Agenda Item No. 14

CITY OF YUCAIPA

AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Ana V. Sauseda, Director of General Services/City Clerk FOR: City Council Meeting of June 12, 2023
SUBJECT: Yucaipa Disposal 2022 Annual Report, Solid Waste Rate Adjustment, Annual Single -Family Residential Property Tax Roll Billing for Fiscal Year 2023-24 RECOMMENDATION:

That the City Council conduct a public hearing and subsequently:

1. Receive the 2022 Solid Waste Annual Report from Yucaipa Disposal; and

2. Approve the Residential Rate Adjustments, recommended by the Solid Waste Committee, implementing all standard increases; however, the rate subsidy to the 15 and 30-gallon rates are reduced resulting in a 15-gallon rate increase of $2.48 (from $18.21 to $20.69), 30-gallon rate increase of $2.01 (from $24.16 to $26.17) and a 60-gallon rate increase of $1.87 (from $32.71 to $34.58); and

3. Approve the proposed Commercial Refuse Rate Adjustment, which includes Food Waste and Recycling (Recommended by Solid Waste Committee); and

4. Adopt Resolution No. 2023-22, approving the rates and requesting the County of San Bernardino to place collection of costs for single-family residential solid waste, organic waste, and recycling services for Fiscal Year 2023-2024 on the County of San Bernardino property tax roll pursuant to Chapter 8.28 of the Yucaipa Municipal Code.

DISCUSSION:

Pursuant to a California Supreme Court Decision in 2006, refuse collection rates are subject to Proposition 218 requirements. To comply with the requirements of Prop 218, the City must conduct a public hearing not less than 45-days after mailing the notice, which must include the amount of the highest proposed fee; the basis upon which the fees were calculated; the reason for the fees; and the date, time and location of the public hearing on the proposed fees. Yucaipa Disposal (YD) mailed out notices to Yucaipa customers on April 27, 2023 (Attachment 3). If written or verbal protests against the proposed fees are not presented by a majority of parcel(s) owners, the City may authorize the proposed fee increases.

On April 11, 2023, a member of the Solid Waste Committee (Committee) met with City staff and representatives of Yucaipa Disposal to review and discuss the 2022 Annual Report, proposed rates for Fiscal Year (FY) 2023/24, and SB 1383 program updates. 356

The following details the issues discussed at the Committee meeting:
2022 Annual Report (AR)
The AR (Attachment 2) focuses on YD's performance and quality of service over the prior year.

Issues discussed in terms of the Annual Report include:

Commercial Food Waste Bin and Barrel Service — AB 1826 mandates organics recycling services (MORe) for certain commercial and multi -family establishments. In 2018 and 2020, the City adopted ordinances to meet the State mandates, which requires all businesses generating more than 4 cubic yards (in 2018) and 2 cubic yards (in 2020) of solid waste per week to recycle organics. Of the 105 businesses that fall within the threshold, 84 commercial customers are signed up for food waste recycling and 21 are either not in compliance or are eligible for an exemption. YD is currently coordinating with City staff to address non -compliant accounts for further action.

Recycling Revenues, Processing Fees, and Contamination — The commercial and residential recycling revenues and processing fees comparisons from 2020 to 2022 are located on pages 5 - 8 of the AR. The commercial commingled recycling revenues (Table 7) decreased over the prior year from $113,548.47 in 2021 to $84,775.12 in 2022. This decrease is attributed to lower commodity market values and tonnage collected. The residential commingled recycling revenues (Table 9) also decreased over the prior year from $153,342.46 in 2021 to $90,271.94 in 2022. Residential recycling revenue is based on the recyclables recovered and sold from the blue barrels.. The 2022 processing fees of $466,085.30 to sort residential commingled recyclables and dispose of all residential waste creates an overall net cost of $375,813.36.

In addition, residential contamination (Table 10) remained unchanged from 2021 at 30%.

Total residue tons decreased from 1,889.86 tons (2021) to 1,784.12 tons (2022). The Committee is recommending ongoing public education and outreach programs to minimize contamination along with running the "Right Stuff' campaign for another year.

