CITY OF YUCAIPA

AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Fermin Preciado, Director of Development Services/City Engineer Landon Kern, Assistant City Engineer VP L%'--
FOR: City Council Meeting of December 12, 2022
SUBJECT: Award of Contract — Professional Engineering Services for the Preparation of a Letter of Map Revision (LOMR) Application Package to FEMA for Wilson Creek RECOMMENDATION:

That City Council:

1. Award and authorize the Mayor to execute a contract with Albert Webb & Associates (Webb) of Riverside CA., in the amount of $51,750, for the preparation of a Letter of Map Revision (LOMR) application package to the Federal Emergency Management Agency (FEMA) for Wilson Creek as part of the Dunlap Boulevard Bridge Removal and Replacement Project — Project No. 11098; and

2. Authorize a contract contingency amount of $6,000 and the amount of $5,000 for staff time, contract administration/coordination for a total professional services budget in the amount of $62,750 for the project; and

3. Authorize the City Manager or his designee to administer the terms of the contract.

BACKGROUND:

On December 13, 2021, City Council awarded a contract to Wright Construction Engineering Corporation of San Marcos, CA for the Phase 1 Construction of the Dunlap Boulevard at Wilson Creek Channel Bridge Removal and Replacement Project (Project). The Project includes the construction of the new bridge foundations and bridge crossing at Wilson Creek, including road improvements. The Phase I improvements are substantially complete.

The proposed Phase 2 improvements will include the transfer of the existing utilities to the new taller and longer bridge structure, removal of the existing bridge and construction of channel improvements to transition into the new bridge. The taller and longer bridge structure will increase the storm water carrying capacity of Wilson Creek under Dunlap Boulevard. The benefits of this improvement will be described further in this report. Staff has applied for and is waiting for the issuance of the resource agency permits and an encroachment permit from the San Bernardino County Flood Control District to initiate the construction of Phase 2 by advertising this phase of work for construction bids. Staff will return to Council with a recommendation to award the Phase II construction contract at a future meeting in early 2023. -430-

DISCUSSION
The Project is an important drainage infrastructure project that will remove a significant number of properties in the City's Dunlap area from the Federal Emergency Management Agency (FEMA) designated floodplain/floodway and is included in the adopted FY2022/2023 Capital Improvement Program (CIP). The properties in the City designated by FEMA as being in the floodplain/floodway have certain restrictions that prohibit the development of these vacant properties and expansion/additions to existing structures on developed properties. In addition, properties within the floodplain/floodway that have a mortgage or similar financial obligations are required by many lenders to pay flood insurance premiums.

With the construction of the Oak Glen Creek Basins Project in 2007, the construction of the bridge (low water crossing replacement) at 10 h Street over Wilson Creek, both of which were funded primarily by grant funding with some partnership funding as well, and the update and adoption of the City's Master Plan of Drainage study document in 2012, the City initiated the Letter of Map Revision (LOMR) application process with FEMA to revise their designation of the floodplain/floodway in the Dunlap area. The City's application indicated that, with the construction of the drainage/flood control projects, and the updating of the MPD mentioned above, the drainage systems in the Dunlap area were significantly improved to convey the 100- year storm event drainage flows through the area. This would effectively reduce the risk of flooding in certain portions of the Dunlap area and remove properties from the FEMA designated floodplain/floodway. The City's LOMR application was approved by FEMA in 2014 and the FEMA floodplain/floodway map was subsequently revised resulting in the removal of 286 properties from the floodplain/floodway. This removed the development and building restrictions from these properties allowing property owners to develop and/or improve their properties resulting in increased property values and provide additional economic development opportunities in the Dunlap area. This effort facilitated the development of several private development projects such as the Yucaipa Gateway Project (AM/PM fuel station/La Quinta Hotel), OPAL Hotel Project on Oak Glen Road and several residential projects in the Dunlap area. Public infrastructure projects such as the Dunlap Neighborhood Park were also able to be developed as a result of that LOMR process.

After the successful completion of the 2014 LOMR process, several properties in the Dunlap area adjacent to Wilson Creek channel remained in the FEMA designated floodplain and floodway due to the Wilson Creek at the Dunlap Boulevard bridge crossing. The existing bridge crossing is "under sized" and does not provide sufficient drainage capacity for the Wilson Creek channel to convey storm flows under the bridge.

By 2015, the City had completed additional drainage/flood control projects along Wilson Creek and the FY2015/2016 Capital Improvement Program adopted by the City Council at the time included a project to improve Wilson Creek channel at the Dunlap Boulevard Bridge. As a result, City Council awarded a professional engineering services contract to WEBB & Associates (WEBB) to prepare a Conditional Letter of Map Revision (CLOMR) report for Wilson Creek Channel through the Dunlap area. This report would be incorporated into an application to -431-

FEMA that would set the stage for another LOMR application to further revise their designation of the floodplain/floodway in the Dunlap area effectively removing additional properties from the FEMA designated floodplain/floodway. In 2017, FEMA approved the City's CLOMR application recognizing that, once the existing Dunlap Boulevard Bridge was removed and replaced with a taller and longer bridge to enhance the Wilson Creek channel storm water conveyance capacity, the City could once again submit a LOMR application to revise the FEMA floodplain/floodway designation in the area. The taller and longer replacement bridge would increase the drainage capacity of the channel, while maintaining vehicular (one way) and pedestrian access across the channel.

