DISCUSSION:

Project Background:

The City of Yucaipa's Development Code (Section 87.0710, Prohibited Sighs) and General Plan (Policy CDL-4.6) does not currently allow for the construction and operation of new billboards within the City's jurisdictional boundaries. The City has received requests to pennit the construction of Electronic Messaging Centers ("EMCs") light -emitting diode (LED) billboards Nvdthiri the City by two different applicants ("Project Proponents"), and to in order to permit the Project, Section

87.0710 is proposed to be amended to remove the complete prohibition off -site advertising, and an addition to Section 87.0725 has been drafted to provide regulations for off -premises advertising for an EMC. Further, an amendment to Policy CDL-4.6 of the General Plan is also proposed to allow for a limited number of EMCs within the City.

Planning Commission Hearing:

The proposals were presented to the Planning Cornrnission at a public hearing during their regular meeting of May 18, 2022. As part of the discussion, the Planning Commission noted that they were in favor of the proposed gateway -type signage, as well as electronic signs in general, but felt that the gateway features would be appropriate if limited to one (1) per offramp location, which would impact the approval of either Case No. 21-104 or 21-154. Due to the partial recusal of a Planning Commissioner near the project proposed under Case No. 21-154, the Planning Commission did not feel it would be appropriate for their actions to ultimately select the preferred Yucaipa Boulevard sign but recommended that their discussion be provided for Council's consideration. In addition, several Conunissioners noted support for an ordinance that would address existing, legal nonconfornning billboard structures where a provision would allow for the enhancement and conversion of those signs to a digital billboard. It should be noted that these provisions are not contemplated by this Project; separate Council direction would be necessary to assess and develop such an ordinance. For reference, there are a total of 19 static billboards located along Interstate 10, and several additional structures located throughout the City.

Project Design and Description:

The Project consists of two different, but related actions that are necessary for the project to be approved by the City. The first part of the Project is a General Plan Amendment and Development Code Amendment ("Amendments") to establish the regulatory scheme necessary to perinit off -site advertising EMCs within the City of Yucaipa. The second part of the Project is the Conditional Use Pen -nits and Development Agreements ("Use Permit") applications to allow for the construction of EMCs, consistent with the provisions of the Amendments, and pertains to the individual submittals that have been received by the Project Proponents.

General Plan Amendment:

The City's Community Design and Land Use Element (CLD) includes a variety of policies intended to promote a high -quality aesthetic environinent, with Goal CDL-4 promoting "Attractive and visually unified corridors that beautify and strengthen the City's identity, image, and aesthetics while retaining design identities." Policy CDL-4.6, Outdoor Signage, currently states -32-

"Prohibit outdoor off -site advertising billboards (but not on -site signs identifying a business on the same property). Require adherence to signage regulations in the municipal code.

Create more tailored signage regulations for scenic roadways." In order to permit EMCs within the City, the proposed Project would involve amending Policy CDL-4.6 to permit up to three (3) EMC billboards within the City, which reflects all of the current proposals that have been submitted. The updated policy, included as part of Resolution No. 2022- 21, would be as follows:
"To enhance the aesthetic environment of the freeway corridor and provide opportunities for a gateway feature, up to three (3) new outdoor off -site electronic advertising billboards that include a decorative structure along with city -identifying elements shall be permitted on privately -owned parcels through a discretionary review process. All other outdoor off -site advertising billboards (but not on -site signs identifying a business on the same property) shall be prohibited on privately -owned parcels. Require adherence to sigmage regulations in the municipal code. Create more tailored signage regulations for scenic roadways." There are two additional policies within the General Plan that reference billboards, CDL-4.7, and CDL-8.6. However, the permitting of an EMC would be consistent with these policies, provided that the proposal, along with the regulations proposed for the Development Code, support Projects that promote improvements to the visual quality of the area. These policies will be accomplished through the implementation of decorative structures for each billboard Development Code Amendment:

Section 87.0710. Prohibited Signs, of the City's Development Code currently prohibits "Pennanent primary signs which advertise or identify a business, function, establishment or product at a location other than the property on which such business or establishment is located or such product is manufactured or sold." To accommodate an EMC within the City of Yucaipa, the Project includes a Development Code Amendment (Ordinance No. 393) that modifies Section 87.0710 to exempt EMC signs if permitted under the City's Electronic Messaging Center Billboard requirements and develops Section 87.0725(c) to provide the Electronic Messaging Center Billboard requirements.

