SUBJECT: Award of Contract for the Phase 2 Construction of the Dunlap Boulevard Bridge Removal and Replacement Project at Wilson Creek Channel — Project No. 11098 RECOMMENDATION:
That the City Council:
1. Award and authorize the Mayor to execute a contract, and the City Manager or his designee to administer the terms of the contract to the lowest responsible bidder, IE General Engineering Inc. of Beaumont, CA in the amount of $2,098,054 for the Phase 2 Construction of the Dunlap Boulevard Bridge Removal and Replacement Project at Wilson Creek Channel — Project No. 11098, and
2. Authorize a construction contract contingency amount of $275,000 for the project, the amount of $175,000 for construction contract administration, inspection, testing, survey and staff time for a total construction contract budget in the amount of $2,548,054; and
3. Approve Amendment No. 5 to the contract with Dudek in the amount of $30,000 for construction engineering and design support services for this project; and
4. Approve the plans and specifications prepared for the project.
BACKGROUND/ DISCUSSION:
The Dunlap Boulevard Bridge Removal and Replacement Project at Wilson Creek Channel (Project) is an important drainage infrastructure project that will remove a significant number of properties in the City's Dunlap area from the FEMA designated floodplain/floodway and is included in the adopted FY2022/2023 Capital Improvement Program (CIP). The existing Dunlap Boulevard bridge over Wilson Creek is "under sized" and does not provide sufficient capacity for Wilson Creek to convey storm flows under Dunlap Boulevard. As defined in the 2015 Conditional Letter of Map Revision (CLOMR) report for Wilson Creek Channel, several areas within the vicinity of the existing bridge currently remain in the FEMA mapped floodplain/floodway. The Project involves the removal and replacement of the existing Dunlap Boulevard Bridge at Wilson Creek Channel. The replacement bridge is taller and longer to 04/24/2023 City Council Agenda 103

increase the storm water conveyance capacity of the channel, while maintaining vehicular (one way) and pedestrian access across the channel.
At the March 25, 2019, City Council Meeting, Council awarded a professional services agreement to Dudek for the engineering design of the Project. The design was completed and the construction of the Project was identified at that time to be completed in phases. Phase 1 construction was completed and accepted by City Council at the February 27, 2023 City Council Meeting. The Phase 1 improvements included the construction of the new bridge foundation, structure and utility casings in anticipation of the utility relocations planned with the Phase 2 improvements. The proposed Phase 2 improvements include the transfer of the existing utilities onto the new bridge structure, fabrication and installation of the steel trusses on the new bridge, Dunlap Boulevard intersection and drainage improvements, removal of the existing bridge, and construction of channel improvements under the new bridge.
The Phase 2 Project was publicly advertised for bids on February 27, 2023. On April 6, 2023 four (4) sealed bids were received from contractors as follows; Bidder

The Engineer's Estimate for Phase 1 of the Project is in the amount of $1,900,000. IE General Engineering Inc. is the apparent responsive low bidder for the Project in the amount of $2,098,054.
Staff has reviewed the bid documents and determined that the documents meet the requirements of the construction contract specifications. IE General Engineering Inc. has completed previous similar work for the City of Yucaipa and other public agencies and their work has been deemed satisfactory. As a result, staff recommends that City Council award the contract to IE General Engineering Inc.in the amount of $2,098,054 for the Project.
Due to the nature of the proposed bridge construction, including the protection of existing bridge and utility infrastructure, staff recommends approval of Amendment No. 5 to the contract with Dudek in the amount of $30,000 for construction engineering and design support services for the construction of the proposed Project. This will allow Dudek to provide engineering design support to the City during construction.

WITNESSETH, in this consideration of their covenants, the parties hereto agree as follows:
The contract documents for the Project shall consist of the Notice Inviting Sealed Bids, Instructions to Bidders, Proposal, General Specifications, Standard Specifications, Special Provisions, Plans, and all referenced specifications and appendices; together with this Agreement and all required bonds, insurance certificates, permits, notices, and affidavits; and also including any and all addenda or supplemental agreements clarifying, amending, or extending the work contemplated as may be required to insure its completion in an acceptable manner (collectively, the "Contract Documents"). The Contract Documents are made a part hereof as trough fully set forth herein.
In consideration of such work, City agrees to pay Contractor and Contractor agrees to accept the sum of Two Million _Ninety-Eit;lit Thonssurtl _Fifty -Four Dollars and Zero Cents (S2,099,064,00) in the manner provided in the Contract Documents and subject to adjustment provided therein_
Concurrently with the execution of this Agreement, Contractor shall file with the City the bonds and certificates of insurance specified in the Contract Documents and subject to adjustment provided therein.
This Contract shall not be assigned without the written pennission of the City Council, IN WITNESS WHEREOF, the parties hereto have executed this instrument the day and year first above written.
