FRONI:Trevor Benson, Public Safety
FOR:City Council Meeting of April 8, 2024
SUBJECT:Extending the Existence of a Local Emergency Due to the2022 September Storm Event
RECOMMENDATION:
That the City Council extend the declaration of a local emergency as a result ofthe 2022 September Storm Event.
2022 SEPTEMBER STORM BACKGROUND/DISCUSSION:
On September 14, 2022, the Yucaipa City Manager proclaimed a local emergency due to the2022 September Storm Event in Yucaipa and surrounding communities. The storm which was caused by remnants of Hurricane Kay produced conditions of extreme peril to the safety of persons and property within the City of Yucaipa, in the form of infrastructure damage, from extreme weather including intense rain, wind, flooding and debris flow.
On September 14,2022, the County of San Bemardino declared a County-Wide, local emergency due to the storm.
At the September 20,2022, Special City Council Meeting, Council adopted Resolution No.2022- 54, ratifoing the proclamation of the existence of a local emergency by the City Manager.
Post storm assessments were conducted in the burn areas and debris basins to identifo on-site and downstream threats to public health or safety from landslides, debris flow, flooding, road hazards and other post-fire related concerns, as well as to determine measures to prevent or mitigate identified threats.
As a direct result of the September Storm Event, several areas within the City were impacted, requiring emergency work, such as El Dorado Park, Oak Glen Road and Pendleton Road. Staff is tracking costs for this required emergency response work necessary to address these areas. In addition to the emergency work performed to close, cleanup and reopen City facilities/roadways, additional emergency work was required to address approximately 18,000 cubic yards of mud, silt and debris that impacted areas within the Wilson tll Basin/Channel area. [n addition, the Oak Clen Creek Basin system sustained approximately 25,000 cubic yards of mud, silt, and debris, that, in conjunction with San Bemardino County Flood Control District was removed.

Subsequently, in August the City experienced another significant storm event, Tropical Storm Hilary creating rainfall totaling as much as 4.5 inches in parts of the community, once again testing the systems constructed over the past twenty years and maintained between and during these storm events.
Pursuant to Yucaipa Municipal Code Section 8.36.160, the City Council shall review, at least every fourteen (14) days, unless waived by the City Council to meet State requirements, until such local emergency is terminated, the need for continuing the local emergency.
Such declaration facilitates the City's response to combat perilous conditions by providing limited immunity for emergency actions of public employees and governing bodies, authorizing the issuance of orders and regulations to protect life and property, and activating pre-established local emergency provisions.

RECOMMENDATION:
That the City Council extend the declaration of a local emergency as a result of Tropical Storm Hilary.
TROPICAL STORNI BACKGROUND/DISCUSSION:
On Sunday, August 20, 2023, the Yucaipa City Manager Chris Mann proclaimed a local emergency due to Tropical Storm Hilary in Yucaipa and surrounding communities. The storm which was caused by remnants of Tropical Storm Hilary produced conditions of extreme peril to the safety of persons and property within the City of Yucaipa, in the form of infrastructure damage, from extreme weather including intense rain, wind, flooding and debris flow.
On August 20,2023,the County of San Bernardino also declared a County-Wide,local emergency due to the storm and on August 19,2023, the State of California pre-emptively proclaimed a state of emergency in several counties including County of San Bernardino.
At the August 24,2023, Special City Council meeting, Council adopted Resolution No. 2023-43, ratifoing the proclamation of the existence of a local emergency by the City Manager.
Post storm assessments were conducted in the burn areas and debris basins to identiff on-site and downstream threats to public health or safety from landslides, debris flow, flooding, road hazards and other post-fire related concems, as well as to determine measures to prevent or mitigate identified threats.
As a direct result of the tropical storm, several areas within the City were impacted, requiring emergency work, for Oak Glen Road, Casa Blanca and Pendleton Road. Staff is tracking costs for the required emergency response work necessary to address these areas. In addition to the emergency work performed to close, cleanup and reopen City facilities/roadways, additional emergency work was required to address approximately 100,000 cubic yards of mud, silt and debris that impacted areas within the Wilson III Basin/Channel area. In addition, the Oak Glen 4 04/08/2024 City Council Agenda 28

