SUBJECT: Acceptance of Contract Work — Demolition of Theatre Structure at 33994 Avenue E —Project No. 11150
RECOMMENDATION:
That the City Council:
1) Accept the contract work completed by NR Development, Inc. in the amount of $3 8,500 for Demolition of Theatre Structure at 33994 Avenue E — Project No. 11150; and 2) Authorize the recordation of the Notice of Completion for the Project.
BACKGROUND:
On September 12, 2022, the City Council approved the revised Conceptual Pickleball Master Plan for the 7t" Street Pickleball facility and approved the development of Phase 1 of the 7"' Street Pickleball facility which included the following:
1. Removal of the existing 7th Street Modular Skate Park equipment and construction of four exclusive pickleball courts.
2. Installation of a steel structure over the four proposed pickleball courts that emulates/expands the existing steel structure cover.
3. Installation of lighting under the proposed cover over the four proposed pickleball courts.
4. Demolition of the existing theatre building located east of the existing basketball courts (Project).
The future Phase 2 of the 7"' Street Pickleball facility would include the following:
1. Construction of a restroom facility at the location of the existing 7t" Street Theater building.
2. Construction of five pickleball exclusive courts at the location of the existing 71h Street Theater building for a combined total of nine new pickleball exclusive courts (when combined with the four courts in Phase 1).
DISCUSSION:
As part of the Phase 1 development, the building located east of the existing basketball courts (71h Street Theater structure) needed to be demolished in order to accommodate the construction of the future Phase 2 improvements.
In November 2022, and in accordance with local regulations and permitting requirements, staff contracted with an environmental firm to complete a lead and asbestos survey on the 7th Street Theater structure. The survey was completed, and the results indicated that the building contained a level of asbestos material that required a specialized contractor to abate and remove the asbestos material prior to demolition of the building.
On February 13, 2023, the City Council awarded a contract to NR Development, Inc. of Downey, CA in the amount of $38,500 for the Project. The Project included the above -mentioned asbestos abatement work and the demolition of the structure. The City Council also approved the amount of $7,500 for construction contract contingency and $4,000 for construction contract administration, staff time and inspection, for a total budget in the amount of $50,000. The Project did not require any additional or unexpected work; therefore, the construction contract contingency was not utilized.

The table below includes the approved budget and actual cost of the Project:

As shown in the table above, the actual cost of the Project in the amount of $42,040.70 is less than the budget approved by the City Council. No further fiscal impact is being requested.

Pursuant to the provisions of Section 9204 of the Civil Code of the State of California, NOTICE IS HEREBY GIVEN that work on the certain project known as:

DEMOLITION OF THEATRE STRUCTURE AT 33994 AVENUE E
for the City of Yucaipa was completed and accepted by the City of Yucaipa on the 14th day of August 2023.
The said work was performed by NR Development, Inc. of Downey, CA in accordance with the terms of the written agreement dated the 131h day of February 2023.