Proposed Residential & Commercial Rate Adjustments — FY 2023/24 Per the City Council adopted rate -setting procedures, which are detailed in Section 17(C) of the current FA, the annual adjustment of rates is implemented July 1st of each year. Pursuant to the FA, the annual rate adjustment is based on: (1) increase/decrease in the landfill fee charged by the County of San Bernardino or other authorized landfill; (2) Operator fee shall be adjusted by 90% of the annual change in the Consumer Price Index (CPI) for the prior calendar year; and (3) recycling rate adjustments based on collection, transportation, processing, non -recyclable disposal, community education, state/county/city reporting and recyclable revenue credits.

The residential and commercial rate proposal is based on the FA terms identified above and the implementation of state -mandated residential food waste recycling and expanded commercial recycling requirements consistent with SB 1383, County of San Bernardino solid waste tip fee adjustments pursuant to the Waste Disposal Agreement (WDA), and recyclables commodity 357

markets. The proposed residential rates include: an operator fee increase of 6.70%, which is based on 90% of the percentage change in the monthly CPI for the prior calendar year (7.45%), a landfill disposal increase of $1.32/ton (from $40.75/ton to $42.07/ton), an organic waste processing fee increase of $6.96/ton (from $80.00/ton to $86.96/ton), a recycling processing fee increase of $11.40/ton (from $49.37/ton to $60.77/ton), HazMat, SB 1383 program costs such as compliance monitoring, compost procurement, edible food recovery, contamination monitoring, and ongoing education, and franchise fees. The cumulative impact of the cost component changes results in an average proposed residential rate increase of $2.12 per month based on Option #2 for all barrel service types.

The proposed residential rate, recommended by the Committee, would implement all standard increases; however, the rate subsidy to the 15 and 30-gallon rates are reduced resulting in a 15- gallon rate increase of $2.48 (from $18.21 to $20.69), 30-gallon rate increase of $2.01 (from $24.16 to $26.17) and a 60-gallon rate increase of $1.87 (from $32.71 to $34.58). The Committee is also recommending the various commercial rates outlined in Exhibit A.

The Committee also discussed the subsidized rate structure currently being utilized by the City.

Under the current structure, rates for the 15 & 30-gallon barrel service have been subsidized by the rates for the 60-gallon barrel service. The Committee felt that applying a standard increase across the board would be a more fair approach. While the recommended rates for FY 23/24 include a reduced subsidy on the 15 & 30-gallon barrels, the direction of the committee was to begin phasing out the current subsidy rate structure. Approval of the FY 23/24 rates would start that process and begin to move the City in a direction that gets to a rate structure with no subsidies within the next few years.

Residential and SB 1383 Program Updates
On September 19, 2016, Senate Bill (SB) 1383 was signed into law to reduce organic waste disposal (food waste, green waste, paper products, etc.) by 75% (20 million tons) and increase edible food recovery by 20%, by 2025 in order to mitigate methane emissions reportedly caused by landfilled organics. SB 1383 is the State's most ambitious and impactful waste reduction law in the last 30 years. This Legislation requires all businesses, residents, and multi -family complexes to subscribe to the City's organic waste collection and recycling services that capture source separated food scraps and landscaping waste, among other organic waste materials. On January 10, 2022, City Council adopted Ordinance No. 403, adding mandatory organic waste disposal reduction requirements to the Yucaipa Municipal Code.

Since the adoption of Ordinance No. 403, YD and City staff have been working together to implement the SB 1383 compliance program and fulfill the state mandated requirements ensuring the following mandates are met:

1. Residential food waste recycling program
a. Collection Program (Yucaipa has a three -barrel system):
i. Blue container: Recyclable materials (plastics #147, glass bottles, jars & aluminum cans, cardboard, and paper). Container will include required labeling to identify the primary acceptable items allowed and not allowed. 358

ii. Green container: Organic waste materials (grass, weeds, flowers, leaves, pruning's and other types of source separated organics resulting from normal yard and landscaping activities). In addition, residents are required to put their food waste in plastic bags and place it in the green container.

Container will include required labeling to identify the primary acceptable items allowed and not allowed.
iii. Black/Brown container: Refuse materials (non -organic and non -recyclable waste materials). Container will include required labeling to identify the primary acceptable items allowed and not allowed.

