were not increased by CPI at that time.
On July 8, 2019, City Council conducted a Public Hearing and adopted Resolution No. 2019-33 amending Resolution No. 019-07 and adopting revised Exhibit B for the YPAC and 71h Street Theater; Exhibit A remained in place. Fees were still not irW4ased by CPI.
On February 24, 2020, City Council conducted a Public Hearing and adopted Resolution No. 2020-07, rescinding Resolution Nos. 2019-33 and 2019-07, which maintained Exhibit A and B and amended the YPAC Not for Profit and K-12 Schools definition to add community colleges and read Not for Profit and K-14 Schools. Fees were not increased by CPI at the time.
DISCUSSION:
On April 25, 2022, City Council conducted a study session to review and provide direction to staff regarding the CSUF and change in CSUF methodology. Based on council consensus staff was directed to:
• Remove the nonresident fee and implement a resident priority registration policy. • Provide a resident priority for rental requests that are received on the same day. • Eliminate rental categories.
• Increase fees to be in line with the fair market value (this increase in fees would range between 16% and 40%).
The proposed CSUF, will become effective on July 1, 2022. Aquatic and summer camp programs will go into effect once the 2022 season is complete.
A public hearing is required for revisions to the CSUF. A public hearing notice was published in accordance with California Government Code section 6066 for a hearing at this June 27, 2022, regularly scheduled City Council meeting to adopt a resolution that confirms the CUFS. The notice was published in the Yucaipa News Mirror on June 6, 2022, and June 13, 2022. Additionally, it was made available for public review at the City Clerk's Department public counter on June 13, 2022.
The approval of the CSUF established in Resolution No. 2022-23 does not constitute a "project" under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Section 15378(b)(4) because such actions involve the creation of a government funding mechanism which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. Furthermore, the approval of the User Fees established in Resolution No. 2022-23 is statutorily exempt from CEQA under CEQA guidelines Section 15273 (a)(1) because the approval of the CUFS is merely establishing fees to meet operating expenses.
FISCAL IMPACT:
It is anticipated that the implementation of Resolution No. 2022-23, will allow the Community Services Department to maintain a minimum cost recovery of 50% for Fiscal Year 22/23, with the remaining costs subsidized by the General Fund.

RESOLUTION NO.2022-23
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YUCAIPA, CALIFORNIA, RESCINDING RESOLUTION NO.2020-07 AND ADOPTING
AN UPDATE TO THE COMMUNITY SERVICES USER FEE SCHEDULE
AND AMENDING FEES AND CHARGES FOR SERVICES RENDERED IN
RELATION TO COMMUNITY SERVICES AND MAKING RELATED
DETERMINATIONS PURSUANT TO THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT.
The City Council of the City of Yucaipa does hereby resolve as follows:
WHEREAS, the City of Yucaipa has conducted an analysis of services provided by the Community Services Department, the costs reasonably incurred in providing those services, the beneficiaries of these services, and the revenues produced by those paying fees and charges for special services; and
WHEREAS, certain current fees charged for services provided by the City do not fully recover the actual costs of providing such services; and WHEREAS, due to the cost of living and the minimum wage increase in the subsequent years, actual costs of certain services have risen; and WHEREAS, the City Council held a duly noticed public hearing on June 27, 2022, concerning the increase in Community Services User Fees; and NOW, THEREFORE, BE IT RESOLVED, determined, and ordered by the City Council of the City of Yucaipa that:
Section 1. The Community Services User Fee Schedule for various Community Services programs provided by the City is hereby amended to account for CPI.
Section 2. Adoption of Fees and Charges. The City Council hereby adopts the City of Yucaipa Community Services User Fee Schedule ("CSUF") as set forth in attached Exhibit "A" and incorporated by this reference. Unless otherwise stated in the CSUF, all CSUF shall be paid to the City by the customer prior to the City's performance of the requested Services.
Section 3. Repeal of Conflicting Resolutions. It is the desire of the City Council that all fees and charges for services, programs or products be set forth in one document for ease of reference.
Accordingly, any and all provisions of prior Resolutions of the City Council establishing or modifying fees for the services, programs or products set forth in Exhibit "A," are hereby repealed and replaced as of the effective dates as set forth in Section 7 of this Resolution in the manner set forth in Exhibit "A;" provided, however, that such repeal shall not excuse or affect the failure of any person or entity to pay any fee heretofore imposed upon such person or entity. The City Council desires to clarify that in adopting this Resolution, it is taking action only on those fees for the services, programs or products set forth in Exhibit A which have been modified from prior resolutions of the City Council. The remaining fees that have not been modified from prior NQ-of 2
resolutions shall remain in full force and effect and are hereby restated for convenience so that all fees are set forth in one document.
Section 4. Policies and Procedures. Staff is hereby authorized and directed to establish policies and procedures for implementation and collection of CSUF.
Section 5. CEQA. The approval of the User Fees established in this Resolution does not constitute a "project" under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Section 15378(b)(4) because such actions involve the creation of a government funding mechanism which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. Furthermore, the approval of the User Fees established in this Resolution is statutorily exempt from CEQA under CEQA guidelines Section 15273 (a)(1) because the approval of the User Fees is merely establishing fees to meet operating expenses.
Section 6. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Resolution or any part hereof is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portion of this Resolution or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrase be declared invalid or unconstitutional.
Section 7. Effective Date. The CSUF shall be effective on July 1, 2022. Aquatic and summer camp programs will go into effect once the 2022 season is complete.
Section 8. Certification. The Mayor shall sign this Resolution and the City Clerk shall attest and certify to the passage and adoption thereof.
PASSED, APPROVED and ADOPTED by the City Council of the City of Yucaipa on this 27th day of June 2022.
