Agenda Item No. 24

CITY OF YUCAIPA

AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Fermin Preciado, Director of Development Services Benjamin J. Matlock, City Planner ,....

Christian Farmer, Assistant Planner{
FOR: City Council Meeting of June 26, 2023
SUBJECT: City of Yucaipa (Case No. 21-113/DCA): Consideration of a Development Code Amendment (Ordinance No. 401), amending Division 7, Chapter 7 of the Development Code to replace regulations requiring the biennial renewal of commercial signage with a one-time sign registration with additional provisions to remove the requirement for a separate entitlement to be processed for freestanding signs which are reviewed concurrently with an application that includes architectural review
RECOMMENDATION:

That the City Council conduct a public hearing, and consider the Planning Commission's recommendation to:

1. Approve first reading, by title only, as read by staff, of Ordinance No. 401, amending Development Code Section 87.0705 of Chapter 7 of Division 7 of the Development Code to replace regulations requiring the biennial renewal of commercial signs with a one-time sign registration without the need for a Sign registration Decal and further remove the requirement for a separate entitlement for a freestanding sign that is reviewed concurrently with another project subject to architectural review; and

2. Find that the Ordinance is exempt from Environmental Review pursuant to Public Resources Code Section 15061(b)(3), Section 15303 (Consists of Small Structures) and Section 15311(a) (Accessory Structures).

BACKGROUND:

On July 281h, 1997, the City Council adopted Ordinance No. 168, which established Chapter 7 Division 7 of the Development Code regulating locational and development standards for primary and accessory advertising structures. With the adoption of Ordinance No. 168, the City created the requirement for a biennial registration of signs to be managed with a City Registration Decal. The biennial registration has not been conducted, nor has there been adequate staffing to review every existing sign on a biennial basis. Similarly, the requirement to display a City Registration Decal has not been incorporated for the same reasons. At the regular City Council meeting of November 23, 2020, the user fee was adjusted to reflect a one-time review and payment for a permanent sign registration, and it was noted that staff would return 532

with an amendment to ensure that the Yucaipa Development Code is consistent with the City's practice.

Planning Commission Hearing:

The proposed Development Code Amendment was reviewed at the regular Planning Commission Meeting of June 7, 2023, and was recommended for approval. During the hearing, the Planning Commission discussed the potential fiscal impact associated with the update to ensure that the City's User Fees account for the necessary review. In addition, the Planning Commission recognized that a more comprehensive update to the City's Sign Code may be needed given its initial adoption date. The minutes are attached for Council's reference.

DISCUSSION:

The proposed Ordinance revises the Sign Registration Requirement by replacing the requirement for a biennial registration for signs with a one-time sign registration and removes the need for a "sign registration decal" and would allow for the review of accessory signage through the architectural review of an entitlement, which is presented to Planning Commission. Eased on Council direction, this requirement would apply to residential, commercial, industrial, and institutional projects, and would remain consistent with the City's adopted General Plan.

The proposed Ordinance also provides a correction for the review of freestanding signs, Currently, all new freestanding signs (such as monument or pole signs) require approval of a Land Use Compliance Review by the Planning Commission. The proposed revision would allow for this review to also be processed through a concurrent Architectural Review process for a new project, rather than requiring a separate submittal and application fee. This process would streamline the process for projects that include those specific actions.

The proposed Ordinance will provide clarity to the Sign Code of the Development Code in order to be consistent with the City's practices; however, a larger update to the overall Sign Code is required to address more recent court rulings and improve the use of the Code for businesses and members of the public. However, such an undertaking requires more effort and outreach activities, and staff is currently exploring ways to tie in these efforts to the update to the City's Development Code, which was included in the fiscal year 2023-2024 adopted budget.

Environmental Review:

The proposed Development Code Amendment to the City's Sign Ordinance does not directly result in the development of any parcel of land. Therefore, staff is recommending that the proposed amendment is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) (General Rule), Section 15303(a) (Consists of Small Structures) and Section 15311 (Accessory Structures) of the CEQA Guidelines.

FISCAL IMPACT:

There is no fiscal impact beyond the adopted budget.
533

CONCLUSION:

The required findings for approval of the Development Cade Amendment have been made and are attached.

DISCUSSION:

The Planning Commissioners noted they had no ex parte communications to disclose.

Assistant Planner Christian Farmer presented the Agenda Report.

The applicant's representative, Scott Mann, thanked the Commissioners and he is excited to open the hotel soon. Scott Mann noted that the sizing of the sign is a corporate standard from La Quinta Hotels and provides freeway visibility.

Commissioner Vick asked Mr. Mann if he could provide any customer acquisition information based on walk-ins. Mr. Mann noted that he did not have that information, but that the hotel's management company might be able to provide that.

PUBLIC COMMENT: One public speaker slip was received.

Kristine Mohler — Fawn Ridge Place - She doted that the sign is beautiful, however a major variance is still a major variance. She stated that the Commission is setting a precedence when major variances are given away, and that there are too many signs on Oak Glen Road at this time.

The Public Hearing was then closed.

Chair J.R. Allgower noted that the City tries to be business friendly, and that signage is important for businesses.

Commissioner Snodgrass asked how long ago the sign had been installed and if the builder knew of the sign parameters. It was determined that the sign was installed about a month and a half ago.

Assistant Planner Christian Farmer stated that sign permits are a separate submittal, and at that point, the applicant was informed that the sign was too large. Planning Manager/City Plattner Benjamin Matlock informed the Commissioners that the sign registration is not part of the architectural review package and typically done by separate contractors from the overall project. Mr. Matlock stated that the content of the sign itself is not anything the Planning Commission would have authority over, ACTION 91: MOTION TO APPROVE BY Commissioner Snodgrass, SECOND BY Chair Allgower, NOT CARRIED, 2-2-3-0, FOR AGENDA ITEM NO.7.
