SUBJECT: Comprehensive User Fee Schedule Update
RECOMMENDATION:
That the City Council conduct a Public Hearing and subsequently approve Resolution No. 2023- 54, rescinding Resolution No. 2023-44, and adopting an update to the Comprehensive User Fee Schedule establishing an EMS User Fee and including fees and charges for services rendered in relation to Community Development, Building and Safety, Fire Prevention and Planning, Business License Administration, Yard Sale Permits, False Alarms, Construction and Demolition Recycling, and various other general or administrative City services, and making related determinations pursuant to the California Environmental Quality Act.
DISCUSSION:
In 2022, the City contracted with Willdan Financial Services (Willdan) to prepare an EMS User Fee Study to determine the current cost of City provided services, and recommendations for changes to the fees charged for those services. As a part of the process to determine the current cost of providing ambulance services, Willdan required input from the Fire Department to determine the direct, indirect and overhead cost of each service.
The principle rationale for an EMS User Fee is that the services rendered by the Yucaipa Fire Department have greatly expanded well beyond the traditional fire suppression generally supported by property taxes. The change in balance from primarily fire suppression to advanced life support emergency medical services has shifted the rationale for financing Fire Department operations from primarily property -related taxes to a combination of property taxes, assessment and user fees. As our department has transitioned to provide trained staff for both fire suppression and medical services for an ever-expanding call volume, there have been no additional taxes or increases in our budget to fund the costs to provide these services considering a failed Measure E in 2020 and Measure Y Paramedic assessment having no built-in funding escalator. This item is a proposed cost recovery mechanism, an EMS User Fee. Not all cities have firefighters who are
also paramedics, as we do in the City of Yucaipa. This enhanced level of service protects our community to a great degree and is now deemed an essential service. EMS User Fees have become an industry standard among cities with this response capability to help offset the cost of the enhanced paramedic level of service provided by fire engine companies. In California, over 100 jurisdictions incorporate fees into their EMS service delivery funding plans.
The intent of the EMS User Fee would be to cover costs for "actual services rendered" by Yucaipa Fire Department Paramedics during emergency medical service calls as well as associated equipment and supplies whose costs are exceeding funding provided by the Measure Y assessment.
This proposed fee would be applied based on call for service to residents and non-residents as a User Fee as established by City Council.
Currently, under the California Code of Regulations, the California Fire Code and Yucaipa Municipal Code Section 3.28.040, Section 9.24.060, Section 9.24.030, Local Ordinance No. 394 (May 2020) and the California Government Code Article 8, Section 51359 (1) allow for cost recovery of emergency response expenses.
The amount of the proposed EMS User Fee is calculated as costs that exceed funding. That is, costs to deliver paramedic services are identified and compared to revenues from Measure Y assessments.
The net cost is divided by estimated calls for service to calculate the revenue shortfall. This shortfall has been increasing since Measure E failed and is currently drawing down previously accumulated property tax revenue that City Council committed to Fire. In the current fiscal year, there is a projected deficit of $2.4 million in the Fire Fund, which includes the paramedic backfill funding. The remaining "savings account" for the Fire Fund is estimated to be approximately $6 million at the end of the fiscal year. If an EMS User Fee is established, any revenue generated would slow the drain on savings within the Fire Fund, which is projected to be depleted in less than 3 years. The fee would be included in the City's Comprehensive User Fee Schedule and be subject to updates in a similar fashion to all other User Fees. Fees are established and amended through the process of a public hearing.
Establishing an EMS User Fee has been previously reviewed and recommended approval to move to a public hearing by the Public Safety Ad -Hoc Committee and City Council at study session.
In addition to the EMS User Fee, the attached Comprehensive User Fee Schedule (Attachment 2) includes three fees related to signage that were not adopted at the September 25, 2023 City Council Meeting. Additionally, minor adjustments to clarify language is reflected throughout Attachment 2.
The changes to the schedule are highlighted in Attachment 3.
FISCAL IMPACT:
There is currently an operational funding deficit in the paramedic department. The recommended action will establish a mechanism to partially offset costs that exceed current funding. While the recommendation establishes the mechanism, staff is continuing to review options for billing and collection of the EMS User Fee and therefore the billing and collection of the fee is not included in this item.

Based on the current costs, the additional squad, and evenly funding paramedic trucks, the City's unfunded cost of the program in FY24 is $2,918,616. Using the average number of paramedic calls for service of 5,966 a fee of $489 is calculated.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YUCAIPA, CALIFORNIA, RESCINDING RESOLUTION NO. 2023-44 AND
ADOPTING AN UPDATE TO THE COMPREHENSIVE USER FEE
SCHEDULE AND AMENDING FEES AND CHARGES FOR SERVICES
RENDERED IN RELATION TO COMMUNITY DEVELOPMENT,
BUILDING AND SAFETY, FIRE PREVENTION AND PLANNING,
BUSINESS LICENSE ADMINISTRATION, YARD SALE PERMITS,
FALSE ALARMS, CONSTRUCTION AND DEMOLITION RECYCLING,
AND VARIOUS OTHER GENERAL OR ADMINISTRATIVE CITY
SERVICES, AND MAKING RELATED DETERMINATIONS PURSUANT
TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT
THE CITY COUNCIL OF THE CITY OF YUCAIPA HEREBY FINDS,
DETERMINES, ORDERS, AND RESOLVES AS FOLLOWS:
Section 1. Findings.