Monthly Treasurer's Report February 2024
RECOMMENDATION:
That the City Council receive and file the Monthly Treasurer's Report for February 2024.
BACKGROUND:
To comply with the requirements of California Govemment Code Section 53607 and the recommendation of California Govemment Code Section 53646, a treasurer's report is submitted to Council monthly.
DISCUSSION:
It is the responsibility of the Finance staff to develop the Monthly Treasurer's Report in a timely manner for review by the City Manager/Treasurer, and ultimately the City Council. It is the function of the Treasurer to deposit and invest funds in accordance with the Investment Policy of the City of Yucaipa to achieve the stated objectives of safety and preservation of capital, liquidity, and return on investment. The purpose of the Monthly Treasurer's Report is to provide the City Council with a snapshot of the City's cash and investment portfolio.
The balances included in the Treasurer's Report represent the month-end market value ofthe City's investment portfolio. The portfolio is one component of assets. The City's net position or fund balance (equity) is comprised of all assets less liabilities. As such, the amounts are related but will differ due to accruals and methods of accounting. The City utilizes the Monthly Treasurer's Report as one tool to monitor fiscal perforrnance.
While the City does not have outstanding debt related to bond issuances, the City acts in a fiduciary capacity for the Successor Agency to the former Redevelopment Agency and the Chapman Heights Community Facilities District, both of which maintain outstanding bonds. The City pools cash and investments of all funds, except for assets related to the bond issuances of the Successor 5 04/08/2024 City Council Agenda 30

Event/Program Summary
Fiscal Year 2023-2024 Grants
In an attempt to assist all awarded agencies, the City has developed an Event Reporting Financial Worksheet (attached) to ensure consistent and accurate reporting of the awarded agencies use of City funding and/or in-kind services. Along with your Event Reporting Financial Worksheet, please provide the information requested below:
I . Did the event/program meet the original intended goal? This event far exceeded our expectations. We have all of the YCJUSD schools participating in our Pickleball in the Schools program. We were hoping for at least 3 schools. We have l0 committed schools in elementary and middle school level and 2 extra programs ( STARS and Adult School) who also participatcd. We are also working with YHS to start a program thcrc. Now that thc gamc has bccn introduccd wc will bc ablc to provide tournaments for the shrdents on a regular basis.
2. If funded in the future, what would the organization do differently? We would try to get our training program started earlier on in the year. We had to wait for the schools to have courts painted which delayed our instruction program to the winter. The weather has created delays for this.
3. What type of feedback did the organization receive from the participants? Tremendous support and enthusiasm. We had teachers tell us that they have never se€n some of their kids so excited to participate in a PE program. We have had students asking when and where they can play outside of school times. The teachers are communicating with their counterparts at other schools to set up inter school toumaments.
4. What other financial/in-kind contributions did the organization seek or receive to fund the evenUprogram (separate from City funding)? We coordinated with USA Pickleball to make the Youth Grant funding program available to each school. This is an additional $350 that each school could access to purchase more equipment. We also parhrered with Selkirk Sports who provided additional paddles and reduced equipment prices to schools. Our members are all volunteers doing the instruction. We estimate that we will have put in over 500 volunteer hours with this program.
5. List the total number of residents served. We are estimating about 3,000 students and adults will receive instruction by the end ofthis school year.

Notes/comments/additional information: This program has led us to work with Yucaipa High school with the goal of having high schools in the area have a league that will eventually be CIF approved. We have already been in contact with Inland Empire Youth Pickleball and Loma Linda Pickleball in regards to establishing a Youth Tour of Toumaments in our area this spring. We often receive comments that the sport has changed the spirit of the kids. Our request for additional Beginner instruction outside the schools has increased.

