SUBJECT: Award of Construction Contract - Traffic Signal Installation for the Oak Glen Road/Live Oak Canyon Road Widening Project, Colorado Street to Outer Hwy-10 South
RECOMMENDATION:
That the City Council:
1) Award and authorize the City Manager to execute a contract, and the City Manager or his designee administer the terms of the contract to the lowest responsive bidder, Belco Elecnor of Chino, CA, in the amount of $314,888 for the Traffic Signal at Oak Glen Road and Colorado Street — Project No. 11089-3 (Project); and 2) Approve the amounts of $30,000 for construction contract contingency and $23,000 for construction contract administration, staff time, and inspection, for a total construction budget in the amount of $367,888; and
3) Authorize the City Manager or his designee to administer the distribution of the contract contingency; and
4) Approve the plans and specifications prepared for this Project.
BACKGROUND/DISCUSSION:
The FY2023-24 Capital Improvement Program (CIP) includes the Oak Glen Road/Live Oak Canyon Road Widening Project, Colorado Street to Outer Hwy-10 South Project (Project). This Project is being completed in Phases, with Phase 1 and 2 completed in 2019 and 2023, respectively.
The construction of the intersection signalization improvements at Oak Glen Road and Colorado Street will complete Phase 3 of the Project. The executed Development Agreement for the hotel and fueling station project being developed at the corner of Oak Glen Road and Colorado Street requires that the City construct the traffic signal at this intersection.
On January 22, 2024 and February 12, 2024, respectively, the City Council authorized the purchase
of traffic signal poles and related equipment required to complete the traffic signal construction.
Phase 3 of the Project was advertised for construction bids on December 21, 2023. On January 30, 2024, five (5) sealed bids were received and opened as follows:

Belco Elecnor of Chino, CA is the apparent responsive low bidder. Staff has reviewed the bid documents and determined that the documents meet the requirements of the construction contract specifications. Belco Elecnor has performed similar work for other agencies and their work has been deemed satisfactory. As a result, staff recommends that the City Council award and authorize the City Manager to execute a contract to Belco Elecnor in the amount of $314,888.
FISCAL IMPACT:
The estimated cost of this portion of the Project in the amount of $367,888 is included in the adopted FY2023-24 CIP. No further fiscal impact is anticipated.

THIS AGREEMENT is made and entered into this 26`h day of February 2024, by and between the City of Yucaipa, a municipal corporation, hereinafter referred to as "City", and located at

PROJECT: Traffic Signal at Oak Glen Road and Colorado Street — Proiect No. 11089-3 WITNESSETH, in this consideration of their covenants, the parties hereto agree as follows:
The contract documents for the Project shall consist of the Notice Inviting Sealed Bids, Instructions to Bidders, Proposal, General Specifications, Standard Specifications, Special Provisions, Plans, and all referenced specifications and appendices; together with this Agreement and all required bonds, insurance certificates, permits, notices, and affidavits; and also including any and all addenda or supplemental agreements clarifying, amending, or extending the work contemplated as may be required to ensure its completion in an acceptable manner (collectively, the "Contract Documents"). The Contract Documents are made a part hereof as though fully set forth herein.
In consideration of such work, City agrees to pay Contractor and Contractor agrees to accept the sum of XXX Thousand, XXXX Dollars and 00 Cents (SXXX,XXX.00) in the manner provided in the Contract Documents and subject to adjustment provided therein.
Concurrently with the execution of this Agreement, Contractor shall file with the City the bonds and certificates of insurance specified in the Contract Documents and subject to adjustment provided therein.
This Contract shall not be assigned without the written permission of the City Council.