2. Commercial organics waste recycling program — SB 1383 mandates organics recycling services for all commercial and multi -family establishments without a City approved waiver. YD is coordinating with City staff to address non -compliant accounts for further action or to issue a waiver. The following commercial waivers are allowed under SB 1383. a. Di Minimis Waiver — The commercial business' total solid waste collection service is two cubic yards or more per week, and organic waste subject to collection in the blue or green container comprises less than 20 gallons per week per the applicable container of the business' total waste. The commercial business' total solid waste collection service is less than two cubic yards per week and organic waste subject to collection in a blue or green container comprises less than 10 gallons per week per applicable container of the business' total solid waste. b. Physical Space Waiver — The commercial business or property owner provides documentation, or the City has evidence from its staff, a hauler, licensed architect, or licensed engineer demonstrating that the premises lack adequate space for organic waste configurations.

3. Commercial edible food recovery program - Tier 1 and 2 generators are edible food generators that will be required to donate edible food to local recovery organizations pursuant to the State regulations. YD and City staff identified qualified Tier 1 and 2 edible generators and are developing a program to: estimate the amount of edible food currently being disposed, identify existing food recovery organizations, develop/ensure adequate infrastructure is made available to support the program and diverting 20% or more of estimated edible food from disposal to food recovery organizations. a. Tier 1 (began January 1, 2022) — Businesses that typically have more produce, fresh grocery and shelf -stable foods to donate (wholesale food vendors, food service providers, food distributors, grocery and supermarkets that are over 10,000 sq. ft.) b. Tier 2 (begins January 1, 2024) — Businesses that typically have more prepared foods to donate which often require more careful handling to meet food safety requirements (hotels, local education agencies (with on -site food facilities), restaurant facilities over 5,000 sq. ft. or 250+ seats and large venues and events).

4. Inspection and mandatory enforcement of SB 1383 compliance to include investigating complaints on 1383 non-compliance.

5. Conduct outreach and education to all impacted parties — YD and the City will use a variety of outreach methods such as: social media outlets, websites, newsletters, short videos, Community Service Guide, newspaper articles, and mailers to ensure the programs ongoing success.

6. Procure paper products with recycled paper content and recovered organic waste products like compost, mulch, and renewable natural gas.
359

a. City staff will be required to ensure all vendors provide specific percentages of recycled -content paper products that consists of postconsumer fiber instead of non - recycled products. Records are required to be maintained and shall include a copy of the invoice, written certifications of recycled content, and other general information.
b. YD will assist the City in meeting its recycle organic waste procurement targets, to include the following:
i. Community compost and mulch giveaway events.
ii. Community parks landscape and turf enhancements where recycled organic products are used to minimize water usage and improve soils.

7. Maintain accurate and timely records of SB 1383 compliance — YD will partner with the City to maintain records that demonstrate compliance. These records will document the City's progress in complying with the regulation in accordance with the statutory requirements and include annual reporting requirements.

8. Contamination minimization and waste audits — YD will partner with City Code Enforcement to ensure commercial businesses and multifamily establishments are subscribed to organic recycling services and comply with the regulatory requirements. YD will also implement route audits to address the container contamination minimization requirements. Beginning January 1, 2024, Notice of Violations may be issued to enforce compliance if necessary.

Single -Family Residential (SFR) Tax Roll Billing
On March 11, 2019, the City adopted Ordinance No. 373, amending Chapter 8.28 of the Yucaipa Municipal Code, to include provisions pertaining to County of San Bernardino property tax -roll billing for SFR solid waste, organic waste, and recycling service fees. As depicted in Table 1 of the AR, a total of 12,760 residential customers paid for services through tax roll billing and 739 customers pre -paid to prevent the fees from going on their tax bill.

Tax roll billing provides an efficient and streamlined billing method and addresses delinquent service fee collections. Over the past 4 years, the solid waste lien list for SFR has had a significant reduction in delinquencies, as detailed below:

Upon Council approval of the residential rate adjustments and Resolution No. 2023-22, residents will pay refuse collection charges for the July 1, 2023 — June 30, 2024, service period when they remit their property tax payments to the San Bernardino County Auditor/Controller Treasurer/Tax Collector office, typically in October 2023 and April 2024. Residents will also have the option to pay the annual costs up front (payment must be received by Yucaipa Disposal on/before July 11, 2023) to avoid payments via tax roll billing.

