CITY OF YUCAIPA
AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Fermin Preciado, Director of Development Services/City Engineer VQ_ Benjamin J. Matlock, Deputy Director of Community Development/City Planner ;'?k-- FOR: City Council Meeting of August 12, 2024
SUBJECT: Resolution No. 2024-53, a resolution of the City Council of the City of Yucaipa, California, establishing a citywide policy and guidelines for public safety funding as part of new development as required by the General Plan RECOMMENDATION:
That the City Council adopt Resolution No. 2024-53 establishing a citywide policy and guidelines for public safety funding as part of new development.
BACKGROUND/DISCUSSION:
Public safety services remain a core priority for the City of Yucaipa. However, due to ongoing cost increases for public safety staff, equipment, and related services, ensuring a sustainable funding source for maintaining the necessary service levels has become a paramount issue for the community. Along with the service needs of the community, ensuring that new development projects are fiscally neutral or positive for the City's General Fund is also a key priority to maintain operation service levels for the community.
The proposed Resolution No. 2024-53 sets forth a formal policy regarding public safety and municipal service funding sources for new development to best ensure that the increased need for service from new development is offset by dedicated funding. The provisions are consistent with those found in the multi -award -winning Wine Country Specific Plan and the upcoming Freeway Corridor Specific Plan update, and formally implements the policies found in the Safety Element update that was approved by the City Council at the regular meeting of July 22, 2024.
FISCAL IMPACT:
Resolution No. 2024-53 sets forth long-term funding for public safety to ensure projects are fiscally neutral to the General Fund.

CITYWIDE POLICY AND GUIDELINES
FOR PUBLIC SAFETY AND MUNICIPAL SERVICE FUNDING AS PART OF NEW
DEVELOPMENT
Adopted: August 12, 2024
Purpose/Discussion:
Public safety services remain a core priority for the City of Yucaipa. However, due to ongoing cost increases for public safety staff, equipment, and related services, ensuring a sustainable funding source for maintaining the necessary service levels has become a paramount issue for the community. Along with the service needs of the community, ensuring that projects are fiscally neutral or positive for the City's General Fund is also a key priority to maintain operation service levels for the community.
As such, all new development shall provide dedicated funding to support public safety and overall municipal service operations. In addition, projects that require specialized equipment that would not be normally required for typical development (such as projects that require an aerial ladder truck), shall also be subject to funding requirements. The benefit of the policy is to ensure the level of service and ability to be fiscally sustainable is met, and to also streamline the provisions for new development and better encourage projects that offer economic or community benefits to the citizens of the community.
Policy/Procedure:
• Prior to approval of recording any final map or issuance of a Building Permit, a Community Facilities District (CFD) or Fire Service Agreement (FSA) shall be approved and implemented to support the needs of the Yucaipa's municipal services, including those of the Fire Department, Police Department, and public works to serve the Project.
The CFD or FSA shall include the maintenance of necessary equipment and staffing for new development, including but not limited to a Type 6 Medic Patrol or Medic Squad, additional police services, emergency access and roadway maintenance funding, and other elements needed for the project.
o Once the initial Project is ready for final map or issuance of a Building Permit, the City shall adopt local goals and policies concerning the use of the Mello -Roos Community Facilities Act of 1982 to initiate the proceedings of establishing a new CFD, as required by California Government Code Section 53312.7(a). The Local Goals and Policies will provide guidance and conditions for the conduct by the City in the proceedings for, and the issuance of bonds secured by special taxes levied in, a CFD established under the Act, and to provide general guidance in the formation for CFDs, including identification of improvements eligible to be financed by a CFD, criteria for bond financing, disclosure requirements, outline of City proceedings, and other components associated with development of a CFD.
• Projects with square footages over 400,000 square feet, or those that are three or more stories tall, or results in a building floor with conditioned space above the height of 30 feet high, or any building higher than 45 tall, requires that the City have and operate an aerial ladder truck to maintain the communitywide Insurance Services Office (ISO) rating. The following provisions shall apply:
o The CFD or similar funding sources shall include funding to cover all costs related to this specialized equipment including but not limited to maintenance, staffing, replacement, and facility alterations necessary to house the related equipment and staffing.
o A fair -share funding agreement shall be executed between the Developer and the City, which provides direct one-time funding for the acquisition of an aerial ladder truck. The City Council authorizes the City Manager to negotiate and execute the terms and fiscal commitments of the fair share agreement.
