Agenda Item No. 6
CITY OF YUCAIPA
AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Fermin Preciado, Director of Development Services/City Engineer Benjamin J. Matlock, Planning Manager/City Planner_
Madeline Jordan, Assistant Planner'
FOR: City Council Meeting of August 22, 2022
SUBJECT: Meridian Land Development (Case No. 15-061/TTM 19974): A final 24-month Extension of Time request for Case No. 15-061/TTM 19974; which is for the phased development of a Tentative Tract Map and Environmental Impact Report to subdivide 236 gross acres into 184 single family lots with a minimum lot size of one (1) gross acre, with two (2) additional "not a part" lots for an existing private residence (Casa Blanca Ranch) and water tank/pump station site owned and operated by Yucaipa Valley Water District, located north of Oak Glen Road and east of Jefferson Street; APN(s): 0321-081-15; 0321-101-02, 12, and 21.
RECOMMENDATION:
That City Council approve a final Extension of Time of 24 months for Tentative Tract Map 19974, subject to the attached Conditions of Approval originally dated July 11, 2016, and amended on April 11, 2019, associated with the first Extension of Time request, and adopt the Findings as contained in this Agenda Report.
BACKGROUND:
This request involves a time extension for Tentative Tract Map No. 19974, which is set to expire in 2022. Tentative Tract Map 19974 was originally approved by the City Council on July 11, 2016, to permit the phased development of 184 single family lots with a minimum lot size of one (1) gross acre, with two (2) additional "not a part" lots for an existing private residence (Casa Blanca Ranch) on approximately 236 gross acres. The applicant submitted their first Extension of Time request in April of 2019, and the City of Yucaipa approved a 36-month time extension pursuant to 83.040220(f) of the Yucaipa Development Code and the Subdivision Map Act, which resulted in a new Tentative Tract Map expiration date of July 11, 2022.
Upon approval, Tentative Tract and Parcel Maps are provided 36 months to timely file a map for recordation, which can be extended by an additional 36 months by staff. Pursuant to Section
83.040220(f) of the Yucaipa Development Code, once a Tentative Tract Map has received an initial extension of time for a period of 36 months, "Additional extensions of time, for a period or periods not exceeding a total of 24 months, may only be approved by the City Council." This provision of -128-

the Development Code is consistent with the Subdivision Map Act, which is the State law governing the regulation of all subdivisions within California. Given the current 24-month extension request was submitted to the City of Yucaipa on May 12, 2022, prior to the expiration date for the Project, pursuant to the Subdivision Map Act, "the map shall automatically be extended for 60 days or until the application for the extension is approved, conditionally approved, or denied, whichever occurs first" whenever an extension is timely filed. As such, the effective expiration date for Tentative Tract Map 19974 is September 11, 2022, unless action from the City Council occurs first.
DISCUSSION:
The Conditions of Approval were previously amended as part of the first Extension of Time request (Case No. 19-029/EXT) and new Conditions added as a part of that approval are bolded and notated with a text box, "Added by 19-029/EXT." In particular, Engineering Department conditions that address drainage and WQMP requirements were added by staff as a part of the previous Extension of Time request.
During the review of the current extension request, staff amended a condition on the Project's original Conditions of Approval in order to meet current requirements of the Fire Code and updated the condition related to undergrounding utility requirements based on Ordinance 389. The amended conditions are shown as strikeout tex for the condition or verbiage that is proposed to be removed, and bolded and underlined text for new conditions or verbiage.
Market conditions and other delays have stalled efforts to complete the recordation process of the Final Tract Map. Further, the applicant had indicated that the current Extension of Time is being requested to maintain the life of the approved entitlement permitted by the City's Development Code.
Staff has been able to make all the necessary findings to support the additional Extension of Time, and under existing State and local law, this is the final extension of time the Project is eligible to receive. No changes to the map are proposed. If the Extension of Time is not approved, the applicant would have to start the process over and submit a new Tentative Tract Map application. Alternatively, if the extension is approved, the applicant would have two years to timely file the Final Tract Map. If the final map is not filed by the extended expiration date, the applicant would have to start the process over and submit a new Tentative Tract Map application. With approval of the Extension of Time, the expiration date would be July 11, 2024, and no further Extension of Time may be granted.
