SUBJECT: Award of Contract Work - Fiscal Year 2023/2024 Concrete Program Phase I - Project No. 11194
RECOMMENDATION:
That the City Council:
1) Award and authorize the Mayor to execute a contract, and the City Manager or his designee to administer the terms of the contract to the lowest responsible bidder, Three Peaks Corp. of Calimesa, CA in the amount $86,982.50 for the FY 2023/2024 Concrete Program Phase I, Project No. 11194 (Project); and
2) Approve the amount of $8,600 for construction contract contingency and the amount of $4,300 for construction contract administration, staff time, and inspection costs for a total construction budget in the amount of $99,883; and 3) Approve the plans and specifications prepared for the Project; and 4) Authorize an amendment to the FY2023/2024 Multi -Year Capital Improvement Program (CIP) Budget to increase the Concrete Program expenditures by $99,883.
BACKGROUND/DISCUSSION:
On March 8, 2022, City Council approved the FY2022/2023 Pavement Management Program (PMP). Included as a part of the PMP is the Concrete Program (Program).
The Program is intended to meet the City's goal to improve pedestrian and ADA access throughout the City as part of the ADA Transition Plan adopted by the City Council on February 22, 2016. The proposed Program includes the replacement of cracked, broken or deteriorated concrete sidewalk, driveway approaches, curb & gutter, and replacement of a curb ramp at various locations throughout the City. The sections of sidewalk being replaced have been reported by residents and the general public. The reported sidewalk related concerns have been processed through the Public Works Department's GIS based maintenance reporting system and have been verified by staff prior to adding the repairs to the Program.
Staff publicly advertised the Project for construction bids and on August 17, 2023, four (4) bids were received from contractors as follows:

Three Peaks Corp. (Three Peaks) of Calimesa, CA, is the apparent lowest responsible bidder. The Engineer's Estimate for the Program is $90,050. Staff has reviewed the bid documents and determined that the documents meet the requirements of the contract specifications. Three Peaks has completed several similar projects for the City in the past and their work has been deemed satisfactory.
Consequently, staff recommends the award of the contract to Three Peaks in the amount of $86,982.50.
The FY2022/2023 budget included $80,000 for the Program that was unused. Staff is recommending reauthorizing that amount in FY2023/2024 and supplementing the authorization by an additional $19,883.
FISCAL IMPACT:
The result of the recommendation is an increase in the FY2023/2024 budget of $99,883.

THIS AGREEMENT is made and entered into this 28th day of August 2023, by and between the City of Yucaipa, a municipal corporation, hereinafter referred to as "City", and Three Peaks Corp. located at P.O. Box 101

PROJECT: 2022-2023 Concrete Proaram — Project No. 11194 WITNESSETH, in this consideration of their covenants, the parties hereto agree as follows:
The contract documents for the Project shall consist of the Notice Inviting Sealed Bids, Instructions to Bidders, Proposal, General Specifications, Standard Specifications, Special Provisions, Plans, and all referenced specifications and appendices; together with this Agreement and all required bonds, insurance certificates, permits, notices, and affidavits; and also including any and all addenda or supplemental agreements clarifying, amending, or extending the work contemplated as may be required to insure its completion in an acceptable manner (collectively, the "Contract Documents"). The Contract Documents are made a part hereof as though fully set forth herein.
In consideration of such work, City agrees to pay Contractor and Contractor agrees to accept the sum of Three Hundred Twenty -Six Thousand Three Hundred Twenty- Six Dollars and Zero Cents ($86,982.50) in the manner provided in the Contract Documents and subject to adjustment provided therein.
Concurrently with the execution of this Agreement, Contractor shall file with the City the bonds and certificates of insurance specified in the Contract Documents and subject to adjustment provided therein.
This Contract shall not be assigned without the written permission of the City Council.