Section 87.0725(c) includes a variety of provisions that would govern the permitting, siting and performance requirements for any EMC proposed within the City. The Development Code would require that EMCs are reviewed through the City's discretionary Conditional Use Permit Process.

EMCs would be limited to conunercially-designated properties within the City's Interstate 10 corridor, and focused along the gateways to the City. Proposed EMCs would feature sign faces that are less than 680 square feet, be Tinted on brightness output that meets or exceeds state requirements, and be limited to a static message or image that is displayed for a minimum of eight (8) consecutive seconds before changing. Each EMC structure would also be required to feature a decorative top and base treatment that can enhance the visual quality of the sign and provide defined monumentation at the City's gateways, consistent with the amended General Plan policy.

Conditional Use Permit(s):

The proposed Project consists of three separate Conditional Use Permits for the development of EMC structures that are designed to be consistent with the draft Development Code Amendment and would complete the discretionary review process required for these specific signs. All three proposals have digital display pleasuring 14' 1.5" by 48' 2.5" that provides a total sign area of 672 square feet, and include an architectural treatment consisting of a decorative top that includes a mountain motif, which provides a homage to the City of Yucaipa logo, and "City of Yucaipa" text in reverse -lit lettering, as well as a corresponding decorative base treatment feature complete with a City logo. All of the signs would also include a dirmner system that adjusts the sign output based on existing exterior lighting conditions, with a timer system that can adjust display output during nighttime hours as a redundant backup systern, to address light -related concerns.

The Project proposals also have the following characteristics:

Case No. 21-096
The proposed EMC is located at 13500 Calimesa Boulevard (APN: 0318-212-19), which is a developed site that features automotive repair uses and is designated as CS (Service Commercial) by the City's General Plan. The sign structure height is approximately 62 feet, when measured from the existing ground level at the subject site, and will be located within an approximate lease area of 16 feet by 12 feet (192 square feet). No existing billboards are currently located at the subject site, however, the Development Agreement proposes the removal of a billboard along Yucaipa Boulevard, west of 2nd Street.

Case No. 21-104
The proposed EMC is located at 31107 Outer Highway 10 (APN: 0300-101-19), Nwluch is developed site that features retail sales of truck trailers and an existing static billboard that would be removed, and is designated as CS (Service Conunercial) by the City's General Plan. The sign structure height is approximately 55 feet, when measured from the existing ground level at the subject site, and will be located within an approximate lease area of 6 feet by 10 feet (60 square feet). As part of the Project design, louvers are proposed to be installed along the southern edge of the sign faces to further obstruct any light that could be cast outside of the sign's viewing angle.

Case No. 21-154
The proposed EMC is located at 31547 Outer Highway 10 (APN: 0300-161-13), which is developed site that features a self -storage facility and an existing static billboard that would be removed, and is designated as CS (Service Commercial) by the City's General Plan. The sign structure height is approximately 59 feet, when measured from the existing ground level at the subject site, and will be located within an approximate lease area of 16 feet by 12 feet (192 square feet).

Development Aw reenrent.

The project developers for each sign have requested the use of a development agreement with the City to identify the developer's and City's responsibilities to obtain the inutural benefits of the Project. To strengthen the public planning process, encourage private participation in -34-

