SUBJECT: Award of Contract - 7th Street Pickleball Courts — Concrete Footings and Steel Structure/Cover Installation — Proiect No. 11150-2
RECOMMENDATION:
That the City Council:
1. Award and authorize the Mayor to execute a contract, and the City Manager or his designee to administer the terms of the contract in the amount of $155,850 with Three Peaks Corporation of Calimesa, CA for the 7th Street Pickleball Courts — Concrete Footings and Steel Structure/Cover Installation — Project No. 11150-2 (Project); and
2. Approve the amount of $15,585 for contract contingency and the amount of $7,793 for contract administration, inspection, and staff time for a total estimated project cost in the amount of $179,228; and
3. Approve the plans and specifications prepared for the Project.
BACKGROUND:
On September 12, 2022, the City Council approved the revised Conceptual Pickleball Master Plan for the 7th Street Pickleball facility and approved the development of Phase 1 of the facility which includes the following:
1. Removal of the existing 7th Street Modular Skate Park equipment and construction of four new pickleball exclusive courts.
2. Installation of a steel structure over the four proposed pickleball courts that emulates/expands the existing steel structure cover.
3. Installation of lighting under the new steel structure cover over the four pickleball courts.
4. Demolition of the existing theatre building located east of the existing basketball courts.
The future Phase 2 of the 7th Street Pickleball facility would include the following:
I . Construction of a restroom facility at the location of the former theater building.
2. Construction of five (5) pickleball exclusive courts at the location of the former theater building for a combined total of nine (9) new pickleball exclusive courts (when combined with the four (4) courts in Phase 1).
On January 23, 2023, the City Council awarded a contract to Western Steel Buildings of Park City, Utah for the Engineering Design and Fabrication Services Including Delivery for Yucaipa Pickleball Court Cover Project— Project No. 11150 in the amount of $149,702.46 and approved a total project budget of $169,702.46.
The Project consists of receiving installing the concrete footings for the furnished steel structure cover, leveling the existing concrete surface, unloading the City furnished steel structure cover components, and installing the components per the plans and specifications.
DISCUSSION:
The Project was advertised for bids in July of 2023. On August 15, 2023, three (3) sealed bids were received and opened as follows:

Three Peaks Corporation (Three Peaks) of Calimesa, CA is the apparent low bidder for the Project with a bid in the amount of $155,850. Staff has reviewed the apparent low bidder's bid documents and determined that they meet the contract specifications for the Project. Three Peaks has performed similar work for the City of Yucaipa and their work has been deemed satisfactory. As a result, staff recommends that City Council award a contract in the amount of $155,850 to Three Peaks for the Project.
FISCAL IMPACT:
The estimated cost of the Project of $179,228 is included in the adopted FY24 Capital Improvement Program.

WITNESSETH, in this consideration of their covenants, the parties hereto agree as follows:
The contract documents for the Project shall consist of the Notice Inviting Sealed Bids, Instructions to Bidders, Proposal, General Specifications, Standard Specifications, Special Provisions, Plans, and all referenced specifications and appendices; together with this Agreement and all required bonds, insurance certificates, permits, notices, and affidavits; and also including any and all addenda or supplemental agreements clarifying, amending, or extending the work contemplated as may be required to insure its completion in an acceptable manner (collectively, the "Contract Documents"). The Contract Documents are made a part hereof as though fully set forth herein.
In consideration of such work, City agrees to pay Contractor and Contractor agrees to accept the sum of One -Hundred Fifty -Five Thousand, Eight Hundred Fifty Dollars and XX Cents ($155,850) in the manner provided in the Contract Documents and subject to adjustment provided therein.
Concurrently with the execution of this Agreement, Contractor shall file with the City the bonds and certificates of insurance specified in the Contract Documents and subject to adjustment provided therein.
This Contract shall not be assigned without the written permission of the City Council.
