SUBJECT: Infrastructure Construction and Coordination Agreement with the Yucaipa Valley Water District Regarding Pavement Rehabilitation
RECOMMENDATION:
That the City Council:
Approve and authorize the City Manager to execute an Infrastructure Construction and Coordination Agreement with the Yucaipa Valley Water District in the amount of $131,940 for the pavement rehabilitation road improvement project on Goldstone Street and Peach Tree Circle; and
2. Amend the FY2023/2024 Capital Improvement Program by adding the amount of $91,940 in funding from the Yucaipa Valley Water District.
DISCUSSION:
On June 12, 2023, the City Council awarded a construction contract for the 2022-2023 Street Rehabilitation Program (Project) to Matich Corporation in the amount of $1,173,357, approved a construction contract contingency amount of $293,000, and authorized the amount of $97,000 for construction contract administration, staff time, testing and inspection for a total construction budget in the amount of $1,563,357. The Project includes asphalt street repair and resurfacing of asphalt pavement in various streets throughout the City consistent with the FY2022/2023 Pavement Management Program (PMP) approved by the City Council on March 8, 2022.
Between January and August of this year, the Yucaipa Valley Water District (YVWD) replaced approximately 3,400 linear feet of water mains on Goldstone Street and Peach Tree Circle. The YVWD projects consisted of approximately 2,742 linear feet of 8-inch water main replacement on Peach Tree Circle, and approximately 660 linear feet of 8-inch water main replacement on Goldstone Street, west of Topaz Street.
In coordination with the City, YVWD completed temporary trench and asphalt repairs on Goldstone Street and Peach Tree Circle in anticipation of the City's Project. In accordance with the
City's asphalt and trench repair standards, YVWD would be required to construct permanent trench and asphalt repairs when they complete their pipeline replacement projects within the City.
As has been done in the past, and due to the timing and scope of work with the City's Project, YVWD has expressed interest in contributing funding to the City's Project to allow the City's contractor to perform the required permanent trench and asphalt repair work as part of the City's overall Project. By performing the trench repairs as part of the City's street rehabilitation work, it will result in a better finished product and will extend the overall life of the pavement by eliminating joints in the asphalt caused by utility pavement cuts and trench repairs.
Staff is recommending that the City Council authorize the City Manager to execute an Infrastructure Construction and Coordination Agreement (Agreement) with YVWD. This Agreement will allow YVWD to contribute $131,940 in funding to the City for the Project in order to complete the required asphalt trench repairs on Goldstone Street and Peach Tree Circle.
Completing the rehabilitation of these street segments now with partial funding from YVWD will result in a timely, cost-effective trench repair completed with the Project in order to improve the overall condition of the asphalt pavement at these locations.
FISCAL IMPACT:
The recommendation results in $91,940 in additional revenue to the FY2023/2024 Capital Improvement Program.

AGREEMENT BY AND BETWEEN
THE CITY OF YUCAIPA AND THE YUCAIPA VALLEY WATER DISTRICT The City of Yucaipa, a Municipal Corporation, hereinafter referred to as "City", and Yucaipa Valley Water District, a Special District, hereinafter referred to as "District", hereby mutually agree as follows.
A. Purpose of Agreement: The District has completed pipeline replacement construction consisting of the installation of approximately 3,402 linear feet of 8-inch and 6-inch water line replacement that will replace the existing water mains in Peach Tree Circle and Goldstone Street. In cooperation with the City, the City will pave Peach Tree Circle and Goldstone Street to include the segments of the newly installed pipeline as part of its 2022-2023 Pavement Rehabilitation Project.

B. Scope of Agreement: In exchange for the City's paving on Peach Tree Circle and Goldstone Street, the District will:
A. Contribute $131,940 toward the City's 2022-2023 Street Rehabilitation Program for pavement rehabilitation on Peach Tree Circle and Goldstone Street, upon award of City contract (Estimated paving cost table attached).
B. The trenches with temporary pavement on Peach Tree Circle and Goldstone Street will remain in place and be maintained by the City until the City's pavement rehabilitation work in this area is completed.
IN WITNESS WHEREOF, the City of Yucaipa and the Yucaipa Valley Water District have executed this Agreement the day and year first written below.
