Agenda Item No.
CITY OF YUCAIPA
AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Trevor Benson, Public Safety Manage
FOR: City Council Meeting of August 14, 2023
SUBJECT: School District Request for Funding a Second School Resource Officer (SRO) Position
RECOMMENDATION:
That the City Council:
1. Approve and authorize the City Manager to execute an agreement between the City of Yucaipa and the Yucaipa Calimesa Joint Unified School District regarding the funding for a second School Resource Officer position; and
2. Approve and authorize the City Manager to execute an amendment to the Schedule A of the Law Enforcement Services Agreement with the County of San Bernardino adding a second School Resource Officer position, effective September 1, 2023; and
3. Approve a budget adjustment to increase police services revenue by $324,260 and to increase police services expenditures by $385,000 for a net cost increase of $61,650.
DISCUSSION:
Currently the City of Yucaipa has an agreement with the School District regarding various obligations related to the funding of a single School Resource Officer (SRO) position. These obligations are covered in an agreement dated May 23, 2016 between the City and the School District and is attached for additional information. In this agreement the City funds 50% of the current SRO, in exchange for the use of school district buildings, fields, parks, gymnasiums and parking lots.
Recently, the School District approached the City desiring to contract for an additional School Resource Officer. In this proposal, the City would cover the administrative supervision costs of $61,650 for the additional SRO, and the school district would cover the remaining salary amount of $324,260. The total amount for a fully burdened deputy sheriff, including a patrol vehicle, dispatch services, workers compensation, vehicle insurance, supervision and administrative support is $385,000, however because the position will not become effective until September 1, 2023, the cost will be pro -rated.
The School Resource Officer Program between the School District and the City has been an effective collaboration of mentoring, teaching, and strengthening partnerships. As a result, strong relationships developed and aided in enhancing school safety.
The mission of the School Resource Officers (SRO) Program is to assist the school district in maintaining a safe environment and to develop a positive relationship between students and law enforcement. The District and the City recognize that school officials have primary responsibility for school discipline issues and as such disciplinary issues related to students will be handled by school officials. School resource officers have primary responsibility for criminal public order offenses.
School officials and school resource officers collaborate on issues of mutual concern, including but not limited to:
• Campus safety
• Dispute Resolution
• Student education and/or mentoring opportunities
• Student threat assessments and follow up
• Law -related counseling
• School official/SRO trainings including in restorative discipline approaches • Data collection and progress monitoring
The SRO's will continue their job duties listed below:
1. Patrol in and around the assigned schools.
2. Handle calls for police service occurring in the common areas of the school.
3. Enforce laws and investigate crimes on and around the assigned school campuses.
4. Constantly work to assess and provide a safe school environment.
5. Provide classroom instruction for students in anger management, vehicle codes, and criminal law, as requested, and as feasible.
6. Identify students engaged in high -risk behavior and refer these students to appropriate intervention services.
7. Serve as a liaison between students, schools, and social service agencies that provide needed services.
8. Provide law -related resource information to students, faculty, administrators, and parents.
9. Participate in student "threat assessment" meetings with at -risk students, parent/guardian, District staff, and school staff.
10. Attend and manage safety -related meetings
11. Attend Campus Safety meetings.
12. Make presentations to faculty, administrators, PTA, and community service organizations.
The addition of a second School Resource Officer, greatly expands and refines the current capabilities and provides a greater level of service to the students, staff, faculty, and parents as well as the general public.
FISCAL IMAPCT:
As a result of the actions outlined above the fiscal impact of the recommendations is a net cost increase in police services of the FY 24 budget of $61,650.

CITY OF YUCAIPA
AND
YUCAIPA-CALIMESA JOINT
UNIFIED SCHOOL DISTRICT
JOINT USE AGREEMENT
IT
THIS AGREEMENT ("Agreement") is entered into this 23rd day of May, 2016 in the State of California by and between the CITY OF YUCAIPA, a municipal corporation, hereinafter referred to as "City," and YUCAIPA-CALIMESA JOINT UNIFIED SCHOOL DISTRICT, a California public school district, hereinafter referred to as "District." In some instances, as shown on Attachment A, "District Facility Locations," City will be the Lessee and District will be the Lessor of the property; and in some instances, as shown on Attachment B, "City Facility Locations", District will be the Lessee and City will be the Lessor of the property. In all instances herein, Lessor shall refer to the agency with a fee title interest in the property involved, and the Lessee shall refer to the agency obtaining a use interest in such property by way of this Agreement.
IT IS HEREBY AGREED AS FOLLOWS:
WHEREAS, District is the owner of several school sites located within the boundaries of the City, and the City owns certain park lands in the vicinity of such school sites; and WHEREAS, it is beneficial to the citizens of the City and District for the facilities to be used in the most cost effective manner possible; and
WHEREAS, the most cost effective use of the facilities owned by District and City can be accomplished through a joint use agreement which provides for a master, joint use lease, and otherwise sets conditions under which District will use City -owned property and facilities ("City Property") and City will use District -owned property and facilities ("District Property"); and WHEREAS, both City and District agree that the uses of the agency that owns a particular property subject to use ("Owning Agency") take precedence in terms of scheduling and use, and both parties agree to a priority of use resting with the Owning Agency, with the exception that the City's use of Yucaipa High School for Fourth of July Festivities shall be considered a priority use for the City, in exchange for the City's provision of police services, at the City's expense, to the District for the Yucaipa High School Graduation Ceremony; and WHEREAS, City and District shall fund one (1) School Resource Officer (SRO) according to the provisions set forth in the Agreement; and
WHEREAS, District owns certain property that may require the exclusion of public for student security reasons, and therefore both parties agree to those provisions of this Agreement set forth below and also contained in Exhibit I, Attachments A, B, C, D, and Exhibit II, which are attached hereto and incorporated herein by this reference.