Additionally, it should be noted that the applicant has been actively involved in the planning process related to the City's Wine Country efforts. They have started preparing a preliminary map and other exhibits, which following the ultimate approval and adoption of the Wine Country Specific Plan by the City Council, would be formally pursued as an alternative to Tentative Tract Map 19974.
Finally, as a courtesy to property owners within the vicinity of a Project requesting the final 24-month Extension of Time, all property owners within 300 square feet of Tentative Tract Map 19974 received Project Notices detailing the original Project proposal and the Extension of Time request. Comment letters were received during this noticing process describing concerns related to loss of views and open space, noise, traffic, infrastructure demands, and noticing procedures. As noted above, the project noticing for property owners as a part of the Extension of Time request is a courtesy provided -129-

to help neighbors within the vicinity better understand upcoming development within the area. This is especially significant if there has been a change of property ownership since the original approval, and ultimately provides further context prior to the build -out of a Project. While the site is currently undeveloped, it is also not designated as "Open Space." Tentative Tract Map 19974 has been previously approved and found to be consistent with the current RL-1 (Rural Living, 1 acre minimum) Land Use Designation of the site. The City of Yucaipa Development Code and General Plan also do not protect private property views, and the previously adopted EIR and Conditions of Approval address necessary infrastructure improvements, and do not identify significant impacts related to noise and traffic.
As the subdivision is still in conformance with the City's General Plan, an Extension of Time can be granted subject to the attached Conditions of Approval. The City Council has discretion to provide new or revised Conditions that are deemed to be necessary for the Project, and as previously stated; staff amended and added several conditions.
ENVIRONMENTAL REVIEW:
The Final Environmental Impact Report for Case No. 15-061/TTM 19974 (SCH No. 2015091088), and Mitigation Monitoring Program was prepared and adopted as part of the original project approval.
Public Resources Code §15162(a) indicates that no subsequent EIR shall be required for a project when the following findings can be made:
• No substantial changes are proposed in the project which will require major revisions of the previous EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; and • Substantial changes did not occur with respect to the circumstances under which the project will be undertaken which will require major revisions of the previous EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; and
• No new information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the previous EIR was certified as complete shows any of the following:
o The project will have one or more significant effects not discussed in the previous EIR;
o Significant effects previously examined will be substantially more severe than shown in the previous EIR;
o Mitigation measures previously found not to be feasible and would substantially reduce one or more significant effects of the project, but the project proponents decline to adopt the mitigation measure; or
o Mitigation measures or alternatives which are considerably different from those analyzed in the previous EIR would substantially reduce one or more significant effects on the environment, but the project proponents decline to adopt the mitigation measure.

Extension of Time for Tentative Tract Map No. 19974
Using Google Earth aerial imagery from 2016, and the current 2022 aerial imagery, staff has analyzed the existing conditions at the time the Tentative Map was approved compared to present conditions.
The topography and extent of development on the Tentative Map site remains unchanged.
Considering the lack of significant or substantial change in existing conditions, staff recommends that the City Council find that this project requires no further environmental analysis based on the findings contained in Section 15162 of the CEQA Guidelines. There have been no changes to the project, and the tentative map remains within the scope of the EIR that had been originally adopted.
FISCAL IMPACT:
There is no fiscal impact as a result of this item.
CONCLUSION:
As stated in the attached findings, staff has found that the proposed Project is consistent with the General Plan and meets or exceeds all development standards specified in the Development Code as conditioned. Therefore, staff recommends that the City Council approve an Extension of Time of 24 months for Tentative Tract Map 19974, subject to the attached Conditions of Approval, and adopt the Findings as contained in this Agenda Report.

