That City Council:
1. Award and authorize the Mayor to execute a contract in the amount of $463,570.87 with MCC Equipment Rentals, Inc. of Yucaipa, California, for the City Yard Underground Utility Installation — Project No. 11182 (Utility Project); and
2. Authorize a contract contingency in the amount of $46,000 and the amount of $23,000 for construction contract administration, survey, testing and inspection for a total construction budget of $532,570.87; and
3. Authorize the Acting City Manager, or his/her designee, to administer the terms of the contract; and
4. Approve the Plans and Specifications prepared for this Project; and
5. Approve and accept a utility easement in favor of the City on Wildwood Calvary Church (WCC) property to accommodate the construction and maintenance of utility service connections for the New City Yard; and
6. Approve and accept a drainage easement in favor of the City on WCC property for access and maintenance of the drainage facilities located on WCC property; and
7. Determine that the Utility Project is within the scope of the Environmental Impact Report prepared for the Oak Glen Creek Specific Plan Project.
In March 2011, City Council approved the preparation of a Specific Plan and an Environmental Impact Report (EIR) for the development of the Wilson Creek Business Park and Flood Control Basin Project.

On May 13, 2013, City Council approved and authorized the Mayor to execute an MOU between the San Bernardino County Flood Control District (SBCFCD) and the City for the Wilson III Basin Project (Basin Project). The MOU detailed the partnership efforts between the City and SBCFCD, including the understanding that the SBCFCD-owned property, which would not be required for the Basin Project, would be deemed "surplus" property and would be transferred to the City for sale as SBCFCD's contribution towards the Basin Project.
On July 11, 2016, City Council selected the "preferred" land use alternative for the Oak Glen Creek Specific Plan as primarily residential with some Innovation Center zoned parcels. The Innovation Center parcels/areas are located on the north, and east sides of the Oak Glen Creek Specific Plan area and are designated for the site of relocated City Public Works maintenance yard (New City Yard). On February 26, 2018, City Council adopted Resolution No. 2017-47, approving the Oak Glen Creek Specific Plan, including the Wilson III Basin and the New City Yard improvements.
Over the last several years, staffhas coordinated with WCC to discuss the impacts of the final design of the Wilson Creek Channel realignment along the western boundary of the Church property, as well as the construction of the New City Yard adjacent to the WCC property. As a result,a Land Exchange Agreement (Agreement) was developed, and subsequently approved by City Council in October of 2019. The Agreement allows the City to move forward with the construction of the Wilson III Basin and New City Yard. The Agreement also includes provisions regarding the exchange of properties between the WCC and the City. These provisions include the City's construction of drainage improvements required to accommodate the New City Yard, as well as WCC drainage facilities to the realigned Wilson Creek Channel. The property identified in the Agreement to be transferred from the City to WCC has been identified for future WCC parking uses.
Beginning in July of 2020, City Council awarded multiple construction contracts for the improvements required for the New City Yard. These contracts include the work required for the grading, fabrication and installation of the New City Yard steel buildings, and interior building improvements. Construction of these improvements are substantially complete, pending final punch list items on the interior building improvements contract.
One of the remaining phases of construction for the New City Yard includes the installation of the wet and dry utilities (Utility Project). The wet utilities include drinking water, recycled water (for landscape irrigation) and sewer service. The dry utilities include communication and electrical service improvements. Since the New City Yard lies within their service area and is anew land development project, the Yucaipa Valley Water District (YVWD) prepared a Development Agreement (DA) specifying the conditions for YVVTD to provide utility service. On February 14, 2022, City Council approved the DA, and City staff has coordinated with YVWD to complete the engineering design of the utilities required to serve the New City Yard. It is important to note that the Utility Project is consistent with the Oak Glen Creek Specific Plan and is within the scope of the EIR prepared pursuant to the provisions of Section 15168 of the California Environmental Quality Act of 1970. 383

efforts resulted in a proposed alignment requiring several easements to accommodate construction and future maintenance of said utilities as well as the future WCC parking uses described previously.
The following proposed easements are being recommended for approval:
1) A 15-foot utility casement 'in favor of the City on WCC property to accommodate the construction and maintenance of utility service connections for the New City Yard; and 2) A Drainage easement in favor of the City for access and maintenance associated with City/WCC drainage facilities located on WCC property; and The approval of these easements will allow the construction of the Utility Project to begin.
In December 2022, the Utility Project was publicly advertised for construction bids. On January 11, 2023, nine (9) sealed bids were received from contractors. The bids received are as follows:

Engineer's Estimate
The Engineer's Estimate for the Utility Project is in the amount of $600,000. MCC Equipment Rentals, Inc. of Yucaipa, CA (MCC), is the apparent low bidder. Staff has reviewed the bid documents and determined that the documents meet the requirements of the construction contract specifications.
MCC has completed several similar projects for the City and other public agencies, and their work has been deemed satisfactory. As a result, staff recommends that City Council award the contract for the Utility Project to MCC in the amount of $463,570.87.

With the award of this contract, staff can move forward and coordinate with the utility companies to obtain utility services to this facility. Those services include potable water, recycled water, sewer, electrical, and communication (fiber optic).

PROJECT: City Yard Underground Utility Installation — Project No. 11182 WITNESSETH, in this consideration of their covenants, the parties hereto agree as follows:
The contract documents for the Project shall consist of the Notice Inviting Sealed Bids, Instructions to Bidders, Proposal, General Specifications, Standard Specifications, Special Provisions, Plans, and all referenced specifications and appendices; together with this Agreement and all required bonds, insurance certificates, permits, notices, and affidavits; and also including any and all addenda or supplemental agreements clarifying, amending, or extending the work contemplated as may be required to insure its completion in an acceptable manner (collectively, the "Contract Documents"). The Contract Documents are made a part hereof as though fully set forth herein.
In consideration of such work, City agrees to pay Contractor and Contractor agrees to accept the sum of Four Hundred Sixty -Three Thousand, Five Hundred Seventy Dollars and Eight -Seven Cents ($463,570.87) in the manner provided in the Contract Documents and subject to adjustment provided therein.
Concurrently with the execution of this Agreement, Contractor shall file with the City the bonds and certificates of insurance specified in the Contract Documents and subject to adjustment provided therein.
This Contract shall not be assigned without the written permission of the City Council.
