SUBJECT: Acceptance of Contract Work — Fiscal Year 2023/2024 Concrete Program Phase I — Project No. 11194
RECOMMENDATION:
That the City Council:
1) Accept the contract work completed by Three Peaks Corp. in the amount of $95,187 for the 2022-2023 Concrete Program — Project No. 11194; and 2) Authorize the recordation of the Notice of Completion for the Program.
BACKGROUND/DISCUSSION:
On March 8, 2022, the City Council approved the FY2022/2023 Pavement Management Program (PMP). Included as a part of the PMP is the Concrete Program (Program).
The Program is intended to meet the City's goal to improve pedestrian and ADA access throughout the City as part of the ADA Transition Plan adopted by the City Council on February 22, 2016.
The Program included the replacement of cracked, broken or deteriorated concrete sidewalks, driveway approaches, curb & gutter, and replacement of curb ramps at various locations throughout the City. The sections of sidewalk that were replaced were reported by residents and the general public. The reported sidewalk related concerns were processed through the Public Works Division's GIS based maintenance reporting system and were verified by staff prior to adding the repairs to the Program.
On August 28, 2023, the City Council awarded a contract to Three Peaks Corp. of Calimesa, CA to complete the Project in the amount of $86,982.50. The City Council also approved the amount of $8,600 for contract contingency and the amount of $4,300 for contract administration, inspection, and staff time for a total construction budget in the amount of $99,883. The Program required additional work and a contract change order was administratively approved by staff in the amount of $8,204.50, increasing the contract amount to $95,187. The additional work included the replacement of additional sidewalk, curb, and gutter encountered during the course of the work.
Inspections performed by staff during the course of the work and upon completion of the work have
assured that the work was completed in accordance with the contract specifications for the Project.
FISCAL IMPACT:
There is no additional fiscal impact as a result of the proposed recommendations. The table below includes the approved budget and actual costs for the completed Project:

NOTICE OF COMPLETION
Pursuant to the provisions of Section 9204 of the Civil Code of the State of California, NOTICE IS HEREBY GIVEN that work on the certain project known as:
PROJECT NO. 11194
2022-2023 CONCRETE PROGRAM
for the City of Yucaipa was completed and accepted by the City of Yucaipa on the 231d day of October 2023.
The said work was performed by Three Peaks Corp. of Calimesa, CA in accordance with the terms of the written agreement dated the 28th day of August 2023.
