RECOMMENDATION:

That the City Council:
1) Accept the contract work completed by Three Peaks Corp. in the amount of $572,254.90 for the Live Oak Canyon Road Improvements at Outer Highway South — Project No. 10981-2; and
2) Authorize the recordation of the Notice of Completion for the Project; and 3) Accept the as -built plans for the Project.

BACKGROUND/DISCUSSION:

The FY2023/2024 Capital Improvement Program (CIP) includes the Oak Glen Road/Live Oak Canyon Road Widening Project, Colorado Street to Outer Hwy-10 South (overall project). The overall project includes the construction of ultimate street improvements consistent with the City's General Plan Transportation Element. These improvements include street widening, constructing new curb/gutter, sidewalk, commercial driveway approaches, signing/pavement striping and the installation of a new traffic signal with intersection improvements at Live Oak Canyon Road and Outer Hwy-10 South. This project was prioritized in order to improve traffic circulation on Oak Glen Road and Live Oak Canyon Road near the I-10 Freeway, improve access to the commercial properties and the Pumpkin Patch property in the area, and improve access to and from the I-10 Freeway.

The engineering design of the overall project was initiated in 2018 and the construction is being completed in phases. Phase I, completed in 2018, included the construction of a new dedicated right turn lane with a commercial driveway approach and modifications to the signing and striping on the north side of Oak Glen Road between 14t' Street and the I-10 Freeway. The Phase I work was completed adjacent to the AM/PM gas station.

For Phase 2, staff prepared the engineering plans and bid documents for the Live Oak Canyon Road Improvements at Outer Highway South Project No. 10981-2 (Project). The Project includes the

installation of a new traffic signal and intersection improvements on Live Oak Canyon Road and Outer Highway South. The Project also includes a fourth approach at the intersection which will serve as an access point to the Pumpkin Patch property. The Project also includes street widening and sidewalk on the east side of Live Oak Canyon Road that will join with improvements that have been constructed by the owner of the Pumpkin Patch property as a requirement of their Conditional Use Permit for the use of the property.

On July I Ith, 2022, the City Council awarded a contract to Three Peaks Corp. to complete the Project in the amount of $531,360.50. The City Council also approved the amount of $43,000 for construction contract contingency for a total construction contract budget in the amount of $574,360.50. Given the importance of completing the Project prior to the peak season for the Pumpkin Patch activities (late September through November) and taking into account the long lead times for delivery of traffic signal poles and equipment, on May 23, 2022, the City Council authorized the purchase of traffic signal poles and associated traffic signal equipment to McCain, Inc. in the amount of $88,658.23. The traffic signal poles were delivered to the City and were installed by the contractor as a part of the Project.

During the course of construction, additional work was required and completed within the authorized contract contingency amount for the Project. Inspections performed by staff during the course of the work and upon completion of the work have assured all work was completed in accordance with the construction contract specifications for the Project.
