SUBJECT: Contract Amendment No. 5 to the Contract with Animal Pest Management, Inc. for the Gopher and Rodent Control Program
RECOMMENDATION:
That the City Council authorize the City Manager to execute Amendment No. 5 to the contract with Animal Pest Management, Inc. (APM) in the not -to -exceed amount of $451 for a revised FY24 contract total of $58,727 for City's Gopher and Rodent Control Program.
BACKGROUND/DISCUSSION:
On July 29, 2019, the City Council approved a contract with Animal Pest Management Services, Inc. (APM) in the amount of $48,888 for the Gopher and Rodent Control Program (Program). Program is designed and implemented to reduce and curb the infestation of gophers and rodents in City parks and other public facilities. The infestation of gophers and rodents can cause damage to irrigation lines, turf, plants/groundcover, and makes areas unsuitable for sports and other recreation activities.
The contract, approved in 2019, was for one (1) year and allowed four (4) annual extensions, with adjustments based on the annual change in the Consumer Price Index (CPI) for the Riverside -San Bernardino -Ontario, CA Area as defined by the original contract. Four (4) extensions and amendments have been approved by City Council since 2019.
On June 26, 2023, the City Council approved the fourth extension and amendment to the contract with APM with a revised contract amount of $58,727.
Over the past year, the City has seen an increase in gopher/rodent infestations in public parks and facilities. This increased infestation required additional visits by APM to address the infestation during FY24.
Staff is recommending that the City Council approve the fifth amendment to the contract with APM for FY24 in the amount $451 for a revised total contract amount of $58,727.
FISCAL IMPACT:
The FY24 Budget includes the cost of this item. No further fiscal impact is anticipated.

FIFTH AMENDMENT TO CONTRACT BETWEEN
ANIMAL PEST MANAGEMENT, INC. AND THE CITY OF YUCAIPA
This amendment ("Fifth Amendment") is an amendment to the Gopher and Rodent Control Program contract between the City of Yucaipa, a municipal corporation ("City"), and Animal Pest Management, Inc. ("Contractor") July 29, 2019, amended on November 9, 2020, June 28, 2021, June 271 2022, and September 12, 2022 (the "Contract"). This Amendment to the Contract is effective as of July 1, 2023.
RECITALS:
A. On or about July 29, 2019, City and Contractor entered the Contract for a Gopher and Rodent Control Program — Project No. 11104 for a term of one year.
B. On or about November 9, 2020, City and Contractor entered the 1st Extension and Amendment to the Contract for the Gopher and Rodent Control Program for a term of one year.
C. On or about June 28, 20211 City and Contractor entered the 2nd Extension and Amendment to the Contract for the Gopher and Rodent Control Program for a term of one year.
D. On or about June 27, 2022, City and Contractor entered the 3rd Extension and Amendment to the Contract for the Gopher and Rodent Control Program for a term of one year.
E. On or about June 26, 20231 City and Contractor entered the 4th Extension and Amendment to the Contract for the Gopher and Rodent Control Program for a term of one year.
F. City and Contractor now wish to amend the Contract to increase the Contract amount by $451.
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto agree as follows:
