SUBJECT: Award of Contract — GeoFence/Automated License Plate Reader (ALPR) Program Phase V
RECOMMENDATION:
That the City Council:
1. Approve and authorize the City Manager to execute the Design Proposal and Statement of Work for the purchase and installation of the Fixed License Plate Reader camera system with Vigilant Solutions in the amount of $70,000; and
2. Find that the public interest will not be best served by a formal proposal process, waive the formal solicitation of proposals/qualifications and award the purchase of the GeoFence/ALPR Program Phase V based on the proposal submitted by Vigilant Solutions.
DISCUSSION:
On May 9, 2011 the City Council approved a Strategic Plan for Citywide video monitoring that included specific areas of the City in need of video surveillance. The installation of surveillance cameras is ongoing and has proven to be an effective policing tool.
To augment the Strategic Plan, the City Council embraced the concept of public safety deployed electronic, data gathering technology, in essence creating a GeoFence, strategically establishing a virtual perimeter around the City. All of the ALPR cameras in the City (including privately owned that are shared with the police department) create the network weave or GeoFence. The data recorded by the ALPR systems is transmitted to the National Vehicle Location Service (NVLS). The data delivered as part of the NVLS web portal is comprised of data shared by law enforcement agencies as well as data harvested by Vigilant from private sources.
NVLS access is restricted for use to law enforcement agencies (LEA's); NVLS data is not shared outside of LEA'S. Data provided by to NVLS be LEA's is only to be used for purposes of providing investigative leads to law enforcement that will ultimately work to protect officers, families and communities.
On December 14, 2015, the City Council approved the Service Level Option, GeoFence/ALPR Program Phase I, which included the purchase and installation of ALPR cameras to monitor egress traffic at the intersections of Yucaipa Boulevard/ Hampton Road and Oak Glen Road/14th Street.
Furthermore, City Council has approved subsequent phases II, 111, and IV,where cameras were installed to monitor ingress and egress at the intersections of Oak Glen Road/Bryant Street, 5t' Street/Wildwood Canyon Road, and Sand Canyon Road/Campus Drive. Three additional mobile ALPR cameras were attached to Yucaipa Police Department (YPD) and the ALPRs have been an instrumental policing tool. The contracts for Phase I -IV were awarded to Vigilant Solutions.
Due to the continued success of the GeoFence/ALPR Program, City staff has met with the YPD to identify locations for the GeoFence/ALPR Program Phase V.
On June 12, 2023, a capital item in the amount of $70,000 for the GeoFence/ALPR Program Phase V was approved as part of the FY 2023-24 Adopted Budget. Vigilant Solutions has proposed the installation of nine fixed ALPR cameras with an addition of four year extended warranties on seven of the cameras, based on installation type.
As stated above, previous phases of the GeoFence/ALPR Program were installed by Vigilant Solutions. In addition, Vigilant Solutions is an exclusive vendor of ALPR technology for the San Bernardino County Sherriff s Department. To ensure the City continues to participate in the efficient sharing of data associated with ALPR technology countywide, staff recommends extending the contract with Vigilant Solutions for the GeoFence/ALPR Program Phase V in the amount of $70,000 as a sole source.
FISCAL IMPACT:
$70,000 is included in the General Fund capital budget for FY 2023-24. The recommended action does not have a further fiscal impact.

Contract Terms Acknowledgement
This Contract Terms Acknowledgement (this "Acknowledgement") is entered into between Vigilant Solutions, LLC, a Delaware corporation ("Vigilant") and the entity set forth in the signature block below ("Customer"). Vigilant and Customer will each be referred to herein as a "Party" and collectively as the "Parties".
1. Contract Terms Acknowledgement. Customer acknowledges that they have received Statements of Work that describe the services provided on this Agreement. Parties acknowledge and agree that the terms of the Master Customer Agreement ("MCA"), including all applicable Addenda, shall apply to the Services set forth in the accompanying Ordering Document. Vigilant's Terms and Conditions, available at https://www.motorolasolutions.com/en_us/about/legal.html , including the Master Customer Agreement, is incorporated herein by this reference. By signing the signature block below, Customer certifies that it has read and agrees to the provisions set forth in this Acknowledgement and the signatory to this Acknowledgement represents and warrants that he or she has the requisite authority to bind Customer to this Acknowledgement.
2. Entire Agreement. This Acknowledgement, including the accompanying Ordering Document, supplements the terms of the MCA, applicable Addenda, and Ordering Documents entered between the Parties and forms a part of the Parties' Agreement.
3. Disputes; Governing Law. Sections 12 — Disputes of the MCA is hereby incorporated into this Acknowledgement mutatis mutandis.
4. Execution and Amendments. This Acknowledgement may be executed in multiple counterparts and will have the same legal force and effect as if the Parties had executed it as a single document. The Parties may sign in writing or by electronic signature. An electronic signature, facsimile copy, or computer image of a signature will be treated, and will have the same effect as an original signature, and will have the same effect, as an original signed copy of this document.
This Acknowledgement may be amended or modified only by a written instrument signed by authorized representatives of both Parties.
