SUBJECT: Acceptance of Contract Work — CDBG 40' Street Drainage and Sidewalk Improvements Project — Project No. 11095
RECOMMENDATION:
That City Council:
1. Accept the contract and extension work completed by I.E. General Engineering, Inc. of Beaumont, CA, in the amount of $177,902.00 for the CDBG 4th Street Drainage and Sidewalk Improvements Project — Project No. 11095; and
2. Approve the final payment for the Project; and
3. Authorize the recordation of the Notice of Completion for the Project.
BACKGROUND:
The approved FY2022/2023 Capital Improvement Program (CIP) includes multiple projects funded through the Community Development Block Grant (CDBG) Program. The CDBG grant program provides funding for pedestrian and transit related improvements in specific target areas of the City such as sidewalk, curb ramps, bus stop improvements and curb/gutter. The CDBG grant program also funds Americans with Disabilities Act (ADA) access improvement projects and projects that provide ADA parking in the public right of way. In 2020, staff recommended, and Council approved the submittal of an application requesting CDBG funding to design and construct inf-11 curb, gutter and sidewalk on the east side of 4th Street, between County Line Road and Avenue H. The City's application requesting the amount of $111,738 in CDBG funding was subsequently approved. In 2021, the City applied for and was granted an additional $194,000 in CDBG funding to fully fund the construction of this project.
The 4th Street Drainage and Sidewalk Improvements Project — Project No. 11095 (Project) consists of constructing curb, gutter, sidewalk, and concrete drive approaches along the east side of 4th Street between County Line Road and Avenue H. The Project is consistent with the City's General Plan Circulation Element.
The Project is included in the adopted FY2022/2023 CIP. The Project is a complement to the County Line Road Corridor Improvements Project currently under construction and funded by the City of Yucaipa and the City of Calimesa.

On December 13, 2021, City Council awarded a contract to IE General Engineering Inc. of Beaumont Ca. in the amount of $172,032, with a contract contingency in the amount of $35,000 and the amount of $17,000 for construction contract administration, inspection, and testing, for a total construction budget in the amount of $224,032.
Throughout the course of construction, staff approved Change Orders 1 and 2 for a net increase in the amount of $5,870. The change in work included additional tree and asphalt pavement removal, water meter relocations, and additional driveway approach work required for the Project. The approved change order amounts are less than the construction contract contingency amount of $35,000 approved by City Council for the contract.
The construction of the Project has been completed. Field inspections performed by staff during the course of the work and upon completion of the work have assured that the work was completed according to the plans and specifications for this project. As a result, staff is recommending that City Council accept the contract work, Approve the final payment for the Project and direct staff to file the Notice of Completion for the Project.

As shown in the tables above, the actual cost of the Project in the amount of $192,402.00 is less than the budget amount approved by City Council in the amount of $224,032.00. As a result, there is sufficient funding available to accommodate staff s recommendations. The remaining balance (savings) in the amount of $31,630.00 will be returned to the Unallocated CDBG Fund Account to fund other eligible CDBG projects. Staff will return to Council at a later date with a recommendation regarding the use of these funds.
