CITY OF YUCAIPA

AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Fermin Preciado, Director of Development Services/City Engineer 7e Benjamin Matlock, Planning Manager/City Planne
Madeline Jordan, Assistant Planner
FOR: City Council Meeting of October 24, 2022
SUBJECT: Shaoul Levy —Levy Rental Senior Housing Development (Case Nos. 21- 084/CUP/DBA & 21-094/CUP/DBA): A Density Bonus Agreement to construct a sixty-two (62) unit rental Senior Citizen Housing Development across two (2) project sites approved as Case No. 21-084/CUP/DBA for a Conditional Use Permit and Density Bonus Agreement for the development of a thirty (30) unit age - restricted project for individuals who are 55 years or older located at APN: 0319- 121-24 and Case No. 21-094/CUP/DBA for a Conditional Use Permit and Density Bonus Agreement for the development of a thirty-two (32) unit, age -restricted housing project for individuals who are 55 years or older located at APN: 0319-012- 40 (collectively, the "Project").

RECOMMENDATION:

That the City Council approve the attached Density Bonus Agreements (DBAs) for Case Nos. 21- 084/CUP/DBA & 21-094/CUP/DBA.

BACKGROUND/DISCUSSION:

In order to qualify for a density bonus request consistent with state law, the applicant had submitted their density bonus request for a sixty-two (62) unit rental Senior Citizen Housing Development that is ultimately developed and operated across two (2) affiliated sites. As further discussed in each site site -specific DBA (attached), it should be noted that the operation of each site shall be contingent on occupancy and operation of the other affiliated site, as the development of both sites is necessary to provide a qualifying senior project consistent with state law, which combined is referred to as the Levy Rental Senior Housing "Project." These DBAs will set forth the reporting requirements and covenants that are necessary to ensure that the target senior units associated with the Project remain available as intended by the original density bonus request.

Division 3, Chapter 1, Article 7 of the City's Development Code contains provisions for processing density bonus projects, which are designed to provide incentives for the production of housing for very low-income, low-income, moderate -income, and senior households in accordance with State Law, by allowing additional units to offset the costs of providing affordable housing. Pursuant to the City's Development Code, a 100% increase in density is permitted for senior housing projects; however, before the Project is constructed, a formal Density Bonus Agreement (DBA) is required to be approved by the City Council. The concurrent filing of a DBA for each site -specific entitlement (Case No. 21-084/CUP/DBA & Case No. 21-094/CUP/DBA) is identified in the Conditions of Approval, and will set forth the reporting requirements and covenants that are necessary to ensure -152-

that the target units remain available as intended by the density bonus request submitted by the applicant.

At the regular City Council Meeting of October 22, 2018, the City Council provided preliminary approval of draft DBA template language, applicable forms, and their content to satisfy one of the permitting requirements of a density bonus application pursuant to Section 83.010735 of the City's Development Code. Two different draft agreements were presented: one agreement provided language specific to a traditional "for -rent" senior housing project, and one agreement provided language for a "for -sale" project. Both agreements were established to ensure that future projects maintain compliance with age restrictions to qualify as senior housing projects, and additionally to help streamline and expedite timelines for these future projects. The draft DBA for a "for -rent" senior housing Project was utilized to prepare the two (2) following site -specific DBAs (attached).

At the regular Planning Commission Meeting of March 2, 2022, the Planning Commission approved Case Nos. 21-084/CUP/DBA & 21-094/CUP/DBA. It should be noted that Case No. 21- 084/CUP/DBA, which is for the development of thirty (30) age -restricted senior housing units located at APN: 0319-121-24, also included, a Major Variance to permit a 43 percent reduction in the required parking, resulting in 34 spaces in lieu of 60 spaces, and finally a Minor Variance for the reduction of the rear yard setback along the southern property line to permit a setback of 14 feet in lieu of 15 feet.

Case No. 21-084/CUP/DBA will provide two-story modular duplex units buildings that share a connected wall, while Case No. 21-094 will provide two (2)-story modular duplex units, where one (1) unit is located on the ground floor, and the other is located above it as a second story unit. Each site -specific entitlement shall have units which provide a minimum of 900 square feet and two (2) bedrooms. Private unit amenities for all 62-units will include: air conditioning, oversized closets, and decorative doors that also have a deadbolt and peephole. Additionally, the two (2) affiliated sites will provide sidewalks, open space, and common area landscaping, including barbeque islands and shade structures for the residents who reside at either of the affiliated Senior Housing Project sites.

As noted in the staff reports and Conditions of Approval for the approved entitlements, the applicant would be required to record and execute DBAs for Case No. 21-084/CUP/DBA & Case No. 21- 094/CUP/DBA concurrently.

The DBAs include provisions to ensure that the Project qualifies as a Senior Housing Project consistent with state law, that the site -specific developments comply with age restrictions, and that they additionally both provide the appropriate multi -family site amenities and individual unit amenities pursuant to Section 88.0215 and Section 88.0210 of the City's Development Code across the two (2) affiliated sites. Now that the applicant has submitted construction plans to the Building and Safety Department for the site -specific entitlement, Case No. 21-084/CUP/DBA, this process is simply a ministerial action to meet the previously approved entitlement's Conditions of Approval for concurrent filing of the DBAs.

FISCAL IMPACT:

There is no fiscal impact to the City's General Fund as a result of this proposed action. -153-

AGREEMENT
NOW, THEREFORE, the parties hereto agree as follows:

Definitions. In this Agreement, the following terms shall have the following meaning:
a. "City" is the City of Yucaipa, California.
b. "Project" is the development described in Recital D above.

C. "Qualified Occupant" shall mean households consisting of a person who is fifty- five (55) years of age or older and any qualified permanent residents under the applicable provisions of California Civil Code Section 51.3 and the federal Fair Housing Act (except to the extent the Project utilizes federal funds whose programs have more stringent definitions for senior projects, in which case those definitions will apply).

The City and the Developer hereby declare their specific intent that the covenants, reservations and restrictions as set forth herein shall be deemed covenants running with the land and shall encumber and "run with" the Site and be binding upon the Developer's successors and assigns and successor to any interest in the Project.

Each and every contract, deed or other instrument hereinafter executed, covering or conveying the development or any portion thereof shall conclusively be held to have been executed, delivered and accepted subject to the covenants, reservations and restrictions expressed in this Agreement, regardless of whether such covenants, reservations and restrictions are set forth in such contract, deed or other instrument.
