RECOMMENDATION:
That City Council:
1. Approve a Purchase and Sale Agreement with Denys J. Merriman, Janice H. Merriman, Michael L. McGeorge and Emily A. McGeorge, (APN 0319-233-23) for the acquisition of a 10,454 square foot permanent easement for right of way purposes and the construction of the County Line Road MSRC Grant Funded Project for an amount not to exceed $10,400; and
2. Approve an expenditure up to the amount of $3,000 for closing costs associated with the proposed purchase and sale agreement and the amount of $2,300 for right of way acquisition coordination/staff time for a total cost in the amount of $15,700 for the acquisition of the permanent right-of-way easement; and
3. Authorize the City Manager, or his designee, to execute the necessary documents to complete the acquisition process.
BACKGROUND/DISCUSSION:
County Line Road is a major arterial road which borders both the City of Yucaipa and the City of Calimesa. The existing interchange at the Interstate 10 Freeway and County Line Road provides access to and from the freeway for the citizens and business community from both cities.
Existing development along County Line Road includes both residential and commercial land uses. County Line Road is utilized not only by vehicular traffic but is also used by pedestrians and cyclists as well.
Vehicular traffic on County Line Road has continuously increased over the years and currently, the intersections between Calimesa Boulevard and Bryant Street are impacted during peak morning and evening commuting hours. Proposed commercial and residential developments currently being planned in both cities will further impact traffic along County Line Road. 410
City Council Meeting of January 9, 2023
Right -of -Way Acquisition - County Line Road MSRC Project, Project No. 11118
At the July 8, 2013 City Council Meeting, City Council approved the Citywide Miscellaneous Intersection Roundabout Study (Study) prepared by RBF Consulting. The Study identified strategic intersections along arterial streets including Yucaipa Boulevard, Avenue E, and County Line Road, in the City where vehicular traffic circulation would be improved and operate more efficiently in the long term with the construction of roundabouts. The Study also showed that potential single -lane roundabout intersections would improve operation and traffic flow along street segments between intersections along the arterial streets. As a result of the implementation of roundabout intersections into the City's General Plan Transportation Element, certain segments of the City's arterials would not require widening from two (2) lanes to four (4) lanes.
These intersection improvements reduced the need for street widening and significantly reduced the amount of right-of-way (and associated costs) and street improvements required to accommodate future traffic conditions along these corridors. Additionally, roundabout intersections introduce significant intersection safety enhancements for both pedestrians and vehicles and represents a cost savings to the City when considering the long-term maintenance costs associated with traffic signal equipment and utility costs.
In early 2017, discussions were held with the City of Calimesa regarding joint participation for the improvements on County Line Road in order to improve operation and traffic flow through the intersections and improve safety for pedestrians and bicyclists. Since both cities would mutually benefit from these improvements, an agreement was prepared in order to identify the responsibility and funding commitment of both cities for the various improvements along County Line Road. These improvements along County Line Road between Bryant Street and Calimesa Boulevard make up the County Line Road Transportation Corridor Project (Project). City Council approved a Fair Share Funding Agreement with the City of Calimesa for the Active Transportation Program (ATP) and Air Quality Management District - Mobile Source Reduction Committee (MSRC) grant funding at the March 12, 2018 City Council Meeting. City Council approved the SB 1 Local Partnership Program (LPP) Grant Funding Agreement with the City of Calimesa at the City Council Meeting of October 26, 2020.
The agreement identifies the City of Yucaipa's share of the grant funding in the amount of $1,986,000 and the local match contribution in the amount of $4,530,000 for the Project. The City of Calimesa's share of the grant funding is in the amount of $1,761,OOOand their local match contribution is in the amount of $1,892,750.
The agreement identifies the following obligations for the City of Calimesa:
• Serve as the lead agency for the Project soliciting Requests for Proposals and bids, as required, and awarding contract(s).
• Provide the services of their City Engineer for the purpose of certifying plans, providing cost estimates, inspections, maintaining all records and providing all reporting as required by the California Department of Transportation (Caltrans), • Obtain approval from Yucaipa for each bid package prior to bidding a phase of construction.
