CITY OF YUCAIPA

AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Fermin Preciado, Director of Development Services/City Engineer Landon Kern, Assistant City Engineer L l
Kevin Garcia, Assistant Engineer tk,(`
FOR: City Council Meeting of August 28, 2023
SUBJECT: Reject Bids — 2022-2023 AC Berm Curb Program — Project No. 11195 RECOMMENDATION:

That the City Council:

1. Reject all bids for the 2022-2023 AC Berm Curb Program — Project No. 11195; and

2. Direct staff to rebid the project and conduct additional project outreach for construction bids/proposals.

BACKGROUND/DISCUSSION:

On March 8, 2022, the City Council approved the FY2022/2023 Pavement Management Program (PMP). Included as a part of the PMP is the FY2022/2023 AC Berm Curb Program (Program).

The Program was initiated in order to replace existing/deteriorated asphalt berm curbs at various locations throughout the City. As these curbs or berms wear out or are damaged, they no longer perform their designed function, which is to keep storm water run-off within the paved areas of the streets. Absent the curbs/berms, this may result in stormwater run-off entering private properties and can also reduce the life of the asphalt on existing City streets.

DISCUSSION:

Staff publicly advertised the Program for construction bids and on July 25, 2023, one (1) bid was received from a contractor as follows:

Contractor
Bid Amount
Onyx Paving Company
$159,840
Engineer's Estimate
$42,500
The amount of the bid received is significantly higher than the engineer's estimate. Staff has reached out to several asphalt contractors and concluded that a combination of factors resulted in

only one bidder submitting a bid for the Program. The primary factor was the timing of the bid advertisement with respect to other asphalt paving construction projects in the region.

Staff believes that re -advertising the project in the next several weeks, clearly defining the scope of work and conducting additional outreach to potential contractors will allow for more bidders to submit bid proposals, and therefore result in more competitive bids. Consequently, staff is recommending that the City Council reject all bids for the Program, and the Program be re - advertised for construction bids in order to ensure that the response from contractors is increased and the number of bids received is increased.

FISCAL IMPACT:

None.
