Agenda Item No. 10

CITY OF YUCAIPA

AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Fermin Preciado, Director of Development Services/City Engineer Landon Kern, Assistant City EngineervF L
Todd Gutjahr, Public Works Analyst
FOR: City Council Meeting of August 8, 2022
SUBJECT: Resolution Approving the Master Agreement between the City of Yucaipa and the State of California, Department of Transportation
RECOMMENDATION:

That City Council Adopt Resolution No. 2022-29 approving the Administering Agency -State Agreement for Federally -Funded projects with the State of California Department of Transportation (Caltrans) and the City of Yucaipa and authorizing the Mayor to execute said Agreement, and authorizing the City Manager or the City Engineer to execute subsequent Program Supplemental Agreements to the Master Agreement, Fund Exchange Agreements and/or Fund Transfer Agreements for Federal -Funded projects.

BACKGROUND/DISCUSSION:

In 1991 the Congress of the United States enacted the Intermodel Surface Transportation Efficiency Act (ISTEA) of 1991 and subsequent Transportation Authorization Bills to fund transportation -related programs. These transportation programs include but are not limited to the Surface Transportation Program (STP), the Congestion Mitigation and Air Quality Improvement (CMAQ) Program, and the Transportation Enhancement (TE) Program.

Before State and Federal funding could be made available for Capital Improvement Program (CIP) projects within the City of Yucaipa, Caltrans and the City were required to enter into an agreement relative to the implementation of projects and maintenance of the completed facilities.

Consequently, on March 23, 1998, the City Council approved and authorized the Mayor to execute an Agency -State Master Agreement for Federal -Aid projects (Master Agreement) between Caltrans and the City of Yucaipa.

For Federal funds to be made available for a specific CIP project, the City and Caltrans must enter into a separate Program Supplemental Agreement to the Master Agreement to establish the terms and conditions applicable to the designated project and to the subsequent operation and maintenance of that completed facility.

Previous Resolutions adopted by City Council have referenced specific federal/state funded projects and associated Program Supplemental Agreements to the Master Agreement, Fund Exchange Agreements and/or Fund Transfer Agreements for State/Federal-Funded projects for specific CIP projects that have received or are receiving State/Federal Funding via Caltrans. :1

Page 2 of 2 ends

Currently, there are two Master Agency -State agreements that are proposed to remain effective, one for State funded projects and one for Federal Funded Projects.

At its meeting on August 23, 2021, City Council adopted Resolution No. 2021-50, rescinding and replacing Resolution No. 2021-46, approving the Administering Agency -State Agreement for State - Funded projects (Agreement No. 08-5457S21) with Caltrans and the City of Yucaipa and authorizing the Mayor to execute said Agreement, and authorizing the City Engineer to execute subsequent Program Supplemental Agreements to the Master Agreement, Fund Exchange Agreements and/or Fund Transfer Agreements for State -Funded projects. This Resolution (Resolution No. 2021-50) applies to State -Funded projects only.

The proposed Resolution No. 2022-29 does not replace any previously approved resolutions or agreements. Instead, proposed Resolution No. 2022-29 authorizes the City Manager or the City Engineer to enter into future Program Supplemental Agreements to the Master Agreement, Fund Exchange Agreements, and/or Fund Transfer Agreements for any Federal grant funds received by the City. The current Resolution (Resolution No. 2017-43) that applies to Federal grant funds is only specific to certain Federal funded projects. As mentioned above, proposed Resolution 2022-29 applies to all Federal funded projects. It is important to note that if approved, the City Manager or City Engineer would only execute documents for the projects included in the approved FY2022/2023 CIP and within the funding allocations identified.

As a result, staff recommends that City Council adopt Resolution No. 2022-29, approving the Master Agreement between the City of Yucaipa and the State of California, Department of Transportation FISCAL IMPACT:

There is no fiscal impact associated with the approval of Resolution No. 2022-29. However, this action will expedite the process for reimbursement of Federal funds consistent with the approved FY2022/2023 CIP and will allow the City to be eligible for additional Federal grant funding in the future.
