Agenda Item No.
CITY OF YUCAIPA
AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Fermin Preciado, Director of Development Services/City Engineer Landon Kern, Assistant City Engineer L
FOR: City Council Meeting of August 28, 2023
SUBJECT: Right of Entry Agreement - Inland Empire Resource Conservation District RECOMMENDATION:
That the City Council:
1) Approve and authorize the Mayor to execute a Right of Entry Agreement (Agreement) between the Inland Empire Resource Conservation District and the City of Yucaipa for the purpose of performing habitat restoration and enhancement pursuant to the Wildlife Conservation Board's Monarch Pollinator Grant Agreement; and 2) Authorize the City Manager or his designee to administer the terms of the Agreement.
BACKGROUND/DISCUSSION:
The Inland Empire Resource Conservation District (IERCD) was recently awarded funding from the Climate Resilience through Habitat Restoration on California Land grant through the Wildlife Conservation Board. The funding is for the uplift and protection of monarch butterfly support habitat within the Inland Empire, along with companion education and outreach. In April 2023, IERCD staff contacted City staff with the interest of implementing grant funding on a section of the El Dorado Ranch Park. The proposed project would consist of the restoration and uplift of a 1.5 acre area within the park with milkweed and other similar Monarch pollinator plants. The IERCD will be responsible for the site preparation, installation, maintenance, and management of the site.
Currently, the site is mostly dominated by invasive weeds, therefore, the project will include invasive species treatment as part of the site preparation. Once completed, the site will be dominated by native plants that will provide pollinator habitat for monarch butterflies. This will improve the functionality of the site and it will provide habitat for other wildlife species as well.
Exclusionary fencing and informational signage will be installed to protect the habitat at the site.
To move forward with this effort, the City must grant IERCD permission to enter the site and complete the project by signing the Agreement. The term of this Agreement shall commence on
the date of the last signature on this Agreement ("Effective Date"). This Agreement shall automatically terminate on December 31, 2033. The term may be extended by written notice from either party.
Staff has worked closely with IERCD over the last several years to identify off -site environmental mitigation needs for the construction of several Capital Improvement Program (CIP) projects, including the Wilson III Basin Project, Fremont Avenue Low Water Crossing Bridge, El Dorado Ranch Park, the upcoming Upper Wildwood Basin Project, and other drainage and flood control projects. The continued partnership with IERCD has been instrumental in facilitating the delivery of these projects and associated long-term management of the environmental mitigation measures required by the resource agencies for the City's projects. The project identified in the proposed agreement is consistent with the required environmental mitigation measures identified for implementation at El Dorado Ranch Park.
FISCAL IMPACT:
None.
