Item No. 3
TO: Honorable Mayor and City Council
FROM: Fermin Preciado, Director of Development Services/City Engineer' Benjamin J. Matlock, Deputy Director of Community Development/City Plannergp/- Christian Farmer, Associate Planner( f
SUBJECT: Theresa Massaro (Case No. 24-0001/OAK): An Oak Tree Permit for the removal of twelve (12) Tucker Oak trees at 13582 Oak Mountain Drive; APN: 0322-791-12.
RECOMMENDATION:
That the City Council approve the Planning Commission's recommendation of Oak Tree Permit No. 24-0001 for the removal of twelve (12) structurally compromised oak trees with a 1:1 replacement ratio, consistent with the City's Municipal Code, to allow adequate space for the construction of a new single-family residence.
BACKGROUND/DISCUSSION:
On February 26, 1996, the City Council adopted Resolution No. 96-03, which established comprehensive oak tree conservation and protection guidelines for the City of Yucaipa. Pursuant to Section 4(B)(1)(b) of this Resolution, requests for Oak Tree removals involving a cumulative quantity of four (4) or more oak trees will be subject to the City Council's review. At the regular meeting of February 2, 2025, the Planning Commission provided a recommendation for approval to the City Council to approve Oak Tree Permit No. 24-0001.
The applicant is requesting the removal of twelve (12) structurally compromised Tucker oak trees located at 13582 Oak Mountain Drive in order to provide adequate space for the construction of a new single-family residence proposed at the subject property. Five (5) of the trees are located within the proposed home's footprint, while the balance of the trees are located where proposed development would result in an encroachment within the protected zone of the trees. Three (3) additional trees are in close proximity of the required proposed grading and will need to be fenced and protected at the time of the grading work. If additional trees need to be removed for the purposes of grading or to install underground utilities, the applicant will need to bring the project back through the review process.
Pursuant to the City Council adopted Resolution No. 96-03, the twelve (12) trees identified for removal shall be replaced at a ratio of 1:1 and that each replacement tree shall be a minimum size of 15-gallons.
This means that with an approval for the removal of twelve (12) trees at the subject site, twelve (12) new oak trees shall be planted on -site or elsewhere in the City pursuant to the City's policy.

The map above was provided by the applicant and is attached to indicate the proposed grading; however, it does not accurately reflect the trees to be removed. An oak tree report has been provided by the City's landscape architect, which is contained in Attachment 1, identifying which trees will be removed or protected in place. With guidance from the City's contract Landscape Architect, the proper application of the required appropriate management program will be implemented to maintain the long-term survival of these oak trees as required by the Oak Tree Permit.

SUBJECT: OAK TREE REPORT Massaro property on Oak Mountain Drive Dear Ben:
In compliance of the City of Yucaipa's Oak Tree Conservation and Protection Guidelines, I have evaluated the health and condition of the 16 trees located West of Oak Mountain Drive, between Pine Mesa Ct. and Wildwood View. The trees are growing within the property at and below street elevation. Location of tree protection zones are within or near the proposed construction area. Trees numbered in this report are either per tags installed by IERCD or site assignments. Date of observation 8/10/2024, 8:00 am. There are two types of oak trees on this site.
Quercus agrifolia Coast Live Oak and Quercus john-tuckeri Tucker Oak. The Quercus agrifolia (tree 45) is outside of proposed grading area. (trees # 1, 870, 877, 876, 878, 879, 880) have structural issues, dead wood and show structural failures. (trees # 3, 14, 15, 16) are multi trunked — sucker growth from cut tree at base. (trees #9, 10) are sharing the same location and are in competition for space. (trees 4 & 6) are Quercus john-tucheri and are scattered over most of the remainder of the north part of the lot. The growth is very dense.
Physical Evaluation
Environment: Native trees, located west and north of street on steep to gentle slope. See attached plan for tree locations.
Structure: Single, double trunk trees with dead wood and heavy bark. Seasonal wet conditions promote heavy moss on trunks. This is due to density of growth, narrow canyon and steep slopes. Over all condition, dead wood, poor structural condition, "co -dominant stems" represents a structural weakness and prone to structural failure.
Horticultural Evaluation
No evidence of insect activity on any trees.
Tree Rating System
(A = Outstanding, B = Above Average, C = Average, D = Below Average/Poor, E = Dead) D - (tree # 1, 870, 877, 876, 878, 879, 880, 15, 16)
C — (tree # 3, 4, 10,
B — (tree #5, 6, 9)
Recommendation
Trees #5, 6 & 9 are outside of proposed grading area and are in the best condition. Protect at time of grading with fencing at protection zone (dripline plus 5') no other trees located wthin proposed grading are rated above C-.
