AGENDA REPORT
City Council Meeting of March 24, 2025
Honorable Mayor and City Council
FROM: Fermin Preciado, Director of Development Services/City Engineer Benjamin Matlock, Deputy Director of Community Development/ City Planner/lN' Ryan C. Miller, Housing and Economic Development Analyst® SUBJECT: Access Easement Acceptance — Oak Glen Road and Colorado Street (APN 0301-174- 07)
RECOMMENDATION:
That the City Council:
1. Accept a Grant of Easement for access purposes located at 32788 Oak Glen Road (APN 0301- 174-07), from SG Opal Inc.; and
2. Authorize the City Manager, or his designee, to execute the necessary documents to complete the easement acceptance process.
BACKGROUND/DISCUSSION:
At the regular meeting on January 23, 2023, the City Council approved a Conditional Use Permit and Development Agreement (DA) for the development of a fuel station, car wash, commercial center, and a 66-room hotel on private property located at 32788 Oak Glen Road (Case No. 21-026) (Project). Consistent with the terms of the approved DA, the City Council authorized a Purchase and Sale Agreement with SG Opal Inc. for the sale of a 39,819-square-foot portion of vacated public right-of-way (ROW), located adjacent to Oak Glen Road, to be incorporated into the SG Opal Inc.
Project. In accordance with the Council's direction, City staff completed the escrow transaction in September of 2023, and the proceeds from the property sale, totaling approximately $198,298, were recorded as revenue in the Traffic Facilities Development Impact Fee Program Fund.
As the project is currently under construction, a grant of easement is proposed to ensure compliance with requirements of the DA. Specifically, Section 10(g) of the DA mandates that the developer execute an access easement through the Project area, to ensure City access to maintain the remaining portion of the adjacent public ROW located east of the site.
The easement will commence at the new signalized intersection at Oak Glen Road and Colorado Street, traverse through the developer's parking lot, and then extend to the northeastern boundary of the Project site. This easement will ensure City access for the maintenance of the remaining portion of the public ROW located directly northeast of the project site.
It is important to note that staff will present a recommendation to accept a sidewalk easement at the newly signalized intersection of Colorado Street and Oak Glen Road at a future City Council meeting. This future public easement area will include the traffic signal pole, sidewalk improvements, and ADA access ramps upon completion of the traffic signal project.
Staff recommends that the City Council accept the proposed access easement, as it fulfills the requirements of the approved DA for the Project.
FISCAL IMPACT:
The recommendations do not result in a fiscal impact.