WHEREAS, pursuant to the provisions of State law, including but not limited to Health & Safety Code Sections 5470 et seq., the City of Yucaipa may adopt and implement fees and charges to cover the cost of collection of solid waste within the City and, when adopted, may collect such fees for residential service on the property tax rolls; and WHEREAS, the City desires to adopt and implement such fees and charges to cover the cost of collection of solid waste within the City and;
WHEREAS, the proposed solid waste fees are set out on Exhibit "A", attached and incorporated hereto; and
WHEREAS, a written report of prospective solid waste collection fees has been prepared and filed with the City Clerk; and
WHEREAS, on June 12, 2023, the City Council conducted a duly noticed public hearing and heard all comments/protests regarding the solid waste fees; and WHEREAS, the City Council finds from such reports that the amount of fees is the reasonable cost of service provided, plus direct and indirect overhead; that amounts collected will be used only for immediately available (and not standby) solid waste collection services; that such fees and charges are proportionate to the amount of service received, and that such fees and charges are not for traditional governmental services such as police, fire, or libraries; and WHEREAS, the City Council further finds that this increase in rates is for the purpose of meeting operating expenses, including wage rates and fringe benefits, required for the collection of solid waste within the City pursuant to its existing franchise, and that such action therefore is statutorily exempt from CEQA under Public Resources Code Section 21080(b) and Section 15273 of the CEQA guidelines.

As of December 2022, there were 517 single-family and 174 multi -family and mobile home park (MHP) customers utilizing the 15-gallon trash barrel option that was approved in November 2009. This is was introduced as a cost savings alternative for low volume residential trash generators that maximize recycling and waste reduction efforts. A list of the mobile home parks and current services is provided in Exhibit A. Special services include accounts with extra trash, recycling and/or organic waste barrels and accounts with animal waste barrels.

Please note that the 63 direct bill customers were not included in the tax roll billing for one of the following reasons: vacant property/non-billed account at the time of tax roll submittal, new residential start service after tax roll submittal, and residential service level changes during the tax roll year.

B. Commercial and multi -family customers may select either a 35-gallon,60-gallon barrel, 1.5 cubic yard, 3 cubic yard or 10 to 40 cubic yard container serviced once per week or as often as six times per week. Customers can also choose between a variety of service options: trash, recycling, green waste, or food waste. Table 2 summarizes the commercial containers as of December 31, 2022.

The commingled recycling bin subsidy program began in October 2009. Under this program, businesses, mobile home parks and multi -family facilities on bin service can subscribe for a recycling barrel or bin at no additional charge. Mandatory commercial recycling (MCR) became effective July 1, 2012, with the passage of state legislation, AB 341, and the corresponding City Ordinance No. 314.

The all-inclusive program where recycling services are available at no additional cost continues to be an ideal solution for businesses and multi -family establishments because the recycling costs are included with the trash service. The financial incentives are built into the commercial rate structure through avoided trash disposal and allows for more accurate tracking of recycling and diversion activities. Table 3 summarizes commercial MCR participants.

The commercial food waste recycling program began in July 2016. The program was implemented in response to the mandatory organics recycling (MORe) law, AB 1826, that became effective April 1, 2016. AB 1826 mandates organics recycling services for certain commercial and multi -family establishments. In order to eliminate barriers, the City adopted an equalized food waste rate structure where a food waste recycling bin is available at a comparable rate as a trash bin. Program implementation included development, customer identification and outreach.

In December 2020, the City approved a mandatory organics recycling program (Ordinance, No. 398) where all businesses generating more than two cubic yards per week of solid waste are required to recycle organics. Table 4 summarizes commercial food waste recycling participation. As of December 2022, there are 84 commercial customers subscribed to food waste recycling and 21 commercial customers not signed up for food waste recycling and are out of compliance with AB 1826. Burrtec is currently coordinating with City staff to address the status of non -compliant accounts for further action.