FINDINGS: TENTATIVE TRACT MAP No. 19974
1. The proposed subdivision, together with the provisions for its design and improvements, is consistent with the General Plan and any applicable specific plan, because the proposed use and overall density is permitted in the RL-1 (Rural Living, 1 acre minimum) Land Use District within the Custom Home (CH) Overlay, and the Conditions of Approval address the provision of public services and improvements.
2. The site is physically suitable for the proposed type and density of development, because the physical constraints that may exist on site have been recognized and mitigated through the Conditions of Approval including access, circulation, drainage, and grading.
3. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage and substantially or avoidably injure fish or wildlife or their habitat, because an EIR has been prepared and found that no significant environmental impacts would result from the project due to its design and mitigation measures, and the project site is located in a developing urban residential area.
4. The design of the proposed subdivision and any related types or proposed improvements are not likely to cause serious public safety and health problems because conditions are included to assure compliance with all City health and safety standards.
5. The design of the proposed subdivision or the type of improvements will not conflict with public easements within or through the site because conditions have been included to ensure non-interference with any existing public easements.
6. The design of the subdivision provides to the extent feasible, passive or natural heating and cooling opportunities, because the project provides north/south facing lots and homes, which provide opportunities for the use of solar energy.
7. The proposed subdivision, its design, density, and type of development and improvements conforms to the regulations of the Development Code and the regulations of any public agency having jurisdiction by law, because all development standards meet or exceed those that are specified in the Development Code and all public agencies that may be affected by this development have had their concerns addressed by the Conditions of Approval.
The proposed subdivision is not deemed to be a land project as defined by the Yucaipa Development Code, Section 812.12030.

107. The property owner or Project contractor will be responsible to schedule vegetation clearing and grading activities outside of the nesting season. The Amended -1 cc nesting season for this Project is January 1 through August 31, or as determined on 7-11-16 g J Y g 9
by a qualified avian biologist (as accepted by resource agencies). This determination will be based on observations in the field, in order to comply with the Migratory Bird Treaty Act (MBTA) and relevant sections of the California Fish and Game Code. The only changes to the nest protection period that may be deemed necessary by the avian biologist would be to extend the nest protection period beyond the January 1 through August 31 period (in particular for any species that would potentially be nesting later than the above dates). If vegetation clearing during the breeding season is unavoidable, avian nesting surveys and adequate nest protection buffers must be implemented and continued, as provided in Mitigation Measure BIO-5. Nest avoidance buffers would be removed once nests are considered no longer active (do not contain eggs, chicks, or dependent juveniles). (Bio-1)
108. Due to their potential for occurrence on the site, additional surveys for sensitive plants, including slender -horned spineflower, white-bracted spineflower, Parry's spineflower and Plummer's mariposa lily, shall be completed during the spring blooming period prior to final map recordation and prior to grading for common areas and streets, or of individual lots. The blooming period for Parry's spineflower is April through June, and Plummer's mariposa lily is May through July. Surveys during May would encompass both species; however, known reference populations should be visited to determine if April/Map for Parry's spineflower would be better and another survey in June should occur to locate Plummer's mariposa lily. Should surveys indicate of the presence of these species, the Project proponent shall contact the California Department of Fish and Wildlife (CDFW) to determine appropriate strategies. Acceptable mitigation options may include:
a) Avoidance of sensitive plant locations,
b) Payment of an in -lieu fee, or,
c) Replacement of plants.
Ground disturbance in areas where sensitive plants have been documented shall not be allowed to proceed until a mitigation option commensurate with the level of impact has been selected and approved by the City. (Bio-2) -150-

109. During Project grading activities, the limits of grading and construction activities within the Project footprint should be clearly delineated with temporary staking, flagging, or similar materials by the property owner or Project contractor.