A. The City Council has determined that it is necessary to assess fees for the process of private development related requests, planning, engineering, building and safety related requests, and other services; and
B. The City Council has conducted an extensive analysis of its services, the costs reasonably borne by the City in providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services; and C. The City Council has determined that City staff provides many types of services ("Services") involving requests by City customers ("Applicants"); and D. The City currently imposes various user fees (the "User Fees") upon Applicants to recover the costs of staff time and other expenses related to providing these Services; and E. Current User Fees charged for the City's Services do not adequately recoup the City's costs of providing certain Services and thus, a certain amount of these costs are currently paid out of the City's General Fund and, therefore, borne by the general public; and F. The City Council desires to better recover the costs of providing these Services from Applicants who have sought the City's Services by revising its schedule of User Fees; and G. The proposed User Fees are initially based upon the information contained in a document by City staff and Consultant ("Consultant") entitled "Comprehensive User Fee Study Report" ("User Fee Study"), dated April 18, 2018; and
H. Pursuant to Government Code Sections 66016, 66017 and 66018, the specific fees to be charged for certain regulations, services and products must be adopted by resolution, following notice and public hearing; and
I. Notice of public hearing has been given pursuant to Government Code Section 6062a, and written notice has been provided to interested parties who filed written requests for mailed notice of meetings on new or increased development -related fees or service charges; and J. The City Council conducted a duly noticed Public Hearing on November 13, 2023, at which time the public was invited to make oral and written presentations as part of the regularly scheduled meeting prior to the adoption of this Resolution; and K. The City published notice of the public hearing as described above in accordance with Government Code Sections 6062(a), 66016, 66017 and 66018 for the various User Fees; and
L. The approval of the User Fees established in this Resolution does not constitute a "project" under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Section 15378(b)(4) because such actions involve the creation of a government funding mechanism which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment, and M. The approval of the User Fees established in this Resolution is statutorily exempt from CEQA under CEQA guidelines Section 15273 (a)(1) because the Resolution is merely establishing fees to meet operating expenses.
Section 2. Adoption of Fees and Charges. The City Council hereby adopts the City of Yucaipa User Fee Schedule ("User Fee Schedule") as set forth in attached Exhibit "A" and incorporated by this reference. Unless otherwise stated in the User Fee Schedule, all User Fees shall be paid to the City by the Applicant prior to the City's performance of the requested Services.
Section 3. Repeal of Conflicting Resolutions. It is the desire of the City Council that all fees and charges for services, programs or products be set forth in one document for ease of reference. Accordingly, any and all provisions of prior Resolutions of the City Council establishing or modifying fees for the services, programs or products set forth in Exhibit "A," are hereby repealed and replaced as of the effective dates as set forth in Section 7 of this Resolution in the manner set forth in Exhibit "A;" provided, however, that such repeal shall not excuse or affect the failure of any person or entity to pay any fee heretofore imposed upon such person or entity. The City Council desires to clarify that in adopting this Resolution, it is taking action only on those fees for the services, programs or products set forth in Exhibit A which have been modified from prior resolutions of the City Council. The remaining fees that have not been modified from prior resolutions shall remain in full force and effect and are hereby restated for convenience so that all fees are set forth in one document.
Section 4. Policies and Procedures. Staff is hereby authorized and directed to establish policies and procedures for implementation and collection of User Fees.
Section 5. CEQA. The approval of the User Fees established in this Resolution does not constitute a "project" under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Section 15378(b)(4) because such actions involve the creation of a government funding mechanism which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. Furthermore, the approval of the User Fees established in this Resolution is statutorily exempt from CEQA under CEQA guidelines Section 15273 (a)(1) because the approval of the User Fees is merely establishing fees to meet operating expenses.
Section 6. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Resolution or any part hereof is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portion of this Resolution or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrase be declared invalid or unconstitutional.
Section 7. Effective Date. The User Fees listed in the User Fee Schedule in Exhibit A, which are imposed on a development project and which apply to the filing, accepting, reviewing, approving or issuing of an application, permit, or entitlement to use shall be effective no sooner than 60 days following the date this Resolution is adopted.
All other User Fees listed in the User Fee Schedule in Exhibit A shall become effective upon adoption.
Section 8. Certification. The Mayor shall sign this Resolution and the City Clerk shall attest and certify to the passage and adoption thereof.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Yucaipa City Council will hold a public hearing on the date and time indicated below to receive and consider the oral and written statements of all persons who wish to be heard relative to the proposal(s) described below. Please note that the City Council may amend, in whole or in part, the proposal(s).
Please check the City Council agenda for the November 13, 2023 meeting, which will be available on the City's website www.yucaipa.org at least 72 hours prior to the start of the Council meeting for information as to how to participate in the City Council meeting.

Additional backup related to how the proposed fees are derived will be made available upon request of the City Clerk.