Kim,
Attached is the Financial Worksheet and Event report you requested regarding our Grant money from the City. Our expenditures have exceeded the grant money as the response was overwhelming. We have covered that overage with our club money. We have not completed our instruction with the schools as we were delayed with court preparation and the weather. However, we are expecting to have been in all the schools by May. There will most likely be more expenses as the demand for more clinics and play rises. We are looking forward to meeting that challenge and continuing to provide an exceptional pickleball program to the community .
I have also attached the backup receipts as well as the presentation we provided to the city council and an instructional guideline provided to the schools.
Let me know if you need any additional information. We are so appreciative of the grant and proud of the work we have accomplished.

Kim, l'll try to work on this next week. I had planned on doing the report when we finished our training in the schools, but we've purchased most of our equipment so I think I can do the form.

AGENDA REPORT
Honorable Mayor and City Council
Jennfier Crawford, Assistant City Manager5d-
Ryan Miller, Housing and Economic Development Analyst @ FOR: City Council Meeting of April 8,2024
SUBJECT: Facility Lease Agreement - Yucaipa VisionQuest Art Gallery Center
RECOMMENDATION
That the City Council authorize the City Manager to execute a Facility Lease Agreement with Yucaipa VisionQuest for the lease of city-owned property located at35l36 Avenue A.
DISCUSSION
In November2018, the City Council approved a five-year lease with Yucaipa VisionQuest (YVQ) for the city-owned property located at35l57 Yucaipa Boulevard (Blvd. Lease), with intent to have an art gallery in Uptown on the Boulevard. In addition, YVQ was simultaneously occupying a supplementary city-owned property located at 35136 Avenue A for storage and art activities associated with their day-to-day operations. The Avenue A Agreement expired in2020; however, had lease extension terms. With the onset of Covid-I9, YVQ and City staff transitions, the renegotiation of the lease terms had not taken place.
With the expiration of the Blvd. Lease approaching and the realization that the Avenue A Agreement had not been officially extended, discussions began to take place between City staff and the YVQ President. The discussions revolved around the organization's structure, the impact of Covid-19 and their ability to occupy both or one of the City-owned facilities. YVQ's President indicated that occupying both properties was not financially feasible. Staff worked with the YVQ's President to discuss downsizing their operation to one facility. After negotiations, YVQ's President took the conversation to the Board for a vote.
YVQ's Board voted to vacate the Yucaipa Boulevard location at the expiration of the Blvd. Lease and enter a new lease agreement for Avenue A. YVQ is working on Board development and rejuvenating their mission to ensure art and promotion of local artists is available in the community.
FISCAL IMPACT
Under the terms of the one-year lease, YVQ will pay the City a total of $8,234.04 for the lease of the Property.

BTD is expanding its operations to include a brick-and-mortar location in the City of Yucaipa that will better serve the local community and their partners. BTD is also committed to partnering with the City to provide "Yucaipa" branded clothing and apparel, to promote shopping local, Yucaipa brand recognition, and enhancing economic activity in the Uptown District.
The subject city-owned property was vacated by the prior tenant after their lease expired on December 31,2023. BTD approached the City in November 2023 and inquired about available commercial zoned properties that may be for lease in the Uptown District. City staff met with BTD on multiple occasions to identi$ potential properties that suited their requirements. On January 24,2024, BTD provided the city with a letter of intent that stated their desire to lease the city- owned property located at 35157 Yucaipa Boulevard.
Staff recognizes the advantages of having occupied commercial buildings in the Uptown District and leasing those owned by the city. In addition, BTD's presence would contribute to the ongoing economic development initiatives in the Uptown District. The lease of the property supports the City Council's adopted 2024 goals towards addressing the structural budget imbalance. 12 04/08/2024 City Council Agenda 148

