SUBJECT: Award of Contract - New City Yard Fencing Project - Project No. I 1208 RECOMMENDATION:
That the City Council:
l) Award and authorizethe City Manager to execute a contract, and the City Manager or his designee administer the terms of the contract to the lowest responsive bidder, AB Fence of Beaumont, CA in the amount of $222,247 for the New City Yard Fencing Project - Project No. I 1208 (Fencing Project); and
2) Approve the amounts of $25,000 for construction contract contingency and the amount of $10,000 for construction contract administration, stafftime, testing, and inspection, for a total construction budget in the amount of $257,247; and 3) Authorize the City Manager or his designee to administer the distribution of the contract contingency; and
4) Approve the plans and specifications prepared for the Fencing Project.
BAC KG ROUND/DISCU SSION :
ln2020,the City Council approved the New City Yard Relocation Project (Relocation Project), which included removing and relocating the City Yard facilities as part of the Oak Glen Creek Specific Plan.
The Relocation Project was completed in phases and included the installation of three (3) steel structures, the installation of tenant improvements inside those buildings, and the design and installation of underground utilities, site/access-road paving, fencing, and landscaping.
The remaining phases of construction for the Relocation Project include the installation of fencing and landscaping. The Fencing Project includes the installation of perimeter fencing and gates to secure the City Yard facility.
The Fencing Project was advertised for bids on December 19,2023. On January 24,2024, four (4) sealed bids were received and opened as follows:

AB Fence Company, Inc (AB Fence) of Beaumont, CA, is the apparent responsive low bidder. Staff has reviewed the bid documents and determined that the documents meet the requirements of the construction contract specifications. AB Fence has performed similar work for the City of Yucaipa, and their work has been deemed satisfactory. As a result, staff recommends that the City Council award and authorizethe City Manager to execute an agreement for the Fencing Project to AB Fence in the amount of $222,247.
Completing the new Fencing Project is a significant highlight for the City and an essential step towards completing the Relocation Project and achieving one of City Council's Goals for 2024.
FISCAL IMPACT:
The Project amount of $257,247 is included in the adopted FY24 Capital lmprovement Program.

AGREEMENT

PROJECT: New Citv Yard Fencine Proiect - Proiect No. I1208 WITNESSETH, in this consideration of their covenants, the parties hereto agree as follows:
The conhact documents for the Project shall consist of the Notice Inviting Sealed Bids, Instructions to Bidders, Proposal, General Specifications, Standard Specifications, Special Provisions, Plans, and all referenced specifications and appendices, together with this Agreement and all required bonds, insurance certificates, permits, notices, and affidavits; and also including any and all addenda or supplemental agreements clarifuing, amending, or extending the work contemplated as may be required to ensure its completion in an acceptable manner (collectively, the "Contract Documents"). The Confact Documents are made a part hereof as though fully set forth herein.
In consideration of such work, City agrees to pay Conffactor, and Contractor agrees to accept the sum of Two Hundred Twentv-Two Thousand. Two-Hundred Fortv-Seven Dollars and 00 Cents ($222.247.00) in the manner provided in the Contract Documents and subject to adjustment provided therein.
Concurrently with the execution of this Agreement, Contractor shall file with the City the bonds and certificates of insurance specified in the Contract Documents and subject to adjustrnent provided therein.
This Contract shall not be assigred without the written permission of the City Council.
