CITY OF YUCAIPA

AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Raymond A. Casey, City Manager Alf
Andrew Hamilton, Director of Finance
Benjamin J. Matlock, Planning Manager/City Planner ss r--- Ryan Blackerby, Accounting Manager IV
FOR: City Council Meeting of July 11, 2022
SUBJECT: Property and Business Improvement Districts
RECOMMENDATION:

That City Council receive and file the following financial reports as prepared by the Property Owner's Association Board of Directors of the Yucaipa Village Square Management Property and Business Improvement Districts:

1. Fiscal Year 2022 Financial Statements for District #1 & District #2

2. Fiscal Year 2023 Annual Budget for District #1 & District #2

3. Fiscal Year 2023 Annual Fiscal Report (Assessments) and Assessment Listing for District #2
BACKGROUND:

On June 23, 1997, the City Council adopted Resolution No. 97-12, establishing a Property and Business Improvement District (PBID) to be known as Yucaipa Village Square Management District #1 (District #1). The purpose of this District is to provide a funding mechanism for levying assessments on properties located within the District to fund certain improvements and maintenance activities within the District. These certain improvements include ongoing monthly utility costs for landscape irrigation and area lighting as well as the actual costs of maintaining the landscaping. District #1 includes the properties located on California Street, between Yucaipa Boulevard and Avenue B. On July 22, 2002, the City Council adopted Resolution No. 2002-32, renewing the District for an additional 10 years. On August 27, 2012, the City Council adopted Resolution No. 2012-55, renewing District #1 for an additional 10 years. Fiscal Year 2022 (FY 22) was the final year of that term and District #1 did not take any action to terminate nor to renew, therefore, it will not be able to levy any new assessments in the future.

City Council Meeting of July 11, 2022
On July 13, 2009, the City Council adopted Resolution No. 2009-16, establishing a PBID to be known as Yucaipa Village Square Management District #2 (District #2). The purpose of District #2 is to provide a funding mechanism for levying assessments on properties located within District #2 to fund certain improvements and maintenance activities within District #2. These certain improvements include ongoing monthly utility costs for landscape irrigation and area lighting as well as the actual costs of maintaining the landscaping. District #2 includes the properties located on Yucaipa Boulevard, between Second Street and Bryant Street. On August 11, 2014, the City Council adopted Resolution No. 2014-44, renewing District #2 for an additional 10 years.

On March 27, 2017, the City Council approved, upon recommendation from the Uptown Association board of directors, an amendment to the Property Management Plan to include private security services. Funding for the private security service was allocated by the City Council in the Fiscal Year 2016-2017 Budget as a Service Level Option in the amount of $10,000 and on February 15, 2017, the Uptown Association board approved an investment in the amount of $9,100, in part due to the annual savings realized as a result of the LED light fixture retrofit.

Ongoing Uptown security services began in July 2017. The future of these security services is currently being evaluated by the Board and City staff.

DISCUSSION:

Streets and Highway Code Section 36633 states that the Advisory Board of the District shall cause to be prepared a report for each fiscal year for which assessments are to be levied and collected to pay the costs of the improvements and activities described in the report. Attached for Council review are Financial Statements for the year ending June 30, 2022 (including estimated actuals for the year), the Fiscal Year 22-23 (FY 23) Annual Budgets, and, for District #2, the Fiscal Report for the year ending June 30, 2023 (District #1 does not have a Fiscal Report as it has expired and will not be levying assessments for FY 23). These Reports were presented to the Districts' Board on June 20, 2022. After review and discussion, the Board approved an increase in the annual assessment for District #2 by an amount equal to 0%. Due to its expiration, the budget previously authorized for District #1 is recommended to be moved to the General Fund. The Board will be discussing the expiration of District #1 in an upcoming meeting.

The Statement of Revenues and Expenses for fiscal year ending June 30, 2022 (attached) for District #1 shows estimated year-end expenditures exceeding revenues by $2,114. The balance estimated to remain at the close of the fiscal year is $1,650.

In addition to the routine landscape maintenance activities funded by the PBID, flowers in the hanging baskets along Yucaipa Boulevard, in District #2, are replaced twice per year by community volunteers in an effort led by the City's contract landscape architect.

FISCAL IMPACT:

The total annual assessment to be collected for FY 23 is approximately $33,856 (for District #2).

Attached is the listing of the assessments by parcel. Currently there are estimated FY 22 ending balances of approximately $1,650 in District #1 and $53,377 in District #2. -410-