NOW, THEREFORE, it is mutually agreed as follows
City and District agree to develop, use, operate and maintain the City and District Properties, as subject to this Agreement (hereinafter, "Leased Premises") as follows:
A. District Obligations. District shall maintain the recreational facilities at the locations and in the manner shown and described in Attachment A, identified herein as the District Property. Those recreational facilities shall be maintained on a regular basis by District with District providing all gardening and maintenance services deemed as necessary by the District.
Unless otherwise provided herein, District shall be responsible for any costs related to its maintenance of such premises.
B. City Obligations. City shall maintain facilities at the locations and in the manner shown and described in Attachment B, identified herein as the City Property. Those facilities shall be maintained on a regular basis by City, with City providing all gardening and maintenance services deemed as necessary by the City. Unless otherwise provided herein, City shall be responsible for any costs related to its maintenance of such premises.
C. Joint Obligations. As, and to the extent, defined or described in Attachments A and B, certain facilities owned by City or District, as the Owning Agency, shall be principally maintained by the other using agency, whether it be the District or City, but shall be subject to the open use of the other agency. In these instances and where indicated on Attachments A and/or B, the agency making use of the facility shall be responsible for clean-up and security of these facilities as a result of their use.
1. Yucaipa High School Baseball Field. As provided in Attachment B, relative to the Yucaipa High School Baseball Field, the District will continue to maintain the utility costs associated with the site, and the City will continue to provide for maintenance support for the site.
D. Scheduling. For scheduling of sports activities, all users will schedule the use of facilities through City's Community Services Department ("Community Services Department").
District will adhere to the Community Services Department schedule when assigning use of facilities except in the cases of District priority activities.
1. City Property. Except as provided in Section D(2), of this Agreement, for scheduling purposes all users of Leased Premises will use City's standard Facility Use Application Form as set forth in Attachment Cl, attached hereto. These forms will be approved by City.
2. District Property, For purposes of scheduling use of District Fields, all users of the Leased Premises will use District's standard Facility Use Application Form as set forth in Attachment C2, attached hereto. These forms will be approved by District and then given to City for coordination of use. In no event shall the City be permitted, absent express written consent from the District, to schedule a use on District Property during school hours (or the 30 minutes immediately preceding or following such hours), which vary from site to site. The District shall, upon request, provide the City with an updated calendar reflecting the applicable school hours during the current and, once approved, upcoming school years.
E. Additional Security Requirements; Cost Responsibility. It is recognized that activities on the Leased Premises attract members of the public other than the participants and coaches. Protection of other areas of the property away from the area being used has become increasingly difficult (i.e. restroom areas). The vandalism in these areas appears to occur during or within an hour after scheduled events. Considering this experience by both parties to this agreement, additional security may be required to protect other areas of the facility on which the activity is taking place. The user will bear the cost of this additional service.
F. Maintenance Exceptions. Each agency's obligations under this Agreement to maintain their respective properties shall be subject to reasonable maintenance and use restrictions, including, but not limited to, watering restrictions that may be imposed or implemented by the State of California, the Yucaipa Valley Water District, or any other agency charged with authority to regulate the agency's respective water use (collectively, "Water Authorities"). Each agency shall reasonably cooperate with the applicable Water Authorities to identify and, as feasible, implement water saving techniques to further benefit the public's ability to enjoy the Leased Premises, though nothing within this Agreement shall obligate either the District or City to incur financial obligations in such regard.
G. Annual Meeting. Designated representatives of City and District shall meet yearly, as needed, to review the effectiveness of this Agreement and to determine ways to improve the overall operation and use of Leased Premises during the following year.
H. Acts of God; Destruction and/or Damage to Facilities. In the event of "acts of God," such as an earthquake, causing major damage or destruction to a Leased Premises, nothing in this Agreement shall obligate the Owning Agency to rehabilitate, repair, or reconstruct the Leased Premises to its original condition. In the event of such natural disaster or other act of God causing such damage, the District and City shall meet and consider what actions, if any, should be taken.
The District and City, at their respective sole discretion, may cooperate in seeking or obtaining any federal, state, or local aid available to effectuate needed repairs or reconstruction.
I. School Resources Officers. City and District shall fund one (1) School Resource Officer (SRO) according to the following provisions:
1. The SRO will be funded jointly by City and District, with each party responsible for fifty percent (50%) of the cost of the SRO, in accordance with Exhibit II, attached hereto.
2. In return for City's payment of fifty percent (50%) of the cost of the SRO, District will make District's sport fields and gymnasiums reasonably available at no cost to local youth organizations, as permitted and approved by City.
J. Term of Agreement The term of this Agreement shall be for a period of approximately ten (10) years, commencing on the date of execution by both parties, whichever is later to occur, and ending on December 31, 2025. Either party may terminate this Agreement, without cause, on furnishing to the other party at least ninety (90) days written notice of intent to so terminate.