City Council Meeting of April 8,2024
Community Activity Grant Program (CAG) Guidelines and Funding Levels for CAG and Non-Department Not-for-Profit Organizations for Fiscal Year (FY) 24125 RECOMMENDATION:
That the City Council:
Approve the CAG Application Review Ad-Hoc Committee recommendation to maintain the current guidelines for FY 24/25 and amend FY 25126 guidelines requiring a l00Yo financial match for all applicants receiving CAG financial awards; and
2. Approve the CAG Application Review Ad-Hoc Committee recommendation to maintain the appropriation of $40,000 for in-kind/fee waivers and increase the appropriation to S20,000 for financial requests for the FY 202412025 CAG cycle; and
3. Approve the CAG Application Review Ad-Hoc Committee recommendation to appropriate funding for FY 24125 to Non-Department Not-for-Profit organizations as outlined in the staff report.
DISCUSSION:
The Community Activity Grant (CAG) program was established in 2010. Council implemented the CAG program to support the efforts of local non-profit 501(c) agencies/organizations that provide valuable services, programs and/or events to Yucaipa residents; ensure that projects/programs that benefit the community were funded; and to enhance the overall accountability and justification of how City funds were spent. The overall intent of the CAG program was not to sustain local ongoing programs or services but to supply the "seed money" to support the creation and launch of new programs, services and/or events in the community.
Since the creation of the CAG program, the guidelines have been reviewed and refined annually, as necessary, by the City Council. The purpose is to afford the City Council with an opportunity to review the CAG program and direct staff as appropriate. The current CAG guidelines adopted by Council for the FY 23124 grant cycle, are as follows:
13 04/08/2024 City Council Agenda 159
Groups/Programs that are Ineligible
o Organization is not an established 501(c).
o Organization is located in another community.
o New proposed program, service, or event that is already being provided for in the community.
o Program/event will take place in another community.
o Programming for and rental of the Equestrian Center, and the Uptown Park facilities. o Programming for and rental of the Yucaipa Performing Arts Center (YPAC), apart from the Yucaipa High School (YHS) Music and Art Department (production equipment and personnel ineligible).
Requirements and Funding Limitations
o The application must be complete and contain applicant information, amount of request, proof of eligibility, clear statement of need, target population, progftlm description/scope, outcome measurement, applicant background, experience in program area, and financial capabilities/budget is required to ensure grant funds are used to subsidize and not supplant the program.
o The grant program will be reviewed on a yearly basis during the budget process to analyze funding availability for the upcoming fiscal year. If Council determines that the budget priorities have changed and funds need to be reallocated, the grant amount may be increased, decreased, or deemed unavailable for that fiscal year. o Grant applications requesting financial support will have a firm deadline. . Applications will not be considered when grant funds are depleted. o Grant applications requesting in-kind support will be reviewed and considered as received until funds are depleted.
o Grant awarded funds must be spent during the grant awarded fiscal year. o The awarded grant recipients must submit a detailed follow-up financial accountability report within one month following the event/project in order to remain eligible for future funding.
The CAG program guideline options (or combination of options) for Council to consider for FY 24125, include, but are not limited to:
Options:
A. Keep the current guidelines process in place and maintain the funding levels in the amounts of $ 17,500 for financial awards and $40,000 for in-kind/fee waiver awards.
Amend the current guidelines and/or funding levels.
For the FY 25126 grant cycle, require a l00Yo financial match for all applicants receiving CAG financial awards.
Establish term limits for eligibility - Example: If non-profit is awarded grants for three consecutive years the non-profit becomes ineligible for two years.
B.
C.
D.
04/08/2024 City Council Agenda 160
Eliminate the CAG program and allocate no funding for local, non-profit organizations.
F. Other possibilities, &S may be suggested by Council
City Council direction pertaining to the CAG program guidelines will be implemented during the FY 24125 CAG cycle and funding levels will be included in the FY 24125 Draft Budget. If approved by City Council, the FY 24125 CAG Program will be announced, and applications will be brought before Council in June for review and consideration.
In addition to the CAG, in 2015, the City Council approved allocating funds for certain community organizations through the budget process versus the CAG program since the program(s)/event(s) were held on an annual basis and benefit City services. The community organizations and program(s)/event(s) that are currently funded in the Fiscal Year 202312024 Adopted Budget include:

For over twenty-five years, the City has provided financial support to the Chamber of Commerce (Chamber). In addition to the annual financial support, the Chamber collaborated with the City and received a revenue share for securing vendors for City events. For the past seven years, on- going discussions have taken place between the City and the Chamber to ensure organization sustainability and less dependence on City funding. In July 2023, the City and Chamber entered 04/08/2024 City Council Agenda 161
into a one-year agreement committing the City to $17 ,942 in financial support while the Chamber committed to the development of a comprehensive business plan that outlined strategies for achieving self-sufficiency. In September 2023, the Chamber elected to move out of the YPAC and the Board has been working on a comprehensive business plan and alternative funding sources.
As identified above, funding is not currently being proposed for the Chamber for FY 24125; however, staff recommends allocating a contingency amount of $20,000 for FY 24125 to provide funding flexibility to possibly support initiatives that are being discussed but not finalized at this time.
Community programs funded through the budget process versus the CAG will be included in the FY 24125 Draft Budget for Council consideration.
At its meeting on April 1,2024, the CAG Application Review Ad Hoc Committee recommended the following for City Council consideration and approval:
Fiscal Year 202412025 Budget funding levels:
o $20,000 for financial grant requests
o $40,000 for in-kind/fee waiver requests
o
a Maintain the current guidelines for FY 24125 and amend FY 25126 guidelines requiring a 100% financial match for all applicants receiving CAG financial awards. This option would address the main intent of the program, which is to provide "seed money" to support the creation and launch of new progftrms, services and/or events in the community and provide adequate notice to local organization that traditionally seek financial support. In addition, requiring organizations to match funding for the requested use would free up CAG funding for other proposed programs and/or events.
a Approve the Non-Department Not-for-Profit proposed funding allocations for FY 24125 as outlined in the staff report.

YUCAIPA CITY COUNCIL
AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Fermin Preciado, Director of Development Services/City Benjamin J. Matlock, Deputy Director of Community Development/City Planner {wFOR: City Council Meeting of April 8 ,2024
SUBJECT: Adoption of Urgency Ordinance No. 466-U establishing a temporary moratorium for the installation of mobile homes greater than twenty years old in the City's 42 existing mobile home parks
RECOMMENDATION:
That the City Council adopt Ordinance No. 446-U, an Urgency Ordinance of the City Council of the City of Yucaipa, California, adopting an Interim Measure lmposing a Moratorium on the Installation, Modification, or Review and Approval of Applications for Mobile Home Set-Down Permits for Mobile Homes Over Twenty Years Old within all Mobilehome Parks Existing in the City.
BACKG ROUND/DI SC US SION :
ln 2008, the City of Yucaipa adopted Ordinance No. 282 and assumed oversight of the City's 42 mobilehome parks. The City of Yucaipa chose to become a "Local Enforcement Agency" to best maintain local control and the enforcement of appropriate codes and requirements for the safety of the thousands of Yucaipa residents that live in our mobilehome parks. As a Local Enforcement Agency, the City of Yucaipa is responsible for the comprehensive park inspections and setdown permit requirements. [t is important to note that the California Department of Housing and Community Development (HCD) remains responsible for interior and structural alterations for individual mobilehome units, as well as providing periodic audits of the City's Local Enforcement Agency activities to ensure consistency with Title 25 requirements.
For the safety of mobilehome residents, the National Manufactured Home Construction and Safety Standards Act of 1974 established the federal standards related to all aspects of construction, including design and construction strength, durability, and transportability of mobilehomes, and has been a common review threshold for the setdown of units. However, units originally constructed under these requirements are now approximately 50 years in age. The City of Yucaipa has seen an increase of setdown permits for park-owned units that are several decades old, and Code Enforcement has also observed one unit that was delivered to the City that still had a "red- tag" slip from another agency, which indicates that this specific structure could pose a threat to the health and safety of its occupants. Once located in the park, these older structures are then rehabilitated by the park owner before an inspection is completed or sought by City or HCD staff. vr/
15 04/08/2024 City Council Agenda 166
Based on this growing concern, staff has developed an urgency ordinance pursuant to Government Code Section 65658 that would provide a stopgap measure by creating a temporary moratorium for the setdown of all mobile and manufactured homes older than 20 years old. Staff will subsequently work through potential solutions that allow for reinvestment within these parks without creating unsuitable and/or unsafe living conditions for our residents.
The City did reach out via teleconference to Robert Evans with the Manufactured Housing Educational Trust (MHET) and Julie Paule with the Westem Manufactured Housing Communities Association (WMA) to discuss the proposed moratorium. They have indicated a willingness to assist in finding potential solutions while the moratorium is in place. The City also held a meeting with the Yucaipa Mobile Home Residents Association (YMRA), that similarly indicated support towards ensuring the quality of life for future residents.
Environmental Review:
The adoption of the Ordinance is exempt from the Califomia Environmental Quality Act (CEQA) pursuant Section 15061(bX3) covering activities with no possibility of having a significant effect on the environment as the Ordinance imposes a temporary moratorium related to the permitting requirements for older mobile home setdowns within existing mobile home parks.
FISCAL IMPACT:
There is no direct fiscal impact to the City's General Fund associated with this Urgency Ordinance.