• Allow Yucaipa to inspect all work within the City of Yucaipa's jurisdiction during construction and as part of the overall final inspection of the work. 411
City Council Meeting of January 9, 2023
Right -of -Way Acquisition - County Line Road MSRC Project, Project No. 11118
• Obtain approval from Yucaipa before issuance of any change orders or stop work orders that could potentially affect Yucaipa's cost.
• Submit to Yucaipa, on a monthly basis, a status of the work completed to date accompanied by a detailed listing of expenditures of the current month and total spent to date. This will also include a fair share project invoice to Yucaipa as appropriate.
The agreement identifies the following obligations for the City of Yucaipa:
• Provide the services of its City Engineer for the purpose of certifying plans and as -built plans, reviewing cost estimates, inspections and records as required. • Prepare plans, specifications and cost estimates; and identify and acquire necessary right- of-way for the segment between Park Avenue and up to and including the 5th Street Intersection. (this segment of the project is all within the City of Yucaipa's jurisdiction) • Yucaipa shall deposit the amount of $653,500 to Calimesa within thirty (30) calendar days from execution of this Agreement by both Cities for Yucaipa's share of the cost of the environmental review, design/engineering, Caltrans Project approval processing and the preparation of construction bid documents.
• Pay invoices submitted by Calimesa for the construction phase of the project within thirty (30) days of receipt. Yucaipa's total share of construction is estimated to be $2,637,250. • Yucaipa's cost shall not exceed $4,410,250 without an amendment to the Agreement.
To fund the Project, the City of Yucaipa and City of Calimesa collaborated on grant funding applications. The Cities successfully acquired grant funding from Caltrans — ATP grant funds in the amount of $512,000 (lead agency - Yucaipa) for street improvements between California Street and 3rd Street; Air Quality Management District — MSRC grant funds in the amount of $380,000 (lead agency - Yucaipa) for street improvements between Calimesa Blvd and 4th Street; and California Transportation Commission LPP grant funds in the amount of $3,747,000 (lead agency - Calimesa) for the remaining segments of the Project. For the City of Yucaipa Development Impact Fee (DIF), Pavement Management Program (PMP), SB 1 and Measure I funds are being used as the local match for the grant funding. The ATP funded portion of the Project has been completed, the LPP funded portion is currently under construction and the MSRC portion is planned to be constructed next. At the August 13, 2018, City Council Meeting, Council approved a Professional Services Agreement with LAN Engineering to complete the engineering, design and construction plans for the MSRC portion.
The MSRC grant includes funding for the construction of pedestrian access improvements, including sidewalk and curb ramps, and bicycle lanes on the north and south side of County Line Road, between Calimesa Boulevard and a point just west of 4th Street. This grant funded project does not include the roundabout at County Line Road and 51h Street, which is a component of the LPP funded portion currently under construction.
At the August 22, 2022 City Council Meeting, City Council adopted the Categorical Exemption pursuant to Section 15301(c) of the CEQA guidelines and directed staff to file a Notice of Exemption to complete the environmental review process for the Project. 412

Right -of -Way Acquisition - County Line Road MSRC Project, Project No. 11118
A real estate appraisal was completed by the City's contract appraiser in accordance with state law to determine the fair market value of the permanent right of way easement required from the subject property to construct the Project. A written offer was sent to the property owner based on the Council approved appraisal report. Staff discussed the City's offer with the owners of the property identified as APN 0319-233-23 located at 34394 County Line Road between Calimesa Boulevard and 5 h Street. The property owner has accepted the City's offer and executed the proposed Purchase and Sale Agreement for the 10,454 square foot area required for the project. Staff is recommending that City Council approve the Purchase and Sale Agreement in the amount of $10,400.
With the approval of this Purchase and Sale Agreement, the acquisition of one of the three permanent right of way easements will have been acquired leaving 2 permanent easements remaining to be acquired for the County Line Road MSRC Project. Staff will return to City Council at a later date with a recommendation regarding these easements.