Dunlap Boulevard and the Dunlap Boulevard bridge currently provide access to several properties located between Oak Glen Road and Wilson Creek Channel. The existing bridge also serves as a utility corridor for water, gas, and telecommunication facilities over Wilson Creek.

The properties located between Oak Glen Road and the Wilson Creek Channel are currently being developed as a commercial center (Yucaipa Gateway Center). The Conditional Use Permit for this development project approved by the Planning Commission requires a third point of access to a public street in addition to the current existing access points on Oak Glen Rd and 14th Street. At the February 23, 2019, City Council Meeting, Council approved a development agreement between the City of Yucaipa and the developer of the Yucaipa Gateway Center. The agreement includes an obligation for the City to complete the removal and replacement of the Dunlap Boulevard bridge. The Project will satisfy both requirements. As part of the Yucaipa Gateway Project, a gas station, car wash and convenience store were completed in 2019 as the first phase of development. The developer of the property is currently constructing phase two, which includes a hotel. At build out, the Yucaipa Gateway Project is estimated to provide in excess of $750,000 per year to the City's General Fund in sales tax, property tax and Transient Occupancy Tax (TOT) revenues.

In addition to increasing the storm water conveyance capacity of Wilson Creek, the removal and replacement of the Dunlap Boulevard Bridge will maintain the public access on Dunlap Boulevard across Wilson Creek, provide a third access point to the commercial center and preserve the utility corridor across the channel for the existing utilities serving the local area as well as the region. It is important to note, the Project will also provide pedestrian access to the existing multi -use trail along the north side of Wilson Creek from the south side of the channel.

The Wilson Creek multi -use trail extends east along the Wilson Creek Channel from this location and ultimately connects to the Crafton Hills and Oak Glen Road trail network near the Yucaipa Regional Park.

Staff distributed a Request for Qualifications/Proposals (RFQ/RFP) for professional engineering services for the Preparation of a Letter of Map Revision (LOMR) Application Package for submittal to FEMA for the study area of Wilson Creek Channel from Yucaipa Boulevard to the I- 10 Freeway. Five (5) qualifications/proposals were received prior to the due date from the following consulting firms:

An evaluation panel comprised of City staff reviewed and evaluated the qualifications/proposals submitted based on the City's administrative qualifications -based review process. All five consulting firms were found to have the experience and expertise to perform the services required. Based on the rankings of the panel, Webb was determined to be the most qualified. This determination was based on their qualifications, experience and approach to the to the services being requested.

It is also important to note that the key staff proposed by WEBB for the requested services also completed the engineering design for other drainage and flood control projects in the City, such as the Wildwood Creek Basins Project, including the CLOMR application approved by FEMA in 2015 for Wilson Creek. That CLOMR effort was the first step in the process to complete the LOMR application that is the subject of the proposed professional services contract.

days before the termination is to be effective. Consultant may terminate this Agreement at any time, at will, for any reason or no reason, after giving written notice to City at least 60 calendar days before the termination is to be effective.

B. _Obligations upon Termination. Consultant shall cease all work under this Agreement on or before the effective date of termination specified in the notice of termination. In the event of City's termination of this Agreement due to no fault or failure of performance by Consultant, City shall pay Consultant based on the percentage of work satisfactorily performed up to the effective date of termination. In no event shall Consultant be entitled to receive more than the amount that would be paid to Consultant for the full performance of the Services required by this Agreement. Consultant shall have no other claim against City by reason of such termination, including any claim for compensation.

13. Force Majeure. Consultant shall not be liable for any failure to perform its obligations under this Agreement if Consultant presents acceptable evidence, in City's sole judgment, that such failure was due to acts of God, embargoes, inability to obtain labor or materials or reasonable substitutes for labor or materials, governmental restrictions, governmental regulations, governmental controls, judicial orders, enemy or hostile governmental action, civil commotion, fire or other casualty, or other causes beyond Consultant's reasonable control and not due to any act by Consultant.

14. Default.

A. Consultant's failure to comply with the provisions of this Agreement shall constitute a default. In the event that Consultant is in default for cause under the terms of this Agreement, City shall have no obligation or duty to continue compensating Consultant for any work performed after the date of default.

Consultant shall have ten calendar days after service upon it of the notice in which to cure the default by rendering a satisfactory performance. In the event that Consultant fails to cure its default within such period of time, City may, notwithstanding any other provision of this Agreement, terminate this Agreement without further notice and without prejudice to any other remedy to which it may be entitled at law, in equity or under this Agreement.

