Help Keep Food Waste Recycling Clean!
Senate Bill 1383 requires a 75% reduction in organic waste disposal. All residences and commercial businesses are required to participate and recycle organic waste including food and landscape waste. Food waste is collected, recycled and made into new products such as compost, mulch and renewable gas. During the sorting process workers must remove non -acceptable material such as trash, plastic containers, glass and other contaminants.
Keeping your containers free of contaminants will help contain recycling costs and keep material clean to create new products.

WASTE AND RECYCLING NEWSLETTER
Sponsored by Yucaipa Disposal for the City of Yucaipa Residents Top 5 Items to Keep OUT of the Recycling Bin
Here are the top 5 items that should never be placed in the recycling bin:
1. No garden hoses. Despite being made from rubber, vinyl, or a combination of both, this item still belongs in the trash.
2. No diapers. Diapers should be placed in your trash bin.
3. No hazardous waste. This means no paint, motor oil, batteries, syringes, needles, etc.
Hazardous Waste places our facility staff at risk. Do not place into any of your Burrtec collection containers.
4. No pet food bags. The wax coating prevents the bags from breaking down in the recycling process, so pet food bags go into the trash bin.
5. No electronic waste. These items are best recycled through a proper e-recycler.
Remember to keep the blue barrel free of contamination! Scavenging is Illegal
Removal of garbage and/or recyclables from solid waste containers is punishable by law (Title 8 Chapter 8.28 Section 8.28.390 & 8.28.400)

properly! Electronic waste, or e-waste, may include

State Required Contamination
Monitoring of Recyclables
California state law SB 1383 requires jurisdictions to monitor trash, recycling, and organics barrels to minimize contamination. Please review the "What Goes Where" guide for reminders of acceptable items in each barrel. Recycling loads containing unacceptable items may be rejected for processing and sent to the landfill, which eliminates the benefits that are produced from the recycling program. High contamination of your recyclables could result in increased processing costs which may impact your trash and recyclables collection fees. Information is on the Burrtec website https://www.burrtec.com/city/ service-location/yucaipa/ or call Burrtec Customer Service at (909) 797-9125 for assistance. 2. Add & Secure- Collect food waste & food soiled paper in its own separate plastic bag. Store it in a convenient place, such as on your counter top, in your refrigerator or under your sink. Secure plastic bag by tying it off. Remember bags do not have to be compostable or biodegradable. They can be any color. We encourage you to re -use bags you may already have such as bread bags and produce bags.
3. Discard- Place your bagged food waste & food soiled paper into your green barrel. Continue using your green waste barrel for non -bagged landscape waste. Remember, food waste no longer belongs in your trash barrel.

During the sorting process workers must remove non - acceptable material such as trash, plastic containers, glass and other contaminants.
Keeping your containers free of contaminants will help sustain recycling costs and keep material clean to create new products.

State Required Contamination
Monitoring of Recyclables
California state law SB 1383 requires
jurisdictions to monitor trash,
recycling, and organics barrels to
minimize contamination. Trash and
other contaminants in the recycling
or organics collection container(s)
could result in a fee and non -collection
due to contamination. If contamination
is found, contamination tags (as
shown to the right) will be affixed
to the container lid. After the first
notice, customers may be charged a
contamination fee and the container
will not be serviced as recyclable; it
will be subsequently serviced as trash.
Please note: the contamination fee will
be automatically assessed if hazardous
or bio-hazardous materials are placed
in any collection container. Not sure
about what goes in each container?
Contact our Burrtec Customer Service at

