SUBJECT: Award of Contract — City Yard Paving and Hardscape Project — Project No. 11190 RECOMMENDATION:
That the City Council:
1) Award and authorize the City Manager to execute a contract, and the City Manager or his designee administer the terms of the contract to the lowest responsive bidder, Three Peaks Corporation of Calimesa, CA in the amount of $488,433 for the City Yard Paving & Hardscape Project - Project No. 11190; and
2) Approve the amounts of $97,000 for construction contract contingency and the amount of $25,000 for construction contract administration, staff time, testing and inspection, for a total construction budget in the amount of $610,433; and 3) Authorize the City Manager or his designee to administer the distribution of the contract contingency; and
4) Approve the plans and specifications prepared for this Project.
DISCUSSION:
The New City Yard Relocation Project (Relocation Project) includes the removal and relocation of the City Yard facilities, as part of the Oak Glen Creek Specific Plan. The Relocation Project is being completed in phases and will serve as the City's Public Works Maintenance Yard. The Relocation Project includes the installation of three (3) steel structures, the installation of tenant improvements inside those buildings, and the design and installation of underground utilities, site/access-road paving, and landscaping.
Beginning in July 2020, the City Council awarded multiple construction contracts for the improvements required for the Relocation Project. These contracts included site grading, fabrication and installation of the New City Yard steel buildings, interior building improvements, and the installation of wet and dry utilities, all of which have been completed. The remaining phases of construction for the Relocation Project include paving of access roads, concrete flatwork, and
construction of material storage bays.
The remaining items of work are included in this phase of the Relocation Project (Project). This Project was advertised for bids in August of 2023. On September 7, 2023, four (4) sealed bids were received and opened as follows:

An additional bid was received and opened. Upon evaluation of this bid, it was determined to be incomplete due to the lack of required documentation submitted with the bid and this bid has therefore been determined to be non -responsive.
Three Peaks Corporation (Three Peaks) of Calimesa, CA is the apparent responsive low bidder. Staff has reviewed the bid documents and determined that the documents meet the requirements of the construction contract specifications. Three Peaks has performed similar work for the City of Yucaipa and their work has been deemed satisfactory. As a result, staff recommends that the City Council award and authorize the City Manager to execute an agreement for the Project to Three Peaks in the amount of $488,433.
FISCAL IMPACT:
The estimated cost of this Project in the amount of $610,433 is included in the adopted FY24 Capital Improvement Program.

PROJECT: City Yard Paying and Hardscape — Proiect No. 11190 WITNESSETH, in this consideration of their covenants, the parties hereto agree as follows:
The contract documents for the Project shall consist of the Notice Inviting Sealed Bids, Instructions to Bidders, Proposal, General Specifications, Standard Specifications, Special Provisions, Plans, and all referenced specifications and appendices; together with this Agreement and all required bonds, insurance certificates, permits, notices, and affidavits; and also including any and all addenda or supplemental agreements clarifying, amending, or extending the work contemplated as may be required to ensure its completion in an acceptable manner (collectively, the "Contract Documents"). The Contract Documents are made a part hereof as though fully set forth herein.
In consideration of such work, City agrees to pay Contractor and Contractor agrees to accept the sum of Four -Hundred Eighty -Eight Thousand, Four -Hundred Thirty -Three Dollars and 00 Cents ($488,433.00) in the manner provided in the Contract Documents and subject to adjustment provided therein.
Concurrently with the execution of this Agreement, Contractor shall file with the City the bonds and certificates of insurance specified in the Contract Documents and subject to adjustment provided therein.
This Contract shall not be assigned without the written permission of the City Council.