Grading of the Project footprint should be minimized to the greatest extent feasible and access to it should be via pre-existing/maintained access routes to the greatest extent possible. (Bio-3)
110. Prior to issuance of the grading permits for any ground disturbing activities occurring in areas that contain FEMA 100-year flood zones or regulated aquatic resources such as washes, streams, or wetlands, the developer or landowner shall either;
1) Obtain federal and/or state permits authorizing the proposed work, including a Clean Water Act Section 404 Permit, Clean Water Act Section 401 Water Quality Certification, Lake/Streambed Alteration Agreement, and/or Waste Discharge Requirements; or,
2) Obtain statements from the U.S. Army Corps of Engineers, CDFW, and Santa Ana RWQCB indicating that such permits are not required, and provide these statements to the City.
A grading permit shall not be issued, and no vegetation shall be removed from these areas, until the conditions above are satisfied. If federal or State permits are obtained, the permittee shall comply with all permit conditions when implementing the proposed activities, including any seasonal timing restriction, impact avoidance measures, limitations on construction means and methods, site restoration, compensatory mitigation, and reporting requirements. (Bio-4) 111. Within 72 hours prior to vegetation clearing or grading that would occur during the avian breeding season, the Project developer/individual land owner for onsite Amended by CC and offsite activity that necessitates a permit shall have a City -approved avian on 7-11-16 biologist conduct a survey to determine if active nests of any bird species protected by the MBTA, or the California Fish and Game Code, are present in the disturbance zone. The disturbance zone would include within 200 feet for non - listed, MBTA covered bird species, or 500 feet for raptors or any species listed by state or federal resource agencies. If active nests are detected, clearing and construction within 200 feet of the nest (500 feet for raptors and listed species), shall be postponed until the nest is vacated and all juveniles have fledged, as determined by the avian biologist. This buffer shall be established in the field by highly visible means. The avian breeding season for this Project is considered January 1 through August 31. The typical breeding season for most birds in this general area would be approximately February 1 through August 31. However, as there is possibility for some early nesting species to occur within, or in proximity to, the Project site (e.g., certain raptor and hummingbird species), the -151-

avian breeding season is designed to cover all nesting birds on the Project site that would be protected by the MBTA and resource agency regulations.
The qualified avian biologist shall be present and monitor vegetation removal, and shall have the authority to stop work to protect nesting birds or other biological resources, or if violations of laws or permit conditions would occur. If it is necessary to perform work inside the avoidance buffer, the biological monitor must be present and will ensure that construction activities are not causing significant disturbance to any active nests. The monitor shall impose any necessary restrictions, including limiting work durations, installing visual barriers, or prohibiting work within the avoidance buffer, to ensure adequate the success of the nest and compliance with federal and state law. (Bio-5) 112. Prior to the issuance of grading permits for an individual lot, the individual lot owner shall submit a Building Pad Constraints Exhibit for City review and approval. The Building Pad Constraints Exhibit shall show how the proposed residence preserves scenic resources and vistas by identifying how the building pads and access driveways for each lot minimize development within areas of one or more of the following attributes:
a) Moderate to steep sloping land (11 % slope or greater). b) Applicable drainage courses per the City Engineer, including but not limited to the FEMA-designated 100-year floodplain.
c) Within identified riparian areas. (AES-1)
113. Individual lot owners shall adhere to a "minimal grading" concept for the property, with circulation and drainage systems conforming to the existing contours of the land, and individual lots to be kept in their natural state to the extent feasible.