thank you for your continued support

ADDRESS
Attention Food Service Providers
Existing state law requires certain businesses to implement a recycling and organics program. The law which went into effect July 1, 2020, requires food establishments that provide trash containers for products purchased and consumed on the premises to also provide properly labeled containers for recyclables and organic waste (food waste). These containers must be placed adjacent to trash containers.
AB 827 applies to limited -service restaurants such as those restaurants where customers order and pay at the counter and bus their own tables after eating. The law will affect restaurants, malls, and other businesses that serve food. Full -service food establishments that do not provide access to trash containers for products consumed on the premises will be exempt, as food workers will likely separate post -consumer food waste and recyclables in the dish washing areas.
Highlights:
• AB 827 requires collection containers at the front -of -house to be visible, accessible and labeled.
• This law affects businesses that sell products that are meant for immediate consumption.
• Full -service restaurants where employees bus and clean tables are exempt but must provide labeled collection containers adjacent to trash containers for employees/staff to separate post -consumer recyclables and organics.

Edible Food Recovery
Requirement
Certain businesses have requirements and responsibilities as it relates to edible food recovery, such as:
• Not intentionally spoiling edible food that is capable of being recovered by a food recovery organization or service
• Making arrangements via contract with a food recovery organization or service to recover edible food that would be redistributed for human consumption
Is Your Business Affected?

Tips for Living With Bears
Bears are attracted to anything smelly or edible,
especially garbage. Bears are also attracted to
beehives, orchards and gardens. Consider these tips
to help make your home "bearproof":
• Deodorize garbage container with bleach or
ammonia.
• Tightly secure bagged food waste to reduce odor.
• Use a garbage disposal whenever possible. Freeze
meat bones or other smelly items until pick-up day.
• Be sure to keep barbecue grills clean.
• Pick up fallen tree fruit, and put away food sources
at night, such as pet food and bird feeders.
• Close windows at night on accessible ground floors
and decks.
• Don't leave food in or near a windowsill or on a
counter near an open window.
• Securely block access to potential hibernation sites, such as crawl spaces under decks or buildings.

IS YOUR BUSINESS OR MULTI-
FAMILY PROPERTY AFFECTED?
C
State legislation mandates businesses
and public entities generating four (4)
cubic yards or more of waste per week
and multifamily residential dwellings with
five (5) units or more to recycle.
AB 827
REQUIREMENTS
COMPLIANCE
California also requires food establishments
that provide trash containers for products
purchased and consumed on the premises to
also provide properly labeled containers for
recyclables and food waste. These containers
must be placed adjacent to trash containers.
A property owner of a commercial business or
a multifamily residential dwelling should require
tenants to source separate their recyclable
materials to aid in compliance.
It is critical that recyclables comply with the
program and are free of contamination. Loads
with contamination may be rejected from
entering the recycling process and subject to
additional handling fees.

WHEREAS, the City of Yucaipa has adopted an exclusive franchise agreement ("Agreement") with Yucaipa Disposal, Inc. ("Yucaipa Disposal"); and WHEREAS, under the Agreement, Yucaipa Disposal provides solid waste collection services for the City of Yucaipa; and
WHEREAS, pursuant to the provisions of State law, including but not limited to Health & Safety Code Sections 5470 et seq., the City of Yucaipa may adopt and implement fees and charges to cover the cost of collection of solid waste within the City and, when adopted, may collect such fees for residential service on the property tax rolls; and WHEREAS, the City desires to adopt and implement such fees and charges to cover the cost of collection of solid waste within the City and;
WHEREAS, the proposed solid waste fees are set out on Exhibit "A", attached and incorporated hereto; and
WHEREAS, a written report of prospective solid waste collection fees has been prepared and filed with the City Clerk; and
WHEREAS, on June 24, 2024, the City Council conducted a duly noticed public hearing and heard all comments/protests regarding the solid waste fees; and WHEREAS, the City Council finds from such reports that the amount of fees is the reasonable cost of service provided, plus direct and indirect overhead; that amounts collected will be used only for immediately available (and not standby) solid waste collection services; that such fees and charges are proportionate to the amount of service received, and that such fees and charges are not for traditional governmental services such as police, fire, or libraries; and WHEREAS, the City Council further finds that this increase in rates is for the purpose of meeting operating expenses, including wage rates and fringe benefits, required for the collection of solid waste within the City pursuant to its existing franchise, and that such action therefore is statutorily exempt from CEQA under Public Resources Code Section 21080(b) and Section 15273 of the CEQA guidelines.

