RECOMMENDATION:
That the City Council approve and authorize the City Manager, or his designee, to execute the acquisition of replacement playground equipment for Community Center Park from Miracle Recreation Equipment Co. in the amount of $155,586.93.
BACKGROUND/DISCUSSION:
The existing playground equipment at Community Center Park is approximately 20 years old and has exceeded its useful life. In August of 2022, portions of the playground equipment were closed for public use and one swing set had to be removed due to its deteriorating condition. Staff is recommending the replacement of the equipment with new playground equipment. Staff has requested quotes from several vendors for replacement playground equipment. In response, three quotes were received from two vendors. One vendor provided quotes for two different types (Option 1 and 2) of playground equipment. The following table includes the three (3) quotes received:

After reviewing the quotes provided and considering the proposed equipment models, configurations and play features, staff is recommending the purchase of the equipment from Miracle Recreation Equipment Co. There are two options proposed by Miracle Recreation Equipment Co., including a structure for 2 to 5 year old kids and one for 5 to 12 year old kids. The larger structure includes a two- story structure, three different types of slides, multiple climbing equipment, and a gymnastics outrigger feature. The smaller playground provides easier access for younger children with multiple slides, stairs, and ladders. Staff believes that the play features included in these models are appropriate for park users at Community Center Park. Therefore, staff is recommending that City Council -21-

approve the acquisition of replacement playground equipment from Miracle Recreation Equipment Co. in the amount of $155,586.93.
FISCAL IMPACT:
The total cost for the proposed equipment/installation is in the amount of $155,586.93. Funding in the amount of approximately $30,000 is available in the adopted FY2022/2023 Capital Improvement Program (CIP) for Parks Playground Equipment Maintenance. The adopted FY2022/2023 Budget also includes funding in the amount of $140,000 specifically for Park Playground Equipment Replacement in the Capital Projects Fund (Fund 35) for a total amount available for this project of $170,000. Utilizing the amount of $155,586.93 for the proposed equipment leaves a remaining balance in the amount of $14,413.07. Consequently, there is sufficient funding available to accommodate staff s recommendation.

EXCLUSIONS: This Contract only covers the cost of equipment, materials and services that are clearly outlined in the Scope of Work. All other equipment, materials and/or services that are not clearly outlined in this quotation are excluded. Exclusions include, but are not limited to the following:
1. Additional services, site work (demo, hauling, grading, drainage, site drains,curbing, border, sidewalks, pavement, striping, etc.), playground safety surfacing, site materials, site furnishings, ADA accessible path of travel, payment and performance bond, builders riskinsurance, furnishing plans, obtaining permits, dealing with inspections and/or permit agencies, engineering calculations, stamped engineered or architectural drawings, etc.
2. Inspection costs, testing and outside testing agencies, CPSI Inspection/audit/report,surfacing HIC test, survey work of any kind, fencing, swpps, barricades, traffic control,flagging, erosion control, dust control, removal of hazardous materials or contaminated soils, digging through rock and rocky soils.
3. Customer shall hire a utility locating service to mark all underground utilities prior to the start of our work, in order to minimize any damage to utilities. Modifications and/orrepairs to any existing or damaged utilities as a result of this work is excluded. If owner would like us to hire a utility locating company, additional cost will be $1,000. Initial here to authorize this additional service
4. Customer shall be responsible for keeping traffic away from the PIP rubberized surfacing area for at least 24 hours after it is poured so that surface can cure properly. PIP must becured for a minimum of 2 weeks before any testing is performed.
5. Additional move -in costs, if required (only one move -in cost is included in this quote),dealing with unforeseen conditions and extra work required as a result of these conditions and anything else that is not clearly outlined in this Contract. See Exhibit A, Terms andConditions for a description of Unforeseen Conditions.

Any questions concerning a contractor may be referred to the Registrar, Contractors' StateLicense Board, P.O. Box 26000, Sacramento, California 95826.
This Contract is executed between Pacific Play Systems, Inc., a California corporation and Customer (also referred to as Owner), identified in the Customer section of this Contract.Either Customer or Pacific Play Systems, Inc. may be referred to as Party, together asParties. The purpose of this Contract is for Pacific Play Systems, Inc. to provide Customer with equipment, materials and/or services as outlined in the Scope of Work section of this Contract in exchange for the sum of money as outlined in this Contract.
By signing below, both Parties acknowledge that they are entering into a legally binding Contract, which includes Exhibit A. Customer acknowledges the receipt and review of Exhibit A (Terms and Conditions) which shall be made a part of this Contract and enforceable to the full extent allowed by law.