Minimal grading is a concept designed to minimize excavation and filling, with roadways conforming closely to the natural contours. (AES-2) 114. Individual lots adjacent to Oak Glen Road shall incorporate the design elements set forth in the Transportation Element of the General Plan. The General Plan states that since Oak Glen Road acts as a gateway to the apple -growing tourist destination of Oak Glen that the following design elements be incorporated into the Project design:
• Deciduous flowering, tree massings;
• Evergreen backdrop trees in windows;
• Split -rail fencing; and
• Appropriate signage and hardscape feature with a rustic theme. (AES-3) 115. Design elements of the Project are required to be consistent with standards identified in the General Plan Urban Design Element Landscape Guidelines, as amended from time to time. (AES-4)

118. Although the cultural resources survey was conducted in as thorough a manner as possible, there is the possibility that previously unidentified archaeological and paleontological resources could be discovered during Project construction. Prior to the issuance of grading permits, the developer or Project contractor will be responsible to retain the services of a qualified archaeologist and/or paleontologist who shall monitor grading activities during Project construction for all of the roads and common areas. In the event that any prehistoric or historic -period cultural resources (chipped or ground stone lithics, animal bone, ashy midden soil, structural remains, historic glass or ceramics, etc.) are discovered during the course of construction when a monitor is not present, the Project contractor will be responsible to cease all work in the vicinity and wait until the archaeologist and/or paleontologist has evaluated the significance of the find and has removed the resource as required by law. In addition, as individual parcel owners develop a parcel, each owner shall retain archaeological and paleontological services to monitor construction activities of each individual parcel. (CR-3)
119. If human remains are encountered, State Health and Safety Code Section 7050.5 states that no further disturbance shall occur until the County Coroner has made necessary findings as to origin and disposition of the remains pursuant to PRC Section 5097.98. The following actions must be taken by the property owner or Project contractor or proponent in the event that human remains are discovered on private or State land:
a) Stop work immediately and contact the County Coroner. The County Coroner must be notified immediately of the find.
b) The Coroner has two working days to examine human remains after being notified by the responsible person. If the remains are determined to be prehistoric or Native American the coroner will notify the NAHC within 24 hours.
c) The NAHC will immediately notify the person it believes to be the most likely descendent (MLD) of the deceased Native American. With the permission of the landowner or agency, or an authorized representative, the MLD may inspect the site of the discovery.
d) The MLD makes recommendations to the owner, or representative, for the treatment or disposition, with proper dignity, of the human remains and grave goods.
e) If the NAHC is unable to identify a descendent, the descendent identified fails to make a recommendation, or the landowner rejects the recommendations of the descendent and the mediation provided for in subdivision (k) of Section 5097.94 fails to provide measures acceptable to the landowner, the landowner or his or her authorized representative shall reinter the human remains and items associated with the Native American burial(s) with appropriate dignity on the property in a location not subject to further subsurface disturbance. 120. Engineering noise controls — to the extent practical, locate stationary and/or continuous major noise producers (e.g., air compressors, generators) as far as possible from the potentially impacted residential receiver. In other words, gain more naturally occurring noise attenuation via increasing distance between source and receiver. (NOISE-1)
121. Equipment noise controls — there are a number of practices that can be employed as follows:
a) Ensure that all engine -driven vehicles and stationary equipment feature factory -approved exhaust silencers/mufflers that are in proper working order. b) Minimize idling time for engine -driven operating vehicles that have the engine running between periods of mobility and/or work -intensive activity. For instance, with respect to its influence on an hourly Leq value, reducing the time that a vehicle or piece of equipment operates by half (e.g., 10 minutes instead of 20 during a given hour) generally enables a 3 dB reduction of noise emission associated with that source (since it is contributing half as much acoustical energy), which can help lower the overall hourly Leq value representing the sound environment at a studied location. c) As certain equipment may have a "louder" side or facing (e.g., an air intake that produces the most noise), position the equipment on -site so that said louder facings are directed away from the noise -sensitive receiver. (NOISE- 2)
122. Beyond noise mitigation measures NOISE-1 and NOISE-2, proper design and installation of temporary construction noise barriers may need to be implemented to reduce construction noise. The following are recommended:
a) Use of quiet construction equipment when possible.
b) Operational limitation within the noise ordinance day time hours. c) Use of temporary sound barriers.
d) When loud equipment is required for construction, noise baffles should be used to reduce impacts.