Dear City Clerk:

Office of the City Clerk
I PROTEST the increase in the Solid Waste Services rates for the second consecutive year.
The Yucaipa City Council increased the rate for rubbish collection from $18.21 to $20.69 for a 15 gallon barrel on July 1,2023 this was a 13.6% increase from the previous year.
Now there is a rate increase proposed of $25.26 for a 15 gallon barrel, which is a
22.1% increase in costs.
This is as a long tiine resident of Yucaipa living on a pension. It is is extremely difficult to have a reasonable quality of life. This rate increase greatly affects my lack of satisfaction with the city.
The city is involved in this contract with the soil waste services company, and there is no competition from other companies to hold or contain their charges. Maybe there could be bids taken for this service.
Sincerely yours.

Re: Schedule of Rates ( Solid Waste Services)
lam protesting another rate hike, as we have been getting them every year and they are getting increasingly hard to pay and expensive on a retirement income ( Social Security).
The increase in rates is outrageous and should stop. The service has not improved, and apparently transferring the billing to the property tax has not cut any costs and has not been a benefit to the customers on this legally required service.
Please review and reduce the residential cost an the schedule to the 2018 level, which was much more reasonable. In the last three year's inflation has increased food costs over 20% and this kind of additional increase on trash service is irresponsible.

CITY OF YUCAIPA
AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Ana V. Sauseda, Director of General Services/City Clerk FOR: City Council Meeting of June 24, 2024
SUBJECT: Adoption of Resolution No. 2024-44, a Resolution of the City Council of the City of Yucaipa, California, Forwarding Amounts Remaining Unpaid on the Certified Solid Waste Lien List to the County of San Bernardino for Addition to the 2024- 2025 Property Tax Rolls as a Special Assessment
RECOMMENDATION:
That the City Council conduct a Public Hearing and subsequently adopt Resolution No. 2024-44 forwarding amounts remaining unpaid on the Certified Solid Waste Lien List to the County of San Bernardino for addition to the 2024-2025 Property Tax Rolls as a Special Assessment.
BACKGROUND/DISCUSSION:
On May 13, 2024, City Council adopted Resolution No. 2024-20, declaring its intention to hold a public hearing on June 24, 2024, to adopt a report of delinquent solid waste charges and directing the City Clerk to file said report with the County of San Bernardino for inclusion of such charges on the property tax rolls as a special assessment. The Resolution also allows affected property owners to appear and show cause as to why their delinquency should not appear on the list to be certified. Public hearing notices were published in the Yucaipa News -Mirror on Friday, May 3 I st and June 70, 2024.
In addition, on June 3, 2024, individual notices were mailed to each property owner whose account was delinquent and potentially in an assessment position, providing the property owner notice of the public hearing to be held on June 24, 2024, pursuant to Yucaipa Municipal Code Section
8.28.160(B).
06/24/2024 City Council Agenda
302
The 2023/2024 delinquent account lien list (attached) contains 44 accounts. The number of annual delinquencies has declined each year due to the incorporation of tax roll billing as detailed below:
Fiscal Year Number of Accounts placed on Lien list
2023/2024 44 (TBD)
2022/2023 38
2021/2022 24
2020/2021 49
2019/2020 602
2018/2019 911
Any property owner appearing on the Iist who makes appropriate payment arrangements with Yucaipa Disposal prior to August 20, 2024, will have their account removed from the list prior to forwarding the list to the County for inclusion on the 2024-2025 tax roll. It is anticipated that the list will be further reduced before the final list is submitted to the tax collector.
The City, the County, and Yucaipa Disposal will all add administrative charges for this process, in addition to the actual delinquency amount owed to Yucaipa Disposal. Since Yucaipa Disposal is covering all direct expenses involved in the lien process, the $6 per delinquent account charged by the City will be sufficient to cover the administrative costs incurred by the Finance Department to process the information generated by the collection of the delinquent accounts FISCAL IMPACT:
The direct cost of the lien process is incurred by Yucaipa Disposal. The City will recover $6 per delinquency recovered by the lien process. This revenue will offset the Finance Department's costs to receive payments from the County and to make remittance payments to Yucaipa Disposal.
There is no further fiscal impact.