15. Notices. 16. Non -Discrimination and Equal Employment Opportunity. In the performance of this Agreement, Consultant shall not discriminate against any employee, subcontractor or applicant for employment because of race, color, religious creed, sex, gender, gender identity, gender expression, marital status, national origin, ancestry, age, physical disability, mental disability, medical condition, genetic information, sexual orientation or other basis prohibited by law. 17. Prohibition of Assignment and Delegation. Consultant shall not assign any of its rights or delegate any of its duties under this Agreement, either in whole or in part, without City's prior written consent. City's consent to an assignment of rights under this Agreement shall not release Consultant from any of its obligations or alter any of its primary obligations to be performed under this Agreement. Any attempted assignment or delegation in violation of this Section shall be void and of no effect and shall entitle City to terminate this Agreement. As used in this Section, "assignment" and "delegation" means any sale, gift, pledge, hypothecation, encumbrance or other transfer of all or any portion of the rights, obligations, or liabilities in or arising from this Agreement to any person or entity, whether by operation of law or otherwise, and regardless of the legal form of the transaction in which the attempted transfer occurs.

release of City from all claims and liabilities for compensation to Consultant for anything done, furnished or relating to Consultant's work or services. Acceptance of payment shall be any negotiation of City's check or the failure to make a written extra compensation claim within ten calendar days of the receipt of that check. However, approval or payment by City shall not constitute, nor be deemed, a release of the responsibility and liability of Consultant, its employees, subcontractors and agents for the accuracy and competency of the information provided and/or work performed; nor shall such approval or payment be deemed to be an assumption of such responsibility or liability by City for any defect or error in the work prepared by Consultant, its employees, subcontractors and agents.

21. Corrections. In addition to the above indemnification obligations, Consultant shall correct, at its expense, all errors in the work which may be disclosed during City's review of Consultant's report or plans. Should Consultant fail to make such correction in a reasonably timely manner, such correction may be made by City, and the cost thereof shall be charged to Consultant. In addition to all other available remedies, City may deduct the cost of such correction from any retention amount held by City or may withhold payment otherwise owed Consultant under this Agreement up to the amount of the cost of correction.

22. Non -Appropriation of Funds. Payments to be made to Consultant by City for services performed within the current fiscal year are within the current fiscal budget and within an available, unexhausted fund. In the event that City does not appropriate sufficient funds for payment of Consultant's services beyond the current fiscal year, this Agreement shall cover payment for Consultant's services only to the conclusion of the last fiscal year in which City appropriates sufficient funds and shall automatically terminate at the conclusion of such fiscal year.

23. Exhibits. Exhibits A and B constitute a part of this Agreement and are incorporated into this Agreement by this reference. If any inconsistency exists or arises between a provision of this Agreement and a provision of any exhibit, or between a provision of this Agreement and a provision of Consultant's proposal, the provisions of this Agreement shall control.

24. Entire Agreement and Modification of Agreement. This Agreement and all exhibits referred to in this Agreement constitute the final, complete and exclusive statement of the terms of the agreement between the Parties pertaining to the subject matter of this Agreement and supersede all other prior or contemporaneous oral or written understandings and agreements of the Parties. No Party has been induced to enter into this Agreement by, nor is any Party relying on, any representation or warranty except those expressly set forth in this Agreement. This Agreement may not be amended, nor any provision or breach hereof waived, except in a writing signed by both Parties.

25. Headings. The headings in this Agreement are included solely for convenience of reference and shall not affect the interpretation of any provision of this Agreement or any of the rights or obligations of the Parties to this Agreement. -11.445-

Section 2. Detailed Scope of Work
WEBB acknowledges the scope of work requested in the RFP, which consists of:
• FEMA Data Research- Obtain Effective Model and determine if there are any data gaps • LOMR Hydrology Calculations - Prepared and process updated hydrology for 10-50 100 and 500 Year frequency storm events
• FEMA Letter of Map Revision Application Package
• LOMR Exhibits
• FEMA LOMR Processing
• Meetings (6 Meetings)
However, based on our previous experience working with the City on this project, the following is the proposed scope to accomplish the objectives of the City.
• Review prior report and Effective Model
• Obtain As -Built Plans for three crossings and verify they are consistent with CLOMR Model - if there are changes we would have to update CLOMR Model
• FEMA Letter of Map Revision Application Package
• LOMR Exhibits
• FEMA LOMR Processing
• Meetings - (two Meetings)
Thoughts and considerations
• WEBB prepared the CLOMR - we have, and are familiar with, the Effective Model - very little ramp up time • There have been no significant changes in the watershed that will require the preparation of new hydrology. The Effective Hydrology has already been bought off by FEMA and we can use the same flow rates in the LOMR. Adding this task will just lengthen the approval time needed for the project • The 13th Street and Avenue D Low Water Dip Crossings have already been constructed. We will prepare the LOMR "as if" the Dunlap Boulevard Bridge Removal has already taken place. The application package will be prepared and ready to go pending the inclusion of "as -built" plans" in the submittal package • Monthly meetings are really not needed for this effort. A kick-off meeting and one other meeting are sufficient to coordinate and get the application prepared and submitted • From authorization to proceed, we can have a submittal package for review by the City within 1.5 months. After approval by the City, we can submit to FEMA once the As -Built Plan for Dunlap is finalized • FEMA has a 90-day statutory review period for the first submittal. It is anticipated we would have FEMA approval 90-days after the return of plan check comments
