Agenda Item No. 10
CITY OF YUCAIPA
AGENDA REPORT
TO: Honorable Mayor and City Council
FROM: Megan Wolfe, Director of Community Services
Sarah Martinez, Community Services Superintendent
Nick Johnson, Community Services Supervisor
FOR: City Council Meeting of December 9, 2024
SUBJECT: Facility Use Agreements between the City of Yucaipa and Yucaipa Valley Youth Soccer Organization, Yucaipa Valley American Little League, Yucaipa Valley National Little League, Yucaipa-Calimesa Girls Softball, Yucaipa Youth Basketball, Inc., Yucaipa Junior All American Football and Cheer, Inc., Yucaipa Swim Team, Sand Canyon Water Polo Club, and Yucaipa Pickleball Inc.
RECOMMENDATION:
That the City Council:
Authorize the City Manager to execute Facility Use Agreements between the City of Yucaipa and Yucaipa Valley Youth Soccer Organization, Yucaipa Valley American Little League, Yucaipa Valley National Little League, Yucaipa-Calimesa Girls Softball, Yucaipa Youth Basketball, Inc., Yucaipa Junior All American Football and Cheer, Inc., Yucaipa Swim Team, Sand Canyon Water Polo Club (Organizations) and Yucaipa Pickleball Inc., for use of facilities; and
2. Authorize the City Manager or his designee to administer the terms of the Agreements.
BACKGROUND/DISCUSSION:
The proposed Facility Use Agreements (Agreements), presented for City Council's review, identify several City of Yucaipa (City), Yucaipa-Calimesa Joint Unified School District (District) and San Bernardino Community College District (SBCCD) owned facilities that are being used by the Organizations, clarify operational procedures relative to that use, and identify the fees associated with the use. Staff will continue to coordinate, and schedule Organizations' use of City, District, and SBCCD facilities and maintain, operate, collect fees, and schedule lights.
The proposed Agreements specify that the City, District, and SBCCD agree to the Organizations' use of facilities and will provide maintenance on the facilities as necessary. In addition, the Agreements clarify the responsibilities of all parties involved.
The current Agreements between the City and Organizations are set to expire on December 31, 2024. The proposed Agreements shall commence on January 1, 2025, and expire on December 31, 2026.
Pursuant to the 2024 City Council goal #5 "Increase Revenue Generation to Offset Costs of Community Services and Development Services Functions; Move Toward Full Cost Recovery for Festivals and User Fees," staff is recommending a change in fee structure from charging a fee per player to charging a per hour fee. Each Agreement has the recommended fee for that Organizations facility use.
The only Organization that will not move to an hourly fee is Yucaipa Swim Team. Yucaipa Swim Team currently pays $10,000 a year, their fee will increase by 50% to $15,000 per year. To move to a per hour fee they need more time to work through the details and structure of the use of the SBCCD Aquatic Center. Their Agreement moves to the hourly rate during year two.
FISCAL IMPACT:
The recommendations do not result in a significant fiscal impact.

Waiver of Subrogation YPI hereby grants to CITY a waiver of any right to subrogation which any insurer of said YPI may acquire against CITY by virtue of the payment of any loss under such insurance. YPI agrees to obtain any endorsement that may be necessary to affect this waiver of subrogation, but this provision applies regardless of whether or not CITY has received a waiver of subrogation endorsement from the insurer. However, the Workers' Compensation policy shall be endorsed with a waiver of subrogation in favor of CITY for all work performed by the Contractor, its employees, agents, and subcontractors.
Self -Insured Retentions Self -insured retentions must be declared to and approved by CITY. CITY may require the YPI to provide proof of ability to pay losses and related investigations, claim administration, and defense expenses within the retention. The policy language shall provide, or be endorsed to provide, that the self -insured retention may be satisfied by either the named insured or CITY.
Acceptability of Insurers Insurance is to be placed with insurers authorized to conduct business in the state with a current A.M. Best's rating of no less than A: VII, unless otherwise acceptable to CITY
Verification of Coverage YPI shall furnish CITY with original Certificates of Insurance including all required amendatory endorsements (or copies of the applicable policy language effecting coverage required by this clause) and a copy of the Declarations and Endorsement Page of the CGL policy listing all policy endorsements to CITY before work begins. However, failure to obtain the required documents prior to the work beginning shall not waive the YPI's obligation to provide them. CITY reserves the right to require complete, certified copies of all required insurance policies, including endorsements required by these specifications, at any time.
Subcontractors YPI shall require and verify that all subcontractors maintain insurance meeting all the requirements stated herein, and Contractor shall ensure that CITY is an additional insured on insurance required from subcontractors.