Agenda Item No. 18
CITY OF YUCAIPA 1121
AGENDA REPORT
TO: I-Ionorable Mayor and City Council
FROM: Fermin Preciado, Director of Development Services/City Engineer FOR: City Council Meeting of June 24, 22024
SUBJECT: Annexation of Tract Map No. 16268 into Landscaping and Lighting Maintenance District No. I (Zone "MM")
RECOMMENDATION:
That the City Council:
1) Conduct a Public Hearing, and subsequently adopt Resolution No. 2024-46, approving the annexation of Tract Map No. 16268 into the City of Yucaipa Landscaping and Lighting Maintenance District No, 1 (Zone "MM"); and
2) Adopt the methodology for and enact the assessments therein.
BACKGROUND/DISCUSSION:
On September 9, 1991, the City Council voted to form a Landscaping and Lighting Maintenance District (LLMD). Numerous projects under development in the City contain public areas that will require on -going maintenance if they are to continue to provide special benefits for the homeowners within the subdivisions. Staff believes that the best way to ensure that these areas receive the appropriate maintenance is to place individual subdivision projects within the City's LLMD.
The proposed annexation will result in the annual levy occurring prior to the City accepting the maintenance obligations. This will allow the buildup of capital reserve funds for the purposes of funding the cost of repairs, inclement weather (such as hard freeze or severe erosion), damage done by vehicular traffic, and the coverage of delinquent property taxes in order to ensure the City will not be required to pay for such costs. This annexation and assessment will not affect previously annexed residential subdivisions. The City has also been assured that the assessment will be disclosed during the sale of the homes by the property owner. It is anticipated that annual assessments for this tract will be levied during the 2024-2025 fiscal year.
It is important to note that the assessments levied for the costs associated with these maintenance districts only apply to the properties located within the boundaries of a particular tract and that no other property owners will be assessed for any of the maintenance costs.
Tract Map No, 16268 was originally approved by the Planning Commission in July of 2004. In 2018, a revision to the map was subsequently approved by the Planning Commission to incorporate new State and City Development Code requirements, This subdivision project was conditioned to 06/24/2024 City Council Agenda
311
annex into the LLMD (Zone "MM") as part of the approval process and contains twenty-two (22) single-family residential lots on 15.48 acres located on the southwest comer of Wildwood Canyon Road and Holmes Street. The developer wishes to have the energy charges and maintenance costs for four (4) streetlights, the maintenance of drainage devices, lighting, multi -use trail, and the maintenance costs of 55,150 square feet of landscape area, including an entry monument sign placed into the LLMD. The total estimated annual costs of these items are included in the attached excerpt from the Engineer's Report for this subdivision.
In accordance with the provisions of Proposition 218, (the right to vote Act), passed by voters in the November 1996 election, it is necessary to vote on the annexation and levy of assessment by mail -in ballot by the owners of the subdivision being annexed into the LLMD. A notice of the hearing and a ballot will be mailed to each property owner.
The City must conduct a public hearing upon the proposed assessment not less than 45 days after mailing the notice of the proposed assessment to record owners of each identified parcel. At the public hearing, the City Council considers all protests against the proposed assessment and tabulates the ballots. The City shall not impose an assessment if there is a majority protest. A majority protest exists if, upon conclusion of the hearing, ballots submitted in opposition to the assessment exceed the ballots submitted in favor of the assessment weighted on financial obligation.
FISCAL IMPACT:
According to the Engineer's Report prepared for Tract Map No. 16268, the estimated costs for streetlight maintenance, drainage device maintenance, landscape maintenance, and trail maintenance for Tract Map No. 16268 totals $864.73 per dwelling unit per year.
The annual increase of assessments includes an escalator clause to adjust based on the change in the Consumer Price Index for the Riverside -San Bernardino -Ontario Area for all urban consumers. Utility rates shall be increased accordingly to reflect actual costs.
There is no fiscal impact to the City's General Fund, as the cost is matched to the assessment.

