CITY OF YUCAIPA
AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Fermin Preciado, Director of Development Services/City Engineer fP Kevin Garcia, Associate Engineer 0
FOR: City Council Meeting of September 25, 2023
SUBJECT: Award of Contract — Painting of Various City Facilities Project, Phase II — Project No. 11196
RECOMMENDATION:
That the City Council:
1) Award and authorize the City Manager to execute a contract, and the City Manager or his designee to administer the terms of the contract to the lowest responsible bidder, Innovation Painting Inc. of Ontario, CA in the amount $90,000 for the Painting of Various City Facilities Project, Phase II — Project No. 11196 (Project); and 2) Approve the amount of $18,000 for construction contract contingency and the amount of $4,500 for construction contract administration, staff time, and inspection for a total construction budget in the amount of $112,500.
BACKGROUNDMISCUSSION:
The Project is being initiated to provide the necessary maintenance of public facility buildings by painting the exterior of said buildings. The existing exterior paint at the various city buildings has exceeded its useful life. By painting the buildings, the exterior surfaces of those buildings can be further protected from the elements, extend the life of buildings, and provide a more aesthetic appearance.
The City facilities/buildings included in the Project are as follows:
• Yucaipa Transit Center (34272 Yucaipa Boulevard)
• Yucaipa Library (12040 5t' Street)
• Gazebo Structures (8) at Yucaipa Community Park (34900 Oak Glen Road) • Fire Station #2 (32664 Yucaipa Boulevard)
The Project shall consist of the painting of all the exterior surfaces of the above listed facilities, including but not limited to flashing, facia boards, trellis material, columns, beams, doors, stucco walls, eaves, handrails, wrought -iron fencing, and trash enclosures. Repair work shall be made to all facia boards that are warped by either replacing the boards or filling in the cracks, depending
upon the severity. The work may include repairing minor damaged sections of stucco.
The Project was advertised for bids in August of 2023. On September 5th, 2023, nine (9) sealed bids were received and opened as follows:

Cramer Painting Co.
$130,500
Tony Painting
$174,300
Mear Construction, Inc.
$233,000
The cost estimate for the Project is $99,000. Pacific Rim Painting of Fresno, CA was initially determined to be the apparent low bidder for the Project with a bid in the amount of $43,900. A letter was received from Pacific Rim Painting on September 8, 2023, requesting to rescind their bid due to a clerical error in regard to price(s) made to the Project. Consistent with California Public Contract Code § 5103 (2022), this constitutes a formal bid withdrawal for Pacific Rim Painting.
Therefore, the apparent lowest responsible bidder was determined to be Innovation Painting Inc. of Ontario, CA.
Staff has reviewed the bid documents and determined that the documents meet the requirements of the contract specifications. Innovation Painting Inc. has completed several similar projects in the past for other public agencies and their work has been deemed satisfactory. Consequently, staff recommends the award of the contract to Innovation Painting Inc. in the amount of $90,000.
FISCAL IMPACT:
The $112,500 in the recommendation is included in the FY2023/2024 Budget in the Capital Projects Fund (Fund 35).