e) When the construction activity of concern has concluded and moved to sufficiently more distant Project locations, thus increasing the distance between it and the Noise Sensitive Receptor, the need for temporary noise barriers would correspondingly diminish or be eliminated altogether. (NOISE- 3)
123. Developer shall consider options for and implement measure(s) such as an earthen berm or wall of sufficient height and extent between 11114 Cherry Croft Drive and the primary roadway traffic noise sources (e.g., engine exhaust and tire/pavement contact) on Jefferson Street so that 4 dBA of Jefferson Street traffic noise reduction as quantified at 11114 Cherry Croft Drive can be achieved. -155-

In response to the City of Yucaipa Planning Division Project Notice dated September 24, 2015 concerning case #15-061/TTM 19974 Applicant: Meridian Land Development:
I view this notice as a legal instrument to attempt to remove my right as a citizen of Yucaipa to speak now within the 10 days allotted to me or forever hold my peace. An attempt to quash my right to seek legal remedy for anything that I might fail to mention in this writhing. Not just my rights but the rights of all the people of Yucaipa to address the aforementioned case. Let me be very clear that I am OPPOSED to any tentative track map being recorded without completely being vetted through the public process. Including but not limited to a full seasonal environmental impact report (EIR). I refute the notion that you may proceed with any mapping at all at this time based on a preliminary report gathered by the developer at his expense. I, by this writing, reserve the right to seek legal remedy / sue, as an individual or as a collective body of Yucaipa Citizens, the entity / entities individually, collectively or in any combination thereof: The City of Yucaipa, their assigns, agents and employees, Meridian Land Development / John Weldy, their assigns, agents and employees, the contractor that runs the building department ACC, their assigns, agents and employees. for any and all matters that may arise from the case number mentioned above. For any of, but not limited to, the list of reasons which follows:
#1. UNLAWFUL NOTICE; Ten day response time. No certified or registered mail. My neighbor received no notice at all.
#2. Recording a TTM; Without regard for the people of Yucaipa, who, for the most part, know nothing of your intentions and have not reviewed your plans for the historic Casa Blanca Ranch. #3. THE VALIDITY OF THE PRELIMINARY EIR REPORT; This report is cursory at best and subject to prejudice and bias. The subject property of this notice is the most environmentally sensitive property left in Yucaipa.
#4. EQUAL TIME; The City of Yucaipa has used paid employee, Joe Lambert and others to meet every Thursday for who knows how many occasions and at what length. If the City wishes to continue the practice of courting large developers then it must provide the same amount of time with the same paid employees to listen to the concerns of the people. I personally witnessed Joe Lambert pitch the original proposal to the planning committee, field questions and advocate on behalf of the developer.
#5 UNLAWFUL CENSURE; While in city council chambers, in front of a crowded room of citizens, during my three minute public comment, I was told I could not say what I was saying on the subject of the EIR. I was called out by a council member and rebuked by the mayor. #6. INTENT TO DEGRADE A WILD LIFE CORRIDOR: So designated and posted by the US Forestry Service.
#7. ON BEHALF OF MIGRATING FOUL, ENDANGERED SPECIES AND PROTECTED FLORA. #8. NEW WATER METER HOOK-UPS IN A DROUGHT RIDDEN CALIFORNIA, #9. TRAFFIC RESULTING FROM THIS DEVELOPMENT; Especially on Oak Glen Rd. #10. CONFLICT OF INTEREST; I dismiss the notion that John Weldy can act in good faith as the head of a major land development company and also head the San Bernardino County Planning Commission.
#11. COLLUSION, COERCION OR CRIMINAL ACTS.
#12. ANYTHING I MAY HAVE OVERLOOKED IN MY HASTE.

RE: Project Notice
Case Number: 22-074/EXT
Applicant: Deodara LLC
Location 36600 Oak Glen Road APN: 0321-101-02, -12, -26 COMMENTS:
We purchased our 10 acre property 41 years ago and were required at the time to pay for sewers that were never installed for us to hook up to. The zoning at that time by the county of San Bernardino was 21/2 acre parcels.
Upon the incorporation of the city of Yucaipa our zoning was changed to 5 acre parcels. At that time we were given a commitment that when development occurred gas and sewer lines would be required by the developer and available for our use. Furthermore, if zoning is changing on the north side of Oak Glen Road then in the interest of a harmonious neighborhood zoning plan our zoning on the south side of Oak Glen Road ought to least revert back to the 21/2 acre parcels that was in effect in 1981. &cy I4037-