WHEREAS, California Government Code Section 65858 provides that, without following the procedures otherwise required prior to the adoption of a zoning ordinance and for the purpose of protecting the public safety, health, and welfare, the City Council may adopt as an urgency measure, an interim ordinance prohibiting any uses which may be in conflict with a "contemplated general plan, specific plan, or zoning proposal that the City Council, planning commission or the planning department is considering or studying or intends to study within a reasonable time"; and WHEREAS, the City Council is concerned that there is a significantly increased number of substandard, old, and delipidated mobile homes being brought into the City that is incompatible with public health and safety of City residents, and the City Council believes that careful consideration and thorough study of potential regulations pertaining to this manner is required; and

l. The City is concerned with the public nuisance caused by the significant increase in substandard, old, and delipidated mobile homes being brought into the City, involving the following:
a. Since 2021, mobile home parks throughout the City have applied for many set- down permit applications for mobile homes in substandard condition. b. Upon performing initial inspections, City staff saw a pattern that the mobile homes being brought in by mobile home park owners were consistently over twenty years old and in deplorable condition;
c. Upon multiple inspections, City staff determined that generally, mobile home park owner's practices included bringing in old and delipidated mobile homes and proceeding to "flip" them, making only superficial improvements, such as paint and minor repairs, in an effort to collect more rent and pose the mobile home as "renovated";
d. City staff also found that approximately forty-four set-down permits had been applied in one mobile home park alone. Roughly thirty percent of those permits have expired and never received a final inspection from the City's Building and Safety department, yet nearly thirty percent of these "renovated" mobile homes are tenant-occupied;
e. City staff received numerous complaints from various mobile home park tenants of these "renovated" mobile homes, many commenting that the "renovated" mobile homes in which they occupy have nonfunctioning electrical, plumbing, and heating components, holes in the floor, and leaking roofs.
2. The City Council desires to investigate and study the impacts of this matter further; and
3. Absent the adoption of this Ordinance, the installation, modification, or review and approval of applications for mobile home set-down permits for mobile homes over twenty years old within all mobile home parks existing in the City may pose a serious threat to public health and safety; and
4. Absent the adoption of this Ordinance, the significant increase in set-down permit applications for these "renovated" substandard mobile homes may increase the burden upon City services; and
5. As a result, it is necessary to establish a temporary, forty-five (a5) day moratorium on the installation, modification, or review and approval of mobile home set-down permit applications for mobile homes over twenty years old within all mobile home parks existing in the City, pending completion of the City's study of the potential impacts; and
6. In addition, it is necessary to prohibit, as a public nuisance, the installation, modification, or review and approval of mobile home set-down permit applications for mobile homes over twenty years old within all mobile home parks existing in the City for the duration of this Ordinance, or any extension thereof; and