Franchise fees are computed as a percentage of the operator pick-up fee. Ten percent was used for 2022 and is the current franchise fee amount. Franchise fees have decreased due to slightly lower billings and service subscriptions from temporary construction roll -off activity.

It should be noted that Yucaipa Disposal, Inc. is remitting franchise fees and household hazardous waste fees to the City based upon service billings rather than customer payments.

This results in a cash flow benefit to the City and also provides for a more accurate audit process.

Table 6 shows the current operator fee effective July 1, 2022 for residential and commercial customers. These serve as the basis for the franchise fee payments listed in Table 5. _ Table 6 — Operator Fee

Table 8 captures roll -off activity wherein the majority of roll -off loads are deposited at San Bernardino County Landfills and some are then processed as part of the County's Consolidated Disposal Site Diversion Program (CDSDP). Construction and Demolition (C&D) roll -off loads with potential revenue commodities or high diversion requirements are processed at the Agua Mansa Material Recovery Facility to comply with the state's CalGreen regulations. Diverted CDSDP tonnage data is provided by San Bernardino County and includes self -haul materials that were not delivered to the landfill by Yucaipa Disposal.

The City of Yucaipa ended its participation in the County's Comprehensive Disposal Site Diversion Program as of August 20, 2022. This change resulted in lower roll -off disposal costs for roll -off customers.

2022's recovered tonnages decreased across all sectors. While scavenging issues have decreased, they are not altogether gone as there is still value in certain recycling materials, such as CRV items. Yucaipa Disposal will continue to work on its anti -scavenging program to include messaging to commercial and multi -family businesses to discourage scavenging and donating recyclables to third party entities.

Table 13 includes a recap of both residential and commercial food waste and organics tonnages collected and diverted from the County landfill. Some of the green waste material that is processed into compost and mulch is re -used by Yucaipa residents and the City as part of the organic waste reuse program which helps support SB1383 procurement requirements.

Commercial food waste tons totaled 112.72 during 2022. The disposal cost increases are reflective of the residential food waste program implementation.

In 2022, a total of 15,204 newsletters were mailed out, which included one residential and two commercial / multi -family mailings - the balance of the residential newsletters were digitally available online via Burrtec's website. This is part of our standard Public Outreach and Education Program. With the introduction of SB1383 programs, additional outreach material was distributed. That included general organics recycling information, benefits of organic recycling, edible food recovery and best practices for residential, commercial and multi -family food waste recycling, including tutorial videos.

Newsletters highlight Yucaipa Disposal's programs as well as reinforce recycling opportunities and programs for residential and commercial customers. Copies of the newsletters are included in Exhibit B.

During 2022, Yucaipa Disposal participated in a number of community events and outreach activities summarized in Table 19.

V. AB 939 REPORTING REQUIREMENTS
Beginning with the 2007 annual report, the department of Resource Recycling and Recovery, (CalRecycle), modified the AB939 50% compliance measurement from solely a disposal and program based system to a per capita and employment based disposal factor. The City's population and employment factors are utilized to establish a target disposal rate of pounds per person per day (PPD) to measure and gauge AB939 compliance.

Table 22 shows that the City of Yucaipa is in compliance with the state's waste diversion requirements. Target numbers are "not to exceed" amounts in order to be compliant with diversion goals. The most recent 2021 data points are not yet available from the state.

To achieve AB939 diversion mandates, the City was one of the first in San Bernardino County to offer a pricing structure with variable rates. In March 2006 the City of Yucaipa eliminated the 90-gallon trash barrel. In November 2009 the City of Yucaipa approved the 15-gallon trash barrel. Residenis continue to have the option of either a 15-gallon, 30-gallon or 6D-gallon trash barrel. The rate structure for these services has been developed to subsidize the lower volume trash services in an effort to incentivize recycling and waste reduction efforts.

Commercial recycling programs include commingled recyclables, green waste, food waste, inert materials and other items. The City implemented further commingled recycling incentives by offering a subsidized commercial recycling and food waste program. Certain bin serviced customers are mandated to subscribe to recycling services at no additional cost thereby reducing their solid waste disposal costs.

