SUBJECT: Change Order No. 2 —New City Yard Tenant Improvements —Project No. 11167 RECOMMENDATION:
That City Council approve Change Order No. 2 to the contract with Three Peaks Corporation for the New City Yard Tenant Improvements — Project No. 11167 in the additional amount of $5,184.24 for a revised total contract in the amount of $610,001.38.
BACKGROUND:
In March 2011, City Council approved the preparation of a Specific Plan and an Environmental Impact Report (EIR) for the development of the Wilson Creek Business Park and Flood Control Basin Project.
On May 13, 2013, City Council approved and authorized the Mayor to execute an MOU between the San Bernardino County Flood Control District (SBCFCD) and the City for the Wilson III Basin Project (Basin Project). The MOU detailed the partnership efforts between the City and SBCFCD, including the understanding that the SBCFCD-owned property, which would not be required for the Basin Project, would be deemed "surplus" property and would be transferred to the City for sale as SBCFCD's contribution towards the Basin Project.
On July 11, 2016, City Council selected the "preferred" land use alternative for the Oak Glen Creek Specific Plan as primarily residential with some Innovation Center zoned parcels. The Innovation Center parcels/areas are located on the north and east sides of the Oak Glen Creek Specific Plan area and are designated for the relocated City Public Works maintenance yard.
On February 26, 2018, City Council adopted Resolution No. 2017-47, approving the Oak Glen Creek Specific Plan, including the Wilson III Basin and the New City Yard Project.
The New City Yard Project is being completed in phases that include multiple construction contracts.
On July 13, 2020, City Council awarded a construction contract to Three Peaks Corporation to complete the New City Yard site grading. The grading work has been completed, and the Notice of Completion was filed on May 24, 2021.

DISCUSSION:
On April 11, 2022, City Council awarded and authorized the Mayor to execute a contract in the amount of $582,444 with Three Peaks Corporation of Calimesa, CA, for the New City Yard Tenant Improvements — Project No. 11167 (City Yard TI) and authorized a contract contingency in the amount of $23,300 and the amount of $12,230 for contract administration, materials testing, and permitting for a total construction budget of $617,974. Tenant Improvement construction began in May of 2022 and is currently underway.
Staff has administratively approved Change Order No. 1 in the amount of $22,373.14, including the installation of required gable vents, additional drywall, and a T-bar ceiling in the larger building that will serve as the Public Works operations office and City record storage facility. The building includes office space, restrooms, an employee break room, storage rooms, and a small meeting/conference room.
During the recent summer months, temperatures inside the existing smaller storage building, which provides for a work area in addition to equipment/materials/supplies storage, have been measured -117-

to be higher than anticipated, and therefore staff has determined that a ventilation and cooling system in a 40' x 40' steel building would be beneficial to staff working in the building and will also help prolong the life of equipment/materials/supplies stored in the building that may be affected by the high temperatures. Staff is recommending City Council approve Change Order No. 2 in the amount of $5,184.24 to install a ventilation and cooling system (including electrical and water) in the smaller 40' x 40' building.