PART B
ESTIMATE OF COST
The 1972 Act provides that the total cost of installation construction, maintenance and servicing of the public landscaping, park facilities and street lighting can be recovered by the District in proportion to the special benefit that they provide to the parcels. Incidental expenses including administration of the District, engineering fees, legal fees and all other costs associated with the formation and maintenance of the District can also be included.
Improvements which are to be included in the District have not yet been completed and are being constructed by the developer of the property who will be responsible for the maintenance of all improvements until accepted by the City of Yucaipa. It is anticipated that the improvements will be completed and accepted by the City by July 2025. In 1998, the City Council amended the original methodology for the Maintenance District. The amendment allows the annual charge to be levied on the tax roll during the fiscal year the annexation takes place, and not after the warranty period ends.
This amendment commenced with Zone G98. The reasons are as follows: It allows the buildup of a capital reserve fund for the purposes of covering the costs of vandalism, inclement weather), damage done by vehicular traffic, and the coverage of delinquent property taxes.
The assessment for the District after construction is complete will be based on the qualifying improvements that are to be maintained by the City. An estimate of the yearly maintenance cost for Fiscal Year 2024-2025 is:
ESTIMATE OF YEARLY MAINTENANCE COST
Street Light Maintenance 4 Ea. @ $165.00 $ 660.00
Drainage devices (basin overflow channel — 1200 SF @ .025ISF) 300.00 Drainage devices (rip rap pads — 1850 SF @ 0.25/SF) 462.50 Drainage devices (catch basins — 2 EA @ $200) 400.00

Landscape Maintenance (55,150 SF @ $0.25/SF) 13,787.50
Subtotal 16,471.00
Administration @ 5% = $15,725.50 @ 5% 823.55
Subtotal $ 17,294.55
10%Capital Improvement Reserve Fund 1,729.46
Total Annual $ 19,024.01
Per EDU (22 new residences) $ 864.73
The 1972 Act requires that a special fund be set up for the revenues and expenditures of the District, Funds raised by assessment shall be used only for the purpose as stated herein.
A contribution to the District by the City may be made to reduce assessments, as the City Council deems appropriate. Any balance remaining on July 1 must be carried over to the next fiscal year. 06/24/2024 City Council Agenda