Yucaipa Disposal promotes this program through outreach efforts including mailings, newsletters and personal visits,
Table 24 below shows a chart with a three- year trend (2020 — 2022) of diversion tonnages and Table 25 reflects the actual tonnage, by waste stream, collected by Yucaipa Disposal for the past five years. Note: these figures do not include chicken manure.

Starting in 2022, all California residents will be required to participate in a Food Waste Recycling Program in order to complywith Senate Bill1383.

Senate Bill 1383 requires a 75% reduction in organic waste disposal statewide by 2025. 0 All residences and commercial businesses will be required to participate in this program to recycle organic waste, including food waste.

Attention Food Service Providers
Existing state law requires certain businesses to implement a recycling and organics program. The law which went into effect July 1, 2020, requires food establishments that provide trash containers for products purchased and consumed on the premises toalso provide properly labeled containers for recyclables and organic waste (food waste).

These containers must be placed adjacent to trash containers.

AB 827 applies to limited -service restaurants
such as those restaurants where customers
order and pay at the counter and bus
their own tables after eating. The law
will affect restaurants, malls, and other
businesses that serve food. Full -service food
establishments that do not provide access to
trash containers for products consumed on
the premises will be exempt, as food workers
will likely separate post -consumer food
waste and recyclables in the dish washing
areas.

Highlights:
• AB 827 requires collection containers at the front -of -house to be visible, accessible, and labeled,
This law affects businesses that sell products that are meant for immediate consumption.
• Full -service restaurants where employees bus and clean tables are exempt but must provide labeled collection containers adjacent to trash containers for employees/staff to separate post -consumer recyclables and organics.

Forfurther information regardingthis law, please visit https://www.calrecycle,ca.gov Tips to Improve Recycling at the Office
✓ Replace paper coffee cups with reusable mugs
✓ Place a recycling container next to every trash container ✓ Post recycling lists and reminders to recycle
✓ Only print when necessary to save on paper use
✓ Create a designated recycling area for ink cartridges, tight bulbs and batteries to ensure proper disposal

Residential Recycling
Yucaipa disposal is working in partnership with your community to raise awareness oft he importance of recycling, increase recycling participation and ell mi nating contamination from recycling and organics containers. This initiative is part of the City's efforts to promote recycling cost impact awareness and the success of the recycling programs.

The recycling container is for plastic containers, cardboard products, paper products, metal products and recyclable glass products only.

The organics container is for brush, grass clippings, leaves, palm fronds, shrub trimmings, small branches, tree trimmings, weeds and bagged food waste only. Reminder: Place bagged food waste in your organics barrel (acceptable items): Bread, Dairy, Fish, Food waste and scraps, Fruit, Meat, Moldy or spoiled food, Vegetables
Items other than the above mentioned materials must not be placed in the recycling or organics barrel(s), as it significantly impacts the recycling process and must be removed at a considerable cost. Recycling loads containing unacceptable items may be rejected for processing and sentto the landfill, which eliminates the benefits that are produced from the recycling program. High contamination of your recyclables could result in increased processing costswhich may impactyour trash and recyclables collection fees.

Everyone has a role to play to ensure we keep unacceptable materials out of the recycling or organics container(s). Not sure about what goes in each container? Contact our Customer Service team for assistance at (909) 797-9125. a,

1 Collection Day Reminder
On collection day, please place your containers in the
street, at the curb, or near the corner of your driveway.

The containers handles should be facing your home.

Barrels should be placed t. foot apart from each other.

The containers need to be placed at least 3 feet away
from any obstruction such as a fence, mailbox, or -vehicle.

All barrels must be curbside by 6:00 a.m. on your
service day.

Bulky Item Pick -Up
Are you replacing an old sofa, water heater or refrigerator and don't know what to do with it? We'll take care of it. Residents can request up to four curbside collections of large or bulky items during a 12 month period (pick-up second week of FebJMay/Aug/Nov). Limit of five items per collection. This program also includes electronic waste. This program is at no additional cost and designed for your convenience. Please call our Customer Service Department one week prior to your scheduled collection day to arrange pick-up.

