2. Find that the Ordinance is exempt from Environmental Review as an Addendum to the 2016 Yucaipa General Plan Environmental Impact Report that had been prepared for the 6th Cycle Housing Element Update (2021-2029) in accordance with Section 15164 of the CEQA Guidelines, and identified that the conditions outlined in Section 15162 of the Guidelines that call for preparation of a subsequent or supplemental EIR were not met; further the adoption of the Ordinance is consistent with Program #8 identified in the Housing Element, and would not result in impacts not originally analyzed in the Addendum to the 2016 General Plan EIR.

1. Approve first reading, by title only, as read by staff, of Ordinance No. 431 that will regulate the development of Two Unit Residential Development or Urban Lot Splits for Single Family-designated Lots in accordance with Senate Bill 9; and

2. Find that Ordinance No. 431 is exempt from Environmental Review as state law includes a provision that explicitly states that an ordinance to implement Senate Bill 9 (California Government Code Section 65852.21) shall not be considered a project under the California Environmental Quality Act (CEQA) and, therefore, is not subject to environmental review. Further, future projects completed under SB9 would be a ministerial action and exempt from CEQA, and under the “General Rule” (Section 15061(b)(3)), SB9 preempts any City regulations that are not in place.

17. SUBJECT: CITY OF YUCAIPA (CASE NO. 22-168/DCA); CONSIDERATION OF ORDINANCE NO. 435, AMENDING ARTICLE 7 OF CHAPTER 1 OF DIVISION 3 OF THE YUCAIPA DEVELOPMENT CODE REGARDS THE CITY’S DENSITY BONUS

BACKGROUND/DISCUSSION:

On March 8, 2022, the City Council approved the FY2022/2023 Pavement Management Program (PMP). Included as a part of the PMP is the Concrete Program (Program).

The Program is intended to meet the City's goal to improve pedestrian and ADA access throughout the City as part of the ADA Transition Plan adopted by the City Council on February 22, 2016.

The Program included the replacement of cracked, broken or deteriorated concrete sidewalks, driveway approaches, curb & gutter, and replacement of curb ramps at various locations throughout the City. The sections of sidewalk that were replaced were reported by residents and the general public. The reported sidewalk related concerns were processed through the Public Works Division's GIS based maintenance reporting system and were verified by staff prior to adding the repairs to the Program.

On August 28, 2023, the City Council awarded a contract to Three Peaks Corp. of Calimesa, CA to complete the Project in the amount of $86,982.50. The City Council also approved the amount of $8,600 for contract contingency and the amount of$4,300 for contract administration, inspection, and staff time for a total construction budget in the amount of $99,883. The Program required additional work and a contract change order was administratively approved by staff in the amount of $8,204.50, increasing the contract amount to $95,187. The additional work included the replacement of additional sidewalk, curb, and gutter encountered during the course of the work.

DISCUSSION:

The Yucaipa Fire Department (YFD) services the City of Yucaipa as well as the community of Oak Glen (under contract from San Bernardino County Fire). With a modest estimated population of 57,000 residents spanning approximately 43 square miles, the Yucaipa area has seen recent major devastation from the Apple Fire, El Dorado Fire, El Dorado Mudslides and active Golden Spotted Oak Borer infestation. Along with these current and lingering major events, the potential for additional impending major disasters with high/very high fire hazard severity zones in the Wildwood Canyon Corridor and Pigsah Peak Range (northern and eastern area in Oak Glen, western area in Avenue E Canyon, and southern area in Wildwood State Park and Wildwood Canyon Corridor of Yucaipa) is substantial. The need for multiple resource management projects is imperative and staff is seeking grant funding to ensure the safety of our community.

The agreement would fund a heavy-duty wood chipper for purchase by the YFD. This chipper would enable the City to provide chipping for community projects and the ability to use the chipper for multiple hazard fuel reduction projects in the High and Very-High Fire hazard severity zones.

There are several proposed resource management projects in the planning and review process. The YFD is also working in collaboration with state parks to reduce hazardous fuels in the Wildland Urban Interface (High and Very High Fire Hazard Severity Zones) in and adjacent to the Wildwood Canyon State Park.

City Council Meeting of October 23, 2023
City of Yucaipa (Case No. 22-165/DCA/ORD): Consideration of Ordinance No. 429, proposing amendments to streamline the review process initially developed as part of Ordinance No. 344, which amended Chapter 4 (Land Use Modifications) of Division 5 (Overlay Districts) of Volume II (Development Code) of the Yucaipa Municipal Code establishing mobilehome park conversion standards, to comply with the City's Housing Element
(Continued from September 25, 2023)
RECOMMENDATION:

That the City Council consider the Planning Commission's recommendation to:

1.Approve first reading, by title only, as read by staff, of Ordinance No. 429 amending Division 4 of the Yucaipa Development Code to streamline the review process initially developed as part of Ordinance No. 344, to achieve compliance with Program #8 of the City's Housing Element; and

2.Find that the Ordinance is exempt from Environmental Review as an Addendum to the 2016 Yucaipa General Plan Environmental Impact Report that had been prepared for the 6th Cycle Housing Element Update (2021-2029) in accordance with Section 15164 of the CEQA Guidelines, and identified that the conditions outlined in Section 15162 of the Guidelines that call for preparation of a subsequent or supplemental EIR were not met; further the adoption of the Ordinance is consistent with Program #8 identified in the Housing Element, and would not result in impacts not originally analyzed in the Addendum to the 2016 General Plan EIR.

BACKGROUND:

State Law requires that cities adopt a General Plan to guide future development, goals, and the long-range vision of a community. It is recommended that General Plan policy documents are updated every 10-20 years to reflect changes to circumstances such as the economy, community values, and the built environment. Further, on April 11, 2016, the City Council adopted Resolution No. 2016-08, adopting the updated 2016 General Plan. This update included General Plan Policy CDL-11 (Preservation and Reuse), Policy CDL-11.5 (Mobile Home Park 15 17110/23/2023 City Council Agenda