CITY OF YUCAIPA
AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Megan Wolfe, Director of Community Services 16
FOR: City Council Meeting of June 24, 2024
SUBJECT: Community Services User Fees
RECOMMENDATION:
That the City Council conduct a Public Hearing and subsequently approve Resolution No. 2024-45, rescinding Resolution No. 2022-23, and adopting an update to the Community Services User Fee Schedule and amending fees and charges for services rendered in relation to Community Services and making related determinations pursuant to the California Environmental Quality Act.
BACKGROUND/DISCUSSION:
The Community Services Department (CSD) is committed to offering quality programs and services at competitive rates, while simultaneously meeting the needs of the community and maximizing participation.
On June 27, 2022, City Council conducted a public hearing and adopted Resolution No. 2022-23, pertaining to various Community Services User Fees (CSUF). Since then, CPI has increased by approximately 15 percent, and as a result staff is recommending an increase in CSUF.
A public hearing is required for revisions to the CSUF. The public hearing notices were published in the Yucaipa News Mirror on June 14, 2024, and June 21, 2024. Additionally, it was made available for public review at the City Clerk's Department public counter on June 14, 2024.
The CSUF will be included in the City-wide Comprehensive User Fee Study to be completed later this year.
FISCAL IMPACT:
It is anticipated that the implementation of Resolution No. 2024-45, will allow the CSD to continue to recover costs.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YUCAIPA, CALIFORNIA, RESCINDING RESOLUTION NO. 2022-23 AND
ADOPTING AN UPDATE TO THE COMMUNITY SERVICES USER FEE
SCHEDULE AND AMENDING FEES AND CHARGES FOR SERVICES
RENDERED IN RELATION TO COMMUNITY SERVICES (TAXPAYER
PROTECTION AND GOVERNMENT ACCOUNTABILITY ACT)
WHEREAS, the City of Yucaipa has conducted an analysis of services provided by the Community Services Department, the costs reasonably incurred in providing those services, the beneficiaries of these services, and the revenues produced by those paying fees and charges for special services; and
WHEREAS, certain current fees charged for services provided by the City do not fully recover the actual costs of providing such services; and WHEREAS, due to the consumer price index increase of approximately 15% since 2022 and the minimum wage increase in the subsequent years, actual costs of certain services have risen; and
WHEREAS, the City Council held a duly noticed public hearing on June 24, 2024, concerning the increase in Community Services User Fees; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YUCAIPA HEREBY RESOLVES AS FOLLOWS:
Section 1.
Section 2.
Section 3.
The Community Services User Fee Schedule for various Community Services programs provided by the City is hereby amended to account for CPI.
Adoption of Fees and Charges. The City Council hereby adopts the City of Yucaipa Community Services User Fee Schedule ("CSUF") as set forth in attached Exhibit "A" and incorporated by this reference. Unless otherwise stated in the CSUF, all CSUF shall be paid to the City by the customer prior to the City's performance of the requested Services.
Repeal of Conflicting Resolutions. It is the desire of the City Council that all fees and charges for services, programs or products be set forth in one document for ease of reference. Accordingly, any and all provisions of prior Resolutions of the City Council establishing or modifying fees for the services, programs or products set forth in Exhibit "A," are hereby repealed and replaced as of the effective dates as set forth in Section 7 of this Resolution in the manner set forth in Exhibit "A;" provided, however, that such repeal shall not excuse or affect the failure of any person or entity to pay any fee heretofore imposed upon such person or entity, The City Council desires to clarify that in adopting this Resolution, it is acting only on those fees for the services, programs or products set forth in Exhibit A which have been modified from prior resolutions of the City Council. The remaining fees that have not been modified from prior resolutions shall remain in full force and effect 06/24/2024 City Council Agenda

and are hereby restated for convenience so that all fees are set forth in one document.
Section 4. Policies and Procedures, Staff is hereby authorized and directed to establish policies and procedures for implementation and collection of CSUF.
Section 5. CEQA. The approval of the User Fees established in this Resolution does not constitute a "project" under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Section 15378(b)(4) because such actions involve the creation of a government funding mechanism which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. Furthermore, the approval of the User Fees established in this Resolution is statutorily exempt from CEQA under CEQA guidelines Section 15273 (a)(1) because the approval of the User Fees is merely establishing fees to meet operating expenses.
Section 6. Severability. if any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Resolution or any part hereof is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portion of this Resolution or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrase be declared invalid or unconstitutional.
Section 7,
Section 8.
Effective Date. The CSUF shall be effective on July 1, 2024. Aquatic and summer camp programs will go into effect once the 2024 season is complete.
Certification. The Mayor shall sign this Resolution and the City Clerk shall attest and certify to the passage and adoption thereof.
PASSED, APPROVED, and ADOPTED this 24th day of June, 2024.
Justin Beaver, Mayor
