Agenda Item No. 16
CITY OF YUCAIPA
AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Fermin Preciado, Director of Development Services/City Engineer C ` FOR: City Council Meeting of July 11, 2022
SUBJECT: Award of Contract — Phase 2 Oak Glen Road/Live Oak Canyon Road Widening Project, Colorado Street to Outer Hwy-10 South Project.
RECOMMENDATION:
That City Council:
1. Award and authorize the Mayor to execute a contract in the amount of $531,360.50 with Three Peaks Corp. of Calimesa, California for the Live Oak Canyon Road Improvements at Outer Highway South Project — Project No. 10981-2; and
2. Authorize a contract contingency in the amount of $43,000 and the amount of $42,000 for contract administration, materials testing, inspection, and permitting for a total construction budget of $616,360.50 for the Project; and
3. Authorize the City Manager, or his designee, to administer the terms of the contract; and
4. Approve the Plans and Specifications prepared for this Project; and
5. Authorize the amount of $61,389 from the City's FY2022/2023 Unallocated Pavement Management Program Budget (projected year-end fund balance) for the Project.
BACKGROUND/DISCUSSION:
The FY2022/2023 Capital Improvement Program (CIP) includes the Oak Glen Road/Live Oak Canyon Road Widening Project, Colorado Street to Outer Hwy-10 South. This project includes the construction of ultimate street improvements consistent with the City's General Plan Transportation element. These improvements include street widening, constructing new curb/gutter, sidewalk, commercial driveway approaches, signing/pavement striping and the installation of a new traffic signal with intersection improvements at Live Oak Canyon Road and Outer Hwy-10 South. This project was prioritized in order to improve traffic circulation on Oak Glen Road and Live Oak Canyon Road near the I-10 Freeway, improve access to the commercial properties and the pumpkin patch property in the area, and improve access to the I-10 Freeway.
The engineering design of the overall project was initiated in 2018 and the construction is being completed in phases. Phase I, completed in 2018, included the construction of a new dedicated right -431-

turn lane with a commercial driveway approach and adjusting the signing and striping on the north side of Oak Glen Road between 14"' Street and the I-10 Freeway, adjacent to the AM/PM gas station.
For Phase 2, staff prepared the plans and bid documents for the Live Oak Canyon Road Improvements at Outer Highway South Project (Project). The Project includes signalization and intersection improvements on Live Oak Canyon Road and Outer Highway South, which includes a fourth approach at the intersection which will serve as an access point to the Live Oak Canyon Farm (Pumpkin Patch) property. The Project also includes curb, gutter, and sidewalk on the east side of Live Oak Canyon Road that will join with improvements to be constructed by the owner of the Pumpkin Patch property as part of their requirements of the Conditional Use Permit (CUP) currently being processed by the City. Since the engineering design of the Project included the widening of Live Oak Canyon Road along their frontage, the proposed conditions of approval for the CUP include a requirement for the Pumpkin Patch to pay for the engineering design of the widening along their frontage and their share of the engineering design costs of the Project as well, currently estimated at $24,500.
Given the importance of completing the Project prior to the peak season for the Pumpkin Patch activities (late September through November) and taking into account the long lead times for delivery of traffic signal poles and equipment, on May 23, 2022, City Council authorized the purchase of traffic signal poles and associated traffic signal equipment to McCain, Inc. in the amount of $88,658.23. The traffic signal poles are scheduled to be delivered to the City in late August for installation as part of the proposed contract.
In June 2022, staff prepared the construction bid documents for the Project, and the Project was publicly advertised for construction bids. On July 6, 2022, seven (7) sealed bid were received from contractors as follows:

The Engineer's Estimate for the Project is in the amount of $440,000. In reviewing the costs submitted for the individual items of work, the bids received for the concrete work and traffic signal installation were higher than anticipated. This is a result of the ongoing increase in costs for concrete, construction materials and electrical equipment/supplies. Although the Engineer's Estimate was adjusted to reflect construction cost increases as of May 2022, the seven (7) bids -432-

received consistently indicate a much higher increase in construction costs over the last few months.
Three Peaks Corp. of Calimesa, CA (Three Peaks), is the apparent low bidder. Staff has reviewed the bid documents and determined that the documents meet the requirements of the construction contract specifications. Three Peaks has completed several similar projects for the City and other public agencies in the past. Their work has been deemed satisfactory. As a result, staff recommends that City Council award the contract for the Project to Three Peaks in the amount of $531,360.50

City Council Meeting of July 11, 2022
Award of Contract — Phase 2 Oak Glen Road/Live Oak Canyon Road Widening Project, Colorado Street to Outer Hwy-10 South Project.
As shown in the table above, the total proposed cost for the construction of the Project is in the amount of $631,360.50. Since the Project includes the widening and asphalt pavement improvements of Live Oak Canyon Road and Outer Hwy-10 South, and associated asphalt pavement rehabilitation within the project limits, staff is recommending Council authorize the use of Unallocated Pavement Management Program (PMP) funds in the amount of $61,389 to the Project. The current balance of Unallocated PMP funds is in the amount of $264,000. Utilizing $61,389 for the Project leaves a remaining balance of $202,611. Consequently, there is sufficient funding to accommodate staff s recommendation.
With the total available and proposed funding in the amount of $834,389 and the total estimated Project cost in the amount of $834,388.73 there is sufficient funding available to accommodate staff s recommendation.