Tap 5 Items to Keep OUT of the Recycling Bin
Here are the top 5 items that should never be placed in the recycling bin:

1. No garden hoses. Despite being made from rubber, vinyl, or a combination of both, this item still belongs in the trash,

2. No diapers. Diapers should be placed in your trash bin.

3. No hazardous waste. This means no paint, motor oil, batteries, syringes, needles, etc. Hazardous Waste places our facility staff at risk. Do not place into any of your Burrtec collection containers.

4. No pet food hags. The wax coating prevents the bags from breaking down in the recycling process, so pet food bags go into the trash bin.

S. No electronic waste. These items are best recycled through a proper e-recycler.

Remember to keep the blue barrel free of contamination! 423

Help Keep Your Recycling Clean
As of 2018, China, the largest market for the world's
recycling materials, enforced the new "National
Sword" policy. This policy banned numerous materials
including several types of plastics, unsorted mixed
paper and set strict standards for contamination
levels. This policy has impacted recycling operations
across the United States. Stakeholders are now faced
with the challenges of processing recyclables that
have little to no market value. Lowering the levels of
contamination (trash) and understanding that certain
materials may no longer be recyclable can help. We
need your support. In order to Continue pursuing
alternative markets and help contain costs, please
help lowerthe levels of contamination by only placing
acceptable materials in your recycling container.

Sorted recycle bales are shipped to recycling
manufacturing companies and made into new
products. At the sorting line at the Material
Recovery Facility (MRF), workers must remove
any contaminants— this is an essential and time-
consuming step that can slow down theprocess. Ifany
contaminants are missed in the sorting process, the
finished recycle bales could be rejected by recycling
manufacturers and, therefore, not acceptable to be
recycled. Keeping your recycling container free of
trash and non -recyclable contaminants will help
reduce costs. Spread the message, "Help keep
your recycling clean]"
Existing state law requires certain qualifying businesses to implement a recycling or organics recycling program. Effective July 1, 2020, Assembly Bill821 now requires food establishments that provide trash containers for products purchased and consumed on the premises to also provide properly labeled containers for recyclables and food waste for materials purchased on the premises for immediate consumption. These containers must be placed adjacent to trash containers.

The new law applies to limited -service
restaurants such as those restaurants
where customers order and pay at the
counter and bus their own tables after
eating. The law will affect restaurants,
malls, and other businesses that serve
food. Full -service food establishments
that do not provide access to trash
containers for products consumed on
the premises will be exempt, as food
workers will likely separate food waste
and recyclables in the dish washing
areas.

Requirements
• AB 827 requires collection containers at public access areas to be visible, accessible, and labeled.
• This law affects businesses that sell products that are meant for immediate consumption.
• Full -service restaurants where employees bus and clean tables are exempt but must provide labeled collection containers adjacent to trash containers for employees/staff to separate recyclables and food waste. ror further information regarding this law, please visit https-:// www.calrecycle.ca.gov
Tips to Improve Recycling at the Office

2 NOTICE OF PUBLIC HEARING IN CONNECTION WITH THE

CITY OF YUCAIPA REFUSE COLLECTION SERVICE CHARGES
NOTICE IS HEREBY GIVEN that on June 12, 2023, at 6:00 p.m., or as soon thereafter as practicable, in the City Hall, Council Chambers, 34272 Yucaipa Blvd, Yucaipa, California, 92399, the City Council of the City of Yucaipa will hold a public hearing concerning the charges for refuse collection service.

INFORMATION ABOUT THE CHARGES
A. Basis upon which the charges were calculated — The City Council has previously determined that the collection and disposal of refuse in the City is a service to be performed by a private company, under an exclusive franchise agreement.

The monthly residential curbside collection charge is comprised of five components: (1) an amount for the administration and operation of automated curbside refuse collection service, which includes the provision of three collection carts; the option of either a 15, 30, or 60-gallon refuse cart, one 90-gallon recycling cart and one 60-gallon green & food waste cart, with weekly pick-up service, (2) an amount for the hauler to dispose of the refuse and process the green & food waste and recyclables (the "tipping fee"), (3) an amount to operate the curbside bulky item collection service, (4) an amount for the administration and operation of a Household Hazardous Waste Program, and (5) an amount to compensate the City for its administrative costs in connection with the services (the "franchise fee").