comprehensive planning and reduce the economic risk of development, the Legislature of the State of California had adopted the Development Agreement Regulations, which authorizes any city to enter into binding development agreements establishing certain development rights in real property with persons having legal or equitable interests in such property. Section 65864 of the Development Agreement Regulations expressly provides as follows:
"The Legislature finds and declares that:
"(a) The lack of certainty in the approval of development projects can result in a waste of resources, escalate the cost of housing and other development to the consumer, and discourage investment in and a commitment to comprehensive planting which would make maximum efficient utilization of resources at the least economic cost to the public. "(b) Assurance to the applicant for a development project that upon approval of the project, the applicant may proceed with the project in accordance with existing policies, rules and regulations, and subject to conditions of approval will strengthen the public planning process, encourage private participation in comprehensive planning, and reduce the economic cost of development.
(c) The lack of public facilities, including, but not limited to, streets, sewerage, transportation, drinking water, school, and utility facilities, is a serious impediment to the development of new housing. NVIienever possible, applicants and local governments may include provisions in agreements whereby applicants are reimbursed over time for financing public facilities."
Section 65865.2 of the California Government Code provides that "A development agreement shall specify the duration of the agreement, the permitted uses of the property, the density or intensity of use, the maximum height and size of proposed buildings, and provisions for reservation or dedication of land for public purposes. The development agreement may include conditions, tenors, restrictions, and requirements for subsequent discretionary actions, provided that such conditions, terns, restrictions, and requirements for subsequent discretionary actions shall not prevent development of the land for the uses and to the density or intensity of development set forth in the agreement. The agreement may provide that construction shall be commenced within a specified time and that the project or any phase thereof be completed within a specified time. The agreement may also include terms and conditions relating to applicant financing of necessary public facilities and subsequent reimbursement over time."
The Development Agreements for each sign have been developed bevveen staff and the project applicants, and has comparable deal points, including a revenue cost share of advertising revenue, a local business program that provides discounted advertising rates, available advertising space for City -sponsored advertising for events, and each call for the removal of an existing static billboard as to not increase the net number of existing billboard structures within the City. As noted previously, two sites feature existing billboard structures that would be removed, and the third Project would remove an existing billboard at 34855 Yucaipa Blvd, which is visible as one approaches the 2" d Street roundabout for the Uptown District.

Processing and Procedural Actions:

Notices of the project were sent to all surrounding property owners within a 300-foot radius of each of the project sites and several written responses were received for the two projects located along -35-

Outer Highway 10. Their concerns included light pollution from the proposed digital screens, as well as general concerns of rural appearance of the City being lost with such projects. One public commment was also received over the phone following, the Notice of Public Hearing for the Planning Commission meeting which requested that the City permit additional billboards beyond the three that are proposed.

Environmental Review:

The Initial Study prepared as part of an initial proposal (Case No. 19-155), xvhich was made available for comment for 30 days beginning on April 27, 2020 and ending on May 27, 2020. After the public review period for the MND, the applicant for the Use Pen -nit withdrew their application following their negotiations with the underlying property owner of the specific EMC site, and no formal action of the Amendments were taken. Following the withdrawal of the original Use Pen -nit. three new Use Permits for EMCs (Case Nos. 21-096, 21-104, and 21-154) have been submitted by two different applicants, one of which was the original applicant for Case No. 19-155. To address project -related changes, a Recirculated MIND was prepared and was made available for agency and public review and cornrment for a 30-day period beginning on March 28, 2022, and ending on April 27, 2022. Together, the R'V ND considers the potential environmental impacts that could occur as a result of the Project. The Planning Commission reviewed the analysis conducted by staff. and reconnnends adoption of a RI\4NTD, noting that all available evidence indicates that any adverse impacts that could occur are at a less -than -significant level. Three (3) connments were received on the Initial Study during the public review processes by local, regional or state agencies, or by members of the public, and a Response to Comments has been prepared.

CONCLUSION:

The proposed Use Permits require a General Plan Amendment and Development Code Amendment prior to their approvals, and associated amendments have been prepared for consideration. Pursuant to the City's Development Code, these actions require a recommendation from the Planning Commission to the City Council, which was provided during their regular meeting of May 18, 2022.

The proposed Use Pennits have been designed to be consistent with the proposed legislative amendments, and the required findings for approval of the General Plan Amendment, Development Code and Conditional Use Pen -nits have been made and are attached should the City Council ultimately approve the projects. It should be noted that the approval can include all, or portions of the overall Project.

FISCAL IMPACT:

Based on the Development Agreements, the City would receive a cost share of revenuesgenerated from each sign, and would also be able to advertise City -sponsored events.
