SUBJECT: Award of Contract — Adams Street and Avenue B Street Sidewalk Improvements CDBG Project —Project No. 11089
RECOMMENDATION:
That City Council:
1. Award and authorize the Mayor to execute a contract in the amount of $547,635.00 with Three Peaks, Corp. of Calimesa, CA for the Adams Street and Avenue B Street Sidewalk Improvements CDBG Project — Project No. 11089; and
2. Approve the amount of $55,000 for construction contract contingency and the amount of $43,000 for construction contract administration, survey, testing and inspection for a total project construction budget in the amount of $645,635.00; and
3. Authorize the City Manager, or his designee, to administer the terms of the contract; and
4. Amend the FY2022/2023 Capital Improvement Program by allocating the amount of $50,502 in TDA Article 3 Grant Funds for the Project; and
5. Amend the FY2022/2023 Capital Improvement Program by allocating the amount of $110,133 in unprogrammed City of Yucaipa CDBG Grant Funds for the Project; and
6. Approve the Plans and Specifications prepared for the Project.
BACKGROUND/DISCUSSION:
The approved FY2022/2023 Capital Improvement Program (CIP) includes multiple projects funded through the Community Development Block Grant (CDBG) program. The CDBG grant program provides funding for pedestrian and transit related improvements such as sidewalk, curb ramps, bus stop improvements and curb/gutter. In 2019, staff recommended, and Council approved the submittal of an application requesting CDBG funding to design and construct infill curb, gutter and sidewalk on Adams Street, from Yucaipa Boulevard to Avenue B. application requesting the amount of $106,758 in CDBG funds was subsequently approved. In 2020 and 2022, staff recommended, and Council approved two applications for an additional $137,000 and $216,358 in CDBG funds, respectively, with the first application expanding the Project boundary to include improvements on Avenue B from Adams Street to 1st Street. Those applications were approved, expanded the Project boundary and further funded the construction of the expanded Project.
In 2015, staff recommended, and City Council approved an application for TDA Article 3 Grant funding from the San Bernardino County Transportation Authority (SBCTA) for bus stop landing and sidewalk improvements for the Omnigo Route 310 bus route. This route traverses a portion of the uptown area with stops along Adams Street and Avenue B within the Project boundary. On April 6, 2016, SBCTA approved the City's application and awarded the City $50,502 in TDA Article 3 Grant Funds.
The Adams Street and Avenue B Street Sidewalk Improvements CDBG Project — Project No. 11089 (Project) consists of constructing curb, gutter, sidewalk, bus stop improvements, and concrete drive approaches along the east and west side of Adams Street between Yucaipa Boulevard and Avenue B, and on the north side of Avenue B from Adams Street to I` Street.
The Project is included in the adopted FY2022/2023 CIP and is consistent with the City's General Plan Circulation Element.
On August 31, 2022, the Project was advertised for construction bids. On September 27, 2022, four (4) sealed bids were received and opened as follows:

The Engineer's Estimate for the Project is $490,000. Three Peaks Corp. is the apparent low bidder for the Project with a bid in the amount of $547,635. Staff has reviewed the bid and compared it with current market bid prices and determined that the bids received are consistent with the current construction market for federal grant projects. Staff has also reviewed the apparent low bidder's bid documents and determined that they meet the contract specifications for the Project.
Three Peaks Corp. has completed previous similar work for the City of Yucaipa and other public agencies and their work has been deemed satisfactory. As a result, staff recommends that City Council award a contract in the amount of $547,635 to Three Peaks Corp. for this Project.
To fully fund the construction of the Project, staff recommends that Council amend the FY2022/2023 CIP by allocating the amount of $50,502 in TDA Article 3 Grant Funds for the Project. Staff also recommends that Council amend the FY2022/2023 CIP by allocating the amount of $110,133 in City of Yucaipa unallocated CDBG Grant funds for the Project. In order -97-

to allocate the unallocated CDBG grant funds to the Project, the City has submitted a formal request to the San Bernardino County Community Development and Housing (CDH, the administering agency of the CDBG program), and has received formal approval from CDH.

PROJECT: Adams Street and Avenue B Street Sidewalk Improvements CDBG — Project No. 11059 WITNESSETH, in this consideration of their covenants, the parties hereto agree as follows:
The contract documents for the Project shall consist of the Notice Inviting Sealed Bids, Instructions to Bidders, Proposal, General Specifications, Standard Specifications, Special Provisions, Plans, and all referenced specifications and appendices; together with this Agreement and all required bonds, insurance certificates, permits, notices, and affidavits; and also including any and all addenda or supplemental agreements clarifying, amending, or extending the work contemplated as may be required to insure its completion in an acceptable manner (collectively, the "Contract Documents"). The Contract Documents are made a part hereof as though fully set forth herein.
In consideration of such work, City agrees to pay Contractor and Contractor agrees to accept the sum of Five Hundred Forty -Seven Thousand, Six Hundred Thirty -Five Dollars ($547,6351 in the manner provided in the Contract Documents and subject to adjustment provided therein.
Concurrently with the execution of this Agreement, Contractor shall file with the City the bonds and certificates of insurance specified in the Contract Documents and subject to adjustment provided therein.
This Contract shall not be assigned without the written permission of the City Council.