The monthly commercial collection charge is comprised of three components: (1) an amount for the administration and operation of commercial bin refuse and recycling collection service, (2) an amount for the hauler to dispose of the solid waste (the "tipping fee"), and (3) an amount to compensate the City for its administrative costs in connection with the services (the "franchise fee").

The charges represent the amount the City has negotiated with the private company franchisee for refuse collection services.

B. Reason for the charges — The City uses the refuse collection charges for the operation and administration of the refuse disposal, recycling, and household hazardous waste programs. The proposed increases per month represent the additional costs, as negotiated with the franchisee, to provide collection service, refuse, recycling, green waste, food waste, and manure collection service in compliance with state mandates. The proposed increases will be finalized after the public hearing but will not exceed the amounts set forth in this notice.

The 2023-2024 proposed increases are due to changes in the consumer price index (CPI), trash disposal tip fee adjustments, and reductions in the residential HazMat fees and declining recyclables commodity markets. In addition, commercial rate adjustments are impacted by state diversion and compliance mandates related to organics and recyclables diversion programs that also include SB 1383 programming such as compliance monitoring, compost procurement, edible food recovery, contamination monitoring, and ongoing education.

C. Charge per parcel — The City proposes to adopt a revised Exhibit D (exhibit of Franchise Agreement) that increases the residential refuse collection services charges for fiscal year 2023-2024 as follows:

Current
Maximum Option
Recommended Option
Monthly curbside collection charge 15gallon)

The City also proposes to increase the charges for residential bin service and commercial bin service for fiscal year 2023-2024. A complete listing of all proposed charges for commercial and residential services is printed on the reverse of this notice. If you need assistance determining the charge for your property or parcel, please contact Yucaipa Disposal by calling (909) 797-9125.

WRITTEN REPORT
The City has caused a written report to be prepared and filed with the City Clerk regarding the proposed increased commercial and residential bin collection service charges. As required by California Government Code Section 66016, the written report also provides data indicating the amount of cost, or estimated cost, to provide refuse collection service and the revenue sources anticipated to provide the service. A copy of the written report will be available on the City website at www.yucaipa.org and at City Hall by June 1, 2023.

PUBLIC HEARING
At the public hearing, the City will hear and consider all objections or protests to the proposed rate increases. All interested persons shall be afforded the opportunity to hear and be heard. Written protests regarding the proposed increases must be filed with the City Clerk prior to the close of the public hearing pursuant to the requirements stated on the June 12, 2023, City Council Agenda, which will be available on the City's website for at least 72 hours prior to the start of the City Council meeting.

Assistant Director
RE: FISCAL YEAR 2023-2024 WASTE DELIVERY AGREEMENT (WDA) CONTRACT RATE

CALCULATION
Dear Mr. Mann:

The purpose of this letter is to notify you the FISCAL YEAR 2023-24 F;nal WDA rate of $42.07 per ton will be effective July 1, 2023 through June 30, 2024, for waste disposal services provided to your city pursuant to the WDA agreement with San Bernardino County.

The Department of Public Works — Solid Waste Management Division has calculated the Cast of Living Adjustment as prescribed in Amended Section 4.2(B) Calculation of Escalation of the amended WDA from June 2022 (Amendment). The Amendment provides that in no case will the adjustment to the WDA rate exceed 85% of the County's approved general public gate rate (without the current CDSDP recycling fee of $12.00). On April 25, 2023, the Board of Supervisors approved a gate rate increase for Fiscal Year 2023- 24 in the amount of $1.55 per ton, or a 3.2% increase over the current gate rate of $47.94 per ton, for a total public gate rate of $49.49 per ton. Therefore, the WDA rate for the upcoming fiscal year will be capped at $42.07 per ton. The calculation worksheet is attached for your information.

The 542.07 per ton final Contract Rate will be applied to your July 2023 tonnage on your WDA credit accounts that will be billed approximately August 15, 2023. If you have any questions about this notice or the rate calculation, please call me at (909) 386-8701 or Michael Hernandez at (909) 387-1871.

Sincerely,
D A R R E J7ME KA, P.E.
